PLEDGE OF ALLEGIANCE Vice Mayor Ashbaugh led the Pledge of Allegiance. 2015-17 FINANCIAL PLAN COMMUNITY FORUM City Manager Lichtig, Assistant City Manager Codron, and Budget Manager Lamers narrated a presentation related to the goal-setting process, current goals, and the fiscal outlook for 2015-20. Facilitator Don Maruska explained the interactive process designed for this forum and facilitated the process throughout the course of the evening. PUBLIC COMMENT During the public comment period, 60 members of the public provided input on the issues and goals that were of priority to them. Public comments were grouped into the following categories: C2-3 San Luis Obispo City Council Minutes of January 13, 2015 Page 2 Laguna Lake The following individuals spoke in support of accelerating the implementation of the Laguna Lake Natural Reserve Conservation Plan, including the dredging of Laguna Lake. Rod Davidson, San Luis Obispo John Wakeman, San Luis Obispo John Smigelski, San Luis Obispo Silvia Drucker, San Luis Obispo, Open Space Acquisition and Maintenance Greg Bettencourt, San Luis Obispo, spoke on the importance of open space maintenance. Michael Alamo, San Luis Obispo, voiced support for open space acquisition and maintenance. Carolyn Huddleston, representing EcoSLO, Templeton, spoke in support of open space acquisition and maintenance. Niels Grether, San Luis Obispo, spoke on the need for additional mountain bike trails. Richard Waller, representing Backcountry Horsemen of California, Arroyo Grande, voiced support for equestrian trail planning. Jobs and Housing/Workforce Housing/Homelessness/Veterans Homelessness Steve Delmartini, representing San Luis Obispo Realty, San Luis Obispo, spoke in support of funding infrastructure improvements to help encourage the development of workforce housing. Jeff Eckles, representing Homebuilders Association of the Central Coast, conveyed support for the development of workforce housing. Amber Johnson, representing the Chamber of Chamber Economic Committee, San Luis Obispo, spoke in support of funding infrastructure improvements to help support the development of housing. Jerry Rioux, representing San Luis Obispo County Housing Trust Fund, Nipomo, spoke to the need for creating affordable housing and housing for the homeless via the implementation of the City’s Housing Element. Donna Lewis, representing the Chamber of Commerce, San Luis Obispo County, stressed the need for increasing the available housing stock in San Luis Obispo. Ron Yukelson, representing Sierra Vista Medical Center, San Luis Obispo, voiced support for developing a diverse housing stock to help businesses retain quality employees. C2-4 San Luis Obispo City Council Minutes of January 13, 2015 Page 3 Biz Steinberg, Executive Director of Community Action Partnership, member of Housing Authority of San Luis Obispo, San Luis Obispo, addressed the importance of completing the Homeless Service Center and diversifying the City housing stock. Dana Cummings, Veteran, spoke on the need to improve homeless veteran services, noting the importance of housing. Robert Bettencourt, American Legion Post 66, San Luis Obispo, stressed the importance of taking action to provide more housing for the veteran homeless and the chronically homeless. Camille Small, San Luis Obispo, spoke in support prioritizing restoration of Laguna Lake and the creation of affordable housing options for students, veterans, and the workforce. Bicycle and Pedestrian Infrastructure Jim Woolf, Bicycle Advisory Committee, San Luis Obispo, spoke in support of bicycle and pedestrian projects, including the Railroad Safety Trail and Bob Jones Trail. Marty Rippens, San Luis Obispo, spoke to the need to address speeding motorists and pedestrian safety improvements on Ferrini Road, Broad Street, and the Foothill Boulevard corridor. Lea Brooks, representing SLO County Bicycle Coalition, San Luis Obispo, addressed the need for developing additional bicycle boulevards to help enhance bicyclist safety. Ken Kienow, San Luis Obispo, opined that the City should decrease the lease costs for the San Luis Obispo County Bicycle Coalition; voiced support for additional buffered bike lanes and improving bicycle safety for children. Karen Aydelott, friends of Bob Jones Trail Steering Committee, San Luis Obispo, spoke the future improvements for the Bob Jones Trail, including the trail head at the Octagon Barn. Myron Amerine, San Luis Obispo, voiced support for a Capital Improvement Project for the rehabilitation of infrastructure in the Palm Street corridor. Odile Ayral, San Luis Obispo, spoke to the need to address traffic and pedestrian safety issues on Ferrini Road. Lighted Tennis Courts at Sinsheimer