HomeMy WebLinkAboutBarnett Cox Associates Amend 2, AMENDMENT TO AGREEMENT NO.2 THIS AMENDMENT TO AGREEMENT is made and entered in the City of San Luis Obispo on November , 2008, by and between the CITY OF SAN LUIS OBISPO, a municipal corporation, herein after referred to as City, and Barnett, Cox and Associates, hereinafter referred to as Contractor. WITNESSETH: WHEREAS, on November 30, 2006 the City entered into an Agreement with Contractor for community education and outreach services per Specification No. 90665; and WHEREAS, per the terms of the Agreement, the City desires to extend the Agreement for one additional year; NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained, the parties hereto agree as follows: 1. Section 1. "Term", is modified as follows: • The term of this Agreement shall be from the date this Agreement is made and entered, as first written above, and is extended until November 30, 2009. 2. SECTION 3. "City's Obligation" is modified as follows: • "total sum not to exceed $67,500 for the contract extension period". 3. All other terms and conditions of the Agreement remain in full force and effect. RECOMMENDATION: Approve an Amendment to the Contract with Barnett, Cox and Associate (BC&A) extending the contract for one additional year for Community Information and Outreach Services not to exceed $67,500. DISCUSSION: In September 2006 the City Council approved a Request for Proposals (RFP) for the Community Information and Outreach Program for the Utilities Conservation Office's programs and authorized staff to advertise for proposals. As part of the approval, the Council authorized the City Manager to award the contract to the most responsive proposer. The contract was awarded to BC&A for a one year term with the option for the City to extend the contract for up to two one year tenns upon agreement by both parties. Last year staff recommended and the City Manager approved the first one year extension. Staff is now recommending the contract be extended for the second one year term, which BC&A has verbally agreed to. The approved 2008-09 Utilities Conservation Office budget identifies $67,500 for this activity. FISCAL IMPACT: There is $67,500 in the consulting services line item in the approved 2008-2009 Utilities Conservation Office operating budget identified for this activity. Attachments: 1.
