SUBJECT: CONSIDERATION OF A LOT LINE ADJUSTMENT WITH
EXCEPTIONS TO THE SUBDIVISION REGULATIONS AT 596 TORO
(LLA 179-00).
CAO RECOMMENDATION
Adopt Resolution "A" approving a lot line adjustment, with exceptions to the Subdivision
Regulations,based on findings and subject to conditions.
DISCUSSION
Situation
The applicant is proposing a lot line adjustment to establish an ownership boundary between two
existing residences on the project site. No development is proposed at this time, but the
adjustment has been designed to allow for a future addition to the smaller residence on 596 1/2
Toro. The property includes portions of four record lots. The adjustment will result in two
parcels that more closely conform to the City's current lot standards.
The four record lots on the property were originally designed to be served by Hathway Avenue,
which was abandoned prior to the construction of the US 101 Northbound On-Ramp adjacent to
the project site. The abandonment of Hathway Avenue and construction of the on-ramp had the
effect of"land locking"three of the four legal lots, but did not have the effect of merging them or
changing their legal status as separate lots of record. The Subdivision Map Act contains
provisions for requiring the merger of such lots, but does not preclude the ability of the applicant
to apply for a lot line adjustment.
The project has been evaluated for consistency with the City's Zoning Regulations, Subdivision
Regulations and building codes and it has been determined that exceptions to lot area and width,
driveway width and garage setback are necessary to approve the request. Normally lot line
adjustment applications are acted on by the Community Development Director without the need
for a public hearing. When exceptions are requested,, the Subdivision Regulations require the
application to be acted on by the City Council.
Site Description
The project site is located on the corner of Phillips Lane and Toro Street, adjacent to Highway
101. The irregularly shaped property includes 12,827 square feet. The land has a moderate cross
slope as it falls from the high point at the southeast corner of the property towards Highway 101.
The site has been developed with two residences and a single car garage: On-site parking
includes one covered space in the garage and one uncovered parking space in a gravel dtfjv_elvay.

There are numerous trees and hedges on the property including a large, double-trunk, native
Sycamore tree (identified as a Maple tree on the map) located between the front house and the
garage. Other trees include a 6" and a 12" Coast Live Oak tree and various fruit trees. The
arborist has determined that the 12" Oak tree, which has recently had a major limb split off,
could be removed if necessary. Although the address for the property is on Toro Street, vehicle
and pedestrian access to the property is taken from Phillips Lane.

Proiect Description
The project is a lot line adjustment and will not result in the creation of any new lots. A flag lot
configuration is proposed so that the existing garage would remain as part of Parcel "A". The lot
line adjustment has been designed to provide for a future addition and parking on Parcel `B", but
no development is proposed at this time. No tree removals are proposed as part of the project,
although the hedges in front of, and to the side of, the existing parking areas will need to be cut
back to,meet City standards for sight distance from driveways.
EVALUATION
The applicant's original lot line adjustment proposal showed a more standard parcel design, with
lot lines perpendicular to Phillips Lane. In the original proposal, the garage was shown on Parcel
"B"; and parking for Parcel "A" was proposed adjacent to the native Sycamore tree. Staff has
worked with the applicant to revise the plans because this approach, although more traditional,
could have had significant impacts on the Sycamore tree. In addition, the area around the
Sycamore tree provides useable outdoor space that is shielded from Highway 101 by the
residence. Staff believes that the revised approach is more creative and more appropriate given
the existing site conditions.
The evaluation of a lot line adjustment is limited by the Subdivision Map Act to a determination
of whether or not the resulting parcels conform to Zoning and Building Code standards.
Although exceptions are being requested, the Subdivision Regulations and the Zoning
Regulations provide a process for the City Council to approve the exceptions being requested if
specific findings are made. Recommended conditions of approval are intended to insure
consistency with City codes and policies and to insure compatibility with the existing
neighborhood. The following is an evaluation of the lot line adjustment proposal in terms of the
requested exceptions, neighborhood compatibility, further development potential, and
consistency with City policies and standards.

