HomeMy WebLinkAboutA36-040—91oay ogba-G I AGREEMENT ~~ THIS AGREEMENT is made and entered into in the CITY of San Luis Obispo on this /~ day of .Itt ,2004 by and between the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafte r referred to as CITY, and THE SAN LUIS OBISPO COUNTY ARCHAEOLOGICAL SOCIETY (SLOCAS). WITNESSETH : WHEREAS, CITY desires to curate the 2003 Downtown Utility Pipeline Replacement project artifacts in a prope r storage environment that provides suitable community access to the collection ; and WHEREAS, SLOCAS has as part of its mission to promote conservation of archaeological sites, records an d collections ; an d WHEREAS, SLOCAS is qualified to provide this service at its Research and Collections Facility, located i n Buildings 1522 and 1523 on Camp San Luis Obispo ; and NOW THEREFORE, in consideration of their mutual promises, obligations, and covenants hereinafter contained , the parties hereto agree as follows : I . TERM . The term of this Agreement shall be from the date this Agreement is made and entered, as firs t written above, and shall continue in perpetuity . 2 . CITY'S OBLIGATIONS .For providing services as specified in this Agreement, CITY will pay, an d SLOCAS shall receive therefore, $700 .00/standard archive box (10"x 12" x15 "with weight not to exceed 40 lbs per box). CITY will deed 2003 Downtown Utility Pipeline Replacement project artifacts the to SLOCAS as specified in the attached Deed of Gift (Exhibit A). The collection includes all artifacts and the catalogue . Any available supportin g documentation such as field records, photographs, and maps shall be organized and submitted with the artifacts along wit h the final reports . The collection will be submitted to SLOCAS following their curation guidelines . CITY reserves the right to borrow artifacts from the 2003 Downtown Utility Pipeline Replacement project artifact s under the following conditions : a.CITY will submit a written request to borrow specimens for public exhibit and will include : a list or description of the items needed ; the purpose and location of the display ; the duration of use ; and the nam e of the CITY staff member(s) that will be responsible for the materials . b.Loaned collection materials will be handled, stored, and exhibited in a safe manner and protected fro m breakage, theft, and other adverse conditions such as excessive heat or moisture, insects, and rodents . c.There will be no charge to CITY for SLOCAS staff time unless the loan request requires an unusua l amount of preparation and packaging time, in which case established staff fees will be assessed . d.Copying, packing, shipping, insurance, or other transport costs will be paid by CITY . e.CITY will sign an inventory and agreement form prior to release of the artifacts, and will be responsibl e for the safe return of all items listed . McCluskey, Director of Public Work s Prepared By : Barbara Lynch Civil Engineer SUBJECT : DEED OF GIFT FOR DOWNTOWN ARTIFACT S CAO RECOMMENDATIO N 1.Approve the Deed of Gift to the San Luis Obispo County Archaeological Society for th e significant artifacts resulting from the Downtown Utility Pipeline Installation Projects , Specification No .s 90240 and 90261 . 2.Authorize the Mayor to sign the Deed of Gift DISCUSSIO N The City has been replacing utility lines in the downtown for the past several months . That work is largely completed now . For the duration of the excavation work, an archeological monito r was present at the work site to determine if artifacts or previously unidentified archeological site s were present in the work zone . As a result of that monitoring work, numerous artifacts wer e found. The archeologists have recommended a number of pieces be permanently retained in a curation facility to provide information to researchers . The cannon and partial cannon will not be part of the curation materials with SLOCAS . Staff is looking into possible public displa y locations with the assistance of the Cultural Heritage Commission . As a part of the curation process, staff recommends that the artifacts be deeded by way of gift t o San Luis Obispo County Archeaological Society (SLOCAS), which is the common practic e when archiving occurs . If the City were to choose to retain ownership of the collection, fee s would shift to a recurring annual charge per box that would result in a substantially higher cost t o the City over the years . The City has previously made a gifts of artifacts found durin g construction to the SLOCAS curation facility . Doing this makes the material readily available , along with other local finds for individuals doing research and study . Staff is recommending tha t we continue our practice of using the SLOCAS facility for the artifacts from the recen t downtown pipeline project . CONCURRENCE S Community Development concurs with the use of the SLOCAS facility to archive the materials . FISCAL IMPAC T The volume of material the archeologist is recommending for permanent storage will fill tw o boxes .
