A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
LUIS OBISPO APPROVING AN AGREEMENT BETWEEN THE
CITY AND FRIENDSHIP SCHOOL, INC. TO PROVIDE
ONE THOUSAND ONE HUNDRED' -NINE DOLLARS ($1109)
FOR SERVICES PROVIDED FROM JANUARY.1, 1982 -
JUNE 30, 1982.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. That certain agreement, attached hereto marked Exhibit "A"
and incorporated herein by reference, between the City of San Luis Obispo
and Friendship School, Inc.
SECTION 2. The City Clerk shall furnish a copy of this resolution
and a copy of the executed agreement approved by it to: Friendship School
Inc „ HRC, and City's Finance Director.

and on the following roll call vote:

Friendship School, Inc.
THIS AGREEMENT, dated January 1, 1982, for the convenience of the
parties hereto, is between the CITY OF SAN LUIS OBISPO, a chartered
municipal corporation (referred to herein as "City ") and FRIENDSHIP
SCHOOL, INC., a non- profit corporation (referred to herein as Friendship
School).
WITNESSETH:
WHEREAS, Friendship School has requested City to contribute to its
human service program to increase the opportunity of normalization for
Frinedship School clients by providing a summer camping experience, said
program as set forth in Exhibit "B" attached hereto; and
WHEREAS, said services will be available to residents of the City,
there:,y serving both a public and a municipal purpose:
NOW, THEREFORE, City and Friendship School, for and in consideration
of the mutual benefits, promises, and agreements set forth herein,do agree
as follows:
1. Friendship School agrees to make its summer camping program
available to its clients, three fifths (3/5) of whom must be residents
of the city of San Luis Obispo, to be used for camping locally; funds
to be expended during the period January 1, 1982 through June 30, 1982.
2. Friendship School will provide City with bi- monthly progress reports
and a final reports, summerizing progress and describing completion of
camping trip, listing funds expended and funds received by Friendship
School from other sources. Said reports shall be in a form approved by City
.Human Relations Commission (Exhibit "C" attached).
3. Friendship School and all of its agents, representatives,
participants in any manner in the performance of Friendship School's
obligations and duties hereunder shall be employees, independent contractors,

or volunteers for Friendship School and shall not for any purpose be
considered as employees or agents of City.
4. Friendship School agrees to hold City harmless, and to defend City
against, from and in any claim, action, proceeding or hearing wherein the
allegations charging liability on the part of the City as a result of any
act or omission, negligent or otherwise, of Friendship School..
5. City agrees to pay Friendship School a one -time only grant, sum,
of One Thousand One Hundred Nine Dollars ($1109) payable on a voucher basis
for funds actually expended during said period.
6. The City Council may by motion terminate this agreement at its
sole discretion after a public hearing held upon ten (10) days written
notice to Friendship School. Said termination shall be effective thirty (30)
days after City mails notice of termination to Friendship School.
7. For purposes of notice under this Agreement, all notices shall
be considered effective upon being sent by certified mail to the following

I INTRODUCTION
Friendship School, Inc. was formed in January 1978 by
local.SLO teachers and citizens to provide community
residential and day programming for SLO city and county
severely /profoundly disabled adults, both ambulatory and
non- ambulatory.. There was none available at the time
for adults already out of school or for those turning
twenty -one and leaving the public school.system. The
first organization. was non - profit with five founding
members.
The purpose of Friendship School, Inc. is to offer the
opportunity in a normal community setting for severely
disabled adults to maintain or reach their maximum
social /educational potential. Philosophically, we be-
lieve there is an ethical obligation to remove all
- superficial- barriers; - -to the extent - feasible, that-have
traditionally discouraged the severely disabled from
participating in normal life.
Over the past 32 years, Friendship has grown from one
small voluntary organization to a comprehensive, four
program agency with over a half - million dollar budget.
Major past events would include two state grants during
1979 & 1980, the opening of a residential home (1979),
the hiring of the first Executive Director (1981), and
revamping of all official documents during October 1981.
CThe two original service offered were a six person
residential program and an in -house school for Casa de
Vida clientele. Added to that are a community school,
a day treatment program with emphasis upon socializa-
tion, and. a class of fifteen very severely disabled a-
dults beginning in December 1981. The major a.ccom.
plishments are noted above. Our impact on the disabled
community is substantial since no other such offering
exists for that population. As of December 1, 1981, . we
will have the largest community program in California
serving severely disabled person. That represents ex-
cellent development.
Our clientele are severely mentally /physically disabled
adults. We serve many local residents not related to.
Casa de Vida. As of December 1981, we will have fifty -
six students.
Staff and students reflect the general make -up of the
community around us. An affirmative hiring plan has
been developed for the School. The only category ex-
periencing a shortage is that of white males.
Th-e primary referring agency for Friendship is the Tri -
Counties Regional Center. This is a state- funded, non-
profit, private referral service that funds services for
all developmentally disabled persons. We also receive a
small amount of private donations approximating $14,000.per
Our programs have been reviewed annually by the Tri- annum.
Counties Regional Center- on an informal basis. They are
satisfied with our service. A formal outside evaluation
has not been accomplished.

II PROBLEM STATEMENV NEEDS ASSESSMENT
Friendship School Inc. wants to increase the opportunity of
normalization for our clients by providing an individualized
summer camping (NOT ,summer camp) experience. Over many years,
consumer and staff needs surveys have consistently identified
the summer period as one that lacks decent camping or other
program opportunities for the adult disabled. It is a chance
to attempt unique personal growth and challenge, to restore
the braincells as all of us need to do. An.associated bene-
fit is respite for parents and others. If necessary, we
can produce examples of consumer surveys supporting this
statement.

III PROGRAM OBJECTIVES
We expect to provide five adult disabled persons with a one
week camping opportunity in the Sierra.mountains. ,_.Emphas,is .
will be upon self -help skills, self-reliance, and an appre-

cd ation of the unusual places and opportunities present
this world.
Specific objectives would be as follows:
1) Each student will receive training in and have the oppor-
tunity to practice survival skills in a wilderness en=
vironment. Cooking, grooming., recreation, personal clean-
liness, and similar activities will be taught.
2) The opportunity to expand personal relationships with
strangers in unusual circumstances will be provided. Our
students have rarely traveled beyond their immediate locale.
This experience will add greatly to their over - all knowledge
a.nd.reduce the innate worry they feel when confronting new
situations..
3) A final.objective will be to offer each student the chance
to have an _exciting, Unique and very enjoyable summer
period aw, 1,from life's normal tasks. Millions of Ameri-
cans do so -.arid our students deserve the same.

