HIST - 0089-2014 (CHC)). RECOMMENDATION As recommended by the Cultural Heritage Committee (CHC), adopt a Resolution (Attachment 1) approving the removal of 549 Buchon Street from the City’s list of contributing historic resources. SITE DATA Applicant/Owner John Cutter Historic Status Contributing Zoning R-2-H (Historic Old Town District) General Plan Medium Density Residential Site Area ~7,380 square feet Environmental Status Exempt from CEQA under Section 15061(b)(3) because the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. DISCUSSION Background On October 27, 2014, the Cultural Heritage Committee (CHC) reviewed the request to de-list a residential building located at 549 Buchon Street from the City’s list of contributing historic resources. The CHC unanimously found the structure did not meet the eligibility requirements for historic listing and recommended the City Council remove the subject property from the City’s list of contributing historic resources. Historic Resource Designation Historic Preservation is an important goal of the City’s General Plan, as described in Conservation and Open Space Element policies 3.3.1 - 3.3.5. In an effort to preserve the integrity of the City’s Historic Resources, it is important that those resources included as Contributing or Master List properties meet the historic criteria provided in the City’s Historic Preservation February 3, 2015 C3 C3-1 Council Agenda Report – Removal of a Contributing Historic Resource at 549 Buchon Street (HIST-0089-2014(CHC)) Page 2 Ordinance. The purpose of the Ordinance is to promote identification, protection, enhancement, and preservation of those resources that represent distinctive elements of San Luis Obispo’s cultural, educational, social, economic, political and architectural history. In this case, a qualified historian (Betsy Bertrando) has confirmed that this property does not meet eligibility requirements for listing (Attachment 3), and the CHC has reviewed and concurred with the evaluation. Site Information The subject site is located in the Old Town Historic District on Buchon Street between Beach Street and Nipomo Street (Attachment 2, Vicinity Map). The site is developed and contains two, attached, residential structures. In 1923, a 24 foot by 30 foot, one story four-room, rustic frame residence was built on the subject site. At some point after the initial construction, the kitchen was expanded and a bedroom and fireplace were added to the structure. By 1926, a small, detached garage was added to the site. In 1959 permits were issued for a stucco and wood garage at the rear of the site with an apartment above (the small detached garage was removed to construct the new structure). The garage/apartment structure was then attached to the original house creating a duplex. In 1987 the modified original structure was added to the City’s List of Contributing Historic Resources as an example of Craftsman Bungalow architecture. Records on the property do not indicate why the structure was added as a historical resource other than the style of architecture, which in this case does not reflect a good example of a significant architectural style since it has been substantially altered. As discussed below, structures must meet specific architectural criteria in order be listed. The previous historic resource inventory on the property does not adequately justify eligibility for listing. Figure 1: 1987 photograph of the subject structure Figure 2: Current photo of the structure C3-2 Council Agenda Report – Removal of a Contributing Historic Resource at 549 Buchon Street (HIST-0089-2014(CHC)) Page 3 Current Building Condition The house has received multiple modifications since 1923, such as the addition of a brick chimney, the stone wall front porch, the addition of a west facing gable over a second entrance to the house (see Figure 3), and the addition of an interior closet (which protrudes from the east exterior wall, see Figure 4). As mentioned above, the structure has also been attached to a garage with a second floor residential unit (see Figure 5). Summary of the Historic Resource Listing Evaluation of 549 Buchon Street The Historic Preservation Ordinance states that in order for a property to be considered historically significant it must meet one of the eligibility criteria, including: 1) architecture, 2) historic significance, and/or 3) integrity. According a Historic Resource Evaluation by Bertrando and Bertrando Research Consultants (Attachment 3), there is no evidence indicating that the structure is historically significant. The structure is an example of a vintage house that has received significant modifications, which have degraded the original appearance and workmanship. Additionally, there are no significant events or persons that have been found to be associated with the structure. It is likely that when