RESOLUTION NO. 6024 (1986 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPOINTING BANK OF AMERICA AS "TRUSTEE" FOR THE
PROPOSED MADONNA ROAD ASSESSMENT DISTRICT BOND ISSUE OF
APPROXIMATELY $9,650,000
WHEREAS, it is a legal requirement to appoint a Trustee for the
proposed bond issue; and
WHEREAS, proposals were solicited in accordance with our purchasing
ordinance; and
WHEREAS, Bank of America's proposal was comparable to the other
proposal received; and
WHEREAS, Bank of America has well- documented expertise in managing
assessment district financing.
NOW, THEREFORE, BE IT RESOLVED by the Council'of the City of San Luis
Obispo as follows:
SECTION 1. Bank of America is appointed Trustee of the City's Madonna
Road Assessment District Bonds.
SECTION 2. The City Administrative Officer is authorized to sign any
related agreements.
SECTION 3. The City Clerk is directed to send copies of resolution to
Bank of America; Rauscher, Pierce, Refsnes, Underwriters; and Jones, Hall,
Hill & White, Bond Counsel.

FEE AGREEMENT
THIS AGREEMENT, made and entered into this 15th. day of
July 1986, between the CITY OF SAN LUIS
OBISPO, hereinafter called "CITY" and BANK OF AMERICA
NATIONAL TRUST AND SAVINGS ASSOCIATION, a national banking
association, hereinafter called "BANK ".
W I T ,fit B S S E T H:
WHEREAS, CITY has authorized and may from time to
time issue Various Local Improvement Bond issues and
authorize and issue additional bonds and wishes BANK to
act as Agent to register, transfer ownership and pay
principal and interest on said bonds.
CITY may from time to time include other bond issues
under the terms of this Agreement.
CITY, as a Registrar, Transfer Agent, and Paying
Agent, wishes to register, transfer ownership and pay said
bonds and additional bonds and interest thereon.
1. CITY hereby appoints BANK its Agent to
register, transfer ownership and pay bonds and interest
thereon.
2. CITY will, on or before the date bonds and
interest is to be paid, deposit immediately available funds
with the Corporate Agency Division of BANK in San
Francisco; otherwise BANK will not be required to make
any disbursement.
3. BANK will cause all of said bonds to be honored .
in accordance with their terms for registration, transfer
of ownership or payment at maturity or when by their terms
they otherwise become payable upon presentation to BANK.
BANK will hold and apply any monies deposited.
4. CITY will deliver or cause to be delivered to
the BANK, at least six (6) days prior to the original
issue date of the bonds the following documents:
- Original issuance instructions from Underwriters
- Supply of bond certificate(s)
- _Specimen bond certificate(s)
- Certified bond resolution(s)
- Bond legal.opinion(s)
- Debt service schedules
5. CITY will pay to BANK fees as set forth below:
INITIAL ACCEPTANCE FEE: (per issue) $500.00
Set up original issue by separate maturities and
rates and prepare bonds for delivery for closing.
ANNUAL ADMINISTRATION FEE: (billed annually)
For each issue: $500.00
REGISTRAR MAINTENANCE AND SERVICING FEE:
(billed semiannually)
Annual minimum (per issue) $500.00
This fee includes the Annual Maintenance of and
servicing of 100 bondholder accounts or any
portion thereof; solicitation of taxpayer
identification numbers; postings; semiannual
interest disbursement; stop payment and
replacement of lost or missing interest checks;
correspondence and research required, documentary
transfers; replacement of lost or stolen bonds;
and one bondholder list.
Should the annual bondholder account base.exceed
100 accounts, then in addition to the minimum
annual maintenance and servicing fee of $500.00,
a charge of $5.00 per bondholder account will be
charged for the excess of 100 bondholder accounts.

OUT -OF- POCKET. EXPENSE:
Fees do not include out -of- pocket expenses such as, but not
imite "d t- postage, .insurance,wires,
stationery, costs of printing forms or letters, publication
of notices of redemption, expenses of BANK personnel
travelling to attend closings or meetings, etc. These
out -of- pocket expenses will be charged at the actual cost
incurred.
ADDITIONAL SERVICES:
The above schedule of fees are for the ordinary services in
connection with the items mentioned, and should BANK be
called upon to render any additional services in connection
with the items mentioned or any services not .set forth in
the above schedule, or services during default, a reasonable
charge depending upon the services rendered will be made.
MICROFILMING OF CANCELLED BONDS:
BANK shall retain cancelled bonds for a period of twelve
months for the purpose of facilitating research, after which
time they shall either be returned to the Issuer or sent to
a commercial record storage warehouse selected by the
Issuer. If cancelled bonds are to be microfilmed, the
cancelled bonds and all supporting documentation are to be
sent to a microfilm service bureau for filming. An original .
and a duplicate copy of the film will be retained by the
BANK for research purposes and all documents will be sent
to the BANK'S record destruction facility. The microfilm
service bureau will bill the Issuer directly with a copy to
the BANK. BANK will charge the Issuer 15% of the
microfilm service bureau's bill as a processing charge (for
handling, coordination, file certification, and
destruction).
6. The foregoing schedule is subject.to change upon
providing at least ninety (90) days advance written notice.
7. BANK will submit its statement for fees and
expenses due BANK, and CITY will pay said statement in
accordance with'Paragraph 2 of this Agreement. Statements
for fees and expenses unpaid after 30 days are subject to a
handling charge of 2% per month.
8. All notices, documents and other correspondence
will be-mailed or delivered to BANK at Bank of America,
Capital Markets Group, Corporate Trust Administration #9528,
201 Mission Street, 15th Floor, San Francisco, CA 94105 and
to CITY at 9.90 .Palm Street, ,.P.O. Box 8100, San Luis Obispo,
California 93403 -8100 or to such other address as
either party shall from time to time indicate in writing to,
the other.
9. CITY upon ninety (90) days written notice to
BANK, may terminate this Agreement.
10. BANK upon ninety.(90) days written notice to
CITY, may terminate this Agreement.
THE TERMS AND CONDITIONS OF THIS Agreement are intended
for the mutual benefit of CITY and BANK exclusively, and
are not intended to give any third party any right or claim,
Contractual or otherwise, hereunder.
. IN WITNESS WHEREOF, the parties have caused these
presents to be duly executed, the day and year first above
written.

SUBJECT:
Traffic Work Orders for the Period of April 1, 1986 through June 30, 1986.
CAD RECOMMENDATION:
Adopt resolution approving Traffic Work Orders for the period of April 1,
1986 through June 30, 1986.
BACKGROUND:
The City Engineer has, over the past three months, issued work orders making
changes to improve safety and operation of the street system. Just under
one -half were requests for signing, including signs for new tracts, from
staff. Over one -third were red curbing requests from the public. The
remainder were parking and signal changes from the public and staff.
It has been Council's policy in the past to accept this report on a quarterly
basis. This report satisfies this past policy.
FISCAL IMPACT:
Minor implementation costs associated with.street maintenance.
RECOMMENDATION:
Adopt resolution approving Traffic Work Orders for the period of April 1, 1986
through June 30, 1986.