THIS AGREEMENT, dated January 1, 1982, for the convenience of the
parties hereto, is between the CITY OF SAN LUIS OBISPO, a chartered municipal
corporation (referred to herein as "City ") and SAN LUIS OBISPO FAMILY YMCA,
a non. -profit corporation (referred to herein as YMCA).
WITNESSETH:
WHEREAS, YMCA has requested City to contribute to YMCA's After School
Program "to provide a safe, fun place for young children to play after school'
by providing low -cost after school care for elementary age school children at .
several school sites throughout the county, and providing bus transportation by
transport children attending non -site schools as set forth in Eyhibit "B"
attached hereto; and
WHEREAS, said services will be available to residents of the City,
thereby serving both a public and municipal purpose:
NOW, THEREFORE, City and YMCA, for and in consideration of the mutual
benefits, promises and agreements set forth hereim, do agree as follows:
1. YMCA agrees to make its After School Program available to residents of
the City of San Luis Obispo on a regular basis for the period January 1, 1982,
through June 30, 1982.
2.:. YMCA will provide City with monthly summary reports and final report
describing the type and quantity of services provided and listing funds expended
and funds received by Y14CA from other sources. Said reports shall be in form
approved by City Human Relations Commission (Exhibit "C" attached).
3. YMCA and all of its agents, representatives, participants in any
manner in the performance of YMCA obligations and duties hereunder shall be
employees, independent contractors. or volunteers for YMCA and shall not for

COUNTY R.S.V.P., a non - profit corporation (refer-red to herein as RSVP.).
WITNESSETH':
WHEREAS, RSVP has requested City to contribute to RSVP's Share -A -Home
human service program to alleviate some of the housing problems affecting
the senior population through establishment of congregate living arrangements;
to relieve financial burdens, provide security, companionship, and the ability
to maintain independence, said program as set forth in Exhibit "B" attached
hereto, and
WHEREAS, said services will be available to the residents of the City,
thereby serving both a public and municipal purpose:
NOW, THEREFORE, City and RSVP, for and in consideration of the mutual
benefits, prom.ises and agreements set forth herein, do agree as follows:
1. RSVP agrees to make its Share -a -Home services available to residents
of the City of San Luis Obispo.on a regular basis for the period January 1, 1982
through June 30, 1982.

II PROBLEM STATEMENT
EEDS ASSESSMENT
Currently in San Luis Obispo, a housing crunch continues to
plague all populations, especially older adults. RSVP is con-
cerned with those seniors 60 years of age and older.
Documentation includes the "present waiting list for seniors
awaiting Section 8 housing is nearly 400. This list is
being kept by the -City Housing Authority. Many phone calls
occur daily at the EOC's Information and Referral Specialist's
office concerning senior housing problems.
The California State House Conference on Aging recently met
and insisted that housing plights be a priority at the upcoming
White House Conference on Aging. Special legislation developed
by Senator Henry Mello (D- Watsonville), SB 1228 and SB 1160
-address the current -- problem. - - - - -
Mr. Eric Raimy authored Shared Houses, Shared Lives, published
in 1979 documents the soE a�fin� anal and health benefits
of congregate living arrangements for seniors.
The Western Geronological Society recently urged senior organ-

to develop programs meeting the needs og housing for
the elderly.
The housing plights presently stirring frustration among older
adults and elected officials is seemingly obvious considering the
amount of consistant and on -going discussions.
III PROGRAM OBJECTIVES
The goals of the SHARE -A -HOME project is to alleviate some of the
housing problems presently affecting the senior population with-
in the San Luis Obispo community.
Currently there are no sources of clearinghouse information or
attempt to solve housing problems in this manner.
The need for such a program has been clearly documented. It is
our contention that many older adults would benefit %rom such a
project. These benefits would include relief of fina-cial burdens,
security, companionship and the ability to maintain independent.
The most successful home sharing program (by numbers) is Project
Match in the City of San Jose. At present, and after 16 months
of operating, they have matched 32 seniors, or 64 individuals.
We intend to alleviate housing complications, and provide alter-
natives to 25 seniors in our-first year of existance.
We also intend to encourage inter - generational housing arrange-
ments through this project. This of course can be considered to
assist California Polytechnic State University with its present
housing shortage.
INTRODUCTION
The Retired Senior Volunteer Program of San Luis Obispo County
was established in April 1973 through a federal grant by ACTION,
the federal agency for volunteer service. The project is locally
sponsored by the San Luis Obispo County Family YMCA. Although
the primary financial assistance is offered by ACTION; the State
of California, the County of San Luis Obispo, the City of San Luis
Obispo and'State Department on Aging provide for the majority of
secondary fiscal aid.
The purpose of the program is to provide meaningful and rewarding
experiences for older persons through volunteer service. Presently
in the City of San Luis Obispo over 200 active senior volunteers,
provide over 75,000 hours of community service in 56 public and
non- profit agencies. The Retired Senior Volunteer Program also

is a clearinghouse" -for the "aging and advocacy network:
The "Shared Housing" component of th'e RSVP is a recently created
service to attempt to alleviate some of the housing problems af-
fecting older adults in the city of -San Luis Obispo.
A Steering Committee was established to guide and advise RSVP
personnel for the development and implementation of the Shared
Housing project. Meetings and organizational strategies were
produced by agency professionals, seniors, students private sector
individuals.
The subsequest results was the co- sponsoring by a consortium of
human service agencies including the Area Agency on Aging, Cal-
ifornia Polytechnic State University Liberal Studies and Child
Development Departments), Economic om Opportuntiy Commission, Hotline,
Community Mental Health, People's Self Help Housing, City of San
ui� s Obi o Housing AuthoritT y and the Senior" Outreach Program.
Other groups expressing interest are the San Luis Obispo Chamber
of Commerce, Human Relations Commission staff of San Luis Obispo
and the Anderson Community Center.
These agencies have agreed to assist the RSVP through facility
in -kind, grant preparation, counselling, consultants and per -
sonnel services.
At the time of this grant preparation, personnel services of
20 hours per week are perfomed, program flyers prepared, a letter
to agencies polished, regestries for program participants de-
veloped and costs of.administrative overhead secured
A list of interested seniors has been established-for contact
when program implementation begins. This list has twenty -seven
older adults involved.

