A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OHISPO FINDING THE EXISTENCE OF CERTAIN CLIMATIC,
GEOGRAPHIC AND TOPOGRAPHIC CONDITIONS WHICH JUSTIFY
AND REQUIRE SPECIFIC AMENDMENTS TO THE UNIFORM
CONSTRUCTION CODES.
WHEREAS, it is the desire and intent of the City Council of the
City of San Luis Obispo to adopt that body of regulations generally
referred to as the Uniform Construction Codes; and
WHEREAS state law allows modifications to substantive portions
of said Uniform Construction Codes relating to residential
construction only where local climatic, geographic or topographic
conditions exist as justifications; and
WHEREAS, the Chief Building Official of the City of San Luis
Obispo has provided information demonstrating the existence of
certain climatic, geographic and topographic features within the City
of San Luis Obispo which indicate the need for specific modifications
to the Uniform Construction Codes;
NOW THEREFORE, be it resolved and found by the City Council of
the City of San Luis Obispo as follows:
Findings:
1. For the most part, the soils in the City are medium to
highly expansive in nature, and such soils may cause damage
to foundations, structures and underground utilities if not
properly mitigated through known construction techniques;
and

2. A significant part of the City lies on hills and rolling
topography which are subject to earth slides and movements
and present problems with surface water drainage and
disposal to developments constructed in such areas; and
3. The frequent high wind conditions, combined with the
existence of dry vegetation on the hills and land within
and around the City, create an extreme fire hazard from
uncontrolled fireplace chimney emissions of burning embers.
Further, it is determined that the amendments set forth in
Ordinance No. 1105 (1987 Series) are reasonable and necessary to
mitigate the potentially damaging effects of the above noted local
conditions.

A RESOLUTION. OF THE COUNCIL OF THE CITY
OF SAN LUIS OBISPO APPROVING A JOINT APPLICATION
WITH THE COUNTY OF SAN LUIS OBISPO FOR FUNDING
FROM THE CALIFORNIA ALLOCATION OF THE FEDERAL
EMERGENCY SHELTER GRANTS PROGRAM
WHEREAS, the City finds that there is a significant need in
San Luis Obispo to provide emergency shelter to homeless.families and
individuals; and
WHEREAS, the Federal Emergency Shelter Grants Program is
designed to assist local jurisdictions in providing these services
within their communities: and
WHEREAS, the Women's Shelter Program of San Luis Obispo County
has requested that the City and the County of San Luis Obispo submit
a joint application for funding of a proposed program to offer
services to homeless women and their children.
NOW THEREFORE BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The City Council has reviewed and hereby approves the
joint application to the State of California Department of Housing
and Community Development, attached herein and incorporated by
reference. The application requests Federal Emergency Shelter Grants
Program funding for the Women's Shelter Program of San Luis Obispo
County to provide employment counseling and childcare services for
homeless individuals.

Describe any special circumstances:
The Shelter has been leased from Stan Dundon since July 1986. It is understood the
Women's Shelter has ongoing leasing rights unless the property is sold in which case
the Women's Shelter would have first chance for purchase. The current lease is in
effect for the duration of this grant proposal.

D. Provide a Chronological history of the shelter and the organiza-
tions involvement with running shelters.
In March 1979 the Women's Shelter Program, Inc. of San Luis
Obispo County was started in response to a county -wide need.
It has been in operation since that time, offering continu-
ally expanding services to an increasing number of women and
children who are left homeless by the crime of domestic
violence.
In July of 1986 the Women's Shelter Program, Inc. moved from
the smaller 11 bed facility it had occupied since 1979 to a
larger house which has the capacity for 14 beds in addition
to both a business and a counseling office on the grounds.
The shelter offers a comprehensive program which includes a
children's program, assistance in finding housing and jobs
and paralegal assistance.

E. Describe the total shelter program as it will exist with FESG
funding, including client group(s) served, services provided,
linkages with other agencies or services. Attach brochures,
reports, or other forms of documentation.
At this time the Women's Shelter Program offers the following
services:
1. Emergency Shelter:
The shelter provides safe housing for homeless victims of
domestic violence and their children. The location of the
shelter facility is kept confidential for the safety of all
the residents. All of the shelter services, including
emergency transportation and intake, are provided twenty -
four hours per day, seven days per week.
2. Food and Clothing:
Food - The shelter keeps a fully stocked kitchen and store-
room. The shelter also provides sacks of food to homeless
battered women not residing at the shelter or ex- residents
who have established their own residences. At holiday time
food baskets are provided for needy battered women and
their children.
Clothing - The shelter receives generous donations of cloth-
ing from the community and also has a voucher system with a
local thrift store.
3. Counseling (Drug and Domestic Violence):
Individual Counseling: Counseling services are provided to
battered women who are temporary residents of the shelter,
and to non - resident women (battered women not in need of
shelter services). These non - resident women are welcomed
at the many groups held weekly, and frequently receive one -
to -one counseling services on an outreach basis. Resident
women are required to attend counseling during their stay
at the shelter. There is one group session per week led by
the shelter's licensed MFCC Counselor and one group session
led by a counselor from Community Mental Health. The women
also attend two individual counseling sessions with the
shelter's counselor and may attend one individual session
with the counselor at Community Mental Health. They also
may attend a weekly group led by the domestic violence
counselor from the victim /Witness Assistance Center.