Park Scott Cleere, San Luis Obispo, advised that a 137 individuals signed a petition in support of providing lighted tennis courts at Sinsheimer Park. Eddy Rodriguez, Morro Bay, urged the Council to move forward with providing lighted tennis courts at Sinsheimer Park. C2-5 San Luis Obispo City Council Minutes of January 13, 2015 Page 4 Community Choice Aggregation/Clean Energy Eric Veinm, representing SLO Clean Energy, San Luis Obispo, spoke in support of creating a clean energy district and moving forward with a Community Choice Aggregation (CCA) program. Rosh Wright, San Luis Obispo, voiced support for a CCA and the need for more local control of energy issues. Eric Meyer, San Luis Obispo, opined that SLO Clean Energy and CCA will help generate jobs. Andy Pease, San Luis Obispo, spoke in support of implementing the City’s Climate Action Plan and addressing solid waste and recycling issues. Neighborhood Wellness Linda White, San Luis Obispo, thanked Council and staff for their work on neighborhood wellness; opined that Cal Poly needs to take responsibility for housing students on campus. Karen Adler, representing the Alta Vista neighborhood, San Luis Obispo, spoke in support of prioritizing neighborhood wellness; opined that there is a need for more than two neighborhood specialists. Sharon Whitney, representing Residents for Quality Neighborhoods, San Luis Obispo, voiced support for prioritizing neighborhood wellness, with a focus on addressing noise issues. Allan Cooper, member of Save our Downtown, San Luis Obispo, spoke in support of a pedestrian plan; spoke to the large number of restaurants that are serving alcohol. Les Beck, San Luis Obispo, spoke on his experience of pedestrian-generated noise problems in the Palm Street neighborhood and the needs for prioritizing neighborhood wellness. INFRASTRUCTURE FUNDING Erik Justesen, San Luis Obispo, spoke to the importance of creating an Infrastructure Investment Fund and the development of “backbone” infrastructure. Victor Montgomery, Avila Beach, voiced support for establishing an Infrastructure Investment Fund and partnering with Chevron for rehabilitation of the Tank Farm site. Bill Almas, representing Chevron, San Luis Obispo, spoke on the high cost to develop infrastructure improvements associated with the Tank Farm remediation project; urged Council to prioritize infrastructure funding toward the Tank Farm corridor. Dan Blandford, representing Chamber of Commerce Economic Development Committee and Economic Vitality Corporation (EVC), San Luis Obispo, spoke in support of infrastructure improvements which support workforce housing and the construction of higher density housing in the southern part of San Luis Obispo. C2-6 San Luis Obispo City Council Minutes of January 13, 2015 Page 5 Mila Vujovich-LaBarre, San Luis Obispo, noted concerns about the Land Use and Circulation Elements and conveyed support of funding mental health and homeless services and recreation infrastructure. Benefit and Pension Costs Bob Stets, representing the Chamber of Commerce, San Luis Obispo, voiced support for controlling benefit costs and unfunded pension liabilities. Barry Vanderklen, San Luis Obispo, urged Council to minimize personnel costs and pay down unfunded pension liabilities. Pickle Ball Jean Hyduchak, San Luis Obispo, voiced support for the establishment of pickle ball amenities at City parks. Tom Freeman, San Luis Obispo, spoke on his experience playing pickle ball and encouraged Council to allow for pickle ball at City parks. BMX Bikes at Santa Rosa Park Alex Raban, San Luis Obispo, voiced support for allowing BMX bikes at Santa Rosa park. La Loma Adobe Greg Morris, representing Friends of La Loma Adobe, Avila Beach, voiced support for the restoration, preservation and use of the La Loma Adobe. Individual Topics Pierre Rademaker, San Luis Obispo, spoke to the need for the City to support the Police Department in dealing with the behavior of transients in the downtown and the update of local design and economic plans. Joan Drake, San Luis Obispo, voiced support for making Senior Center programs a priority. William Ostrander, member of Citizens Congress, voiced support for enacting publicly-funded elections and stronger disclosure laws. David Juhnke, San Luis Obispo, voiced support for obtaining needed infrastructure funding and paying down pension debt. Leslie Halls, San Luis Obispo, spoke in opposition to a special assessment district for Laguna Lake and the rental inspection program; urged Council to make pension reform a major goal. C2-7 San Luis Obispo City Council Minutes of January 13, 2015 Page 6 Lisa Myrick, San Luis Obispo, stated that the she is a “casualty of the South Street expansion