Section A Medical Insurance
For medical insurance the city agrees to contribute an amount equal to the cost
of providing medical insurance for management employees and their dependents.
Such contribution shall be spent first on employee coverage under an approved
medical insurance plan and, second on dependent coverage. The city reserves

the right to choose the method of insuring and funding the benefit.
Section B Eye Care
The city agrees to contribute an amount equal to the cost of providing an
approved eye care insurance plan for management employees and their
dependents.
Section C Dental Plan
The city agrees to contribute an amount equal to the cost of providing an
approved dental insurance plan for management employees and their dependents.
Section D Unexpended Fringe Benefit
The city shall pay to each management employee as soon as practicable prior
to December 31, an annual lump sum payment (subject to appropriate taxation)
for the difference between the amounts provided under Sections A through C
above, and any lesser sum expended by the employee for medical, eye care;'
and dental coverage for the period of July 1, 1981, through December 31, 1981.
Each employee shall be required to carry a minimum of medical, eye care, and
dental insurance for self.
Section E Life and Disability
The city shall provide the following special insurance benefits:
1. Long -term disability insurance providing 60% of gross salary
to age 65 for any sickness or accident after a 90 -day waiting
period.
2. $50,000 term life insurance including accidental death and
dismemberment.
3. One -half of employee's health insurance premium paid for retired
employees who elect to remain members of the city's group health
plan.
Section F Retirement
The city agrees to provide the Public Employees' Retirement System's 2%

� at age-60 plan to all eligible employees including the amendment-permitting
conversion of unused sick leave to additional retirement credit, the 1"9
survivor's benefit and one year final compensation.
The police and fire chiefs shall receive the same retirement benefits as sworn
personnel in their department.
The city further agrees to implement a plan whereby the city will pay the
employee's current contribution (percentage of salary effective 7 -1 -81) on
behalf of the employee to P.E.R.S. These amounts paid by the city are
employee contributions and are paid by the city to satisfy the employee's
obligation to contribute the current percentage of salary to P.E.R.S. An
employee has no option to receive the contributed amounts directly instead
of having them paid by the city to P.E.R.S. on behalf of the employee. It
is further understood and agreed that the payment of the employee's P.E.R.S.
contribution is made subject to I.R.S. approval and reporting procedures.
Section G Vacation
Vacation leave is governed by Section 2708.7 of the Municipal Code except that
it may be taken after the completion of the sixth calendar month of service
since the benefit date. Vacation leave shall be accrued as earned each payroll
period up to a maximum of twice the annual accrual rate. However, if the
City Administrator determines that a management employee has been unable
to take vacation due to the press of city business, the City Administrator
may increase the accrual limits or once annually authorize payment for one -half
of the excess accumulation up to a maximum of five (5) days. In addition to
vacation leave the City Administrator may grant up to five (5) days of
administrative leave to department heads for special training or recuperation
purposes. The City Attorney shall receive seventeen (17) days paid vacation
per year.

Section H Holidays
The twelve (12) holidays as provided by M.O.U. for the general employees'
association shall apply to management personnel.
Section I Sick Leave
Sick leave is governed by Section 2708.5 of.the Municipal Code. An employee
may take up to two (2) days per year of sick leave if required to be away from
the job to personally care for a member of his /her immediate family as defined
in Section 2708.5. This may be extended to five (5) days per year if the family
member is part of the employee's household, and to seven (7) days if a household
family member is hospitalized and the employee submits written verification of
such hospitalization.
Upon termination of employment by death or retirement, a percentage of the
dollar value of the employee's accumulated sick leave will be paid to the
employee, or the designated beneficiary or beneficiaries according to the
following schedule:
(A) Death - 25%
(B) •Retirement and actual commencement of PERS benefits:
(1) After ten (10) years of continuous employment- 10%
(2) After twenty (20) years of continuous employment - 15%
Section J Workers' Compensation Leave
An employee who is absent from duty because of on- the -job injury in accordance
with the state workers' compensation law and is not eligible for disability
payments under Labor Code Section 4850 shall be paid the difference between
his base salary and the amount provided by workers' compensation law during
the first ninety (90) business days of such temporary disability absence.
Eligibility for workers' compensation leave requires an open workers'
compensation claim.

Section K Vehicle Assignment
For those management personnel who require the use of an automobile on a
regular 24 -hour basis to perform their normal duties, the city will, at city
option, provide a city vehicle or an appropriate allowance for the employee's

use of a personal automobile. The use of a personal automobile for city
business beyond the three - county area (San Luis Obispo, Monterey and
Santa Barbara) will be eligible for mileage reimbursement in accordance
with standard city policy.

The following range adjustment shall be effective 1/1/83. These were
inadvertently omitted from the final Memorandum of Agreement:
TREE TRIMMER classification (range 13) shall be paid at range 14
effective 1/1/83.
The Tree Trimmer classification had previously been in the same pay
range as our highest level Park Maintenance Worker and it was not a
desired intent of either parties to the negotiations to alter this
relationship.
GREENSKEEPER classification (range 16) shall be paid at range 17
effective 1/1/83.
The Greenskeeper classification had previously been set at a pay
range 5% below the Crew Leader pay range and it was not a desired
intent of either parties to the negotiations to alter this relation-
ship.

ARTICLE 2
RECOGNITION
Pursuant to Government Code Section 3500 et seq and City Resolution No. 3405.,
the City hereby recognizes the San Luis Obispo City Employees' Association as the
bargaining representative' for purposes of representing regular and probationary
employees, occupying the position classifications set forth in Appendix A, in the
General Unit with respect to their compensation, hours and other terms and
conditions of employment for the duration of this Agreement.

1 ARTICLE 3
2 DUES DEDUCTION
3 The City shall deduct dues from City employees and remit said dues to the
4 Association on a monthly basis for the duration of this Agreement, which dues shall
5 not include assessments.
6 Monthly dues deduction additions and /or deletions shall be recorded by the City's
7 Finance Officer and a notification of all dues transactions shall be sent monthly to
8 the Association President.
9 The Association shall hold the City harmless from any and all claims, and will
10 indemnify it against any unusual costs in implementing these provisions. The
11 Association shall refund to the City any amount paid to it in error upon
12 presentation of supporting evidence.

2 EMPLOYEE RIGHTS
3 Employees of the: City shall have the right to form, join and participate in the
4 activities of employee organizations of their own choosing for the purpose of
5 representation on all matters of employer- employee relations including but not
6 limited to, wages, hours and other terms and conditions of employment.
7 Employees of the City also shall have the right to refuse to join or participate in
8 the activities of employee organizations and shall have the right to represent
9 themselves individually in their employment relations with the City. No employee
10 shall be interfered with, intimidated, restrained, coerced or discriminated against
11 because of the exercise of these rights.

