Adopt Draft Resolution "A," approving the lot line adjustment map including minor exceptions to
the Subdivision Regulations,based on required findings and subject to conditions.
DISCUSSION
Situation
The City has received an application for a lot line adjustment (LLA) map on a 2.23-acre site
located between South, Lawton, Meadow and Funston Streets (see Attachment 1). This property
consists of portions of 14 existing lots of record created in 1901 (Lots 1 through 14 of Block 2 of
Norton's addition to the City of San Luis Obispo). These lots range in size from 3,750 to 7,500
square feet and are presently developed with a church, parking lot and a.single-family residence.
The owners, Church of Christ, Inc. would like to consolidate and reconfigure the 14 existing lots
into seven lots ranging in size from 6,000 to 60,000 square feet to allow for expansion of the
church facilities and the construction of five new residences.
Typically, lot line adjustments are reviewed at the administrative level without a public hearing.
This application is being referred to the City Council because it involves exceptions to the
Subdivision Regulations. Specifically, the applicant is asking the Council to approve the lot line
adjustment map with exceptions to lot size and width for two comer lots. Attachment 2 is a copy
of the preliminary Lot Line Adjustment map. The Council can approve the request if it finds the
adjustment complies with City Zoning and Building Regulations, including Subdivision
Regulations.

Site Description
The site is a rectangular-shaped parcel consisting of approximately 2.23 acres and 14 underlying
lots (two of which are non-conforming). Bordered by public streets on all four sides, the site is
developed with a church, parking lot and single-family residence. The site is ful yimproved with
public utilities and services.
Surrounding uses include single-family residences, a public park (Meadow Park) and a gas
station/convenience market(under-construction).
Project Description/RequestedExceptions
Since the site is zoned R-1,the parcels resulting from the lot line adjustment must comply with the
minimum lot area and dimension standards for that zone as specified in the City's Subdivision
Regulations. Those standards include: a minimum lot area of 6,000 square feet (sq.ft,)for interior
lots and 6,900 sq.ft. for comer lots, a minimum lot width of 50 feet for interior lots and 60 feet for
corner lots,a minimum lot depth of 90 feet,and a 3-to-1 depth-width ratio.
The proposed lot line adjustment requires approval of an exception to the size and width
standards for two corner lots. As shown in Table 1, all but two of the lots meet the minimum lot
size and dimension standards—Lots 4 and 7. Lot 4 would be 6,120 square feet in area and 51 feet
wide. Lot 7 would be 6,656 square feet in area and 64 feet wide. As designed,Lot 4 requires an
exception for both lot.size and width. Lot 7 requires an exception to lot width only.

Evaluation
Staff has identified two issues with this project--neighborhood compatibility and consistency
with City policies and standards. These issues are discussed in the following paragraphs.
1. Neighborhood Compatibility
The project site is on the edge of an established single-family residential neighborhood between
South Street, Broad Street, Lawrence Drive and Meadow Street. The applicant submitted two
surveys of the surrounding parcel sizes. The first survey (Attachment 3) shows that most of the
lots are over 6,000 square feet in size and 50 feet in width. The second survey (Attachment 4)
shows that a majority of the existing corner lots (24 out of 39) are less than 6,900 square feet in
area (the current standard). An older neighborhood, this area was developed prior to adoption of
the wider corner requirements. Based on this information, staff finds that the proposed size and
shape of the corner lots are consistent with existing corner lots in the neighborhood.
2. Consistency with City Policies and Standards
In order to approve an exception to the Subdivision Regulations the City Council must make four
specific findings (SLOMC 16.48.020), as follows:
A) That the property to be divided (adjusted) is of such size or shape, or is affected by such
topographic conditions, that it is impossible, impractical or undesirable, in the particular
case, to conform to the strict application of the regulations codified in this title.
While the site is not affected by severe topographic conditions, it is constrained by the
location of the existing church, parking lot and residential structure. Specifically, the
siting of the existing house and church makes it impractical and undesirable to conform
to the strict application of the regulations. The house would either have to be moved,
demolished or modified (i.e., a portion cut-ofd to provide corner lots that meet the
-minimum standards for area and width_. The house could, however; be saved by
eliminating one lot, creating oversized corner lots and deeper interior lots. For
example, the lot at the corner of Meadow and Funston would need to be 80'x116'
(9,280 square feet) and the interior lots 50'X]16 However, the deeper lots would
conflict with the driveway and the planned church expansion. The proposed adjustment
would consolidate the 14 existing lots into seven lots to allow for residential
development consistent with the surrounding properties and accommodated the
planned church expansion.
B) That the cost to the subdivider of strict or literal compliance with the regulations is not
the sole reason for granting the modification.
Although the applicant believes that requiring strict or literal compliance with the
regulations would create a financial burden on the property owner, cost is not the sole
reason for granting the modification. The proposed exception will not reduce any costs