project.” Adam Stowe, San Luis Obispo, spoke in support of promoting a healthy and active community, including increasing baseball programs. Rosemary Wilvert, San Luis Obispo, spoke in support of removing billboards from open space areas. Don Hedrick, San Luis Obispo, opined that the government is taking away citizen rights. Michelle Tasseff, San Luis Obispo, spoke in support of prioritizing programs that support public safety personnel and the waste water treatment plant. David Brodie, San Luis Obispo, voiced support for making downtown a social and cultural center that supports businesses. Ron Batterson, representing the Jack House Committee, San Luis Obispo, spoke on the need to remove the house’s wooden elevator shaft and restore its bay window, which would require 50% City funding. ROLL CALL Council Members Present: Council Members Dan Carpenter, Carlyn Christianson, Dan Rivoire, Vice Mayor John Ashbaugh, and Mayor Jan Marx. Council Members Absent: None City Staff Present: Katie Lichtig, City Manager, Christine Dietrick, City Attorney, Michael Codron, Assistant City Manager, and Anthony Mejia, City Clerk, were present at Roll Call. PUBLIC COMMENT Julie Cox, representing the Area Agency on Aging, announced upcoming community meetings in San Luis Obispo and Paso Robles for federal funding for senior citizens and caregivers; noted the availability of the Senior Resource Guide. Odile Ayral, San Luis Obispo, commented on the circumstances surrounding the hiring of Jason Stilwell, opining that Mr. Stilwell was controversial in the City of Carmel and should not have been hired by the City. Linda White, San Luis Obispo, inquired whether Stilwell is being paid with Measure G funds. Steve Delmartini, San Luis Obispo, noted that he is a real estate agent; voiced support for the creation of an Infrastructure Investment Fund to help support the funding of infrastructure improvements and spurring of workforce housing development. Donald Hedrick, San Luis Obispo, voiced concern that the government is not protecting citizen rights. C2-9 San Luis Obispo City Council Minutes of January 20, 2015 Page 2 Lisa Myrick, San Luis Obispo, made general comments and recited the Pledge of Allegiance. Steve Barasch, San Luis Obispo, stressed the importance of addressing the City’s unfunded pension liabilities and distributed written materials from CalPERS. A hard copy of Mr. Barasch’s handout is on file with the City. Matt Kokkonen, San Luis Obispo, voiced objection to the hiring of additional staff for a rental housing inspection program; opined that the City should focus attention on paying down its unfunded pension liabilities. Leslie Halls, San Luis Obispo, urged Council to prioritize the pay down of the City’s unfunded pension liabilities; thanked Council for building the new skate park. In response to public comment, City Manager Lichtig encouraged the community to attend the Skate Park Grand Opening on February 28, 2015; summarized the qualifications of Mr. Stilwell and outlined the terms of his contract. CONSENT AGENDA Donald Hedrick, San Luis Obispo, opined that adoption of ordinances should be agendized as a Business Items. Toni Kincaid, San Luis Obispo, urged Council to approve Item C2 related to the acceptance of a Jack House wallcovering donation. MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5-0, to approve Consent Calendar Items C1 through C8, with Council Member Carpenter registering his recusal from Item C4 and voting “No” on Item C8. C1. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5-0, to waive reading of all resolutions and ordinances as appropriate. TRAFFIC SIGNAL MANAGEMENT SYSTEM UPDATE MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5-0, to award a sole source purchase order to McCain for upgrading the City’s Traffic Signal Management System, not to exceed $160,000 in State Highway Account (SHA) grant funds. C8. ORDINANCE NO. 1611 (SECOND READING) – ADOPTION OF AN ORDINANCE ALLOWING OWNER-OCCUPIED HOMESTAY RENTALS MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 4-1 (COUNCIL MEMBER CARPENTER VOTING NO), to adopt Ordinance No. 1611 (2015 Series) entitled “An Ordinance of the City Council of the City of San Luis Obispo, California, amending Title 17 (Zoning Regulations) of the Municipal Code regarding Homestay Rentals and approving the Negative Declaration of Environmental Impact (CODE 0058-2014).” (Intro. on 01/06/2015) PUBLIC HEARING PH1. CITY OF SAN LUIS OBISPO HOUSING ELEMENT UPDATE (GPI/ER 15-14) - RESOLUTION Community Development Director Johnson and Housing Programs Manager Corey narrated a presentation entitled “Housing Element Update” and responded to Council inquiries. Mayor Marx opened the public hearing. Scott