2 REPRESENTATIVE ROLE
3 Members of any recognized employee organization may, by a reasonable method,
4 select not more than three employee members of such organization and one
5 employee observer to meet. and confer with the Municipal Employee Relations
6 Officer and other management officials (after written certification of such
7 selection is provided by an authorized official. of the organization) on subjects
8 within the scope of representation during regular duty or work hours without loss
9 of compensation or other benefits. The employee organization shall, whenever
10 practicable, submit the name(s) of each employee representative to the Municipal
11 Employee Relations Officer at least two working days in advance of such meeting.
12 Provided further:
13 (1) That no employee representative shall leave his'or her duty or work
14 station or assignment without specific approval of the department
15 head or other authorized City management official. If employee
16 representatives cannot be released, date of meeting will be
17 rescheduled in accordance with item (2) below.
18 (2) That any such meeting is subject to scheduling by City management
19 consistent with operating needs and work schedules. Nothing
20 provided herein, however, shall limit or restrict City management
21 from scheduling such meetings before or after regular duty or work
22 hours.

GRIEVANCE PROCEDURE

A grievance is defined as an alleged violation, misinterpretation or misapplication
4
of the personnel rules and regulations or of any Memorandum of Understanding,
5
excluding disciplinary matters, or other matters as fall within the scope of
6
representation.
7
Each grievance shall be handled in the following manner:
8
A. The employee who is dissatisfied with the response of the immediate
9
supervisor shall discuss the grievance with the supervisor's immediate superior.
10
The employee shall have the right to choose a representative to accompany
11
him /her at each step of the process. If the matter can be resolved at that level
12
to the satisfaction of the employee, the grievance shall, be considered terminated.
13
B. If still dissatisfied, the employee may 'immediately submit the
14
grievance in writing to the department head for consideration, stating the facts on
15
which it was based, including the provision' of the rules, regulations, or agreement
16
said to be violated, and the proposed remedy.. This action must take place within
17
fifteen (15) business days of the occurrence of .the grievance. The department
18
head shall promptly consider the grievance and render a decision in writing within
19
fifteen .(15) business days of receiving the written grievance. If the employee
20
accepts the department head's decision, the grievance shall be considered
21
terminated.
22
C. If the employee.is dissatisfied with the department head's decision,
23
the employee may immediately submit the grievance in writing to the Personnel
24
Director within five (5) business days of receiving the department head's decision.
25
The Personnel Director shall confer with the employee and the department head
26
and any other interested parties, and shall conduct such other investigations as may
27
be advisable.
28
D. The results or findings of such conferences and investigations shall be

1 submitted to the City Administrative Officer in writing within fifteen (15) business
2 days of receiving the employee's written request. The City Administrative Officer
3 will meet with the employee if the employee so desires before rendering a decision
4 with respect to the complaint. The City Administrative Officer's decision shall be
5 in writing and.given -the employee within fifteen (15) business days of receiving the
6 Personnel Director's results and findings. Such decision shall be final unless
7 employee desires the Personnel Board to review the decision. If such is the case,
8 the employee will have five (5) business days following receipt of the City
9 Administrative Officer's decision to submit a written request to the Personnel
10 Board through the. Personnel Director for a review of the decision. The Personnel
11 Board within thirty (30) business days shall review the record and either (1) issue
12 on advisory opinion to the City Administrative Officer; or (2) conduct a hearing on
13 the matter. If a hearing is held, an advisory opinion shall be rendered by the
14 Board within ten (10) business days of the close of such hearing. If an opinion
15 signed by at least three (3) members of the Personnel Board recommends overruling
16 or modifying the City Administrative Officer's decision, the City Administrative.
17 Officer shall comply or appeal this recommendation to the City Council. Such
18 appeal shall be filed with the City Clerk within three (3) business days of the
19 Board's action. If appealed, the City Council shall review the case on the record
20 and render a final decision within fifteen (15) business days of submittal..

Section A Rules Governing Step Increases

The rules governing step increases for employees covered by this MOU are included
5
in the current Salary Resolution with the following modification: Each department
6
head shall be authorized to reevaluate employees who reach Step 5 in their pay
7
range. An employee who is not performing up to standard for the fifth step shall
8
be notified in writing that the department head intends to reduce him one step
9
unless his job performance improves to an acceptable level by the end of 60 days,
10
the pay reduction shall then.become effective. ...The fifth step may be reinstated
11
at any time upon recommendation of the department head. If the department
12
head deems _ it necessary to again remove the fifth 'step during the some fiscal
13
year, he may make the change at any time with three business days written notice.

Each salary range consists of five steps (I through 5). Steps I through 4 equal

95% of the next highest step, computed to the nearest one dollar.

accordance with the above formula. Employees who are eligible for advancement

to Step 4 or. 5 after . June 30, 1979 must receive at least "Above Satisfactory"

ratings on their most recent performance evaluation prior to or coincident with

their being eligible for advancement by time in grade.

Section B Salary Provisions for the Term of Agreement

I. The parties agreed to a five percent (5%),solary increase effective I
January 1982 for all employees covered by this Agreement who are
City employees on the day this Agreement is formally approved by
the City Council. The pay adjustment required for the period from
I January 1982, to the implementation date of this Agreement shall
be computed at five percent (5 %) of the gross earnings of each
employee .during that time period. .
2. The parties agree to a three percent (3 %) salary increase effective 1
July 1982 for. all employees covered by this Agreement.
3. The parties agree to a.salary.range adjustment, effective I July 1982
for those classifications as shown in Appendix A.
4. The parties agree to a salary range adjustment, effective I January
1983 for those classifications as shown in Appendix A.
5. The. parties agree that effective I January 1983 all employees
covered by this Agreement shall receive a salary increase based on
the, change in the Consumer Price Index for all Urban Consumers, Los
Angeles -Long Beach Metropolitan Area, all items., (1967 =100) as
published by the Bureau of Labor Statistics, U.S. Department of
Labor. The increase shall equal three quarters (3/4) of the
percentage increase from November 1981 to November 1982 as
published on

In no event shall the salary increase

ARTICLE 9
OVERTIME
All employees, except those on mid- management classifications listed in Appendix
B, are eligible for overtime pay computed at one and one -half their base rate for
all hours ordered by management and worked by the employee in excess of forty
(40) hours worked in a work week.. Holidays and sick leave will be counted as
hours worked . for purposes of computing the number of hours worked in a week.
For purposes of overtime, base rate means the salary step the employee is on
within the range assigned to the employee's classification:
All overtime shall be authorized in writing by the department head prior to being
compensated.
All overtime shall be paid to the nearest quarter hour worked.
Employees eligible for overtime pay may elect to receive CTO at straight time in
lieu of overtime pay if approved. by the department head. A maximum of forty
(40) hours CTO'can be accumulated.semi- annually.
Accumulated CTO not taken within the semi - annual period shall be compensated at
straight time at the end of the semi - annual period.