the building was originally constructed it did not represent a significant architectural style or theme. Proposed Future Project The applicant is exploring an option to remove all current structures on the site in order to redevelop the site with two new residential units, as allowed in the R-2-H (Medium Residential density-Historic Overlay) zone. Action on the future project is not a component of Council review and action on the de-listing of the property, however, the process for review of a future project is described below. If the site is removed from the Contributing Historic Resource list, future development on the property will be reviewed by the CHC because the site is located within the Old Town Historic District. The CHC recommendation would include conditions necessary to find the new project complementary/consistent with the Old Town Historic District and would be forwarded to the Community Development Director for action. If the site is not removed from the Contributing List of Historic Resources, any future project would return to the CHC for review of consistency with the Old Town Historic District as well as compliance with the Secretary of the Interior Guidelines for rehabilitation of historic structures. The CHC recommendation would be forwarded to the Community Development Director for action. CONCURRENCES The applicant’s request has been reviewed by the CHC and no other departmental recommendations are required at this time. FISCAL IMPACT The proposed project will have no fiscal impacts since the property is not currently eligible for historic preservation benefits (i.e. Mills Act) and the historic designation of the property has no bearing on City fiscal resources. RECOMMENDATION Adopt the attached resolution (Attachment 1) approving the removal of property located at 549 Buchon Street from the City’s list of Contributing Historic Resources (HIST-0089-2014(CHC)). ALTERNATIVES 1. Maintain 549 Buchon Street on the City’s list of contributing historic resources, based on findings that satisfy the criteria for Historic Resource Listing of the City’s Historic Preservation Ordinance (architecture, historic significance, and/or integrity). 2. Continue the item for additional information or discussion. (2015 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO REMOVING THE PROPERTY LOCATED AT 549 BUCHON STREET FROM THE CONTRIBUTING LIST OF HISTORIC RESOURCES IN THE OLD TOWN HISTORIC DISTRICT (HIST-0089-2014 (CHC)) WHEREAS, the applicant, on August 20, 2014, submitted an application to remove the property located at 549 Buchon Street, San Luis Obispo (the “Property”) from the Contributing List of Historic Resources; and WHEREAS, the Cultural Heritage Committee of the City of San Luis Obispo at a public hearing held in the Council Meeting Room of City Hall, 990 Palm Street, San Luis Obispo, California, on October 27, 2014, and recommended the Council remove the Property from the Contributing List of Historic Resources; and WHEREAS, the City Council conducted a public hearing on February 3, 2015, for the purpose of considering removing the Property from the Contributing List of Historic Resources (HIST-0089-2014 (CHC)); and, WHEREAS, the City Council has duly considered all evidence, including the testimony of the applicants, interested parties, the records of the Cultural Heritage Committee hearing, and the evaluation and recommendations by staff, presented at said hearing. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Findings. The Council makes the following findings regarding the Historic Preservation Program Ordinance eligibility criteria for the Contributing List of Historic Resources: 1. Though the subject building is within the Old Town Historic District, the character of the building is not historically significant due to its lack of architectural significance, a lack of historic and original architectural features, and numerous modifications that have occurred to the interior and exterior of the property. 2. The property is not associated with any significant historical person groups or events in the City's history. 3. The building does not maintain authenticity and integrity because the building has been significantly modified over time and the building no longer retains its original appearance or workmanship. 