RESOLUTION NO. 6021 (1986 SERIES)
A RESOLUTION OF INTENTION TO ABANDON A PORTION OF
BISHOP STREET BETWEEN JOHNSON AVENUE AND LAUREL STREET
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. It is the intention of the City of San Luis Obispo to abandon
right -of -way easterly of Johnson Avenue as shown on the map marked "Exhibit A" attached
hereto and incorporated herein by such reference, pursuant to Section 8300 et. seq. of
the Streets and Highways Code.
SECTION 2. Copies of the map showing the particulars of the proposed abandonment
are also on file in the office of the City Clerk.
SECTION 3. Tuesday, August 5, 1986, in the Council Chamber of the City Hall, 990
Palm Street, San Luis Obispo, California is the time and place set for hearing all
persons interested in or objecting to the proposed abandonment, which time is not less
than fifteen (15) days from the passage of this resolution.
SECTION 4. This resolution, together with the ayes and noes, shall be published
once in full at least three (3) days before the public hearing on the proposed
abandonment, in the Telegram- Tribune, a newspaper published and circulated in this city.
SECTION 5. The City Engineer shall post at least three (3) notices of the proposed
abandonment along that portion of the street proposed to be abandoned at least fourteen
(14) days before the date set for hearing in accordance with section 8322 of the Streets
and Highways Code.
SECTION 6. The proceeding to be taken will be subject to reservation by the city of
public easements for utilities, drainage, and access, and subject to such other
conditions as the council deems appropriate.

SECTION 7. The City Engineer shall notify utility companies affected by the
proposed abandonment at least ten (10) days after adoption of the Resolution of Intention
in accordance with Section 8347 of the Streets and Highways Code.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO GRANTING APPROVAL OF TENTATIVE TRACT NO. 1399
LOCATED AT 3547 SOUTH HIGUERA STREET
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Findings. That this council, after consideration of the tentative map of
Tract 1399 and the Planning Commission's recommendations, staff recommendations and
reports thereon, makes the following findings:
1. The design of the tentative map and proposed improvements are consistent with the
general plan.
2. The site is physically suited for the type and density of development allowed in a
C -S zone.
3. The design of the tentative map and the proposed improvements are not likely to cause
serious health problems, substantial environmental damage or substantially and
unavoidably injure fish or wildlife or their habitat.
4. The design of the subdivision or the type of improvement will not conflict with
easement for access through (or use of property within) the proposed subdivision.
5. The Community Development Director has determined that the proposed subdivision will
not have a significant effect on the environment and has granted a negative
declaration.
SECTION 2. Conditions. That the approval of the tentative map for Tract 1399 be
subject to the following conditions:
1. The subdivider shall establish covenants, conditions, and restrictions for the
regulation of land use control of nuisances and architectural control of all
buildings and facilities. These CC &R's shall be approved by the Community
Development Department and administered by [give name] homeowner's association.
2. The subdivider shall include the following provisions in the CC &R's for the Tract:
a. Property owner's association shall be created to enforce the CC &R's and provide
for professional, perpetual maintenance of common areas including, but not
limited to, the driveway, parking lot, landscaping, sewer, utilities and
building exteriors.

b. The right shall be granted to the City to maintain common areas if the property
owner's association fails to do so, and to assess said association for expenses
incurred.
c. All parking spaces provided in the project shall be available for use by all the
individual owners.
d. There shall be no change in city - regulated provisions of the CC &R's without
prior approval of the Community Development Department.
3. Subdivider shall provide individual water services for each unit.. Meters shall be
clustered at property frontage, to the approval of the City Engineer.
4. Subdivider shall extend individual gas and electrical services and metering for each
unit, to the approval of affected utilities and the City Engineer.
5. Final maps shall note a blanket easement over the common lot area, except under the
structures, for underground public utilities serving the site, to the approval of the
City Engineer and affected utility agencies.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
DENYING A REQUEST TO CHANGE THE GENERAL PLAN LAND USE ELEMENT
AND ZONING MAPS FROM HIGH- DENSITY RESIDENTIAL (R -4) TO TOURIST -
COMMERCIAL (C -T) AT 625 TORO STREET (GP /R 1253)
WHEREAS, the Planning Commission and City Council have held hearings to consider a
request for amendments to the Land use Element Map and Zoning Map, in compliance with
the Government Code; and
WHEREAS, the proposed amendments are not consistent with the city's General Plan,
specifically with the following Housing and Land Use Element policies for residential and
tourist - commercial uses as follows:
Housins: "In decisions where residential use is a suitable option based on land use
and environmental conditions, favor the residential use over non- residen_ tial uses
(through use permits and zoning actions)."
Land Use "The city should encourage the expansion of tourist - oriented facilities
by the restructuring and intensification of existing tourist - commercial areas."
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. The request for rezoning and general plan amendments is hereby denied.

A RESOLUTION OF THE COUNCIL OF THE CITY
OF SAN LUIS OBISPO, ESTABLISHING A
POLICY REGARDING FEDERAL AID URBAN
(FAU) FUNDS
WHEREAS, the City of San Luis Obispo receives Federal Aid Urban funds,
WHEREAS, these funds may only be used to construct and maintain
streets on the Federal Aid Urban system, and
WHEREAS, the City receives approximately $150,000 per year in FAU
funds, and
WHEREAS, the experience of the City is that FAU projects may cost in
excess of 20% more than similar non -FAU projects.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1.
A. City shall determine its unobligated balance of FAU
apportionments.
B. It shall be the City's policy to exchange unobligated FAU funds
for unencumbered funds whenever possible.
C. Unencumbered funds received by the City shall only be used for
transportation - related purposes.
SECTION 2. The City shall receive the best possible exchange rate for
the unobligated FAU funds.

AGREEMENT FOR PROFESSIONAL SERVICES
THIS AGREEMENT, made and entered into this 1st day July, 1986, by
and between the SAN LUIS OBISPO DOWNTOWN BUSINESS IMPROVEMENT AREA,
hereinafter called "BIA," acting on behalf of the City of San Luis
Obispo, and THOMAS L. JONES, doing business as TOM JONES CREATIVE
ADVERTISING, hereinafter called "Consultant," providing for certain
advertising services to be performed by Consultant to assist BIA;
WITNESSETH:
WHEREAS, BIA requires certain advertising services to promote its
activities and desires to employ Consultant to perform those services;
and
WHEREAS, Consultant is willing to perform those services;
NOW., THEREFORE, in consideration of these facts, the parties
mutually agree as follows:
1. SERVICES TO BE PERFORMED-BY CONSULTANT:
Consultant will perform the following advertising services:
a. Creative Services (ideas, copywriting).
b. Coordinate Radio /TV /Newspaper campaigns.
C. Assist the BIA in planning advertising budgets..
d. Assist with promotional planning,.
e. Place all advertising for the various BIA campaigns.
f. Provide professional advertising and promotional
consistency.
g. Attend the BIA promotional comm.ittee meetings.
h. Supervise all radio and TV production.
i. Verify advertising charges prior to the invoices being
approved for payment.
j. To assist the Administrator with the preparation of the
monthly BIA newsletter_
k. To establish a complete and accurate BIA member list and
provide a monthly computer update with all additions,
deletions and corrections.
1. Assist the advertising committee in communicating with the
BIA membership.
2. TERM OF AGREEMENT:
The term of this Agreement shall be from July 1, 1986 to June 30,
1987, unless terminated earlier by either party by fifteen (15) days'
written notice.