Requested Exceptions
The proposed lot line adjustment requires exceptions to some of the City's standards for
subdivision design (SLOMC 16.36.160) and deep lot subdivision design (SLOMC 16.36.230).
The requested exceptions are called out in bold in the following table.

Staff believes that the proposed exception to the Minimum Lot Area standard for Parcel `B" is
unnecessary. The exception request can be eliminated with a slight change to the proposed lot
line at the rear of the properties. By taking approximately 550 square feet of land from proposed
Parcel "A" and giving it to proposed Parcel `B", both lots would have the minimum required lot
area. This recommendation is incorporated as a condition of approval in draft Resolution"A"
and is supported by the applicant.
Staff supports the proposed lot width exception because a more standard lot line configuration
would separate the existing garage from proposed Parcel "A" and would require new parking to
be developed on the site. Staff believes that the creation of parking on Parcel "A" would have
impacts to the native Sycamore tree and would eliminate useable outdoor space on Parcel "A".
Staff believes that the reduced width of the driveway, 13.5 feet with 10 feet of paving, instead of
20 feet with 16 feet of paving, is appropriate because there are no structures on the property that
are greater than 150 feet from the Phillips Lane right-of-way. As a result, Fire Department
vehicles will not need access to the property in an emergency and the additional width to the
driveway in unnecessary. A 3-foot setback from the property line and edge of driveway to the
existing garage is required by the Building Code. This setback will also provide for a landscape
planter along the edge of the driveway.
Neighborhood Compatibility
Staff believes that the proposed lot line adjustment is compatible with the adjacent neighborhood
because it would result in two lots that are comparable in size to the lots on Howard Street and
Johnson Avenue (see Attachment #4). Although zoned R-2 and R-3, these neighboring
properties are developed primarily with two and three bedroom single-family residences. The
adjustment will continue this neighborhood pattern.

Further Development Potential
Proposed Parcel "A" is developed with a 3-bedroom house and the residence on proposed Parcel
"B" has two bedrooms (see floor plans, Attachment #5). Based on the properties R-2 zoning,
Parcel "A" would be "maxed out" in terms of bedroom count. Parcel `B", however, could be
developed with an additional bedroom. A bedroom addition on Parcel `B" would trigger the
requirement for an additional parking space, which could be provided in the front yard area (see
Attachment#6).
Consistency with City Policies and Standards (Required Findings)
In order to approve the requested exceptions to the Subdivision Regulations, the City Council
must make four specific findings(SLOMC 16.48.020), as follows:
A) That the property to be divided (adjusted) is of such size or shape, or is affected by
such topographic conditions, that it is impossible, impractical or undesirable, in the
particular case, to conform to the strict application of the regulations codified in this
title.
Staff recommends that the City Council make this finding based on the fact that the
slope of the lot, together with the location of the Sycamore tree, makes it impractical
to provide additional parking on Parcel "A" as originally proposed. Parking on
Parcel "A" would be required under a more conventional parcel design.
B) That the cost to the subdivider of strict or literal compliance with the regulations is
not the sole reason for granting the modification.
Staff believes that the proposed exception results in a better lot line configuration for
the property than a more conventional alignment. This is because the property is
already developed and the lot line adjustment is intended to allow each home to be
sold separately. The exception will not reduce costs to the applicant, but will
provide for the property to be developed to its full potential in a practical and more
desirable way.
C) That the modification will not be detrimental to the public health, safety and welfare,
or be injurious to other properties in the vicinity.
The proposed exceptions will result in two lots that more closely resemble existing
developed properties in the neighborhood. The modification will not be detrimental
to the public health, safety and welfare, or be injurious to other properties in the
vicinity because it will result in more consistent lot sizes in the vicinity, will maintain
the aesthetic amenities of existing mature trees, will preserve outdoor space that is
shielded from traffic noise and will result in individual homeownership of the two
residences and a greater level of property maintenance, which will benefit the
neighborhood as a whole.