E. 3. Counseling (Drug and Domestic Violence) cont:
Peer Group Counseling: The women attend a weekly group
session led by a staff member trained in peer counseling.
The residents, both individually and in groups, also re-
ceive peer counseling on an as- needed basis.
4. Legal Assistance and Court Support:
The Women's Shelter Program employs a half -time Paralegal
Assistant who works under the direction of the Executive
Director. She has office space in the Victim /Witness
Center where there is access to copying machines, type-
writers and the use of conference rooms. The Paralegal
Assistant is supervised on a daily basis by the Victim/
Witness Supervisor. The Paralegal Assistant offers assis-
tance in obtaining Temporary Restraining Orders and "Kick
Out" orders which enable the women to return to their
homes.
5. Social Service Advocacy and Referrals:
The Women's Shelter Program has a good working relation-
ship with the Department of Social Services, Child Protec-
tive Services, Victim /Witness, County Mental Health,
Housing Authority, EOC, the local police agencies and
local hospitals.
6. Household Establishment:
The shelter assists the victims in establishing a new
permanent residence. Advocacy is offered with low income
housing programs and other landlords. The shelter sub-
scribes to newspapers which list available housing. The
women are provided with furniture, appliances, utensils,
food and bedding as needed for new households.
7. Crisis Hotline:
At all times, twenty -four hours per day, a member of the
shelter staff is wearing a beeper. This beeper number is
also provided to the police agencies, hospital emergency
rooms, Community Mental Health, Public Health, and the
Victim /Witness Assistance Center of the District Attorney's
office, so that they can contact shelter staff directly at
all times.

Counseling for Children:
Children's Program Coordinator: The Children's Program Co-
ordinator is responsible for coordinating the counseling for
the children when it is requested or deemed advisable by
center staff. She also trains and supervises volunteers who
work with the children and plans recreational activities for
the children. She enrolls the children in school and offers
transportation.
Licensed MFCC Counselor: The shelter employs a licensed
counselor who works directly with the children and their
mothers, either individually or together. She makes child
abuse and neglect reports as needed to Child Protective
Services.
Licensed Consultant: A licensed MFCC Counselor, who is in
private practice, serves as a volunteer consultant for the
shelter. Her specialty is the treatment of sexually and
physically abused children.
Emergency Response to Law Enforcement and Hospital
Emergency Rooms:
All nine law enforcement agencies in the service area (San
Luis Obispo County) have been provided with the Shelter's
emergency beeper number, and can reach shelter staff twenty -
four hours per day, seven days per week. There are five
emergency medical treatment facilities in San Luis Obispo
County and all have been provided with the Shelter's
emergency beeper number enabling them to contact the shelter
twenty -four hours per day. The staff regularly responds to
referrals and requests for assistance from these facilities.
The staff offers it- service training for the hospitals; the
training includes a description of services, intake criteria
and protocol, and background information on domestic violence.

E. New Services to be added with FESG Funding:
10. Employment Counseling:
The Women's Shelter Program will offer an Employment Counseling
Program to homeless residents of the Women's Shelter Program,
the People's Shelter and referrals from other service agencies
(based on staff time). The program will consist of the
following components:

C. Job readiness
d. Placement assistance
e. Transportation
11. Childcare:
The Women's Shelter Program will have two part -time childcare
workers available to watch the children of the women while they
attend employment related activities.

The shelter staff is highly experienced in running shelter
programs (see attached resumes). The Executive Director has
had 4 years experience in Domestic Violence and Homeless
Shelter management. The Counseling Coordinator has had ex-
perience with two domestic violence shelters.
The current staff includes a Executive-Director, Counseling
Coordinator, Children's Program Coordinator, House Manager,
Office Assistant and Paralegal Assistant (half- time).
Grant funds would be used to hire an experienced Employment
Counselor and two part -time child care workers.

C. Describe why this activity is necessary to carry out the shelter
program and why this grant is the most appropriate funding source.
The essential services to be provided are an Employment Coun-
selor, 2 part -time childcare workers and funds for transporta-
tion. The Women's Shelter Program and the other homeless
shelters in San Luis Obispo County offer shelter but have not
had the resources to address the economic realities affecting
shelter residents in trying to obtain permanent housing in a
high cost rental, low industry area. Employment Counseling
will enable a percentage of the residents to become employed
and thereby increase their ability to afford and find housing.
Childcare will enable the women at the Women's Shelter Program
to pursue the search for employment and the transportation
funds will pay staff expenses in transporting residents to job
placement related activities.
Other funding sources have been allocated for general shelter
services and basic operations.

San Luis Obispo is a county with little industry, minimal low
income housing and high rents. Many professional people are
attracted to the area but are forced to accept cuts in pay
which places them in competition with low income families for
lower priced rental properties. All of these factors seriously

women and children on AFDC to obtain housing. These people are
thereby often made homeless. Many victims of domestic violence
who were made homeless by the battering occurring at home are
forced to choose between continued homelessness or returning to
the batterer.
In order to help address the economic causes of homelessness
the Women's Shelter Program proposes to offer, under the
auspices of San Luis Obispo County, employment counseling to
residents of the Women's Shelter Program and the People's
Shelter (see attached Memorandum of Understanding). The services
will be offered at no cost to any interested shelter resident and
an effort will be made.to publicize the program with the target
population. All shelter beds involved will be benefited by the
employment program.

D. The employment program will consist of the following components:
1. Assessment:
Shelter residents will be assessed for appropriateness for
the employment counseling program.
2. Needs'.Assessment:
Referrals will be made to skills and interest testing and
training programs.
3. Job Readiness:
Through individual and group counseling assistance will be
given in resume writing, interviewing skills, grooming tips,
and self - esteem raising activities.
4. Placement Assistance:
Potential employers in the county will be identified.
5. Childcare:
Childcare will be available to the residents of the women's
Shelter Program while they are involved in any of the above
mentioned employment related activities.
6. Transportation:
Mileage will be paid staff for employment program related
driving.

The Women's Shelter Program has funding sources allocated for many
general shelter services and basic operations, but food, insurances
and utilities are essential services for a homeless shelter which
are not covered by other sources of funds.

Women's Shelter Program, Inc. of San Luis Obispo County
and
People's Shelter
The Women's Shelter Program, Inc. of San Luis Obispo County and
the People's Shelter pledge to work together to help alleviate
homelessness in San Luis Obispo County. The assistance between
the agencies will be offered in the following ways:
1. The Women's Shelter Program will continue to offer shelter and
services such as food, clothing, advocacy and counseling to women
and children from San Luis Obispo County who are made homeless by
the crime of domestic violence. Paralegal assistance is also
offered to help the women regain possession of their homes. If
funding is obtained, the Women's Shelter Program will hire an
employment counselor who will assist the shelter residents in the
steps necessary to find employment.
In addition the Women's Shelter Program agrees to offer the
services of its employment counselor to residents of the People's
Shelter who have been screened to be appropriate for the service.
2. The People's Shelter of San Luis Obispo will continue to
shelter and feed homeless people in San Luis Obispo County.
In addition the People's Shelter will screen its residents
for eligibility to be assisted by the Employment Counselor for the
Women's Shelter.