INSURANCE

a)
City agrees to contribute $122.12 per month for medical, dental and

life insurance for each regular, full -time employee covered by this
5
Agreement.

b)
Effective I July 1982, . City agrees to increase life insurance for
7
regular, full -time employees to.a $20,000.00 benefit and contribute
8
$148.80 per month for medical, dental and,life insurance for each
9
regular, full -time employee covered by this Agreement.
10
c) _
Effective I January 1983, if the monthly insurance premium total
11
exceeds $148.80 per month, City shall directly fund such increases to
12
a maximum of $175.00 per month for each regular, full -time
13
employee:

d)
City shall pay to each full -time, regular employee, as soon as
15
practicable prior to December 31, an annual lump sum payment for
16
the difference between the City'.s actual monthly contribution and any
17
lesser sum utilized by the employee for insurance coverage for the
18
period of January I through December 31. For purposes of this
19
payback, City's actual contribution shall be $122.12 per month until I
20
July 1982 at which time it shall become $148.80 per month. For
21
payback purposes, City's actual contribution shall remain at $148.80
22
for the balance of the term of this Agreement. Employees who are
23
not full -time employees, shall receive pro rata share of the City's
24
actual contribution as applicable.

e)
Each employee shall be covered by the medical, dental and Life
26
insurance. If an employee selects dependent coverage, they shall
27
have dependent coverage for each insurance plan that provides
28
dependent coverage. If during an enrollment period an employee

selects dependent coverage, such coverage shall apply to all eligible
dependents and shall remain in effect at least twelve (12) months or

ARTICLE II
CALLBACK
Callback is defined as that circumstance which requires on employee to
unexpectedly return to work .after the employee has left work at the end of the
employee's workshift or workweek; except that, an early call -in of up to two (2)
hours prior to the scheduled start of a workshiftshall not be considered a callback.
City will guarantee either four (4) hours pay at straight time or pay at time and
one -half for time actually worked, whichever is greater.
If an employee, who was called back and has completed his /tier assignment and left
work; is again called back to work, he /she will not receive another four -hour
minimum if the return is within the original four -hour minimum.

2 STANDBY
3 Standby duty is defined as that circumstance which requires an employee so
4 assigned to.
5 I. Be ready to respond immediately to a call for service;
6 2. Be readily available at all hours by telephone or other agreed -upon
7 communication equipment; and
8 3. Refrain from activities which might impair his /her assigned duties
9 upon call:
10 An employee assigned to standby duty by management shall receive twelve dollars
11 ($12.00) for each week day, fifteen dollars ($15.00) for each weekend day, and
12 thirty dollars - ($30.00) for each holiday of such assignment.

ARTICLE 13
WORK SCHEDULE
This article is intended to define the normal hours of work and shall not be
construed as a guarantee of hours of work per day or hours of work per week, or
of days of work per week.
Employees shall be scheduled to work on regular workshifts having regular starting
and quitting times. Except for emergencies, employees' workshifts shall not be
changed without prior notice to the employee. Neither callback nor overtime
constitute a change in workshift. All references to accrual of vacation, holiday or
sick leave in the Agreement shall be interpreted as one (1) day being equivalent to
eight (8) hours.

1 ARTICLE 14
2 SICK LEAVE
3 A. Sick. leave shall be defined as absence from duty because of illness or off -
4 the -job injury, or exposure to contagious diseases as evidenced by
5 certification from an accepted medical authority.
6 B. Rules governing sick leave:
7 I. Each 'incumbent of aline -item position shall accrue sick leave with
8 pay at the rate of twelve (12)-days or the shift equivalent per year of
9 continuous service since the benefit date.
10 2. Sick leave may be used after the completion of the month of service.
11 in which it was earned.
12 3. Sick leave shall begin with the first day of illness.
13 4. Department heads shall be responsible to the City Administrative
14 Officer for the uses of .sick leave in their departments.
15 5. A department head shall require written proof of illness from an
16 authorized medical authority at the employee's expense for sick leave
17 use in excess of five (5) consecutive working days by personnel in
18 his /her department. Such proof may be required for periods of less
19 than five (5) consecutive working days where there exists an
20 indication of abuse.
21 6. Any employee who is absent because of sickness or other physical
22 disability shall notify his /her immediate supervisor or department
23 head as soon as possible but in any event during the first day of
24 absence. Any employee who fails to comply with this provision
25 without having a valid reason will be placed on leave of absence
26 without pay during the unexcused absence and be subject to
27 disciplinary action.
28 7. Any employee absent for an extended illness or other physical
1 disability may be required by the Personnel Director to have an
.2 examination by the City's medical examiner at City expense prior to
3 reinstatement to the City service.
4 8. An appointing authority, subject to approval of the Personnel
5 Director, may require any employee to be medically examined where
6 reasonable cause exists to believe that an employee has a medical
7 condition which impairs his /her job effectiveness or may endanger the
8 health, safety or welfare of the employee, other employees, or the
9 public. Employees who are judged to be physically incapable of
10 meeting normal requirements of their positions may be placed in a
11 classification of work for which they are suitable when a vacancy
12 exists, or may be separated for physical disability.
13 9. In the event that an employee's sick leave benefits become exhausted
14 due to illness or exposure to contagious disease, the employee shall
15 revert,to.a status of leave of absence without pay and be subject to
16 the provisions`of the'Personnel Rules.
17 10., The right to benefits under the sick leave plan shall continue only
18 during the period that the employee is employed by the City. This
19 plan shall not give any employee the right to be retained in the
20 services of the City, or any right of claim to sickness disability
21 benefits after separation from the service of the City. When an
22 employee receives compensation under the Worker's Compensation Act
23 of California, such compensation received shall be considered part of
24 the salary to be paid to the employee eligible for such payments as
25 required by state law. The amount paid by the City shall be the
26 difference between the amount received by the employee from the
27 City's compensation insurance coverage and the eligible employee's
28 regular rate of pay.

Notwithstanding anything contained in this section, no employee shall
2 be entitled to. receive any payment. or other compensation from the
3 City while absent from duty by reason of injuries or disability
4 received as a result of engaging in employment other than
5 employment by the City for monetary gain or other compensation
6 other than business or activity connected with his /her City
7 employment.
8 12. Accumulation of sick leave days shall be unlimited.
9 13. Upon termination of employment by death or retirement, a
10 percentage of the dollar value of the employee's accumulated sick
11 leave wilt be paid to the em
ployee,.or the designated beneficiary or
12 beneficiaries according to the following schedule:
13 (a) Death ;`- 25%
14 (b) Retirement and actual commencement of PERS benefits:
15 (1) After ten years of continuous employment - 10%
16 (2) After twenty years of continuous employment - 15%

1 ARTICLE 15
2 BEREAVEMENT. LEAVE
3 At each employee's option, absence from duty due to the death of a member of the
4 employee's immediate family, meaning spouse, child, brother, sister, parent, parent-
5 in -law, step - parent, step - brother, step - sister,• grandparent, or any other relative
6 living in the same household; provided such leave as defined in this section shall
7 not exceed five (5) working days from each incident. The employee may be
8 required to submit proof of relative's death before being granted sick leave pay.
9 False information concerning the death or relationship shall be cause for discharge.