D) That granting the modification is in accord with the intent and purposes of these
regulations, and is consistent with the general plan and with all applicable specific
plans or other plans of the City.
Staff believes that the lot line adjustment is consistent with the purpose of the
Subdivision Regulations because the proposed lot design will minimize conflicts
between adjacent properties and is designed to help support a desirable living
environment on the site. The project design will maintain useable outdoor space on
Parcel "A" that is shielded from Highway 101 and provides the possibility for
additional development on Parcel "B" that is consistent with General Plan objectives
for residential projects as outlined in Land Use Element Policy 2.2.12..
General Plan Land Use Element policies 2.2.10 and 2.2.6 support projects which are
compatible with existing neighborhoods and development that occurs as part of a
neighborhood pattern. The proposed lot design is consistent with these Land Use
Element policies because the proposed lots are similar in size and are developed
similarly to other properties in the neighborhood(see Attachment #4).
CONCURRENCES
The project was routed to Public Works, Fire, Building, and Utilities. Comments from these
departments have been incorporated into the discussion and, where appropriate, included as
conditions of approval.
ALTERNATIVES
1. The Council may deny the lot line adjustment request if the Council cannot make one or
more of the four required findings listed in this report.
2. The Council may continue discussion if additional information is needed. Direction should
be given to staff and the applicant.

A RESOLUTION OF THE COUNCIL OF THE CITY
OF SAN LUIS OBISPO APPROVING A LOT LINE
ADJUSTMENT LOCATED AT 596 TORO,(LLA 179-00).
WHEREAS, the City Council conducted a public hearing on, April 24, 2001, and has
considered testimony of the applicant, interested parties, and the evaluation and recommendation
of staff, and
WHEREAS, the City Council finds that the project is consistent with the State
Subdivision Map Act, City Zoning Ordinance, Building Code and other applicable City
ordinances.
WHEREAS, the City Council finds the project to be categorically exempt from
environmental review as provided for by the California Environmental Quality Act Guidelines,
Section 15035, Minor Alterations in Land Use Limitation, as determined by the Community
Development Director.
BE IT RESOLVED,by the City Council of the City of San Luis Obispo as follows:
SECTION 1. Findings. That this Council, after consideration of the proposed project
(LLA 179-00), the applicant's statement, staff recommendations and reports thereof, makes the
following findings:
I. The lot line adjustment will not increase the number of parcels and complies with Section
66412(d)of the Subdivision Map Act and the City's Subdivision Regulations.
2. The proposed lot line adjustment is categorically exempt from environmental review,
pursuant to Section 15305 of the CEQA Guidelines.

SECTION 2. Exceptions. That an exception to the Subdivision Regulations is hereby
granted, allowing lot width to be 46 feet, where 60 feet is the standard; allowing the setback from
to the garage to be 3 feet where 10 feet is the standard; and allowing the driveway to be 13.5 feet .
wide with 10 feet of paving, where 20 feet wide with 16 feet of paving is the standard,based on
the following findings:
1. It is impossible, impractical or undesirable, in this particular case, to conform to the strict
application of the' regulations codified in the Subdivision Regulations because the.
property is already developed with two residential structures that will be retained in their
current configuration and there is an existing native Sycamore tree on the property that
would be impacted by a standard subdivision design.
2. The cost to the applicant of strict or literal compliance with the regulations is not the sole
reason for granting the modification because the exception will result in a more desirable
living environment for the residents of the site.
3. The modification will not be detrimental to the public health, safety and welfare, or be
injurious to other properties in the vicinity because it will result in more consistent lot
sizes in the vicinity, will maintain the aesthetic amenities of existing mature trees,
will preserve outdoor space that is shielded from traffic noise and will result in
individual homeownership of the two residences and a greater level of property
maintenance, which will benefit the neighborhood as a whole.

consistent with the pattern of development in the neighborhood..
SECTION 3. Action. That the approval of Lot Line Adjustment 179-00, 596 Toro, be
subject to the following conditions:
1. All utility services serving the existing residence that cross the new property lines must be
removed (e.g water, sewer, telephone, cable, gas, and electric lines). All new utility
services serving the reconfigured lots shall be underground.