A. Authority and Purpose. The Emergency Shelter Program (hereinafter "ESP") has
been estab I fished pursuant to Section 50800, et seq., of the California Health
and Safety Code and Title 24, California Adm'nistrative Code Section 7950,
et seq., within the State of-California Department of Housing and Community
Deve pment (hereinafter "State ") for the purpose of assisting entities that
are providing shelter for the homeless. Pursuant to this authority, the State
has awarded a grant to the Contractor to provide shelter and services to the
homeless subject to the terms and conditions of this Agreement and in the
.amount and for the term set forth herein.
B. Nature of Services. Contractor will perform those tasks, services and activities
specs led in ttachment A, which is attached to and made a part of this Agreement,
in accordance with the Contractor's application, and any subsequent written
alterations submitted by the Contractor which are approved-by the State and
incorporated into thi.s Agreement. Such tasks, services and activities are
herein referred to as the "Program ".

The Drug Program is committed to continuing its services to the
Women's Shelter Program as a Community Service. Services include

Dear Mr. Briam:
On behalf of the San Luis Obispo Coalition for the Homeless I am writing this
letter in support of the application of the Women's Shelter Program of San Luis
Obispo for $50,000 in Federal Emergency Shelter funds.
Coordinated assistance to the homeless is the chief goal of our Coalition. This
proposal with it's emphasis on employment counseling for not only clients of the
San Luis Obispo shelter, but also clients of the North County Shelter, People's
Shelter and any other existing shelter for the homeless will fill a very
critical void.
Such counseling will not only be of benefit to the individual and their
families, but also to society as a whole as we as a county deal with the
ever — expanding homeless problem.
This proposal has our enthusiastic support.

A RESOLUTION OF THE COUNCIL OF THE
CITY OF SAN LUIS OBISPO DECLARING
THE RESULTS OF THE GENERAL MUNICIPAL
ELECTION HELD TUESDAY, NOVEMBER 3, 1987
WHEREAS, a General Municipal Election was held in the City of San Luis
Obispo on the 3rd day of November, 1987, which election was duly held and
conducted in the manner provided by the Charter of the City of San Luis
Obispo, and as provided by law for the purpose of electing a Mayor and
two (2) City Councilmembers; and
WHEREAS, under the provisions of City Council Resolution No. 6231
(1987 Series), the Board of Supervisors was authorized to perform the
official canvass of the November 3, 1987, General Municipal Election
pursuant to the election laws of the State of California; and
WHEREAS, a statement of the results of said election has been duly
entered by the City Clerk in the official records of the City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo that:
SECTION 1. The whole number of votes cast in said election within the
City of San Luis Obispo was 7906.
SECTION 2. The names of the persons voted for, the office for which
each person was voted for, the number of votes given at each precinct to
each person, are shown by the tabulation of votes, marked Exhibit "A" and
attached hereto, and by this reference incorporated herein as though fully
set forth.

SECTION 3. RON DUNIN, the candidate having received the highest
number of votes cast at said election for the office of Mayor, is hereby
declared elected to such office for the term prescribed by the City
Charter.

received the highest number of votes cast at said election for the office
of City Councilmember, are and each of them is hereby declared elected to
such office for the term prescribed by the City Charter.
SECTION 5. The City Clerk is hereby directed to sign and deliver to
each of said Ron Dunin, Peg Pinard and Jerry Reiss a certificate of
election certifying to him /her election to him /her respective office, as
hereinbefore set forth.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING THE FINAL MAP AND ACCEPTING PUBLIC IMPROVEMENTS
FOR TRACT 1478 AT 1010 BISHOP STREET
(PETRA,Subdivider)
WHEREAS, the City Council made certain findings concerning Tract 1478
and as contained in Resolution No. 6189, (1987 Series), and
WHEREAS, all public improvements have been constructed to City
standards and specifications, and
WHEREAS, all other conditions required.for Resolution No. 6189, (1987
Series) have been met, and
WHEREAS, the Subdivider has requested City acceptance of the public
improvements, and has requested reimbursement for future sewer and water
connections to mains installed by Subdivider in accordance with Municipal
Code Sections 13.04.110, 13.08.070 and 13.08.080, and
WHEREAS, the City Engineer has established the reimbursement rates as
indicated on the attached Exhibit A, based on a certified statement of
costs submitted by the Subdivider,
NOW THEREFORE BE IT RESOLVED that final map approval is hereby granted
for Tract 1478 and the public improvements are hereby accepted for
maintenance by the City. The reimbursement rates for future sewer and
water connections per the attached Exhibit A are hereby approved for a
period of 15 years in accordance with the above mentioned Municipal Code
Sections.

SAN IUIS OBISPO REGARDING AN AGREEMENT FOR
ENGINE EPJM SERVICES FOR THE GEt J OKATER STUDY
WHEREAS, the City established as.a major objective.of the
1987. -89 Financial Plan the preparation of a Groundwater Study; and
WHEREAS, a direct relationship exists between the City's water
resources and its groundwater resources; and
WMMAS, the City desires to engage an Engineer to provide
technical services necessary to prepare the study by reason of the
Engineer's qualifications and experience,
NOW, THEREFORE, BE IT RESOLVED that the City Council of San
Luis Obispo authorizes staff to negotiate an agreement with John L.
Wallace and Associates for technical services related to a
Groundwater Study and authorizes the City Administrative Officer to
execute, if agreement is within the budget. Funds are authorized
for Contract Phases Land II only, in the amount of $6,840.

