HomeMy WebLinkAbout03-17-2015 C5 Subdivision Improvements for Tract 3011 - 301 PradoCity of San Luis Obispo, Council Agenda Report, Meeting Date, Item Number FROM: Derek Johnson, Community Development Director Prepared By: Hal Hannula, Supervising Civil Engineer Diane Dostalek, Engineering Consultant SUBJECT: ACCEPTANCE OF SUBDIVISION IMPROVEMENTS FOR TRACT 3011 PHASE 1, 301 PRADO (FORMERLY 400 PRADO) (TR 112-07) RECOMMENDATION Adopt a resolution accepting the public improvements, certifying completion of the required private subdivision improvements, and releasing the securities for Tract 3011 Phase 1 at 301 Prado Road. DISCUSSION Background Tract 3011 (TR 112-07) is located at 301 Prado Road (Attachment 1). A vesting tentative map for Tract 3011 was approved by the City Council on November 3, 2009, by Resolution No. 10124 (2009 Series). The vesting tentative map approved a six-lot subdivision, including five commercial lots, one open space lot, and provisions for air space condominium ownership of spaces within the project buildings. In order to accommodate a regional drainage basin to serve the Serra Meadows subdivisions on the north side of Prado Road (Tracts 2342 and 2353) along with other future users, the Community Development Director on April 21, 2014, pursuant to Section 16.10.160 of the Municipal Code, approved a modification to the Tract 3011 tentative map to accommodate phasing and the addition of an extra open space lot for the basin. The Phase 1 final map (Attachment 2) was approved by Council on June 10, 2014, by Resolution No. 10529 (2014 Series). The Phase 1 final map created one lot for the regional drainage basin and one Remainder lot for the future development of the rest of the subdivision. Accepting the Public Improvements and Certifying Completion of Private Improvements Public improvements for Tract 3011 include minor street widening and installation of approximately 150’ of curb, gutter, and sidewalk along the basin frontage, plus one drive approach to access the basin for maintenance purposes. The private improvements include the frontage landscaping along the basin. The basin, which is privately maintained, was recently certified complete by the Council on March 3, 2015. Maintenance of the basin and the frontage landscaping are set forth in the CC&R’s for the Serra Meadows Homeowner’s Association, the Serra Meadows Business Park Association, and shared private maintenance agreements. The subdivider recently requested final acceptance of the Tract 3011 Phase 1 subdivision improvements by the City and release of the respective securities. The subdivision improvements, as required in the Subdivision Agreement for Tract 3011 Phase 1, have been completed and inspected to the satisfaction of the City, except for the setting of survey monuments. The Subdivision Agreement authorizes release of the Faithful Performance and Labor & Materials securities upon Council’s acceptance of the subdivision improvements and receipt of a guarantee of ten percent of the cost of the subdivision improvements. The ten- percent guarantee is to insure that the subdivider will remedy any defects in the improvements arising from faulty workmanship or materials or defective construction of said improvements for a period of one year. The total cost of the Tract 3011 Phase 1 subdivision improvements was 3/17/2015 C5 C5-1 ACCEPTANCE OF SUBDIVISION IMPROVEMENTS FOR TRACT 3011 PHASE 1, 301 PRADO (FORMERLY 400 PRADO) (TR 112-07) Page 2 estimated to be $50,000. Therefore, a $5,000 security will be retained for the ten-percent warranty amount. The monumentation bond will continue to be held by the City until the monuments have been set. A draft resolution Accepting and Certifying Completion of the Subdivision Improvements is attached (Attachment 3). This resolution authorizes the Public Works Director to release the monumentation bond and the warranty security upon satisfactory completion of the one-year warranty periods. CONCURRENCES The Public Works Department and Utilities Department concur with the recommended action. ENVIRONMENTAL REVIEW The necessary findings and environmental review requirements related to the development of Tract 3011 were made with the tentative map approval. Therefore, no further environmental review is required. FISCAL IMPACT The public improvements constructed with Tract 3011 will result in a minor increase in maintenance costs for the streets improvements. At this time, the Public Works Department Streets Division will not need additional resources to maintain this new public infrastructure. However, cumulative increases in infrastructure eventually require additional resources to maintain. When required, these additional resources would be requested as part of the Financial Plan process, consistent with City policy. Nonetheless, a fiscal analysis of the Margarita Area Specific Plan area demonstrated that sufficient revenues would be provided on a per capita basis to fund the incremental increases in service costs to the City of San Luis Obispo. ALTERNATIVES Do not accept the public improvements for Tract 3011 Phase 1. If some of the required subdivision improvements for Tract 3011 Phase 1 have not been completed, then Council can continue this item until such time as the improvements have been completed to the satisfaction of the City. Staff does not recommend this alternative because all of the subdivision improvements for Tract 3011 Phase 1 have been completed in accordance with the approved plans and specifications and modifications thereof. (2015 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ACCEPTING THE PUBLIC IMPROVEMENTS AND CERTIFYING COMPLETION OF THE PRIVATE IMPROVEMENTS FOR TRACT 3011 PHASE 1 (301 PRADO ROAD, TR 112-07) WHEREAS, the City Council made certain findings concerning Tract 3011, as prescribed in Resolution No. 10124 (2009 Series); and WHEREAS, the City Council approved the final map for Tract 3011 Phase 1 per Resolution No. 10529 (2014 Series); and WHEREAS, with the exception of setting the monuments, the subdivider has satisfactorily completed the public improvements for Tract 3011 Phase 1, in accordance with City standards and specifications and has requested acceptance of the public improvements for maintenance and operation by the City; and WHEREAS, the subdivider has satisfactorily completed the private improvements for Tract 3011 Phase 1, in accordance with City standards, specifications and the approved plans, and has requested that the City certify completion of these private improvements. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The above recitals are true and correct and incorporated herein by this reference. SECTION 2. The City Council hereby accepts the public improvements for Tract 3011 Phase 1. SECTION 3. The City Council hereby certifies completion of the private improvements for Tract 3011 Phase 1. SECTION 4. The Faithful Performance and Labor & Materials securities may be released upon submittal of a security or securities totaling $5,000, which is ten percent of the cost of the total subdivision improvements, as required in the approved Subdivision Agreement for Tract 3011 Phase 1. SECTION 5. The Public Works Director is hereby authorized to release said $5,000 security upon completion of the one-year warranty period to the satisfaction of the City, as required in the Subdivision Agreement for Tract 3011 Phase 1. SECTION 6. The Public Works Director is hereby authorized to release the monumentation security upon setting of the monuments to the satisfaction of the City, as required on the final map and in the Subdivision Agreement for Tract 3011 Phase 1.
