SUBJECT: CONTRACT AMENDMENT WITH SAN LUIS COASTAL UNIFIED
SCHOOL DISTRICT FOR RELEASE OF PEG FUNDS - TRANSFER OF
PUBLIC, EDUCATIONAL, AND GOVERNMENTAL ACCESS CHANNEL
EQUIPMENT TO SAN LUIS OBISPO COUNTY OFFICE OF EDUCATION
RECOMMENDATION
1. Approve, and authorize the Mayor to execute, the Second Amendment to the Agreement
by and between the City of San Luis Obispo and San Luis Obispo Unified School District
for Release of PEG Access Funds (E-Portion), extending the term of the agreement
through August 4, 2018.
2. Authorize the transfer of equipment currently housed at Charter Communications to the
San Luis Obispo County Office of Education for the purpose of broadcasting Educational
Channel content.
DISCUSSION
PEG Funds are collected pursuant to the City’s Municipal Code, and permissible uses of the
funds are dictated by State and Federal law. PEG funds, which are currently collected from
Charter Communications through a surcharge on City residents’ cable television bills, may only
be used for costs associated with the purchase and maintenance of equipment and facilities used
in the production of PEG programming. State and federal law contain no directives regarding the
share of funding allocated to the public, educational, or governmental channels.
Agreement for Release of PEG Access Funds (E-Portion)
At the May 20, 2014 Council Meeting, Council approved a contract amendment with the San
Luis Coastal Unified School District for release of PEG Access Funds (E-Portion), for a period
ending August 5, 2015. This agreement allowed for the extension of the contract term for an
additional three-year term by mutual consent. The Second Amendment to the Agreement would
allow for the extension of this agreement through August 5, 2018 (Attachment 1).
Transfer of Equipment to San Luis Obispo County Office of Education
Charter Communications possesses equipment (Attachment 2) purchased with City PEG funds
for the purpose of broadcasting Public Access content. The City maintains its own playback
equipment for broadcasting Government Access Channel content and has no need for the Charter
equipment. The San Luis Obispo County Office of Education has requested that the equipment
be transferred to their office for the purpose of expanding its broadcasting of Educational
content. The City would retain ownership of the equipment and SLOCOE would return said
equipment to the City for appropriate surplus/disposal after its useful life.

FISCAL IMPACT
There are no fiscal impacts to the General Fund associated with these recommendations. The
PEG Access funds will continue to be evenly divided between the educational and governmental
access channels.

SECOND AMENDMENT TO AGREEMENT BETWEEN CITY OF SAN LUIS
OBISPO AND SAN LUIS COASTAL UNIFIED SCHOOL DISTRICT FOR
RELEASE OF PEG ACCESS FUNDS (E-PORTION)
THIS AMENDMENT TO AGREEMENT is made and entered in the City of San Luis Obispo on
______________, by and between the CITY OF SAN LUIS OBISPO, a municipal corporation, herein after referred
to as City, and San Luis Coastal Unified School District, hereinafter referred to as “SLCUSD”.
WITNESSETH:
WHEREAS, on August 4, 2009 the City entered into an Agreement with SLCUSD for the release of PEG
access funds (E-Portion);
WHEREAS, on May 20, 2014 the City enterer into the First Amendment to the Agreement with SLCUSD
for the release of PEG access funds (E-Portion) to retroactively extend to contract period between August 4, 2012
through August 4, 2015;
NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter
contained, the parties hereto agree as follows:
1. Section 14 (Term of Agreement) is hereby amended to provide for a term of three (3) years
commencing on August 4, 2015 and ending on August 4, 2018, unless terminated earlier, as
provided in this Agreement.
3. All other terms and conditions of the Agreement remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this instrument to be executed the day and year
first written above.