AGREEMENT
THIS AGREEMENT, dated July 1, 1986, for the convenience of the
parties hereto, is between the CITY OF SAN LUIS OBISPO, a
chartered municipal corporation (referred to herein as "City ")
and CASA SOLANA, INC., a non - profit corporation (referred to
herein as "Casa Solana ").
WITNESSETH:
WHEREAS, Casa Solana has requested City.to contribute to a
program to provide a residential treatment program for alcoholic
women, said program as more fully described in Exhibit "B"
attached hereto and WHEREAS, said services will be available to
residents of the City, thereby serving both a public and
municipal purpose:
NOW, THEREFORE, City and Casa Solana, for and in consideration
of the mutual benefits, promises, and agreements set forth
herein, do agree as follows:
1. Casa Solana agrees to make its services as described in
Exhibit "B" and incorporated herein, available to residents of.
the City of San Luis Obispo on a regular basis for the period.-,
July 1, 1986 through June '30, 1987. .
2. Casa Solana will provide the City with periodic summary
reports and a final report, describing the type and quantity of
services and listing funds received by Casa Solana from other
sources. Said reports shall be in the form of Exhibit "C ",
attached hereto and incorporated herein, or in such form as
shall be approved by the Human Relations Commission or its
staff.
3. Casa Solana and all of i.ts agents, representatives, or
participants in any manner in the performance of Casa Solana's
obligations and duties hereunder shall be employees, independent
contractors, or volunteers for Casa Solana and shall not for any
purposes be considered employees or agents of the City.
4. Casa Solana agrees to hold City harmless, and to defend City
against, from and in any claim, action, proceeding or hearing
wherein the allegation charging liability on the part of the
City as a result of any act of omission, negligent or otherwise,
of Casa Solana..

5. City agrees to pay Casa Solana a one -time only grant, the
sum of Six Thousand Four Hundred Fifty Dollars ($6,450), payable

6. The City Council may by motion terminate this agreement at
its sole discretion after a public hearing and upon ten (10)
days written notice to Casa Solana. Said termination shall be
effective 30 days after City mails notice of termination of the
agreement to Casa Solana. Any funds not paid pursuant to
paragraph 5, above, shall revert to City upon said termination.
7. For purposes of notice under this agreement, all notices

III. PROGRAM OBJECTIVES
PROGRAM PHILOSOPHY
The philosophical basis to create Casa Solana, Inc. and "Sunshine House" is the
belief that alcoholic woven have soecifi'c recovery needs; and that those needs can
be met with individual concern, care, guidance and love.
A guiding principle is that recovery from alcoholism is a life -long process typically
involving a series of recovery experiences of which participation in the Casa Solana
program is only one.
PROGRAM OBJECTIVES
Process: To initiate and /or further the resident's progress in the recovery process
through participation in all scheduled program activities and the Resident Council.
To maintain eighty percent occupancy over a 365 day reporting period.
Outcome: Expectation of successful completion on sixty percent of residents
entering the program as evide -ced in a written exit plan by the resident.
Casa Solana, Inc. defines "success" as achievement of measurable objectives
and continued contact and participation in the orogram of fifty percent
of the women who have returned to their homes.
EVALUATION
Evaluation procedure consists of the Director's monthly and annual activities
report, the resident's weejkt actuvutues reoirt, the treasurer's monthly and
annual financial report and other stipulations set down by funding sources.
II. PROBLEM STATEMENT/NEEDS ASSESSMENT
The National Council on Alcoholism and other researcher's estimates that ten percent
of the population are alcoholic, and indicates about fifty percent of all alcoholics
are women.
The State Department of Fina.nee for the State of California estimates the 'population
of San Luis Obispo County by 19-87 will be 200,000: Accordin�l_v, the estimated
population having problems with - alcohol would be about 209000, and the number of
women suffering from alcohol related problems would be aoproxinately forty -nine
percent of the population of San Luis Obispo County, or 9,800: Approximately one-
fourth of these women reside in the City of San Luis Obispo, oneT fourth reside in
F'orro.Bay, Souty Bay, Atascadero and Paso Robles., and the remai`nin'o are living
in other areas of the county.
Casa Solana is the only recovery home for alcoholic women in S-an Luis Obispo County,
and can accomidate a maximun of ten women at any given time. The time is rapidly
aonroachina when we will not be able to accomidate all women who seek our services.
Studies reported in medical and alcohol /alcoholism journals and papers indicate
that the orobler of alcohol use /abuse and alcoholism among women is -not declining.
on the contrary, as the status of women changes the problem appears to be increasing.
Therefore, the need to address this devistating problem.and provide direct services
increases.
Alcohol related problems and alcohol -is is not confined to the individual. Every
person in the county is in one way or the other effected by this oroblem, therefore,
it is reasonable to view alcohol use /abuse and alcoholism as a community problem.

SPECIFIC GUIDELINES
Periodic reports shall be due as specified on an agency -by- agency

6. FINAL REPORT: Due one month after the close of the fiscal year.
Should be a brief cummulative report including synopsis of
service(s) provided, an overall narrative as to goal(s)
assessment and a year end financial spending form of City funds.

PHILOSOPHIC ASSUMPTION: Aim to help people to help themselves.
GENERAL GUIDELINES:
As you know, funded agencies are paid with City of San Luis Obispo
taxpayer's money. As such, we are all required to be accountable
for these funds. Accountability will be achieved through the
following methods:
1. Liason._Pro¢ ram: The HRC, through the Commissioners or
staff. will be in contact with the funded program on a
regular basis to identify areas of concern and /or to
provide a resource for each program funded.
2. Periodic Reports will be due to the HRC. The release of
funds shall be contingent on the reciept of a complete
report. Guidelines for such reports shall be as deemed
appropriate.by the HRC.*
3.. Fiscal Year,End Reports shall be the responsibility of
each funded agency, and shall be due by July 30, of
fiscal year. Said report shall consist of synopsis of
service(s), an overall narrative of goal(s)assessment
during the fiscal. year and a year -end financial spending
form of City funds.
4:... - Documentation: Through —tHe
supplied to each funded agency by the-HRC, programs will
be required to categorically display their use of
city funds. While supporting documentation is not
necessarily required within the reporting guidelines,
it is necessary to have such documentation on hand in
order to satisfy any need for such documentation.
5. Annual Audit: if necessary, the agency must provide for
an annual audit by an independent.auditor mutually
agreed upon.

to the taxpayers of the City. Your cooperation is very much
appreciated. As always, the HRC and staff are available for help
and consultation whenever the need arises.

Contracts have been developed and are just now being utilized for each adult resident.
The Initial Contract covers the first 72 hours that the woman and her children are at tF
Shelter; at this time she is asked to commit to adhering to all house rules, to a visit
with a Mental Health therapist (provided as a community service) and other individualized
requirements as determined by the admitting staff. After successful completion of the
assessment period, a Temporary Residency Contract is negotiated; this reiterates the
house rules, provides substantially more detail about the goals and objectives of each
individual client, and established a length of stay provision of three weeks maxima,.
Extensions are granted on a case by case basis with a ma,Kimn stay of 60 days. As
stipulated in the contracts, the women are required to attend the groups, contribute
daily to the operation of the household, and make a daily effort to improve their
situation (such as .seeking housing, employment, etc.) Other items included in these
contract are: enrolling school age children in classes, attending a Job Search Work-
shop or meeting of Adult Children of Alcoholics, for example.
Our on -going volunteer recruitment, interviewing and screening will continue. A day-
long training session for new volunteers will be held every two months. In- service
trainings for staff and all volunteers will be held every six weeks and will cover
such topics as Recognizing the Signs of Child Physical or Sexual Abuse, and Crisis
Intervention..
Cal Poly interns have been recruited and are working on the development of public.
service announcements and the brochure and stationary revision. More interns from
the Child Development and Family Studies departments will be recruited to assist with
the development of a Children's Program and activities.
Staff and Board will continue to work together in the reorganization of personnel
policies and committee structures.
Legal Services: Each client will have the opportunity to meet with a paralegal vol-
unteer to strategize legal actions. The paralegal and Shelter staff will assess if
the woman will be referred to the attorney working with the Shelter or to an outside
resource. Appropriate referrals and connections will be made as needed. Shelter staff
and volunteers will assist in the preparation of legal documents and will provide court
support if requested. Peferrals to and our strong cooperation with the Victim - Witness
Center of the District Attorneyl.s Office will continue. A 'Law Library" section will
be established at the Shelterand will contain "in pro per" divorce materials and other
resources. Restraining order and dissolution forms will be kept on site for immediate
access by clients.
Outreach services: Battered women who are not in need of shelter, and former clients
who are now living in safety, will continue to be welcomed at the residence and to
attend the groups. One - to-one sessions will also be provided to them as needed. We
will also continue extensive.consultations with the women who call into the Shelter
for information and support.