to the applicant of developing the property. Also see discussion on item "D. "
C) That the modification will not be detrimental to the public health, safety and welfare, or
be injurious to other properties in the vicinity.
With the requested exceptions, the resulting parcels will be consistent with the lot area
and dimensions of other properties in the surrounding area. A survey of surrounding
parcel sizes shows that many of the corner lots in the vicinity do not meet the minimum
area and width standards (see Attachment 3). The smaller corner lots will not create
visibility problems because future construction would have to comply with the required
yard requirements and street curve standards. Therefore,granting this modification will
not be detrimental to the public health, safety and welfare or injurious to other properties
in the vicinity.
D) That granting the modification is in accord with the intent and purposes of these
regulations, and is consistent with the general plan and with all applicable specific plans
or other plans of the City.
The exception is in accord with the regulations because the corner lots will be
consistent with surrounding developments and allow for the installation of a street
curve radius that conforms to current City standards. The proposed exception may be
considered consistent with General Plan goals and policies relating to conservation of
existing housing, development and retention of housing on sites that are suitable for
that purpose, and the provision of a wide variety of housing in the City. Land Use
Element goals and policies encourage a new development within existing
neighborhoods to be compatible in scale and character with the neighborhood.
Housing Element (HE)policies state that there should be a variety in the location, type,
size, tenure, cost, style and age'of dwellings to accommodate the wide range of
households desiring to live within the City. Granting the exception would allow the
existing house to remain in its present form and location.
Conclusion
In conclusion, staff supports the proposed lot line adjustment for several reasons. The lot line
adjustment will not result in a greater number of lots; the proposed lot line adjustment will
consolidate 14 lots into seven parcels that are more suitable for development. The appearance of
the lots from the street will be consistent with the normal pattern and spacing of development in
the neighborhood; the resulting corner lots will be of a similar size and shape as other corner lots
in the vicinity. Development of the resulting lots will be consistent with other development in
the neighborhood and with the City's property development standards; the project meets all other
R-1 zone property development standards including density requirements. Cost to the subdivider
was not the sole consideration for the proposed exception; granting the exception allows for the
existing house to remain its present form and location and facilitates the construction of much
needed housing, both of which are considered consistent with General Plan. Granting this