ARTICLE 16
FAMILY LEAVE
An employee may take up to two days per year of sick leave if required to be
away from the job to personally care for a member of his /her immediate family as
defined in Article IS, Bereavement Leave: This may be extended to five days per
year if the family member is part of the employee's household, and to seven days
if a household family member is hospitalized and the employee submits written
verification of such hospitalization.

VACATION LEAVE
3
A.
Each incumbent of a 40 hour a week line -item position shall accrue vacation
4
leave with pay at the rate of 12 days per year of continuous service since
5
the benefit date for the first five years, 15 days per year upon completion
6
of five years, 18 days per year upon completion of ten years, and 20 days
7
upon completion of twenty years. Employees scheduled for more than 40
8
hours a week shall receive the equivalent number of vacation days pro-rated
9
to the number of regularly scheduled work hours.
10
B.
An incumbent is not eligible to use accrued vacation leave until after the
11
completion of the sixth calendar month of service since the benefit date.
12
C.
A regular employee who 'leaves the City service shall receive payment for
13
any unused vacation leave. Probationary employees with Less than six (6)
14
months:of.' continuous, service shall not be ,eligible. for such payment.
15
D.
Vacation schedules must be reviewed by management prior to the scheduled
16
vacation. Vacation schedules will be based upon the needs of the City and
17
then, insofar as- possible, upon the wishes of the employee. Management
18
may not deny an employee's vacation request if such denial will result in the
19
loss of vacation accrual by the employee, except that, management may
20
approve a two month extension of maximum vacation accrual. However, in
21
no event shall more than one such extension be granted in any calendar
22
year.
23
E.
Any employee who is on approved vacation leave and becomes eligible for
24
sick leave as defined in Section 2108.5A may have such time credited as
25
sick Leave under the following conditions:
26
I. A physician's statement certifying that illness, injury or exposure to
27
contagious disease has occurred is presented to the supervisor upon
28
returning to work.

WORKERS' COMPENSATION LEAVE
Any employee who is absent from duty because of on- the -job injury in accordance
with state workers' compensation law and is not eligible for disability payments
under labor code section 4850 shall be paid the difference between his base salary
and the amount provided by workers' compensation: law during the first 90 business
days of such temporary disability absence. Eligibility for workers' compensation
leave requires an open workers' compensation claim.

I ARTICLE 21
2 UNPLANNED VACATION
3 An employee may use up to two days of vacation annually as personal leave days.
4 It is preferred but not required that a personal leave day be scheduled in advance.
5 If a day is taken which has not been scheduled in advance, the employee must
6 notify his /her supervisor directly, within the first half hour of the work shift. If
7 in the sole judgment of management, the employee's absence would cause a severe
8 disruption of City business, management may require the employee to report to
9 work. In such case, the time lost by the late arrival will be charged against the
10 employee's accumulated vacation or compensatory time off balance. An employee
11 may not use more than two unplanned vacation days per calendar year. This
12 benefit shall only be in effect during the term of this agreement and shall

UNIFORM ALLOWANCE
3
I.
The secretaries and clerk typists in the Police Department shall receive an
4
annual uniform allowance which equals 25% of the monthly fifth step for
5
Secretary II rounded off to the nearest $1.00.
6
2.
This allowance shall not be paid for any employee who is off duty due to a
7
job- related injury at the start of any calendar quarter. If the employee
8
returns to work during that quarter, his /her uniform allowance will be
9
prorated.
10
3.
All other employees required to wear City uniforms shall be provided clean
11
uniforms. A uniform includes either one shirt and pants combination or one
12
pair of- coveralls.. The Personnel Director ,shall authorize any modification
13
in the 'current number and. type of uniforms provided. _
14
4.
Uniforms and work shoes shall only be used on City business.
15
5.
Employees required to wear City uniforms shall only be permitted to wear
16
other clothing for medical reasons upon submission of a letter from the city
17
doctor certifying that the city uniform is injurious to their health.
18
Decisions regarding this paragraph shall be made by the Personnel Director
19
on a case by case basis.

3 Employees required by management to wear protective footwear for safety reasons

2 RETIREMENT
3 Section A
4 The City agrees to provide the .Public Employees' Retirement System's 2% at age
5 60 plan to all eligible employees including the amendments permitting conversion
6 of unused -sick leave to additional retirement credit and the 1959 survivor's benefit;
7 and one year final compensation.
8 Section B
9 The City agrees to contribute seven (7) percent of an employee's salary on behalf
10 of the employee to PERS. These amounts paid by the City are employee
11 contributions, and are -paid by the City to- satisfy the employee's obligation to
12 contribute seven .(7) percent of salary to, PERS. An employee has no option to
13 receive the contributed' amounts directly instead of having them paid by the City
14 to PERS on behalf of the employee. It'is .understood and agreed to by the parties
15 that the City "pick up" of the employee's PERS contribution is made in lieu of a
16 wage increase. Therefore, in all comparisons made with other agencies, seven (7)
17 percent of salaries will be added to the total compensation provided by the City to
18 the employees. It is further understood and agreed to by the parties that payment
19 of the seven (7) percent PERS contribution is made subject to I.R.S. approval of
20 reporting procedures.

2 WORK- OUT -OF- CLASSIFICATION
3 For the purposes of this article, an out -of -class assignment is the full -time
4 performance of all the significant duties of an available, funded position in one
5 classification by an individual in a position on another classification. An employee
6 assigned in writing by management to work out -of -class on a position assigned a
7 higher pay range' and, is vacant.pending an examination or is vacant due to an
8 extended. sick or disability leave shall receive five (5) percent, but in no case more
9 than the fifth step of the higher class, in addition to their regular base rate
10 commencing on the eleventh_ consecutive workday on the, out -of -class assignment.

3 An employee who is not performing up to established job standards may be "Y'!

TEMPORARY ASSIGNMENT
An appointing authority may temporarily assign an employee to a different position
for a specific period. of time, after which- the employee. returns to his /her regular
duties and position from which he /she was detailed. Such action shall have the
prior approval of the Personnel Director. An appointing authority may assign an
employee to a different position for a period of time not to exceed 90 days,
provided the employee has received 24 hours written notice which includes reasons
for the assignment.