III. PROGRAM OBJECTIVES
1. To provide child care and child abuse prevention /intervention and treatment
services to a target of 95 children and 80 parents ( total 175 participants )
in 1986 -87.
2. To continue to coordinate and network through the Child Abuse Prevention
Network which we established in 1984.
3. To work toward the improvement of child abuse prevention services through
the Child Abuse Prevention Network, Commission on Children and Youth, and through
our statewide affiliations with the California Consortium of Child Abuse Councils,
and with the Office of Child Abuse Prevention.
4. To reduce the staff /child ratio in each of our programs for children to more
effectively meet the need of each child
5. To provide immediate family counseling and play therapy not available through
other sources in the communityfor the children and families enrolled. All other
sources of these services will also be utilized to extend the Center's services
to as many families as possible.
6.. To continue to work toward developing volunteer professional consultants
for our Board of Directors and for program development in the direction of a
therapeutic family program.
6. To assist each family toward rehabilitation and 6trengthening their family
unit. To assist each family to become self sufficient to enable low income families
.to secure and maintain employment, and to gain training for future employment.
7. To develop a system of support between families outside.of the Center to
encourage independence.
8. To continue to bring all available resources to the community through our
statewide connections to improve prevention services locally, and to increase.
community support.
9. To continue to utilize our volunteer support which help to provide labor
for facility and equipment repair and renovation, extra help with the children,
special events for the children, etc. We use volunteers from Tri Counties Regional
Center, Cal Poly, Cuesta, California Conservation Corps, Department of Rehabilitation,
SAVE ('Sexual Assault victims Education ), Men's Colony ( equipment repair ) etc.
10. To continue to work cooperatively with the County Health Department's program
for helping families under stress.
11. To expand servcies when funding becomes available, and to work toward-diversifyirg
funding sources.
12. To maintain and increase community support for our program through public
awareness efforts in the Network.
13. To provide a play therapy environment appropriate for working intensively
with our children and to focus in play therapy on helping children individually
and with sensitivity.

THIS AGREEMENT, dated July 1, 1986, for the convenience of the
parties hereto, is between the CITY OF SAN LUIS OBISPO, a
chartered municipal corporation (referred to herein as "City ")
and CIRCLE OF LOVE, a non - profit corporation (referred to herein
as "Circle of Love ").
WITNESSETH:
WHEREAS, Circle of Love has requested City to contribute to a
program to provide_ disability awareness programming, featuring
the Kids on the Block" puppet show, said program as more fully
described in Exhi.bi.t "B" attached hereto and WHEREAS, said
services will be available to residents of the City, thereby
serving both a public and municipal purpose:
NOW, THEREFORE, City and Circle of Love, for and in
consideration of the mutual benefits, promises, and agreements
set forth herein, do agree as follows:

Exhibit "B" and incorporated herein, available to residents of
the City of San Luis Obispo on a regular basis for the period
July 1, 1986 through June. 30, 1987.

III. PROGRAM OBJECTIVLS
Circle of Love believes in the fundamental importance of
accepting attitudes as a necessary ingredient for the successful
Integration of disabled citizens into the mainstream of our
schools and community. Our objectives are as follows;
1. To develop positive attitudes, sensitivity and under -
standing toward individuals with disabilities.
2. To dispel misconceptions, biases and myths about
disabilities
3. To teach appreciation of how it feels to have a
disability.
4. To teach how individuals with disabilities want to be
treated.
5• To teach how to accept differences.
A survey will be conducted in several schools in the
county this Spring which will evaluate prevailing attitudes
and feelings about individuals with disabilities. Next Spring
(1987) another survey will be conducted to measure our effective-
ness in meeting our objectives.
Four educators are on our Advisory Board. Their expertise
will be used to ensure the best possible programs will be
implemented.

during and after the onset of a terminal illnesss;
continue our counseling programs.through group sessions as well as
one -to -one, for any situation demanding our expertise;

continue to be reactive to our communities needs, whether by
increasing staff time, increasing training program presentations
or adding to our group counseling a high - school program for those
who may need our expertise.

dealing with topics and situations that would normally be most un-
comfortable and sometimes totally traumatizing..
Even'our office volunteers must take part in our training course for

We offer at least two of these training programs yearly at no charge and
it appears that additional courses.must be planned due to demand.
ADDITIONAL ASSESSMENTS
As quoted in the introduction, the heavy move.toward out- patient care
and the increased awareness and acceptance of Hospice has caused
a 30% increase in just our in-home-clients. There is of course an
attendant increased load in counseling as the other part of the pro-
gram increases.
Another area of expenseand staff involvement is in meeting the com-
munity's "need to know "regarding service availability. We provide a
speaker and audio- visual presentation which tells the "story of Hospice
in a genteel and professional manner. This is available at any time to
any group wishing it, at no charge.
Finally, we have responded to a campus need at Cal Poly at the request
of their housing department. Following the death of the students on
Cuesta Ridge some time ago, we were asked to help. We're facilitating
a group on campus, open to any college age person. They need not be
Poly students. Also, we have resonded within this past year to help
with the AIDSyndrome TAsk Force.

Achievenent of RSVP's purpose is facilitated by a coordinated use of resources of ACTION, the
RSYP sponsor, and the community to fulfill the coals of RSVP which are to:
(1) Develop a variety of opportunities for community service for older people willing to
share their experience, abilities and skiil for the betterment of their community and
themselves;
(2) Ensure that volunteer assignments are made consistent with the interests and abilities
of the volunteers and the needs of the community served ;
(3) Ensure that volunteers are provided needed orientation, inservice instruction,
individual support and supervision, and are given recognition for their volunteer service;
(4) Provide reasonable opportunity for community and volunteer involvement and support
in the development, operation and appraisal of the RSYP project;
(5) Develop local support to supplement available federal resources, and ensure that
program expenditures are incurred at the lowest possible cost consistent with effective
operation of the project, as required by ACTION legislation;
(6) Cooperate with agencies and organizations involved with the fields of aging and
voluntarism ;
(7) Develop a sound, locally - controlled senior volunteer program with continuing
community support.
V. FUTURE FUNDING
Retired Senior Volunteer Program is requesting S 2,500. from the City of San Luis Obispo.
This represents 3 X of the annual operating budget for the program. The application requests an
increased level of support . This is necessary to ensure the continued level of services with the
anticipated loss of federal funds as a result of the implementation of the Gramm/ Rudman/
Hollings amendment.
RSYP has initiated a campaign to secure local funding to permit the continued level of service.
This includes to date the following ; application to the United Way of the Central Coast,
application to each city in the county, and requests to Southern California Gas Company and Quota
Club. The program plans to expand this aspect of program operation . An initial effort of this
expanded effort includes a benefit performance by the San Luis Obispo Little Theatre scheduled
for April 24, 1986.

Department of Aging has developed the following working definition Seniors who have at least
two of the four characteristics: handicapped, language/ communication barrier, lives alone, age
75 years and older.'
A Management Information System ( MIS ) has been used for the past several years for the
collection of information regarding the programs funded through the Older Americans Act in
CAlifornia. As a result it is possible to provide you with the following information. This
Information is based on the first six months of service in this fiscal year.