4. The removal of the existing structure from the list of Contributing Historic Structures is consistent with the Historic Preservation Ordinance because the building does not meet the criteria for inclusion on the City’s list of historic resources. SECTION 2. Environmental Determination. Section 15061(b)(3) states a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a C3-5 Resolution No. _______________ (2015 Series) ATTACHMENT 1 Page 2 significant effect on the environment, the activity is not subject to CEQA. The determination of historical significance is not subject to CEQA because the project will not have a significant effect on the environment since it is a review of whether the subject site satisfies at least one of the criteria for historic resource listing within the Historic Preservation Ordinance. Any future development related to the proposed site will be subject to environmental review as required under CEQA. SECTION 3. Action. The Council of the City of San Luis Obispo does hereby remove the property located at 549 Buchon Street from the Contributing List of Historic Resources. Since 1987, the structure, containing two residences that have been attached, has been on the "Contributing List of Historic Resources" for the City of San Luis Obispo. This study finds that the building on the property does not qualify as significant as defined in the Public Resources Code and the City of San Luis Obispo Guidelines. In addition, the residence(s) does not reach the level of significance for inclusion to the "Contributing List of Historic Resources." INTRODUCTION The work carried out as a part of this study was conducted by Betsy Bertrando, of Bertrando & Bertrando Research Consultants (BBRC), who was assisted in the field by Luther Bertrando. Betsy Bertrando has over twenty years experience researching the cultural resources of the central coast. The project property (APN 003-616-004) is depicted on the San Luis Obispo 7 .5 quadrangle topographic map as existing in the City of San Luis Obispo at 549 Buchon Street (Block 59-Lot 4). Currently, the house sits within the Old Town Historic District and is on the City of San Luis Obispo's "List of Contributing Historic Resources ." PROJECT DESCRIPTION The owners, who live at 557 Buchon Street on the adjacent property, have recently acquired 549 Buchon Street. The purpose ofthis report was the reevaluation of the structure(s) and to re-access previous documentation regarding listing of the property on the City of San Luis Obispo 's "List of Contributing Resources." The original house on the property has been rented for a long period of time and is in very poor condition. An earlier addition across the rear of the original house has since been increased to connect with a garage apartment. :METHODS Archival Research Background for the property was gathered by a search of the historic literature, maps, directories, newspapers, documents, the internet, building permits, census and Great Register records. The purpose was to establish the structure 's background, historic use and people associated with the property. This included research to investigate if historic events or persons important to the history of the City of San Luis Obispo were a part of the period of significance. Photographs and survey assistance was provided by Luther Bertrando. Notes were written focusing on the condition and original features of the extended residence. Important information collected included: • Architectural features within the context of the "Historical Period of Significance" • Type of construction and materials used • Additions to the original residence • Grounds, setting and landscaping IDSTORICAL BACKGROUND The mission community was first organized in 1859 when ordinances were drawn up and residents initiated requests for land. Most of the requests came between the years 1869 to 1872 (Bertrando 1996). The Map of the Town of San Luis Obispo, produced in 1870 by Harris and Ward, surveyed the lots and blocks within the original town boundaries. This was followed by an insert depicting the Town of San Luis Obispo on the 1874 County of San Luis Obispo Map produced by R. R. Harris. Situated within the original town boundaries, block (59) was formed between Buchon, Islay, Nipomo and Beach Streets. The 1874 Harris map gives the owner of the project parcel (lot 1) as Thomas Whiteley. Whiteley also owned the original lots 2, 5 and 6 on the same block. By 1872, residences on lots 2 and 3 were the only structures on the block. An official request for land permit on file at the City of San Luis Obispo was for lot 2 on block 59, land claimed by Thomas Whiteley in 1870 and deeded to him in 1872 . On the sketch map that accompanied the request, the owner for lot 1 was C. Mills. Chester Mills was a farmer in San Luis Obispo during the 1880s. 549 Buchon St., City of San Luis Obispo 2 ATTACHMENT 3 C3-10 Lot 1 was later carved into four parcels with the project parcel, as new lot 4, located on the east side. A check of the Sanborn Fire Insurance Maps from 1886 to 1905 for the project parcel depicts no prior structures on the project parcel. Neither Mills nor Whiteley developed the lot. SIGNIFICANCE CRITERIA Effective in February 1999, changes made to the California Environmental Quality Act of 1970 (CEQA) removed thresholds of significance from the main document and relied upon criteria set forth in Public Resources Code, Section 5024.1 Title 14 CCR Section 4852 . These revisions to qualifying criteria for determining the significance of a resource include the following; 1. Is associated with events that have made a significant contribution to the broad patterns of California's history and cultural heritage. 