exception will not be detrimental to the public health, safety and welfare or injurious to other
properties in the vicinity because the corner lots will be developed consistent with City Street and
safety standards. Finally, staff believes that no useful purpose would be realized by strict
compliance to the regulations given the minor nature of the request.
CONCURRENCES
The Public Works Department Engineering Division does not have a problem with the proposed
lot line adjustment. The Utilities Department indicates that there are adequate public utilities
(water lines) present at or near the site. The Fire Department and Pacific Gas and Electric have
no concerns with the proposed lot line adjustment at this time. Any department comments have
been included as conditions of approval.
FISCAL IMPACTS
None
ALTERNATIVES
1. Adopt draft resolution`B"denying the lot line adjustment map with findings.
2. Continue review to allow revisions to the map or presentation of additional information.
Specific direction should be given to the applicant and staff.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO APPROVING LOT LINE ADJUSTMENT MAP LLA 1-019
INCLUDING EXCEPTIONS TO SUBDIVISION REGULATIONS FOR
TWO LOTS (LOTS 4 AND 7), LOCATED AT 2201 LAWTON STREET
WHEREAS, the City Council conducted a public hearing on March 20, 2001, and
considered the applicant's request for a lot line adjustment map to consolidate portions of 14 lots
that existed prior to 1977, and exceptions to lot area and width for Parcel 4, and lot width for
Parcel 7, and the evaluation and recommendation of staff; and
WHEREAS, the City Council finds that the proposed lot line adjustmentand minor
subdivision exceptions are consistent with the Zoning and Building Regulations, and other
applicable City ordinances; and
WHEREAS,the City Council finds that the lot line adjustment is categorically exempt as
provided fof by California Environmental Quality Act Guidelines, Section 15305 Minor
Alterations in Land Use Limitations.
BE IT RESOLVED, by the Council of the City of San Luis Obispo as follows`.
SECTION 1. Findings. That this Council, after consideration of Lot Line Adjustment Map No.
LLA 1-01, staff recommendations and reports thereof, makes the following findings:
1. The lot line adjustment will not increase the number of parcels and complies with Section
66412(d) of the Subdivision Map Act and the City's Subdivision Regulations.
2. With minor exceptions to the subdivision regulations, the resulting parcels from the lot line
adjustment will conform to the City's Zoning Regulations and building codes.
3. The site is physically suited for the type and density of development allowed in the R-1 zone.
4. The proposed lot line adjustment is categorically exempt from environmental review
pursuant to Section 15305 of the CEQA Guidelines.

SECTION 2. Conditions.Lot Line Adjustment Map No. 20-99 (County Map No. SLO 99-
006), including exceptions to the Subdivision Regulations is approved subject to the following
conditions and code requirements:
1. The lot line adjustment shall be finalized with either a parcel map or a lot line adjustment
agreement. If the agreement is pursued, the applicant shall submit a "Declaration of Lot Line
Adjustment", along with recording and processing fees, and an 8-1/2 x 11 map exhibit
suitable for recording, to the City Engineer for review, approval and recordation, based on
samples available in the Community Development Department.
2. The location of all existing utilities(water, sewer, gas, electric,telephone and cable TV) shall
be verified,and if they cross proposed property boundaries those utilities shall be relocated,or
appropriate easements granted,to provide service directly from the public right-of-way adjacent
to each parcel. The Building Division shall review any plan to relocate or create easements
prior to recordation.
SECTION 3. Exceptions. That the requested exceptions to Sections 16.36.160 of the
Subdivision Regulations be approved along with the tentative map for Lot Line Adjustment LLA
1-0 1 based on the following findings:
1. The property to be divided is of such size or shape, or is affected by such topographic
conditions,that it is impossible,impractical or undesirable,in the particular case,to conform to
the strict application of the regulations codified in Title 16 of the Municipal Code(Subdivision
Regulations). The site is constrained by the location of an existing church, parking lot and
house that make it impractical or undesirable to conform to the strict application of the
Subdivision Regulations.
2. The cost to the subdivider of strict or literal compliance with the regulations is not the sole
reason for granting the modification.
3. The exception to the subdivision regulations will not be detrimental to the public health,safety
and welfare, or be injurious to other properties in the vicinity. The lot line adjustment map
with exceptions will create seven lots that are more suitable for development and consistent
with the normal pattern and spacing of development in the neighborhood.
4. Granting the subdivision exception is in accord with the intent and purposes of these
regulations, and is consistent with the general plan and with all applicable specific plans or
other plans of the city. Development on the resulting lots will comply with all applicable R-1
standards and City Codes. The exception will allow the existing house to remain in its current
