Grigsby, Public Works Director Prepared By: Bridget Fraser, Senior Civil Engineer SUBJECT: DOWNTOWN RENEWAL PROJECT: HIGUERA STREET – GARDEN TO BROAD; SPECIFICATION NO. 91320 RECOMMENDATIONS Award a contract in the amount of $504,450 to Brough Construction, Inc. for construction of the "Downtown Renewal Project, Specification No. 91320,” and authorize the mayor to execute the agreement. DISCUSSION Background In the 2007-09 Financial Plan the City Council approved a Major City Goal for Downtown Maintenance and Beautification and in 2009-11 as an Other Important Objective. Past work includes street resurfacing, pedestrian light installation, new Mission-style sidewalk and tree grates, tree removal, replacement and maintenance, new trash cans, painting of street and traffic light poles and other similar improvements. In a continuing effort to maintain and enhance the downtown, the Council again approved a Major City Goal to Assess and Renew the Downtown as part of the 2013- 15 Financial Plan. At the November 18, 2014 meeting, Council approved the plans and specifications and authorized staff to advertise for bids for the Downtown Renewal Project. On December 17, 2014, four bids were received, all of which exceeded the Engineers Estimate of $473,000 (Refer to Attachment 1 for Bid Summary). Brough Construction, Inc. (BCI) of Arroyo Grande, after providing a clarification of its references, was found to have submitted the lowest responsive bid in the amount of $504,450.00. This bid was $31,450, or approximately 7%, over the Engineer’s Estimate. A review of the bid received from BCI reveals the overage is attributed to significantly higher than estimated costs for pedestrian and vehicular traffic management. All four bids were significantly higher for this same bid item. Staff attributes the higher costs to the contractors and subcontractors having a better understanding of the project scope with this project compared to the 2012 project. The primary cost drivers include the difficulty of working at nighttime during typically wet months, tightly controlled work areas, reduced work hours compared to the 2012 project, and stringent access requirements. FISCAL IMPACT The 2013-15 Financial Plan, pages 3-232 through 3-233 of the Capital Improvement Plan, identifies $525,000 of Measure Y funds to support the construction and construction management phases for this project. At this time, construction management/inspection will be performed by in-house staff thereby freeing up the construction management funds and making them available for the construction phase. On November 18, 2014, the Council authorized an additional $79,000 for the project bringing the project budget to $604,000. t r u c t i o n   AT T A C H M E N T 1 C4-3 1 of 4 AGREEMENT THIS AGREEMENT, made on this ______ day of ___________, 2015, by and between the City of San Luis Obispo, a municipal corporation and charter city, San Luis Obispo County, California (hereinafter called the Owner) and BROUGH CONSTRUCTION, INC. (hereinafter called the Contractor). WITNESSETH: That the Owner and the Contractor for the consideration stated herein agree as follows: ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to be performed, shall provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and transportation services required to complete all the work of construction of DOWNTOWN RENEWAL PROJECT HIGUERA STREET – GARDEN TO BROAD, SPECIFICATION NO. 91320 in strict compliance with the plans and specifications therefor, including any and all Addenda, adopted by the Owner, in strict compliance with the Contract Documents hereinafter enumerated. It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work performed and completed under the direction and supervision and subject to the approval of the Owner or its authorized representatives. It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument and the bid of said Contractor, then this instrument shall control and nothing herein shall be considered as an acceptance of the said terms of said bid conflicting herewith.