2. Is associated with the lives of persons important in our past. 3. Embodies the distinctive characteristics of a type, period, region or method of construction, or represents the work of an important creative individual, or possesses high artistic value. 4. Has yielded, or may be likely to yield, information important in prehistory or history. Cultural resources displaying one or more of these criteria, may be considered significant and thereby subject to special measures of avoidance or evaluation prior to any potential impacts. If impacts cannot be avoided then a mitigation plan is normally developed. CEQA directives regarding mitigation of cultural resources are also addressed in the Public Resources Code. In addition, the City of San Luis Obispo has produced The Historical Preservation Guidelines which were adopted by the City Council, (Resolution No. 6158) in 1987. This was amended by the City Council resolution No. 6857 to incorporate U. S. Secretary of the Interior standards for rehabilitation as informational guidelines . Standards for the Treatment of Historic Properties have been developed for preservation, rehabilitation, restoration and reconstruction projects and have been codified as 36 CFR Part 68 in July 12, 1995 Federal Register (Vol60, No. 133). It was also stated in an additional Historic Resources Survey Completion Report produced by the City of San Luis Obispo in 1992 that: "The City of San Luis Obispo has adopted specific criteria for measuring the value of individual structures and districts. These criteria complement those of the National Register of Historic Places." (Lovell1992: 15) 549 Buchon St., City of San Luis Obispo 3 ATTACHMENT 3 C3-11 These criteria will be applied in this report. RESULTS House/Ownership History-549 Buchon Street Building Permit # 1825 states that Bernard Samuel Hawkins built a residence at 549 Buchon Street in 1923 . The "residence was a 24ft by 30ft deep one story, frame rustic with four rooms " for $1000 . No permit was found for an additional twelve feet across the back of the house that added a bedroom and increased the size of the kitchen. The brick fireplace is also not a part of the original house. By 1926, there was a small garage at the end of a driveway . The garage was constructed along the fence line with the lot to the west. It has since been removed. Bernard Hawkins Bernard S. Hawkins was born Feb 4, 1897 in Arroyo Grande . Both of his parents were born in California. His father, Arthur, worked as a retail clerk in a hardware store in 1910 while Bernard's older brother worked at the Post Office. When Bernard registered for the Draft in 1918, he was working as a butter maker and cream tester at the Los Angeles Creamery in San Luis Obispo. By 1920, Bernard was living with his brother Arthur's family on Broad Street. Both brothers were working as boiler maker helpers at the round house. Arthur, then age 29, was married to Hattie with whom he had three children. By 1930, Bernard was living in the house he had built at 549 Buchon Street with his wife, Merle and two small children. By this time he was working as a clerk in the Post Office. By 1938, it was a rental property and later in 1942 it was vacant until it was sold. Later Owners Bernard and Merle deeded the property to Walter W. and Juanita J . Maness in 1944 (Deed Book 365:495). The same year the property transferred again to Ralph M. and Dorothy Mcintyre (Deed Book 375: 101). Ralph worked as a clerk at a hardware store and soon sold the property to Jack G. and Betty K. Lipscomb . Alfred and Donna Lang acquired the property from Jack G. and Betty K. Lipscomb near the end of 1947 (Deed Book 461:214). The Lang 's lived in the house for several years while Alfred worked as a repairman for Pacific Telephone and Telegraph. By 1959, the owner was Harold E. Vanderberg. Harold worked as a machinist and was responsible for some of the additions to the original residence . Two 1959 building permits were found under his name . Permit #2603 was for a garage that was set diagonally at the rear of the 50 ft by 150 ft lot. Permit #2413 added an apartment over the garage. The garage and apartment 549 Buchon St., City of San Luis Obispo 4 ATTACHMENT 3 C3-12 were stucco and approximately 24 ft by 24 ft.. Vanderberg attached the original house and the garage together making the building into a duplex . In 1977, the property was sold to Edward Upton and Joan Upton (1977-R-C31561). The property changed hands once more to Donald and Paul Sverchek the owners of Contractors Glass (1986-R-008754). Their parents lived next door at 541 Buchon