III . PROGRAM OBJECTIVES
The objectives of the Caring Callers program for the next fiscal year are
• Provide 5500 hours of visiting services to 175 senior citizens;
• Recruit and orient 35 new volunteers;
Conduct four meetings of the Project Advisory Council ;
Provide information regarding the Caring Callers program at ten (10) community
meetings, events, or organizations; and
4 Develop and implement a fund raising plan.
The unit of service for Caring Callers is visiting. The definition of visiting is to visit a
client to provide reassurance end comfort ( one hour).
IV. METHODOLOGY
The Caring Callers program mrves as link between the volunteer and the client in the
establishment of a friendly visiting servie to the benefit of the patient. In this capacity the
Caring Callers program provides the important service of recruiting, training and supervising
the volunteer in service to the homebound senior citizen . The methodology for the provision of

AGREEMENT
THIS AGREEMENT, dated July 1, 1986, for the convenience of the
parties hereto, is between the CITY OF SAN LUIS OBISPO, a
chartered municipal corporation (referred to herein as "City ")
and FAMILY SERVICES CENTER, INC., a non - profit corporation
(referred to herein as "Family Services Center ").
WITNESSETH:
WHEREAS, Family Services Center has requested City to contribute
to a program to provide short term crisis counseling, said
program as more fully described in Exhibit "B" attached hereto
and WHEREAS, said services will be available to residents of the
City, thereby serving both a public and municipal purpose:
NOW, THEREFORE, City and Family Services Center, for and in
consideration of the mutual benefits, promises, and agreements
set forth herein, do agree as follows:
1. Family Services Center agrees to make its services as
described in Exhibit "B" and incorporated herein, available to
residents of the City of San Luis Obispo on a regular basis for
the period July 1, 1986 through June 30,. 1987.
2. Family Services Center will provide the City with periodic
summary reports and a final report, describing the type and
quantity of services and listing funds received by Family
Services Center from other sources. Said reports shall be in the
form of Exhibit "C ", a.ttached hereto and incorporated herein, or
in such form as shall be approved by the Human Relations
Commission or its staff..
3. Family Services Center and all of its agents,
representatives, or participants in any manner in the
performance of Family Services Center's obligations and duties
hereunder shall be employees, independent contractors, or
volunteers for Family Services Center and shall not for any
purposes be considered employees or agents of the City.
4. Family Services Center agrees to hold City harmless, and to
defend City against, from and in -any claim, action, proceeding
or hearing wherein the allegation charging liability on the part
of the City as a result of any act of omission, negligent or
otherwise, of Family Services Center.

5. City agrees to pay Family Services Center a one -time only
grant, the sum of Four Thousand Two Hundred Dollars
($4200),payable in twelve monthly payments, or if deemed

6. The City Council may by motion terminate this agreement at
its sole discretion after a public hearing and upon ten (10)
days written notice to Family Services Center. Said termination
shall be effective 30 days_ after City mails notice of
termination of the Family Services Cente,r agreement. Any funds
not paid pursuant.to paragraph 5, above, shall revert to City
upon said termination.
7. For purposes_of notice under th.is agreement, all notices
shall be considered effective upon being sent by certified mail

PHILOSOPHIC ASSUMPTION: Aim to help people to help themselves.
GENERAL GUIDELINES:
As you know. funded agencies are paid with City of San Luis Obispo
taxpayer's money. As such, we are all required to be accountable
for these funds. Accountability will be achieved through the
following methods:
1. Liason Program: The HRC, through the commissioners or
staff, will be in contact with the funded program on a
regular basis to identify areas of concern and /or to
provide a resource for each program funded.
2. Periodic Reports will be due to the HRC. The release of
funds shall be contingent on the reciept of a complete
report. Guidelines for such reports shall be as deemed
appropriate by the HRC.*
3. Fiscal Year -End Reports shall be the responsibility of
each funded agency, and shall be due by July 30, of
fiscal year. Said report shall consist of synopsis of
service(s). an overall narrative of goal(s) assessment
during the fiscal year and a year -end financial spending
form of City funds.
- Documentation:- Through the "use or--a- stafidardiaed -'form
supplied to each funded agency by the HRC, programs will
be required to categorically display their use of
city funds. While supporting documentation is not
necessarily required within the reporting guidelines,
it is necessary to have such documentation on hand in
order to satisfy any need for such documentation.
5. Annual Audit: If necessaLy, the agency must provide for
an annual audit by an independent auditor mutually
agreed upon_
Through the use of this system, you can aid us to be accountable
to the taxpayers of the City. Your cooperation is very much
appreciated. As always. the HRC and staff are available for help
and consultation whenever the need arises.

BUS OPERATIONS /MAINTENANCE FACILITY
CONSULTANT'S SERVICES AGREEMENT
This agreement, made this 1st day of July , 1986, by and
between the CITY OF SAN LUIS OBISPO, California (hereinafter- referred
to as "City "), and Gannett Fleming Transportation Engineers, Inc.,
Los Angeles, (hereinafter referred to as "Consultant ").
WITNESSETH:
WHEREAS, City intends to design and construct a bus
operations /maintenance facility, hereinafter referred to as
"project "; and
WHEREAS, City requires professional engineering and
design /construction management and inspection services, hereinafter
referred.to as "A /E services ", for the project; and
WHEREAS, Consultant represents -that it has available employees--
who are well qualified by educat -ion and experience to perform the
required A/E services; and
WHEREAS, City desires and Consultant-.is willing to provide the
required A/E services for the project;
NOW, THEREFORE, in consideration of their mutual'covenants, the
parties hereto agree as follows:
1. PR0;7ECT COORDINATION
a. City. The Transit Manager shall be the representative of
the City for 311 purposes under this agreement. The Transit
Manager hereby is designated as the Project Manager for the
City and shall supervise the progress and execution of this
agreement.
b. Consultant. Consultant shall assign a single Project
Officer to have overall responsibility.for the progress and
execution of this agreement-for Consultant. Walter
Marriott III is hereby designated as the Project Officer for
Consultant. Should circumstances or conditions subsequent
to the execution of this agreement require a substitute
Project Officer for any reason, the Project Officer designee
shall be subject to the prior written acceptance and
approval of the director. Consultant's Project Team is
further described in Exhibit "C" attached hereto and
incorporated herein by this reference. The individuals
identified_ and the positions held as described in Exhibit
"C" shall- be changed except by prior written approval of
City.
2. DUTIES OF CONSULTANT
a. Services to be furnished. Consultant shall provide all work
described in this agreement including Exhibit "A" and "B"
attached hereto and incorporated herein by this reference.
b. Laws to be observed. Consultant shall:
(1) Procure all permits and licenses, pay all charges and
fees, and give all notices which may be necessary and
incidental to the due and lawful prosecution of the
services to be performed by Consultant under this
agreement;
(2) Keep itse_lf.fully informed of all existing and proposed
federal, state and local laws; ordinances, regulations,
orders, and decrees which may affect those engaged or
employed under this agreement, any materials used in
Consultant's performance under this agreement, or the
conduct of the services under this agreement;
(3) At all times observe and comply with, and cause all of
its employees to observe and comply with all of said
laws, ordinances, regulations, orders, and decrees
mentioned above;
(4) Immediately report to the City's Project Manager in
writing any discrepancy or inconsistency it discovers
in said laws, ordinances, regulations, orders, and
decrees mentioned above in relation to any plans,
drawings, specifications, or provisions of this
agreement.
C. Release 6f--reports and.information. Any reports,
informatiori., data, or other material given to, or prepared
or assembled by, Consultant under this agreement shall be
the property of City and shall not be made available to any
individual or organization by Consultant without the prior
written approval of the City's Project Manager.
d. Copies of reports and information. If City requests
additional copies of reports, drawings, specifications, or
any other material in addition to what the Consultant is
required to furnish in limited quantities as part of the
services under this agreement, Consultant shall provide such
additional copies as are requested, and City shall
compensate Consultant for the costs of duplicating of such
copies at Consultant's direct expense.
e. Quality of Consultant's work. Consultant shall be
responsible for the professional quality, technical
accuracy, timely completion, and coordination of all work
performed by Consultant under this agreement. Consultant
shall, without additional compensation, correct or revise
any errors, omissions, or other deficiencies in its work.
Approval by City of Consultant's work shall not in any way
relieve Consultant of responsibility for the technical
adequacy of its work., Neither City's approval or acceptance
of Consultant's work nor City's payment for Consultant's
work shall be construed as a waiver of either City's rights
or Consultant's responsibilities under this agreement.

