SUBJECT: ACCEPTANCE OF JACK HOUSE WALLCOVERING DONATION
RECOMMENDATION
Accept the donation of wallcoverings for installation valued at $9,270 in materials and donated
labor at the Historic Jack House to be donated by the Jack House Committee in collaboration
with the Jack House Foundation and Friends of the Jack House, and authorize the Mayor to
execute a Donation Agreement.
DISCUSSION
Background
Deeded to the City in 1975, the Jack House and Gardens, a community gem, are located in the
heart of downtown San Luis Obispo at 536 Marsh Street. The Jack House Committee was also
established in 1975 as a condition of the grant deed of the former Jack Family residence to the
City. The Jack House Committee is a seven member advisory body to the City Council and
Parks and Recreation Department focused on the administration and restoration of the historic
Jack Residence. The Jack House Committee makes recommendations regarding public use and
enjoyment of the house and grounds, while balancing the need to protect and preserve the history
and integrity of this cultural and recreational facility
In deeding this facility to the City, the Jack Family descendants articulated their desires to keep,
preserve, and use the property and the residence in a manner which maintained, enhanced, and
celebrated its place in the historical development of the City of San Luis Obispo. The grant deed
specifies that the residence shall be maintained to its original character, a Victorian vintage
residence. General maintenance and any restoration improvements are to be in keeping with the
age and period when the original residence was constructed (Attachment 1 – Jack House Grant
Deed).
For the past 39 years, the residence and public gardens have been home to many tours, special
events, and weddings. This historic location is visited and enjoyed by thousands of community
members annually.
Existing Conditions
Recently, City staff was approached by the Jack House Committee and Jack House Foundation
about wallpaper and drapery renovations within the dining room parlor of the historic residence.
The current wallcovering is in poor condition. Further deterioration of the wallcoverings in this
location has led to some exposure of the drywall underneath and could result in significant
repairs if not addressed.

Proposed Donation
The Jack House Committee, in collaboration with the Jack House Foundation (Family Trust),
Friends of the Jack House and Parks and Recreation Department staff, have worked to identify a
wallpaper covering design that is consistent with the historic period of the house (Attachment 2 –
Wallcovering design). The Jack House Committee proposes to donate and install the new
wallpaper at the City of San Luis Obispo Historic Jack House. The Jack House Committee is
recommending installation be provided by an experienced wall-hanger contractor specializing in
historic wallcoverings; J.C. Coverings of Cayucos, California. In partnership with the Jack
House Committee, staff has drafted and included a proposed donation agreement to memorialize
the scope of work and terms of this donation (Attachment 3 – Donation Agreement).
City staff has evaluated this proposed donation within the City’s adopted Financial Management
Policies and finds that the proposed donation meets the following donation criteria as presented
in the adopted Donation Policy, Section 760, of the Financial Management Manual (Attachment
4 – Donation Policy). A summary of the donation criteria is provided below.
Concurrence
Parks and Recreation and Public Works Department staff have reviewed this donation concept
for consistency with the City’s approved donation policy (Attachment 4 – Donation Policy). Per
the City’s Donation Policy, all donations exceeding $5,000 in value must be accepted through a
written agreement and approved by City Council. The proposed donation is consistent with the
grant deed restrictions and the Parks and Recreation Department goals and objectives and will
enhance the recreational experience of residents and visitors. The proposed donation is valued at
over $9,270 in materials and donated labor.

Next Steps
If accepted by City Council, the Parks & Recreation and Public Works departments will
coordinate with the Jack House Committee to shepherd the project through the permitting
process and facilitate the installation of the wallcoverings in early 2015.
FISCAL IMPACT
The City’s Financial Management policies set forth responsibilities and general strategies for the
City’s acquisition of property, whether by sale, grants, donations, gifts, dedication or exchange.
The goal of this policy is to set the framework for evaluating and accepting donations. The Jack
House wallcoverings donation has been evaluated and meets the donation criteria as presented in
the adopted Donation Policy, Section 760. Consistent with the City’s Donation Policy, the City
Council shall review and approve all donations exceeding $5,000 in value.
The Jack House wallcoverings donation is estimated at a value of $9,270, which includes
materials (wallpaper, drapes and lace curtains) and labor. All project expenditures will be
supported by private funds raised by the Jack House Committee, Friends of the Jack House and
the Jack House Foundation Family Trust. There is no General Fund fiscal impact associated
with Council’s acceptance of the Jack House wallcoverings donation.
ALTERNATIVE
Decline the donation. Declining the Jack House Committee wallcovering donation is not
recommended as the wallcovering donation is consistent with the Jack House grant deed for
restoration improvements and are in keeping with the age and period of the original residence.
The Jack House Committee, Friends of the Jack House and the Jack House Foundation (Family
Trust) continue to be strong supporters of the City’s tremendous local history through numerous
beneficial donations such as this. Declining this donation is not recommended as there is no
General Fund impact associated with this acceptance.