Street. By 1987, the Sverchek's acquired this property as well and since then it has been a rental. The Cutter's bought the house(s) next door at 559/557 Buchon Street soon after the Sverchek acquired the project parcel. Recently, the Cutter's purchased the house after it had gone into receivership . The most recent owner was John Pearce. For much of the property's history and through several owners, the residence( s) served as rentals. Field Investigation -549 Buchon Street In 1987, when the City of San Luis Obispo placed 549 Buchon Street on the "List of Contributing Resources," it was noted as being in "good condition." This is no longer true . Figure 1: West gable entrance with garage apartment in the rear Building Description Noted in the city files as a "craftsman bungalow," the original four room house has gone through several changes . See "House History" above . Its condition is very poor. The brick chimney and low stone wall porch were later additions to the clapboard exterior. The low pitched composition shingle roof cover twin double hung windows that are on either side of the off centered door. A west facing small gable covers another entrance off the driveway (Figure 1 ). A protrusion on the exterior of the east wall was constructed to allow for a closet in the bedroom (Figure 2). The later addition across the ... rear of the house is attached to the stucco ' d garage apartment with older boards (Figure 3). The two story garage apartment is constructed on the lot on a diagonal and has been joined to the front house. 549 Buchon St., City of San Luis Obispo 5 ATTACHMENT 3 C3-13 Figure 2: East side of original house rear extension, garage apartment and connecting structure Setting The surrounding original neighborhood has been impacted by larger developments, the middle one third of the block is now in condominiums . For the most part, the remaining houses have been extensively remodeled with additions for rental units. There are other smaller flat roofed apartments on the 500 block ofBuchon Street. The list of "Contributing Historic Resources" for the City of San Luis Obispo has six properties on each side of the 500 block ofBuchon Street. Only 533 Buchon appears to be original. At least three are questionable as "contributing properties" and the remaining two have been modified with additions . SIGNIFICANCE EVALUATION The residence at 549 Buchon does not come up to the level of a contributing property as defmed by the City of San Luis Obispo Guidelines and the Figure 3: West side of figure 2 California Public Resources Code. In addition, visually, the block has not sustained the cohesiveness necessary for contributing properties listings . Other properties on the block may still rise to a level of significance, however, when evaluated separately. The following criteria have been found not applicable to 549 Buchon Street. 549 Duchon St., City of San Luis Obispo 6 ATTACHMENT 3 C3-14 1. Is associated with the lives of persons important in our past. 3. Embodies the distinctive characteristics of a type , period, region or method of construction, or represents the work of an important creative individual, or possesses high artistic value. 4 . Has yielded, or may be likely to yield, information important in prehistory or history. (Rachel Cohen) Contract Planner Cohen presented the staff report, recommending the City Council adopt a resolution removing 549 Buchon Street from the City’s list of contributing historic structures, finding the the de-listing is not considered a project under CEQA. PUBLIC COMMENTS: Eric Meyer, SLO, stated that this house needs to be “put down” because it is not worth saving. He added that the house is sagging and soggy from leaks, and the wiring is “haywire.” He supported the staff recommendation. There were no further comments made from the public. COMMITTEE COMMENTS: Comm. Members Platt and Taylor supported demolition. Comm. Member Brajkovich stated that the house does not have much integrity and he is sure that whatever the applicant builds in its place will be much better. He supported delisting. At this point a motion was made by Comm. Member Taylor and seconded by Comm. Member Baer. Discussion ensued. Comm. Member Hill stated she wanted to make sure the findings are whatever is necessary and specific enough to justify delisting. Comm. Member Pavlik stated that he thinks there has been due diligence based on all the changes that have been made to the house, such as the chimney addition, the gable over the side door and other extensive alterations. There were no further comments made from the Committee. On motion by Committee Member Taylor, seconded by Committee Member Baer recommending the City Council adopt a resolution removing 549 Buchon Street from the City’s list of contributing historic structures, finding the project exempt from environmental review.