f. Consultant's liability. Consultant shall be and remain
liable in accordance with applicable law for all damages to
City caused by Consultant's negligent performance of any of
the services furnished under- this agreement, except for
errors, omissions, or other deficiencies attributable to
City, City- furnished data, or any third party. Consultant
shall not be responsible for delays in the project's
progress caused by circumstances beyond Consultant's
control.
g. Errors, omissions and deficiencies. "Errors, omissions, and
deficiencies" are defined as acts of Consultant in
performing work under this agreement which are the result of
Consultant's failure to perform in accordance with the
standard of practice normally exercised in the performance
of similar professional services and which result in costs
to City above the costs incurred without such acts. Nothing
contained herein shall expand or increase the responsibility
of Consultant to any party beyond that imposed by the
statutory and case law of the State of California..
h. Interpretation of construction contract documents. when
required, Consultant shall interpret the construction
contract documents and judge the performance under them by
both City and contractor. Consultant shall render
interpretations necessary for the.proper execution or
progress of the work with reasonable,promptness on written
request of either -City or the contractors and shall render
written decisions within a reasonable time, on all claims,
disputes and other matters in question between City and the
contractor relating to the progress of work or the
interpretation of the contract documents. Interpretations
and decisions of Consultant shall be consistent with the
intent of and reasonably inferable from the construction
contract documents and shall be in written or graphic form.
As interpreter and judge, Consultant shall try to-ensure
faithful performance by both City and the contractor, shall
not show partiality to either, and shall not be liable for
the result of any interpretation or decision rendered in
good faith in such capacity.
i. Judgment of artistic effect. Consultant's decisions in
matters relating to artistic effect shall be final if
consistent with the intent of the construction contract
documents.
j. Rejection of work. Consultant shall have the authority to
reject work which does not conform to the construction
contract documents.

k. Special testing and inspection of work. Consultant shall
the have authority to require special inspection or testing
of the work according to the provisions of the construction
contract documents, whether or not such work has been
fabricated, installed or completed.
1. Modification of Consultant's.responsibility,. Consultant's
duties, responsibilities and limitations of authority as
City's representative during construction shall not be
modified or extended without written consent of Consultant
and the City.
3. DUTIES - -OF CITY
City agrees to cooperate with Consultant in order to complete all
the work described in this agreement including - Exhibit "A-:"
4. DATA FURNISHED -BY_ CONSULTANT
a. Soils testinci data. Consultant shall provide, as needed to
complete the work set forth in Exhibit 6AII, the services of
soil engineers. Such services shall include test borings,
test pits, calculations of soil values., percolation
tests air and water
pollution tests, ground corrosion and
resistivity tests, operations for determining subsoil, air
and water conditions, preparation of reports and submittal
of appropriate professional recommendations.
b. Other technical data. Consultant shall provide, as needed
to complete the work set forth in Exhibit "A," structural,
mechanical, chemical and other laboratory tests, inspections
and reports as required by law or this agreement documents.
5. COMPENSATION
The Consultant will perform the work in phases as described in
Exhibit "A:"

Consultant shall be paid by the City at the completion of each
work phase in accordance with the schedule identified in Exhibit
"B." Each work phase shall be complete when the Consultant
receives written notice from the City's Project Manager stating
such. Upon receipt of said written notice, Consultant shall
submit an invoice for the completed phase of work. A separate
invoice shall be prepared for each phase of work. City shall pay
Consultant within thirty days upon receipt of invoice.
6. TIME FOR COMPLETION OF THE WORK
Program scheduling shall follow the schedule set forth in Exhibit
"B" unless revisions to the chart are approved by the City's
Project Manager and Consultant's Project Officer.
Time extensions may be allowed for delays caused -by City, other
governmental agencies, or factors not directly brought about by
the negligence or lack of due care on the part of the Consultant.
7. TEMPORARY SUSPENSION
The City's Project Manager shall have the authority to "suspend
this agreement wholly or in part, for such period as she deems
necessary due to unfavorable conditions or to the failure on the
part of the Consultant to perform any provision of this
Agreement. Consultant will be paid the - compensation due and
payable to the date of temporary suspension.
8. SUSPENSION; TERMINATION
a. Right to suspend or -terminate. The City retains the right
to terminate this agreement for any reason by notifying
Consultant in writing seven days prior to termination and by
paying the compensation due and payable to the date of
termination; provided, however, if this agreement is
terminated for fault of Consultant, City shall be obligated
to compensate Consultant only for that portion of Consultant.
services which are of benefit to City. Said compensation is
to be arrived at by mutual agreement of the City and
Consultant and should they fail to agree, then an
independent arbitrator is to be appointed and his decision
shall be binding upon the parties.
b. Return of materials. Upon such termination, Consultant
shall turn over to the City immediately any and all copies
of studies, sketches, drawings, computations, and other
data, whether or not completed, prepared by Consultant, and
for which Consultant has received reasonable compensation,
or given to Consultant in connection with this agreement.
Such materials shall become the permanent property of City.
Consultant, however, shall not be liable for city's use of
incomplete materials or for City's use of complete documents
if used for other than the project contemplated by this
agreement.
5.
9. INSPECTION
Consultant shall furnish City with every reasonable opportunity
for City to ascertain that the services of Consultant are being
performed in accordance with the requirement intentions s and intentns of
this agreement. All work done and all materials furnished, if
any, shall be subject to the City's Project Manager's inspection
and approval. The inspection of such work shall not relieve
Consultant of any of its obligations to fulfill its agreement as
prescribed.
10. OWNERSHIP OF MATERIALS.
All original drawings, plan documents and other materials
prepared by or in possession of Consultant pursuant to this
agreement shall become the permanent property of the City, and --
shall be delivered to the City upon demand.
11. .INDEPENDENT.JUDGMENT
Failure of City to agree with Consultant's independent findings,
conclusions, or recommendations, if the same are called for under
this agreement, on the .basis of differences in matters of
judgment shall not be construed as a failure on the part of
Consultant to meet the requirements of this agreement.
12. ASSIGNMENT: SUBCONTRACTORS: EMPLOYEES
This agreement is for the performance of A/E services by the
Consultant and is not assignable by the.Consultant without prior:_
consent"of the City in writing. The Consultant may employ
specialists (other than the subcontractors identified in Exhibit
"C") to perform special services as required with prior
additional written approval by the City..
13. NOTICE
All notices hereinun_der shall be given in writing and mailed,
postage prepaid, by Certified Mail, addresses as follows:

