As Mr. Carpenter stated in prior city council session, this ordinance is unenforceable and restricts private property uses. As a vacationer, I never expect the manager of a Hilton Hotel to sleep on the couch and occupy the same space. Additionally, if I rent a property for family vacations, I certainly do not want the owner occupying the same space. Of particular concern is the granting of CCD Director permission to change, delete or alter provisions for permits. The prohibition of guest houses or quarters is over - reaching and will be challenged in court. Vacation rentals will not disappear, they will simply go underground and no TOT taxes will be collected within the city. By welcoming enforcement based on complaints creates an undo burden on any property owner and promotes ill feelings between neighbors. I recommend the following from agenda summary: "2. The Council could continue final adoption of the proposed amendments and provide direction to staff for research and revisions, which would require re- introduction of the ordinance ". Remove restrictions of guest quarter use and remove ban on vacation rentals.