1 ARTICLE 28
2 TRANSFER
3 Upon proper notice and concurrence by the City Administrative'Officer, an
4 employee may be transferred by the appointing authority from one position to
5 another in the some pay range provided he /she possesses the minimum
6 qualifications as determined by the Personnel Director.
7 If the transfer involves a change from one department to another, both department
8 heads must consent thereto unless the City Administrative, Officer orders the
9 transfer for purposes of economy and efficiency.
10 The employee shall,be .given five (5) business days' written notice of the transfer
11 including the reason for .the change.

PAYDAY

2 SAFETY PROGRAM
3 The City shall continue a compensation program for safety representatives on the
4 basis that each designated safety member shall be compensated at the rate of
5 $10.00 per month. The description of the duties of a safety committee member

7 safety representatives is to assist the Personnel .Director and the overall safety
8 program in reducing accidents by reporting hazardous conditions.

RETIREE'S MEDICAL INSURANCE.

Employees
covered by this Agreement who meet all of the conditions set forth

the employee must retire from City service, apply for and actually

receive retirement benefits through the City's retirement system.

b)
the employee must be at least 55 years of age.

the employee must have at least ten (10) years service with the City.

, the employee may have dependent coverage only for those dependents

covered= for -the last year of employment with the City.

"e)
'all employee( and'dependent coverage will cease upon the death of the

employee or upon the employee reaching age 65.

This benefit
only applies to employees who retire during the term of this

Agreement.
This benefit shall continue beyond December 31, 1982, if, and. only if,
16
there is mutual agreement of the parties to continue such benefit.

STATE DISABILITY INSURANCE
At the written request of the Association, an election shall be held among the
employees in the unit to decide if such employees will purchase State Disability
Insurance. If an election is requested; the parties shall meet to decide the

Association on'26 January 1982. (Appendix D)

MANAGEMENT RIGHTS
The rights of the City include, but are not limited to, the exclusive right to
determine the mission of its constituent departments, commissions and boards, set
standards of service; determine, the procedures and standards of selection for
employment and promotion; direct its employees, take disciplinary action; relieve
its employees from duty because of lack of work or for other legitimate reasons;
maintain the efficiency of governmental operations, determine the methods, means
and personnel by which government operations are to be conducted; determine the.
content of job classifications; take all necessary actions to carry out its mission in
emergencies; and exercise complete control and discretion over its organization and
the technology of performing its work.

2 PEACEFUL PERFORMANCE
3 Participation by an employee in a strike or a concerted work stoppage is unlawful
4 and shall terminate the employment relation. Provided however that nothing
5 herein shall be so construed as to affect the right of any employee to abandon or
6 to resign his employment.
7 (a) Employee organizations shall not hinder, delay, or 'interfere, coerce
8 employees of the City to hinder, delay, or interfere with the peaceful
9 performance of City services by strike, concerted work stoppage,
10 cessation of. °work, slow -down, sit -down, stay -away, or unlawful
11 picketing.
12 (b) In the event that thereoccurs any strike, concerted work stoppage, or
13 any other form of linterference with or limitation of the peaceful
14 performance of City services prohibited by this article, the City, in
15 addition to any other .lawful remedies of disciplinary actions, may by
16 action of the Municipal Employee Relations Officer cancel any or all
17 payroll deductions, prohibit the use of bulletin boards, prohibit the use
18 of City facilities, and withdraw recognition of the employee
19 organization or organizations participating in such actions.
20 (c) Employees shall not be. locked out or prevented by management
21 officials from performing their assigned duties when such employees
22 are willing and able to perform such duties in the customary manner
23 and at a reasonable level of efficiency, provided there is work to
24 perform.
25 Any decision made under the provisions of this Article may be appealed to the City
26 Council by filing a written Notice of Appeal with the City Clerk, accompanied by
27 a complete statement setting forth all of the facts upon which the appeal is based.
28 Such Notice of Appeal must be filed within ten (10) working days after the

complaint is based, or it will be considered closed and not subject to any.other

LONGEVITY
3
A.
Each employee shall be paid an additional one percent (1 %) of his base
4
salary step following ten years of continuous full -time service with the City.
5
An additional one percent (1 %) of base salary will be added for each
6
subsequent five year period, calculated to the nearest two dollars ($2.00).
7
B.
In the event an employee receiving longevity pay is not performing up to the
8
established standards set for the job, the department head with the
9
concurrence of the City Administrative Officer, may suspend payment of the
10
longevity pay until such time as the employee's work performance comes up
11
to the standard level, in the opinion of the department head and concurred
12
in by the City Administrative Officer.

C.
The department head shall notify the employee in writing that he intends to
14
suspend the longevity pay unless the employee's job performance improves
15
significantly within a 60 -day period. If the employee's job performance does
16
not ,improve to the desired level by the end of 60 days, the pay reduction
17
shall then become effective. Longevity pay may be reinstated at any time
18
upon recommendation of the department head. If the department head
19
deems it necessary to again remove longevity pay during the same fiscal
20
year, he may make the change at any time with three business days written
21
notice.

D.
Effective I January 1983 no employees will become eligible for longevity

pay and employees then receiving. longevity pay shall receive no increases in

EDUCATION INCENTIVE
No new employees will become eligible for education. incentive pay and employees
currently receiving education incentive pay shall receive no increases in education
incentive pay based on additional education received; except that, employees who,
in the opinion of the department head, have been working toward a degree which
will make them eligible for education incentive pay and will complete such work by
31 December 1982, shall be eligible for education incentive.

2 MANAGEMENT EMPLOYEES
3 A. Employees filling those positions defined in Appendix B as "Management"
4 shall receive $25,000 term life insurance, a long -term disability insurance
5 plan for recognition_ of their. management responsibilities, and shall be
6 subject to overtime provisions in Appendix C.
7 B. Prior to July of 1982, there shall be an election among the mid - management
8 and confidential classifications in this unit (Appendix B) to decide if they
9 will remain within this unit. Prior to the election, management and the
10 Association - shall' meet:to (1) prepare an' election procedure, (2) prepare the
11 wording on the ballot and (3) prepare a resolution for adoption by the City

2 LIGHT DUTY ASSIGNMENT
3 If an employee's medical condition temporarily precludes the performance of
4 his /her normal duties and management determines modified work is available and
5 necessary to be performed, he or she may, with medical authorization,' be
6 - temporarily assigned to such work for a period not to exceed six months. No
7 change in Base pay will result unless the duties to be performed are substantially
8 greater 'or lesser than, those normally performed by the employee and the
9 employee's current, .pay' rate is not within the pay range for the temporarily
10 assigned work. In no event shall an employee's current pay rate be reduced more
11 than four (4) ranges at the same step.