Smith, San Luis Obispo Housing Authority Executive Director, voiced support for the proposed Housing Element update, noting the importance of affordable housing incentives and developing smaller housing units. Jerry Rioux, San Luis Obispo County Housing Trust Fund, urged the Council to adopt the proposed Housing Element update; commended staff's efforts to move forward with projects that support housing for persons with special needs. Steve Delmartini, San Luis Obispo, voiced support for adopting the Housing Element; noted the lack of diverse housing currently available and the relative difficulty of developing affordable housing. Steve Barasch, San Luis Obispo, suggested that the City address its development impact fees, noting that such fees impact the affordability of new housing units. Don Hedrick, San Luis Obispo, opined that Cal Poly should better utilize campus property for student housing to reduce the demand on affordable housing. Charlene Rosales, Chamber of Commerce, voiced support for adoption of Housing Element update as presented, noting its emphasis on a diverse housing stock. C2-12 San Luis Obispo City Council Minutes of January 20, 2015 Page 5 Lisa Myrick, San Luis Obispo, spoke about her disabilities; stated that she used to have quality housing but no longer does. Mila Vujovich-LaBarre, San Luis Obispo, opined that San Luis Ranch could be used for student housing via a land swap with Cal Poly. There being no others desiring to speak on this item, the public hearing was closed. In response to public comment, Community Development Director Johnson stated that it is difficult to influence housing supply and demand via General Plan Policy changes, but that the programs presented can increase certain types of housing stock. In response to Council comment, Johnson clarified that City staff cannot waive impact fees, but that other financing options can be considered. Following discussion, MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 4-1 (COUNCIL MEMBER CARPENTER VOTING NO), to: 1. Adopt Resolution No. 10594 (2015 Series) entitled “A Resolution of the City Council of the City Of San Luis Obispo Approving a Negative Declaration of Environmental Impact and Amendments to the Housing Element of the General Plan (GPI /ER 15 - 14)” with the amendment that Program 1.6 shall be retained, and its language revised to read as follows: a. “Consider a Rental Inspection Program to improve the condition of the City’s housing stock.” 2. Adopt a Negative Declaration of Environmental Impact related to the Housing Element of the General Plan. RECESS Council recessed at 7:51 p.m. and reconvened at 8:06 p.m., with all Council Members present. BUSINESS ITEM B1. HOMELESS SERVICES CENTER DESIGN AND CONSTRUCTION GRANT Community Development Director Johnson and Special Projects Manager Hermann narrated a presentation entitled “Homeless Services Center Grant” and responded to Council inquiries. Lauri Sweeny, San Luis Obispo, conveyed support for approving the grant and moving forward with the Homeless Services Center. Scott Smith, San Luis Obispo Housing Authority Executive Director, urged Council to approve the grant for the homeless services center design and construction. C2-13 San Luis Obispo City Council Minutes of January 20, 2015 Page 6 Jerry Rioux, San Luis Obispo County Housing Trust Fund, spoke in support of the proposed grant and thanked Council for its support in addressing housing needs. Roy Rawlings, President of Friends of Prado Day Center, San Luis Obispo, voiced support for the homeless services center and urged Council to move forward. John Spatafore, San Luis Obispo, spoke on the variety of services which will be available at the new homeless services center. Jim Famalette, Community Action Partnership of San Luis Obispo (CAPSLO), spoke on the proposed use of the grant funding and the future fundraising efforts for the homeless services center. Charlene Rosales, representing the Chamber of Commerce, voiced support for providing the grant funds for the design and construction of the homeless service center. Dave Cox, Homeless Foundation Board Member, San Luis Obispo, urged Council to support the grant for the homeless service center. Michelle Tasseff, San Luis Obispo, encouraged Council to move forward with the proposed grant; voiced concerns regarding the shelter’s size and proposed staffing levels. Mayor Marx and Vice Mayor Ashbaugh reported on their City-paid travel to Sacramento for attendance at the League of California Cities Revenue and Taxation Committee meeting and Environmental Quality Committee meeting, respectively. Mayor Marx noted that former Mayor Dave Romero was named Citizen of the Year by the Chamber of Commerce.