AGREEMENT FOR ENGINEERING SERVICES t
This agreement, made this 7th day of December , 1987,
by and between the CITY OF SAN LUIS OBISPO (hereinafter referred
to as "City "), and JOHN L. WALLACE AND ASSOCIATES (hereinafter
referred to as "Engineer").
WITNESSETH
WHEREAS, City is in the final stages of the development
of its water management plan and water management element for
the.City's General Plan; and
WHEREAS, a relationship exists between the City's water
resources and its groundwater resources; and
WHEREAS, City desires to prepare a groundwater study
(hereinafter referred to as the "Study ") to guide in the
development of the City's groundwater resources; and
WHEREAS, City desires to engage Engineer to provide the
engineering services necessary to prepare the Study by reason of
the Engineer's qualifications and experience; and
WHEREAS, Engineer has available and offers to provide
personnel and facilities necessary to accomplish the work within
the required time.
NOW, THEREFORE, in consideration of their mutual
covenants, the parties hereto agree as follows:
1. PROJECT COORDINATION
a. City. The City Utilities Engineer shall be the
representative of the City for all purposes under
this agreement and is designated as the Project
Manager for the City. He shall supervise the
progress and execution of this agreement.
b. Engineer. Engineer shall assign a Project Director
and a Project Manager for this project. Mr. John
Wallace is hereby designated as the Project Director
and Mr. Tim Cleath is hereby designated as the
Project Manager for Engineer. Should circumstances
or conditions subsequent to the execution of this
Agreement require a substitute Project Director or
Project Manager for any reason, the Project Director
or Project Manager designee shall.be subject to the
prior written acceptance and approval of the City's
Project Manager. Key members of the Engineer's
Project Team are further described in Exhibit "A"

attached hereto and incorporated herein by this
reference. The individuals identified and the
positions held as described in Exhibit "A" shall not
be changed except by prior approval of the City.
DUTIES OF ENGINEER
a_. Services to be furnished. Engineer shall provide
all the planned engineering services as set forth in
Exhibit "B", attached hereto and incorporated herein
by this reference.
City and Engineer agree that certain of the work
contemplated to be performed by Engineer cannot be
defined sufficiently at the time of execution of
this Agreement, and incidental engineering work
related to the project and not covered in Exhibit B
may be needed during the performance of this
Agreement. This work may include (but is not
limited to) further field investigations and studies
related to investigation of areas outside of the
City's urban reserve line. It is intended that such
categories of work be classified as special
engineering services.
b. Laws to be observed. Engineer shall:
(1) Procure all permits and licenses, pay all
charges and fees, and give all notices which may
be necessary and incidental to the due and
lawful prosecution of the services to be
performed by Engineer under this agreement.
(2) Keep himself fully informed of all existing and
proposed federal, state and local laws,
ordinances, regulations, orders and decrees
which may affect those engaged or employed under
this agreement, any materials used in Engineer's
performance under this agreement, or the conduct
of the services under this agreement.
(3) At all times observe and comply with, and cause
all of his employees to observe and comply with
all of said laws, ordinances, regulations,
orders, and decrees mentioned above.
(4) Immediately report to the City's Project
Manager, in writing, any discrepancy or
inconsistency it discovers in said laws,
ordinances, regulations, orders, and decrees
mentioned above in relation to any plans,
drawings, specifications, or provisions of this
agreement.

C. Release of reports and information. Any reports,
i information, data, or other material given to, or

3. DUTIES OF CITY
City agrees to cooperate with Engineer and to perform
that work described in Exhibit "C" attached hereto and
incorporated by this reference.
4. COMPENSATION
For the services described in Exhibit "B" which are to be
performed by the Engineer, the City agrees to pay, and
the Engineer agrees to accept, compensation in accordance
with the methods and schedules set forth in Exhibit "D ",
attached hereto.
For all special services and for work performed in
Phase 1 and subsequent phases, Engineer will invoice City
on a monthly basis and City will pay within 30 days of
receipt. The Consultant may not charge more than the
amount shown in Exhibit "D" without prior approval of the
City's Project Manager.
5. TIME FOR COMPLETION OF THE WORK
Engineer shall complete the draft report for Phase 1 and
Phase 2 within 6 weeks of receiving the City's
authorization to proceed. The final report shall be
completed within 3 weeks of receiving the City's comments
on the draft report'.
It is estimated that, Phases 3 through 5 will be
completed within 31 weeks of receiving the City's
authorization to proceed. This schedule will be set
through the negotiations for Phases 3 through 5.

Time extensions may be allowed for delays caused by City,
/ other governmental agencies, of factors not directly
brought about by the negligence or lack of due care on
the part of the Engineer.
6. TEMPORARY SUSPENSION
a. Right to suspend or terminate. The city retains the
right to terminate this agreement for any reason by
notifying Engineer in writing 7 days prior to
termination And by paying the compensation due and
payable to the date of termination; provided,
h owever, if this agreement is terminated for fault
of Engineer, City shall be obligated to compensate
Engineer only for that.portion of consultant
services which are of benefit to City. Said
compensation_ is to be arrived at by mutual agreement
of the City and Engineer and should they fail to
agree, then an independent arbitrator is to be
appointed and his decision shall be binding upon the
Parties.
b. Return of- materials. Upon such termination,
Engineer shall turn over to the City immediately any
and all copies of studies, sketches, drawings,
computations and other data, whether or -not
completed, prepared by Engineer, and for which
Engineer has received reasonable compensation, or
given to Engineer in connection with this
agreement. Such materials shall become the
permanent property of City. Engineer, however,
shall be not be liable for City's use of incomplete
materials or for City's use of complete documents if
used for other than the project contemplated by this
agreement.
g. INSPECTION
Engineer shall furnish City with every reasonable
opportunity for city to ascertain that the services of
Engineer are being performed in accordance with the
requirements and intentions of this agreement. All work
done and all materials furnished, if any, shall be
subject to the City Project Manager's inspection and
approval. The inspection of such work shall not relieve
Engineer of any of its obligations to fulfill its
agreement as prescribed.
9. OWNERSHIP OF MATERIALS
All original drawings, plans, documents and other
materials prepared by or in possession of Engineer
pursuant to this agreement shall become the permanent
property of the City, and shall be delivered to the City
upon demand.