14. INTEREST OF CONSULTANT-
Consultant covenants that it presently has no interest, and
shall not acquire any interest, direct or indirect, financial or
otherwise, which would conflict in any manner or degree with the
performance of the services hereunder. Consultant further
covenants that, in the performance of this agreement, no
subcontractor or person having such an- interest shall be
employed. Consultant certifies that no one who has or will have
any financial interest under this agreement is an officer or
employee of City. It is expressly_agreed that, in the _-
performance of the services hereunder, Consultant shall at all
times be deemed an independent contractor and .not an agent or
employee of City.
15. AUDIT AND INSPECTION OF RECORDS
Consultant shall permit the authorized representatives of City,
the U.S. Department of Transportation, and the Comptroller.
General of the United States to inspect and audit all data and
records of Consultant relating to Consultant's performance -under
this agreement until the expiration of three (3) years after
final payment under this agreement.
Consultant shall include in all Consultant's subcontracts
hereunder a provision to the effect.that the subcontractor
agrees that City, the Department of Transportation, and the
Comptroller General of the United States or any of their duly
authorized representatives shall, until the expiration of three
(3).years after final payment under the subcontract, have access
to and the right to examine any directly pertinent books,
documents, papers, and records of such subcontractor, involving
transactions related to the subcontractor.
The periods of access and examination described above, for
records which relate to (1) litigation of the settlement of
claims arising out of the performance of this contract, or (2)
costs and expenses of this contract as to which exception has
been taken by the Comptroller General or any of his duly
authorized representatives; shall continue until such appeals,
litigation, claims, or exceptions have been disposed of.

16. INDEMNITY
Consultant hereby agrees to indemnify and save harmless City,
its officers, agents, and employees of and from:
1. Any and all claims and demands which may be made against
City, its officers, agents or employees by reason of any
injury to or death of any person or corporation caused by
any negligent act or omission of Consultant under this
agreement or of Consultant's employees or agents;
2. Any and all damage to or destruction of the property of
City, its officers, agents, or employees occupied or ueed
by or in.the care, custody, or control of Consultant, or in
proximity to the site of Consultant's work, caused by any
negligent actor omission -of Consultant under this - -- -
agreement or of Consultant's employees or agents;
3. Any and all claims and demands which may be made against.
City, its officers, agents, or employees by reason of any
injury to or death of or damage suffered or sustained by
Any employee or agent of Consultant under this agreement,
however caused, excepting, however, any such. claims and
demands which are the result of the negligence or willful
misconduct of City, its officers, agents, or.employees;
4. Any and all claims and demands which may be made, against
City, its officers, agents, or employees by reason of any
infringement or alleged infringement of any patent:rights
or claims caused by the sue of any apparatus, appliance, or
materials furnished by Consultant under this agreement; and
S. Any and all penalties imposed or damages sought on account
of the violation of any law or regulation or of any term or
condition of any permit, when said violation of any law or
regulation or of any term or condition of any permit is due
to negligence on the part of the Consultant.
Consultant, at its own costs, expense, and risks, shall
defend any and all suits, actions, or other legal
proceedings that may be brought against or for employees on
any such claim or demand of such third persons, or to
enforce any such penalty, and pay and satisfy any judgment
or decree that may be rendered against City, _ its officers,
agents, or employees in any such suit, action or other
legal proceeding, when same were due to negligence of the
Consultant.

WORKERS COMPENSATION
Consultant certifies that it is aware of the provisions of the
Labor Code of the State of California, which require every
employer to be insured against liability,for workers
compensation or to undertake self- insurance in accordance with
the provisions of that code, and it certifies that it will
comply with such provisions before commencing the performance of
the work of this agreement.
INSURANCE
Consultant shall pay for and maintain public liability and
property damage insurance which shall protect City and its
employees against loss from liability imposed by law from
damages on account -of bodily injury, -- including - death resulting
therefrom, suffered or alleged to have been suffered by any
person or persons, resulting directly or indirectly from the
negligent performance or. execution of this agreement by
Consultant or any subcontract with Consultant thereunder, and
also to protect City and its employees against loss from
liability by the negligent performance or execution of this
agreement by Consultant or by subcontract with Consultant, which
insurance shall also cover accidents arising out of the use and
operation of automobiles, trucks, and /or other mobile
equipment. All required public liability and property damage
insurance shall be for the period of performance under this
agreement. The amounts of this insurance coverage shall not be
less than the following:
Public Liability: $500,000 single limit
Property Damage: $500,000 single limit
Consultant shall pay for and maintain errors_ and omissions
insurance in the amount of $1,0001000.
DISADVANTAGED AND WOMEN OWNED BUSINESS ENTERPRISES (DBEs AND
WBEs
A. Policy. It is the policy of the U.S. Department of
Transportation that disadvantaged business enterprises as
defined in 49 CFR Part 23 shall have the maximum
opportunity to participate in the performance of contracts
financed in whole or part with Federal funds under this
agreement. Consequently the DBE requirements of 49 CF.R
Part 23 apply to this agreement.

B. DBE Obligation. The consultant agrees to ensure that
disadvantaged business enterprises as defined in 49 CFR
Part 23 have the maximum opportunity to participate in the
performance of contracts and subcontracts financed in whole
or in part with Federal funds provided under this

necessary and reasonable steps in accordance with 49 CFR

agrees for itself, its assignees and successors in interest to

hereby incorporated into this agreement as- Exhibit "D."
AGREEMENT BINDING
The terms, covenants, and conditions of this agreement shall
apply to, and shall bind, the heirs, successors, executors,
administrators, assigns, and subcontractors of both parties.
WAIVERS
The waiver by either party of any breach or violation of any
term, covenant, or condition of this agreement or of any
Provision, ordinance, or law shall not be deemed to be a waiver
of any subsequent breach of violation of the same or of any
other term, covenant, condition, ordinance, or law. The
subsequent acceptance by either party of any fee or other money
which may become due hereunder shall not be deemed to be a
waiver of any preceding breach or violation by the other party
of any term, covenant, or condition of this agreement or of any
applicable law or ordinance.

24. COSTS AND ATTORNEY'S FEES
The prevailing party in any action between the parties to this
agreement brought to enforce the terms of this agreement or
arising out of this agreement may recover its reasonable costs
and attorney's fees expended in connection with such an action
from the other party.
25. DISCRIMINATION
In connection with the execution of this contract, the
Consultant shall not discriminate against any employee or
applicant for employment because of race, religion, color, sex,
age, or national origin. The Consultant shall take affirmative
action to ensure that applicants are employed, and that
employees are treated during employment without regard to their
race, color-, sex, age, or national origin. Such action shall
include, but not be limited to, the following: employment,
upgrading, demotion or transfer, recruitment or recruitment _._.__
advertising, layoff or termination, rates of pay or other forms
of compensation, and selection for training, including
Apprenticeship. Consultant further agrees to insert a similar
provision in all subcontracts, except subcontracts for standard
commercial supplies or raw materials.
In performing the work required by this agreement, Consultant
and such subcontractors as may be employed, shall comply with
Executive Order 11246, entitled "Equal Employment Opportunity"
as amended by Executive Order 11375, in U.S. Department of Labor
regulations (41 CFR Part 60) including, but not limited to,
provisions requiring:
- non - discrimination against any employee or applicant for
employment because of race, religion, color, sex, or national
origin; and
- affirmative action to ensure that applicants are employed, and
that employees are treated during their employment, without
regard to their race, religion, color, sex, or national origin.
If Consultant is found in violation of the nondiscrimination
provisions of the State of California Fair Employment Practices
Act or similar provisions of federal law or executive order in
the performance of this agreement, it shall thereby be found in
material breach of this agreement. Thereupon, City shall have
the power to cancel or suspend'this agreement, in whole or in
part, or to deduct from the amount payable to Consultant the sum
of Twenty -five Dollars_ ($25) for each person for.each calendar
day during which such person was discriminated against, as
damages for said breach of contract, or both. Only a finding of
the State of California Fair Employment Practices Commission or
the equivalent federal agency or officer shall constitute
evidence of a violation of contract under his paragraph.

