RECOMMENDATIONS
1. Award a contract to Newton Construction & Management Inc. in the amount of $127,800 for
the “Sinsheimer Stadium Stairs Replacement, Specification No. 91255”.
2. Approve a transfer of $21,000 from the Santa Rosa Skate Park construction management
account to the project construction account.
DISCUSSION
On December 16, 2014, the City Council authorized inviting bids for the Sinsheimer Stadium Stairs
Replacement, Specification Number 91255, a Measure Y funded project (Attachment 1). Five bids
were opened on February 26, 2015 and Pacific Builders was the lowest bidder with a proposal of
$123,742. This amount is higher than the Engineer’s Estimate of $110,000. On February 27, 2015,
the City received a bid protest (Attachment 2) from Newton Construction & Management, the
second lowest bidder, contesting the responsiveness of Pacific Builder’s bid. Upon review, staff
determined that Pacific Builders’ bid was non-responsive due to failure to provide documentation
that Pacific Builders and their subcontractors were registered with the Department of Industrial
Relations. City specifications are clear that such documentation is a requirement for this project.
The second lowest bidder was Newton Construction & Management Inc. of San Luis Obispo with a
proposal of $127,800. Their bid package contained the required documentation of registration with
the Department of Industrial Relations and was otherwise a fully responsive bid.

CONCURRENCES
The project has the concurrence of the Parks & Recreation Department.
FISCAL IMPACT
The 2013-15 Financial Plan, Appendix B, pages 3-390 to 3-392, identifies $20,000 for design,
$105,000 for construction, along with $15,000 for construction management. The construction
management and the remaining design funds will be transferred into the construction phase at the
time of bid award for the project, for a total construction budget of $126,951.
A transfer of $21,000 from the construction management account of the Santa Rosa Skate Park
project into the project construction account will fully fund the construction contract and adjust

the construction contingency amount to maintain 10% of the construction cost. Currently the
Santa Rosa Skate Park, also a Measure Y project, has $73,030 additional funding in the
construction management account, as construction management was performed by City staff. A
transfer of $21,000 will leave $52,030 in the construction management account if needed for
final completion of the Skate Park.
This project is fully funded by Measure Y, the local half-percent sales tax.

ALTERNATIVES
Deny approval to award. The City Manager could choose to deny or defer the approval for
award of this project. Staff does not recommend this option. Should this be denied or deferred,
replacement of the stairs would be delayed. The existing steel staircase would continue to
deteriorate with the possibility of the stairs being closed for use by the baseball organizations
using the stadium. Since the stadium is a facility that the City charges a fee for use, the facility
should be maintained in a reasonable state of usability.

RECOMMENDATIONS
1.Approve plans and specifications for “Sinsheimer Stadium Stairs Replacement, Specification
No. 91255”.
2.Authorize staff to advertise for bids and authorize the City Manager to award the contract if
the lowest responsible bidder is within the Engineer’s Estimate of $109,000.
3.Approve the transfer of $7,732 from the project’s design account and $15,000 from the
construction management account to the construction account at the time of bid award.
DISCUSSION
The easterly stairs leading to the field at Sinsheimer Baseball Stadium was built in the mid-
1970’s. These stairs have primarily served as access to the field area for the players and
occasionally for the public during special events. Unlike the concrete stairs on the north side of
the stadium, this stairway is of steel fabrication with concrete treads.
Over forty years of use have left the stairs in a poor condition. Most of the concrete treads are
missing portions of concrete or have been patched. The steel nosings on the treads have worn
smooth from use and create a slippery condition on the stairs. The ground at the top landing to
the stairs has sunk, resulting in a wide gap and vertical displacement between the landing and the
stairs. This gap has been patched over but requires constant maintenance.
This project will replace the existing steel staircase with a cast-in-place concrete stairs that is
fully compliant with the Americans with Disabilities Act (ADA). The treads and nosings will be
entirely covered with a metal plate embedded with slip-resistant material to handle the cleats of
the baseball player’s shoes. The railing will be replaced with new steel railing compliant with
current building codes. Also, the design will provide for level and connected landings at the top
and bottom of the staircase.
CONCURRENCES
This project has the concurrence of the Community Development Department with building
permits pending approval. Construction of an ADA ramp was not required due to this project
being an ADA upgrade to existing facilities.

construction schedule allows for staff inspection and negates the need for consultant services for
construction management. A transfer of the $15,000 from construction management and the

AGREEMENT
THIS AGREEMENT, made on this ______ day of ___________, 2015, by and between the City of San Luis
Obispo, a municipal corporation and charter city, San Luis Obispo County, California (hereinafter called the
Owner) and NEWTON CONSTRUCTION & MANAGEMENT INC., (hereinafter called the Contractor).
WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to be performed, shall
provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and
transportation services required to complete all the work of construction of
SINSHEIMER STADIUM STAIRS REPLACEMENT, SPECIFICATION NO. 91255
in strict compliance with the plans and specifications therefor, including any and all Addenda, adopted by
the Owner, in strict compliance with the Contract Documents hereinafter enumerated.
It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work
performed and completed under the direction and supervision and subject to the approval of the Owner or its
authorized representatives.
ARTICLE II, CONTRACT PRICE: The Owner shall pay the Contractor as full consideration for the faithful
performance of this Contract, subject to any additions or deductions as provided in the Contract Documents,
the contract prices as follows:

Payments are to be made to the Contractor in compliance with and subject to the provisions embodied in
the documents made a part of this Contract.
Should any dispute arise respecting the true value of any work omitted, or of any extra work which the
Contractor may be required to do, or respecting the size of any payment to the Contractor, during the
performance of this Contract, said dispute shall be decided by the Owner and its decision shall be final, and
conclusive.
ARTICLE III, COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the following
documents, all of which are as fully a part thereof as if herein set out in full, and if not attached, as if hereto
attached:

ARTICLE IV. It is further expressly agreed by and between the parties hereto that should there be any
conflict between the terms of this instrument and the bid of said Contractor, then this instrument shall control
and nothing herein shall be considered as an acceptance of the said terms of said bid conflicting herewith.