INDEPENDENT JUDGEMENT
Failure of City to agree with Engineer''s' independent
findings, conclusions, or recommendations, if the same
are called for under this agreement, on the basis of
differences in matters of judgement shall not be
construed as a failure on the part of the Engineer to
meet the requirements of this agreement.
ASSIGNMENT SUBCONTRACTOR "S EMPLOYEES
This agreement is for the performance of professional
engineering services of the Engineer and is not
assignable by the Engineer without prior consent of the

Engineer hereby agrees to indemnify and "save harmless
City, its officers, :agents, and employees of and from:
1. Any and all claims and demands which may be made
against City, its officers, agents or employees by
reason of any injury to or death of any person or
corporation caused by any negligent act or omission
of Engineer under this agreement or of Engineer
employees or agents;
2. Any and all•damage to or destruction of any
property, including the property of City, its
officers, agents, or employees, occupied or used by
or in the care, custody, or control of Engineer, or
in proximity to the site of Engineer's work, caused
by any negligent act or omission of Engineer under
this agreement or of Engineer's employees or agents;
3. Any and all claims and demands which may be made
against City, its officers, agents, of employees by
reason of any injury to or death of or damage
suffered or sustained by any employee or agent of
Engineer under this agreement, however caused,
excepting however, any such claims and demands which
are the result of the negligence or willful
misconduct of City, its officers, agents, or
employees;
4. Any and all claims and demands which may be made
against City, its officers, agents, or employees by
reason of any infringement or alleged infringent of
any patent rights or claims caused by the use of any
apparatus, appliance, or materials furnished by
Engineer under this agreement; and
5. Any and all penalties imposed or damages sought on
account of the violation of any law or regulation or
of any term or condition of any permit, when said
violation of any law or regulation or of any term or
condition of any permit is due to negligence on the
part of the Engineer.
Consultant, at its own costs, expense, and risks,
shall defend any and all suits, actions, or other
legal proceedings that may.be brought against or for
employees on any such claim or demand of such third
persons, or to enforce any such penalty, and pay and
satisfy any judgement or decree that may be rendered
against City, its officers, agents, or employees in
any such suit, action or other legal proceeding,
when same were due to sole negligence of the
Engineer.

' 15. WORKERS COMPENSATION

Engineer certifies that it is aware of the provisions of
the Labor Code of the State of California, which require
every employer to be insured against liability for
workers compensation or to undertake self- insurance in
accordance with the provisions of that code, and it
certified that it will comply with such provisions before
commencing the performance of the work of this agreement.
16. INSURANCE
Engineer shall provide proof of comprehensive general
liability insurance ($1,000,000) (including automobile)
and professional liability insurance ($250,000)
satisfactory to the City.
17. AGREEMENT BINDING
The terms, covenants, and conditions of this agreement
shall apply to, and shall bind, the heirs, successors,
executors, administrators, assigns, and subcontractors of
both parties.
18. WAIVERS
The waiver by either party of any breach or violation of
any terms, covenant, or condition of this agreement or of
any provision, ordinance or law shall not be deemed to be
a waiver of any subsequent breach of violation of the
same or of any other term, covenant, condition,
ordinance, or law. The subsequent acceptance by either
party of any fee or other moeny which may become due
hereunder shall not be a waiver of any term, covenant, or
condition of this agreement or of any applicable law or
ordinance.
19. COST AND ATTORNEY'S FEES
The prevailing party in any action between the parties to
this agreement brought to enforce the terms of this
agreement or arising out of this agreement may recover
its reasonable costs and attorney's fees expended in
connection with such an action from the other party.
20. DISCRIMINATION
No discrimination shall be made in the employment of
persons under this agreement because of the race, color,
national origin, ancestry, religion or sex of such
person.

If Engineer is found in violation of the
nondiscrimination provisions of the State of CZalifornia
Fair Employment Practices Actor simila -r provisions of
federal law.or executive order in the performance of this
agreement, it shall thereby be found in material breach
of this agreement. Thereupon, City shall have the power
to cancel or suspend this agreement, in whole or in part,
or to deduct from the amount payable to Engineer the sum
of Twenty -five Dollars ($25) for each person for each
calendar day during which such person was discriminated
against, as damages for said breach of contract, or
both. Only a finding of the State of California.Fair
Employment Practices Commission or the equivalent federal
agency or officer shall constitute evidence of a
violation of contract under this paragraph.
If Engineer is found in violation of the
nondiscrimination provisions of this agreement or the
applicable affirmative action guidelines pertaining to
this agreement, Engineer shall be found in material
breach of the agreement. Thereupon, City shall have the
power to cancel or suspend this agreement, in whole or in
part, or to deduct from the amount payable to Engineer
the sum of Two Hundred Fifty Dollars ($250) for each
calendar day during which Engineer is found to have been
in such noncompliance as damages for said breach of
contract, or both.
21. AGREEMENT CONTAINS ALL UNDERSTANDINGS
This document represents the entire and integrated
agreement between City and Engineer and supercedes all
prior negotiations, representations, or agreements,
either written or oral. This document may be amended
only by written instrument, signed by both City and
Engineer. All provisions of this agreement are expressly
made conditions. This agreement shall be governed by the
laws of the State of California.
IN WITNESS WHEREOF, City and Engineer have executed this
agreement on the day and year first above written.

EXHIBIT B
SCOPE OF WORK
The basic approach to the groundwater study is to screen
existing data within the urban reserve area, then focus on
distinct areas for detail analysis, and finally establishing a
specific Groundwater Development Plan and Supplemental EIR.
The following paragraphs present five work phases.
Phase 01• Survey of Resources. The objective of this phase is
to quantify and describe baseline groundwater conditions within
San Luis Obispo area. Key tasks include:
(a)' Definition of Water Basins. Based on existing
reports and records, map the general location of
groundwater basins within and adjoining the City of
San Luis Obispo. It is not the intent of this
study to do basic geologic field research.
(b) Basin Recharge Dynamics.. Describe and quantify
when possible the dynamics of extracting and
recharging the identified water basins. The effect
of wet and drought periods on the basin would be
described. The role of surface and stream flows in
recharging the basins would be described. The role
of possible artificial recharge would be described.
(c) Hvdrogeology and Storage Potential. Describe the
underlying geological formations within the
identified basins and determine the groundwater
storage characteristics of these:areas. Based on
existing records, reports and other readily
available information and limited investigations,
identify and amp the depth of groundwater and
prepare specific estimates of available groundwater
in storage.
(d) Reliability. Based on existing information
augmented by new field tests on existing equipped
wells, describe draw -down and pumping capacity
characteristics of representative wells that may be
available for testing within the identified
basins. Describe the effect a proposed operation
program, during wet and dry cycles, would have on
the groundwater yield.