If Consultant is found in violation of the nondiscrimination
provisions of this agreement or the applicable affirmative
action guidelines pertaining to this agreement, Consultant shall
be found in material breach of the agreement. Thereupon, City
shall have the power to cancel or suspend this agreement, in
whole or in part, or to deduct from the amount payable to
Consultant the sum of Two Hundred Fifty Dollars ($250) for each
calendar day during which Consultant is found to have been in
such noncompliance as damages for said breach of contract, or
both.
26. SCOPE OF AGREEMENT
This agreement includes the following documents incorporated
herein by this reference and supercedes any conflicting

27. AGREEMENT CONTAINS ALL UNDERSTANDINGS
This document represents the entire and integrated agreement
between City and Consultant and supersedes all prior
negotiations, representations, or agreements, either written or
oral. This document may be amended -only by written instrument,
signed by both_ City and Consultant. All provisions of this
agreement are expressly made conditions. This agreement shall
be governed by the laws of the State of California.

TITLE VI ASSURANCES
During the performance of this agreement, Consultant, for itself, its
assignees and successors in interest agree as follows:
1. Compliance with Regulations. Consultant shall comply with the
regulations relating to nondiscrimination in federally assisted
programs of the U.S. Department of Transportation ( "DOT ") Title
49, Code of Federal Regulations, Part 21, as they may be amended
from time to time, (hereinafter referred to as the Regulations),
which are herein incorporated by reference and made a part of
this agreement.
2. Nondiscrimination. Consultant, with regard to the work performed
by it during the Agreement, shall not discriminate on the grounds
of race, religion,.color, sex, age or national origin in the
selection and retention of subcontractors, including procurements
of materials and leases of equipment. Consultant shall not
participate either directly or indirectly_ in the discrimination
prohibited by Section 21.5 of the Regulations, including
employment practices when the contract covers a program set forth
in Appendix B of the Regulations.
3.
Materials and Equipment. In all solicitations either by
competitive bidding or negotiation made by Consultant for work to
be performed under a subcontract, including procurements of
materials or leases of equipment, each potential subcontractor or
supplier shall be notified by Consultant of Consultant's
obligations under this agreement and the Regulations relative to
nondiscrimination on the grounds of race, color, or national
origin.
4. Information and Reports. Consultant shall provide all
information and reports required by the Regulations or directives
issued pursuant thereto and shall permit access to its books,
records, accounts, other sources of information, and its
facilities as may be determined by City or the Urban Mass
Transportation Administration (UMTA) to be pertinent to ascertain
compliance with such Regulations, orders, and instructions.
Where any information required of a Consultant is in the
exclusive possession of another who fails or refuses to furnish
this information, the Consultant shall so certify to City or
UMTA, as appropriate, and shall set forth what efforts it has
made to obtain the information.
5. Sanctions for Noncompliance. In.the event of Consultant's
noncompliance with the nondiscrimination provisions of this
agreement, City shall impose such agreement sanctions as it or
UMTA may determine to be appropriate, including, but not limited
to:

(a) withholding payments to Consultant under -the agreement until
Consultant complies, and /or
(b) cancelling, terminating, or suspending the agreement in

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN LUIS OBISPO, CALIFORNIA
RECITING THE FACT OF THE SPECIAL MUNICIPAL
ELECTION HELD ON JUNE 3, 1986, DECLARING THE
RESULT OF SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a Special Municipal Election was held and conducted in the
City of San Luis Obispo, California, on Tuesday, June 3, 1986, as required
by law; and
WHEREAS, notice of the election was given in time, form and manner as
provided by law; that voting precincts were properly established; that
election officers were appointed and that in all respects the election was
held and conducted and the votes were cast, received and canvassed and the
returns made and declared in time, form and manner as required by the
provisions of the Elections Code of the State of California for holding of
elections in charter cities; and
WHEREAS, under the provisions of City Council Resolution No. 5901
(1986 Series), the Board of Supervisors was authorized to perform the
official canvass of the June 3, 1986, Special Municipal Election pursuant
to the Elections Code of the State of California; and
WHEREAS, a statement of the results of said election has been duly
entered by the City Clerk in the official records of the City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo that:
SECTION 1. The number of votes given at each precinct and the number
of votes given in the City for and against the measures were as listed in
Exhibit "A" attached.
SECTION 2. The following measures having been voted on and approved
by the voters are hereby approved.

MEASURE "B"
This section to be deleted in its entirety as follows:
"SECTION 727. Voter Approval of Annexations.
Except for territory which is dedicated solely and entirely to a
permanent public use, no annexation of territory to the City shall
become effective until approved by a vote of the people at a general
or special election held after the final decision'by the Council to
annex such territory (amended June 6, 1978 - Measure G)."
MEASURE "C"
"SECTION 410. Compensation.
The Mayor and each Councilmember shall receive compensation for
services, payable monthly, with the Mayor receiving greater
compensation than the other Councilmembers. Compensation for Mayor
and Councilmembers shall be reviewed biennially in even - numbered
years. When warranted, said compensation may be adjusted by Council
resolution, to be effective January 1st of the year following the
review. The compensation rate may be revised by the electorate by
initiative.
Mayor and Councilmember expenses incurred for official business shall
be reimbursed."
MEASURE "D"
"SECTION 609. Violation of Ordinances.
The violation of any ordinance adopted and published by the City
Council shall constitute a misdemeanor unless by ordinance it is made
an infraction, provided that the City Attorney may elect to prosecute
any misdemeanor as an infraction. Both misdemeanors and infractions
may be prosecuted or may be redressed in the manner provided by the
general law of the State."
MEASURE "E"
"BE IT ORDAINED by the People of the City of San Luis Obispo as
follows:
SECTION 1. Chapter 17.92 is added to the Zoning Regulations of the
City of San Luis Obispo.
17.92.010 Onshore Support Facilities, Findings.
A. There is a strong likelihood that serious adverse effects will
result from onshore processing, storage, or related service facilities
supporting offshore oil and gas development authorized by the federal
and state governments.

B. Such facilities would threaten the community's vital economy and
environmental quality.
17.92.020 Onshore Support Facilities Prohibited.
No onshore support facility for offshore oil or gas development shall
be allowed or permitted within the City of San Luis Obispo until such
time that the City Council proposes the inclusion of such uses in an
appropriate zone district or districts, and such proposal has been
approved by a vote of the people of the City of San Luis Obispo. For
the purpose of this ordinance, the term "onshore support facility"
means any activity or land use required to support directly the
exploration, development, production, storage, processing,
transportation, or related aspects of offshore energy resource
extraction."
SECTION 3. The City Clerk shall certify to the passage and adoption
of this resolution and enter it into the book of original resolutions.

A RESOLUTION OF THE COUNCIL OF THE CITY ,OF SAN LUIS OBISPO
RANKING RESIDENTIAL PROJECTS ACCORDING TO GROWTH MANAGEMENT
STANDARDS AFFECTING PROJECTS REVIEWED DURING THE MONTH OF
MAY, 1986
The Council of the City of San Luis Obispo resolves:
SECTION 1. Findings.
1. The council has carefully reviewed the characteristics of each of the following
projects, based on scoring standards established by Section 17.88.100 of the
Residential Growth Management Regulations.
SECTION 2. Action. The following scores are assigned to each project and
authorization is granted for issuance of building permits as follows:
A. Storni Apartments, 566 Pacific Street (ARC 85 -138), Growth Management Score: 12
points. Building permit authorization: 6 units.
B. Margarita Condominiums, 251 Margarita Avenue (Tract 1210; ARC 84 -29, U1150), Growth
Management Standards Score: 12 points. Building permit authorization: 19 units.