CITY OF SAN LUIS OBISPO CALIFORNIA
AGREEMENT
THIS AGREEMENT, made on this 20th day of January, 2015, by and between the City of San Luis Obispo, a municipal
corporation and charter city, San Luis Obispo County, California (hereinafter called the Owner) and Jack House
Committee (hereinafter called the Donor).
This written Agreement, including all writings specifically incorporated herein by reference shall constitute the complete
agreement between the parties hereto. No oral agreement, understanding, or representation not reduced to writing and
specifically incorporated herein shall be of any force or effect, nor shall any such oral agreement, understanding, or
representation be binding upon the parties hereto. To the extent that there are any conflicts between the City’s
specifications and this Agreement and the Donor’s proposal, the terms of the City’s specifications and this Agreement shall
prevail, unless specifically agreed otherwise in writing signed by both parties.
WITNESSETH:
That the Owner and the Donor for the consideration stated herein agree as follows:
ARTICLE 1, SCOPE OF WORK: The Donor shall perform everything required to be performed, shall provide and
furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and transportation services
required to complete all the work of construction of
Jack House Residence Wallpaper Restoration Project
in strict accordance with the Scope of Work as provided as Exhibit A, including any and all Addenda, adopted and
approved by the Owner, and those documents noted in Article III of this agreement.
It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work performed and
completed under the direction and supervision and subject to the approval of the Owner or its authorized representatives.
ARTICLE II, CONTRACT PRICE: The Donor shall furnish all labor and materials to complete the work in strict
accordance with the contract documents at no cost to the Owner.
If the Donor falls to complete the work, the Owner may complete the work and bill the Donor for the direct costs.
Should any dispute arise respecting the true value of any work omitted, or of any extra work which the Donor may be
required to do, during the performance of this work, said dispute shall be decided by the Owner and its decision shall be
final, and conclusive.
ARTICLE III, COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the following documents, all
of which are as fully a part thereof as if herein set out in full, as Exhibits A and B:

2. Insurance Requirements
Any amendments, modification or variation from the terms of this Agreement shall be in writing and shall be effective only
upon approval by the Parks and Recreation Director of the City.
It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this
instrument and the proposal of said Donor, then this instrument shall control and nothing herein shall be considered as an
acceptance of the said terms of said proposal conflicting herewith.
ARTICLE IV, CITY OBLIGATIONS: The City shall perform as follows:
a. Coordinate and provide oversight to the project to ensure that the project conforms to the approved plans and
specifications.
b. Assist donor in shepherding the project through the City review and approval process.

INSURANCE REQUIREMENTS: CONSTRUCTION – EXHIBIT B
The Contractor shall procure and maintain for the duration of the contract insurance against claims for injuries to
persons or damages to property which may arise from or in connection with the performance of the work hereunder by
the Contractor, its agents, representatives, employees, or sub-contractor.
Minimum Scope of Insurance.
Coverage shall be at least as broad as:
1. Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001).
Minimum Limits of Insurance.
Contractor shall maintain limits no less than:
1. General Liability: $1,000,000 per occurrence for bodily injury, personal injury and property damage. If
Commercial General Liability or other form with a general aggregate limit is used, either the general aggregate
limit shall apply separately to this project/location or the general aggregate limit shall be twice the required
occurrence limit.
Acceptability of Insurers.
Insurance is to be placed with insurers with a current A.M. Best's rating of no less than A:VII.
Verification of Coverage.
Contractor shall furnish the City with a certificate of insurance showing required insurance coverage. Original
endorsements effecting general liability and automobile liability coverage required by this clause must also be provided.
The endorsements are to be signed by a person authorized by that insurer to bind coverage on its behalf. All
endorsements are to be received and approved by the City before work commences.
Subcontractors.
Contractor shall include all subcontractors as insured under its policies or shall furnish separate certificates and
endorsements for each subcontractor. All coverages for subcontractors shall be subject to all of the requirements stated
herein.