(e) Water- Dual -itv. Based on existing records and
reports, describe the quality of the groundwater in
relationship to state and federal standards.
Identify any limitations to using groundwater for
domestic purposes. Take field samples and conduct
water quality testing where existing information is
inadequate. Describe anticipated quality changes
with proposed operation program. (Note: water
quality data for stream flows has generally not
been published).
(f) Availability. Determine the current usage of
groundwater resources in the San Luis Obispo area.
Review historic safe . yield estimates in light of
existing land uses and discuss any resulting
increase or decrease in safe yield.
(g) Well Development Areas. Identify specific
locations where the City might conduct test
drilling and water quality sampling as needed to
supplement inadequate information.
Phase 42• Constraints Analysis. The objective of this phase is
to describe constraints to the City's development and domestic
use of groundwater. Key factors that will be evaluated include
the following:
(a) Water Rights and Historic Usage. Determine the
effect that City use of area groundwater might have
on riparian and appropriative water rights or
historic water use by area property owners.
(b) Development Limitations. For the well development
areas (see Task 1.9.), identify engineering,
property rights, or jurisdictional constraints to
testing, well development, and water distribution.
(c) Treatment Requirements. Based on the results of
Task l.e., describe actions that would be necessary
to ensure water quality for domestic use (e.g.
on -site treatment, mixing with existing domestic
resources, etc.).
Phases #1 and #2 Report: Prepare a technical report that
summarizes the findings of the first two phases. The engineer
will submit 5 copies of a draft report to the City.Utilities
Division for review and editing, within 60 days of contract
award. After- staff concerns have been addressed, the engineer
will submit a "camera ready" original of a final report to the
City and present the report's findings to the City Council.

Upon receiving authorization from the City Council tojcontinue
with the Groundwater Study, the City staff and the engineer will
negotiate a final scope of work and services agreement necessary
to complete Phases #3 through #5. An out-line of these work
phases are presented below.
Phase 03• Program Design Analysis. The objective of this phase
is to evaluate options for drilling, pumping, storing, treating
and delivering groundwater for either domestic use or park .
irrigation in San Luis Obispo and its urban reserve. Key design
concerns that will be addressed include:
(a) Test Drillings. Identify and set priorities for
specific test drilling and sampling locations and
describe constraints and opportunities for those
specific sites. For purposes of this proposal,
consultant shall assume five test wells. The
actual number will be determined after Phase #2.
The results of this analysis would be presented in
An appendix of the Groundwater Development Plan --
see Phase #4. All test drilling and water quality
testing would be completed by the consultant prior
to initiating Phase #4 of this work program.
(b) Water Treatment options. Evaluate and rate options
for on -site or satellite treatment of groundwater
or diluting it with treated water from the City's
existing system to achieve state and federal
quality standards.
Phase #4 Recommended Groundwater Development Plan. The
objective of this phase is to prepare an action plan that the
City can follow in developing groundwater resources. The plan
should present the following elements:
(a) Well Sites. Recommend the specific design and
location of wells and well fields. Describe a
proposed groundwater basin, or basins, operation
program and variations for proposed operation
programs.
(b) Groundwater Use Alternatives. Analyze and suggest
alternative uses for groundwater, taking into
account quantity, quality, reliability, and
location of groundwater source. Different
alternatives for wet and dry seasons should also be
addressed. Overall impact of groundwater as a
"safe annual yield" water resource for the City
would be identified. Alternative use strategies
shall be developed in close cooperation with City
staff.

M Capital Facilities. Present schematic designs and
specifications for all well,. surface storage,
treatment, recharge and distribution facilities.
(d) Cost. Estimates. Present cost estimates
(1988 dollars) for all groundwater well development
and capital.improvements associated with full
implementation of the plan.
(e) Preliminary Schedule. Recommend a preliminary
schedule and priorities for the capital facilities
recommended above:
(f) Environmental Mitigation Measures. Present
specific measures needed to mitigate any'adverse
affects identified in this program's EIR
Supplement. (See Phase #5).
(g) Resource Management Strategies. Present resource
management strategies, if applicable, to best
utilize the groundwater resource including need for
basin recharge optimum drawdown rates and other
management methods.
Phase #5- Environmental Impact Review. The objective of this
phase is to document the environmental impacts of. implementing
the Groundwater Development Plan in compliance with CEQA and the
City's EIR guidelines.
The City has published a final EIR that evaluates the San Luis
Obispo Water Management Plan (published February 1987). This
document focuses on the impacts that water development will have
on City growth and development. As a "supplement" to the
existing EIR, the consultant will prepare a report that
identifies all adverse environmental effects and ways to
alleviate them, that may result from implementing the
Groundwater Development Plan.
The EIR "supplement" need not repeat information included in the
previous EIR but must comply with pertinent sections of CEQA and
City EIR guidelines.
The consultant will submit 5 copies of an administrative draft
of the Groundwater Development and Operational Plan and EIR
Supplemental to the City Utilities Division for review and
editing. After staff concerns have been addressed, the
consultant will submit a "camera ready" original of the final
reports to the City and present findings and recommendations to
the City Council.