2 FULL AGREEMENT
3 It is understood this Agreement represents a complete and final understanding on
4 all negotiable issues between the City and the Association. This Agreement
5 supersedes all previous Memoranda of Understanding or Memoranda of Agreement
6 between the City and the Association except as specifically referred to in this
7 Agreement. The parties, for the term of this Agreement, voluntarily and
8 unqualifiedly agree to waive the obligation to negotiate with respect to any
9 practice, subject or matter not specifically referred to or covered in this
10 Agreement event though such practice, subject or matter may not have been within
11 the knowledge of the parties at the time this Agreement was negotiated and
12 signed. In the even any new practide,.subject or matter arises during the term of
13 this Agreement and an action is. , proposed by the City, the Association shall be

2 SAVINGS CLAUSE
3 If any provision of this Agreement should be held invalid by operation of law or by
4 any court of competent jurisdiction, or if compliance with or enforcement of any
5 provision should be restrained by any tribunal, the remainder of this Agreement
6 shall not be affected thereby, and the parties shall enter into a meet and confer
7 session for the sole purpose of arriving.at a mutually satisfactory replacement for
8 such provision within a thirty (30) 'day work period. If no agreement has been
9 reached, the parties agree to invoke _the provision of impasse under Section 13 of
10 City Resolution No. 3405 (1977 Series).

RENEGOTIATION

OVERTIME PROVISIONS FOR MID - MANAGEMENT. EMPLOYEES LISTED
IN APPENDIX B
Each department head may grant those employees in the mid - management
classifications compensating time -off (CTO) not exceeding five (5) regularly
scheduled work days at a time; however, in no case shall more than five (5) CTO
days be combined with,the use of any vacation leave. In. no case shall the number
of CTO and vacation days taken exceed twenty -five (25) consecutive days. A
maximum .of forty (40) hours of CTO not taken:as -time off shall be paid off and no
time carried over as. of,.June 30. each year;for time earned during the previous six
months. The same procedure shall apply for time earned from I July through
31 December. each year. All such paid CTO shall be approved by the department
head prior to payment.
All CTO earned shall be authorized in writing by the department head at the end
of each payroll period, and all CTO earned. shall be accounted for to the nearest
quarter hour.

Management Proposal
STATE DISABILITY INSURANCE
The City and employee representatives agree to study the desirability and
feasibility of joining the State Disability Insurance Program. The parties have met
and agreed that it is both desirable and feasible to join the SDI program in the
following manner.
The. City management will recommend to the City Council that it approve the
following plan to join the State Disability Insurance Program:
I. It is mutually agreed that an election of all eligible employees in the unit
will be held to determine whether employees are interested in joining SDI.
2. The parties will 'work together in preparing-.'information to be distributed to
employees at the time'of the election.
3. A majority of the total eligible employees in the unit will determine
whether that,unit.joi_ns SDI..
4. The decision of the majority will be binding and if the unit elects to
participate in SDI all employees must participate in the program for a
minimum of two (2) calendar years beginning the January following the year
the SDI program is selected.
5. If this unit chooses to withdraw from SDI after the required two (2) years
membership it must present a majority petition indicating such desire.
6. The City will require employees receiving SDI benefits to coordinate
accumulated paid time such as vacation, sick leave, etc. so take home will
not exceed regular take home. Time -in- service and other City benefits will
only accrue on City -paid time.
7. This coordination of payments will be administered by the City and charged
to the program by an assessment of each participating employee which shall

be 1 /10 of 1% (.001) of the first $17,000 in annual wages. This annual wage
maximum will be'adjusted in, accordance with future State adjustments.
In addition to the coordination of benefits, such administrative fee shall
cover the cost of administrative control /deductions and payments and the
cost of the initial election.
The employee shall also pay all costs of the program. Current costs are
understood to be 8/ 10 of 1% (.008) of the first $17,000 in annual wages.
Per State regulations, SDI coverage for new enrollees will become effective
approximately seven (7) months after enrollment.
The administrative fee noted in:item.7..above will be subject to review and
revision. by, all parties. during the Memorandum of Understanding meet-and-
confer' sessions beginning in 1984.

as counsel -of- record in this matter and handle any and all
local appearances and motions which can be more efficiently

all our clients, we will actively work and cooperate with you -
in order to minimize legal expenses to the fullest extent

As with our standard practice, we will be billing you on
a'monthly basis for services rendered. The bill will reflect
the time devoted to this matter at the hourly rate quoted

AGREEMENT
This agreement dated this 16th day of February , 1982 by and
between WALTER BROTHERS CONSTRUCTION COMPANY, INC., herein referred to as
t "Developer" and the CITY OF SAN LUIS OBISPO, herein referred to as the "CITY"
J WHEREAS, Developer has been granted a Use Permit (U0794 -A) pursuant to
City Council Resolution No. 4269 (1980 Series) which sets forth several conditions
to allow construction of a three -story social services office complex at 3220
South Higuera Street; and
WHEREAS, two (2) of the conditions (4 and 5) of the use permit require
Developer to:
1. Pay to City, thirty -five (35) percent of the total cost (current
estimated total cost = $86,000) of proposed future traffic signals
at the intersection of South 'Higuera Street and Margarita Avenue, and
2. Pay to City, fifteen (15) percent of the total cost (current estimated
total cost'= $86,000) of proposed future traffic signals at the inter -
set•tion of South Higuera Street and Prado Road; and

WHEREAS, Developer desires to submit a bond to guarantee the above - mentioned
traffic signals in lieu of cash payment as required per said resolution.
NOW THEREFORE, in consideration of the foregoing, Developer does hereby
agree to pay, upon demand by City, the respective above - mentioned monies as
calculated by the City Engineer, within sixty (60) days notice thereof.
In the event eithersor both of the respective traffic signals are not
installed by City within five (5) years from the above date, Developer shall
either pay to City the respective monies, or, request an extension of this
Agreement by the City Council. Any extension of time hereunder shall not operate
to release the surety filed pursuant to this Agreement. In this connection, the
surety waives the provisions of Section 2819 of the Civil Code of the State of
California.
The Developer hereby attaches hereto, and as an integral part hereof,
and as security for the performance of this Agreement, (a bond) approved by and
in favor of the City, and conditional upon compliance with this Agreement, which
said bond is in the initial amount of $43,000, and which is in the amount of
the present estimated share of the cost of said improvements ($30,100 for

Margarita Avenue; $12,900 for Prado Road). Said amounts shall be adjusted
to reflect actual costs at time of installation.
City shall install the respective traffic signals when sufficient funds
are available.
It is understood and agreed by and between the Parties hereto that this
agreement shall bind the heirs, executors, administrators, successors and
assigns of the respective Parties to this agreement.