AND METHODS OF PAYMENT

The payment for Phases 1 and 2 of the study are to be
performed on a lump sum basis consisting of two payments
totaling $6,840. However, any special studies: outside of
the scope of work shown in Exhibit B are considered to be
special services and will be compensated for in
accordance with the Schedule of Fees shown in
Exhibit D-2.
Of the two payments scheduled for Phases 1 and 2, a 50%
payment will be scheduled within 30 days after a Notice
to Proceed is given to the Engineer and after meeting
with the City's Project Manager. The City's Project
Manager shall authorize said payment if satisfied as to
sufficient progress towards completing Phases 1 and 2. A
second 50% payment will be made after submittal of the
final report for Phases 1 and 2 to the City Council.
Payment for Phase 3 and subsequent phases will

WHEREAS, Subdivider has executed an agreement to pay park -in -lieu fees
in the amount of $10,000.00 within six months of the date of approval of
the final map secured by a deed of trust against lot 6 of Tract 1459, and
a common driveway agreement per Condition 5 of Resolution No. 6138 (1986
Series), and
WHEREAS, the Subdivider has posted a $1,000.00 cash guarantee to
install a street light adjacent to lot 1 of Tract 1459 in accordance with
the approved plans, and

and between Susan Schriner, Donald Halvorson, and Charles Crotser, herein
referred to as "Subdivider" and the City of San Luis Obispo, herein referred
to as "City."
WITNESSETH:
Reference is made to the proposed subdivision of real property in the
City of San Luis Obispo, County of San Luis Obispo, State of California, as
shown on the final map of Tract 1459, as approved by the City Council
on 1st day of 11Prpmhpr , 1987.
WHEREAS, the Subdivider desires that Tract 1459 be accepted and approved
as a final map pursuant to the Subdivision Regulations and Ordinances of the
City of San Luis Obispo, and
WHEREAS, it is a condition of the regulations and ordinances that the
Subdivider pay park -in -lieu fees in the amount of ten thousand dollars
($10,000.00), and
WHEREAS, the Subdivider has requested postponement of the payment of said
park -in -lieu fees for six (6) months after approval of the final map by the
City Council, and
WHEREAS, the Subdivider has agreed to execute a deed of trust to
guarantee payment of said park -in -lieu fees.

This Agreement is entered into between the CITY OF SAN LUIS OBISPO, a Municipal

Corporation (hereafter referred to as "City ") and and Donald Halvorson
(hereinafter referred to as "Owner ") with reference to the following facts:
A. Owner owns the following described real property situated in the City of
San Luis Obispo, County of San Luis Obispo, State of California, to wit:
Lots 4, 5, and 6 of Tract 1459 as recorded Page of Maps
in the San Luis Obispo County Recorder's Office.

The parties hereto agree as follows:
1. Owner hereby dedicates an easement for a carat nn driveway over said property
and as Shawn on Lot 5 said Tract 1459 for the use and benefit of all of
said lots.
2. Owner and his heirs, and assigns hereby agree to comply with the following
terms and conditions:
(a) The owners of lots 4,5, &6, Tract 1459 , their neirs and assigns will
be jointly responsible to improve, maintain and keep in repair said driveway.
(b) Prohibit all parking on the common access portions.
(c) Owners agree jointly and individually to reimburse the City of San
Luis Obispo for all costs connected with the remval of vehicles from the common
access portions, and will reirrburse the City for, and hold the City harmless from,
all final judgments against the City for damages or other liability arising from the
enforcement of the aforesaid prohibition against parking.

(d) Owner understands that the City cannot regulate vehicle usage or
hazards upon said cor=n access driveway and agree jointly and individually, to
defend and hold the City harmless from all claims for damages or liability arising
from the alleged failure of the City to regulate vehicles or to provide protection
from hazards upon said driveway.
(e) Repair any portion of said driveway that is damaged through the
intentional or negligent acts of said party, or parties, or his or their licensees
and invitees.
3. The parties agree that this easement is superior and paramunt to the
rights of any of the parties in the respective servient estates so created, and that
it is a covenant running with the land.

WHEREAS, the City of San Luis Obispo has entered into an
agreement with the San Luis Obispo County Flood Control and Water
Conservation District, Zone 9 ( "Zone 911); and
WHEREAS, under this agreement Zone 9 will reimburse the city
for specific streambed maintenance and construction in the City's
flood control program; and
WHEREAS, the money receivable under this agreement was not
budgeted because this agreement was executed after preparation and
approval of the 1987 -89 Financial Plan;

AWARDING A CONTRACT AND TRANSFERING MONEY FROM
CAPITAL OUTLAY FUND AND THE GAS FUNDS CRP APPROPRIATIONS
WHEREAS, the City received bids for "Street Widening Project - Prado Rd. &
S. Higuera St.; and Traffic Signal Installation —Prado Rd. & S. Higuera St.;
City Plan Nos. M -12B and K -31C ", and
WHEREAS, the Engineer's estimate was $151,060.00, and
WHEREAS, the low bid was received from Walter Bros. Construction Company of
San Luis Obispo, California in the amount of $157,838.00, and
WHEREAS, there is money available in the Capital Outlay Fund CRP
appropriation for a portion of this project, and
WHEREAS, there is money available in the Gas Funds CRP appropriation for a
portion of this project,
NOW THEREFORE BE IT RESOLVED, the following items:

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AUTHORIZING THE INSTALLATION OF PUBLIC ART IN RAILROAD SQUARE AND
APPROVING INTERIM GUIDELINES FOR PUBLIC ART
Whereas, the City Council has adopted Resolution No. 5645 (1985 Series) supporting the
installation of art in public places; and
Whereas, city parking facilities in Railroad Square were designed to accommodate public
art at a major entry to the City; and
Whereas, the Art in Public Places Committee and the Arts Council of San Luis Obispo
County have requested City authorization to install a public artwork in Railroad Square;
and
Whereas, the Committee and the Arts Council intend to select an artist, coordinate
funding, and administer the project,
THEREFORE, BE IT RESOLVED by the City of San Luis Obispo as follows:
SECTION 1. Location.
The location in Railroad Square shown in Exhibit "A" is designated for the placement,
maintenance, and public appreciation of public art. The Community Development Director
and the City Engineer shall be responsible for insuring that the placement and
construction of public art complies with applicable city codes, programs, and policies.
SECTION 2. Authorization.
The Art in Public Places Committee and the San Luis Obispo County Arts Council are
authorized to proceed with the screening and selection of artists, fund raising, project
planning, and other steps required to develop public art within public right -of -way,
consistent with city standards and policies. The City Council, or city advisory body
designated by the City Council, retains all development review and approval authority for
public art.
SECTION 3. Guidelines.
To guide the design and review of public art in Railroad Square, the Council adopts the
guidelines listed in Exhibit "B." At its sole discretion, Council retains the right to
add to, modify, or revoke the guidelines.
SECTION 4. Responsibility.
Staff is hereby directed to prepare for the Mayor's signature an agreement between the
City and the Arts Council addressing the issues of public art ownership, access,
maintenance, liability, removal or modification, legal remedies, and other issues deemed
appropriate.

GUIDELINES FOR PUBLIC ART IN RAILROAD SQUARE
1. Public Art shall be located within public right -of -way, or shall otherwise be easily
visible or accessible from a public right -of -way.

2. Public Art shall be appropriate in terms of the architectural scale, materials, and
the historical and environmental context of the immediate site and neighborhood.
3. No expressions of profanity, vulgarity, or obvious poor taste shall be allowed.
4. Public art shall be'constructed of permanent, durable materials and require minimal
or no maintenance.
5. Artwork shall reflect a high level of artistic excellence, and shall be designed a! nd
installed by persons with appropriate experience and knowledge.
6. The design and placement of public art shall not impede pedestrian or vehicle
traffic, or conflict with public or private easements.
7. Public art shall be integrated with the site, and include landscaping, lighting,
interpretative information, other amenities where appropriate.
8. Public art shall not directly or indirectly cause adverse environmental effects, or
otherwise jeopardize public health, safety, or welfare.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
GRANTING AN APPEAL AND GRANTING FINAL APPROVAL SUBJECT TO MODIFIED
CONDITION TO A COMMERCIAL PROJECT FOR 158 HIGUERA (CASE NO. ARC 87 -129)
WHEREAS, on September 14, 1987, the Architectural Review Commission of the City of
San Luis Obispo did at the request of Paul Prather, applicant, grant final approval for a
commercial project located at 158 Higuera (Case No. ARC 87 -129); and
WHEREAS, on September 23, 1987, the Planning Commission of the City of San Luis
Obispo did direct staff to file on their behalf an appeal of said final approval due to
the concerns that circulation problems, resulting particularly from the number and
location of driveways, could pose significant public safety hazards; and
WHEREAS, on September 24, 1987, the Secretary to the Planning Commission did file a
timely appeal on behalf of the commission; and
WHEREAS, on October 20, 1987, continued to November 17, 1987, the City Council of the
City of San Luis Obispo did conduct a duly noticed public hearing on said appeal.
NOW, THEREFORE, the council resolves as follows:
SECTION 1. That based on the recommendation of a majority of members of a committee
composed of ARC members, Planning Commission members, staff and the applicant as well as
an analysis of the various staff reports and the site plan, the council finds that the a
modified site plan will be superior in terms of traffic and circulation; and, therefore,
the council grants the appeal and approves a modified site plan, subject to the
conditions listed below, for Case No. ARC 87 -129.
SECTION 2. The project is granted final architectural approval subject to the
following conditions:
Details of the trellis and signage shall be sub_ mitted to and approved by the
Community Development Director.

2. Applicant shall offer to dedicate to the city land for right -of -way purposes to
accommodate a right turn lane onto the site as generally depicted on Exhibit A
attached hereto and as approved by the City Engineer and City Attorney.
3. The applicant shall install driveway improvements on Higuera Street as generally
depicted on Exhibit A attached hereto and subject to the approval of the City
Engineer.
4. Prior.to issuance of a building permit, applicant shall combine the subject lots
into one parcel or shall record a common driveway and access agreement for the
two lots, subject to the approval of the Community Development Director and City
Attorney.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
DENYING GENERAL PLAN AND ZONING AMENDMENTS AT 2.2.31 BROAD STREET
(GP /R 1323)
WHEREAS, the Planning Commission and the City Council have held public hearings on
the proposed amendments in accordance with the California Government Code; and
WHEREAS, the amendments come to the council upon appeal from the Planning Commission;
and
WHEREAS, the potential environmental impacts of the amendments have been evaluated in
accordance with the California Environmental Quality Act and the city Environmental
Guidelines.
NOW, THEREFORE, the council resolves as follows:
SECTION I. Finding.
The requested amendments are not consistent the with general plan Land Use Element policy
which favors making more efficient use of existing neighborhood commercial centers before
expanding them.
SECTION 2. Environmental determination
An intial environmental study (ER 33 -87) has been prepared and the Community Development
Director has approved a negative declaration.
SECTION 3. Action.
The request to amend the general plan map and the zoning map from office (0) to
neighborhood commercial (C -N) is hereby denied.

WHEREAS, the subdivider has requested a 12 -month time extension to receive approval
of his final map; and
WHEREAS, the subdivider has experienced financial difficulties which have delayed
improvements and filing the final map; and
WHEREAS, neither applicable city regulations nor the circumstances which warranted
the original approval have changed significantly.
NOW, THEREFORE, the City Council resolves as follows:
SECTION 1. That Tract 1310 is granted a 12 -month time extension to September 17,
1988, subject to original tract map conditions as specified in City Council Resolution

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
CONFIRMING COSTS OF S- TDEWALKS CONSTRUCTED UNDER THE 1911 ACT
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. That pursuant to public hearings duly held, the
Council hereby determines that there are no objections or protests to
the costs of construction submitted by the Superintendent of Streets
and hereby confirms said costs as submitted and as set forth
hereafter.
SECTION 2. That the hereinafter listed construction costs shall
be paid within five (5) days after the date hereof and any such costs
remaining unpaid thereafter shall be turned over to the City Tax
Collector to be placed as a lien against the property and collected
with the city taxes, and subject to the same penalties and costs if
not paid on the first installment. The property owners, addresses
and construction costs are shown on Exhibit °A °.
SECTION 3. If the assessment is $1000 or more, payment may
made in three annual installments at seven percent (7%) interest
subject to all the curative clauses and powers of the 1911 Act. The