2. All driveways and parking surfaces shall be paved with an all-weather surface such as
asphaltic concrete or concrete. Alternative permanent paving, such as grass-crete,
decorative pavers, or concrete wheel strips may used, to the approval of the Community
Development Director, consistent with the Parking and Driveway Standards.
3. The hedges adjacent to the driveway shall be pruned or removed to comply with City
criteria for obstructions adjacent to driveways, to the approval of the Public Works
Department. Sight distance to vehicles or pedestrians in the street right-of-way shall be
maintained.
4. A single driveway may be constructed to serve both driveways, with the final alignment
of the driveway approach to be designed to the approval of the Public Works Director.
5. The lot line adjustment map shall be modified so that each lot has a minimum area of
6,000 square feet.
6. The lot line adjustment shall be finalized with either a parcel map or a lot line adjustment
agreement. If the agreement is pursued, the applicant shall submit a "Declaration of Lot
Line Adjustment", along with recording and processing fees, and an 8-1/2 x 11 map
exhibit suitable for recording, to the City Engineer for review, approval and recordation,
based on samples available in the Community Development Department..
7. Prior to finalization of the Lot Line Adjustment the applicant shall coordinate with the
Community Development Department to have a new address assigned to the residence on
Parcel `B". The new address shall be on Phillips Lane.
8. The lot line adjustment warrants an investigation of the condition of the sewer lateral(s)
currently serving the two residences. It is advised that the sewer lateral be video
inspected. The City can assist in the evaluation and possibly the repair of the sewer
lateral(s). The owner should contact the Utilities Department at 781-7215 and request an
application to the Voluntary Sewer Lateral Repair Program. The City will then video
inspect the sewer lateral and make recommendations for repair or replacement. Through
the program, each property could be eligible for reimbursement of 50% of the
repair/replacement cost, up to a maximum of$1,000 per property.

Dear Mayor Settle:
I see several new faces on the Council and I would like to take this opportunity to
introduce myself to the newcomers and refresh the memories of the "elder
statesmen".
My name is Steven Frank and San Luis Obispo is my hometown. I am the Engineer
of Record for the above-referenced agenda item. I am a Registered Civil Engineer
and I am licensed to practice land surveying in California. I make a comfortable
living as the senior design and construction engineer for the County of San Luis
Obispo Public Works Department. From time to time, over the last twenty years, I
have taken on the responsibility of engineering specific projects within the City of
San Luis Obispo that I feel will improve the quality of life in my hometown.
I love San Luis Obispo. It was a great place to grow up. In 19621, I moved next door
to Lee Price, your City Clerk. Her brother, Dill, was my best friend until his
untimely death several years ago. In 1964, while working on the Eagle rank in Boy
Scouts, former Councilman.Dave-Romero took me out to dinner at the Motel Inn
and told me about his career as a civil engineer in the public sector. Twenty-six
years ago this week, I stood next to Councilman Schwartz's son, Jan, at what used
to be the Methodist Church and we both received the Eagle rank. San Luis was a
great place to grow up.
Although I am bitterly opposed to some of the present City's policies,I want to work
with City government to produce quality homesites for the people of San Luis
Obispo. I think the modifications to the-existing property lines of these two Poly
rentals will permit the parcels to convert back to single family residences and be
sold to families. I would sincerely appreciate your approval of the exceptions to the
subdivision design standards.

Dear Mayor and Members of the Council,
We are writing in support of the proposed lot line adjustment at 596 Toro Street. We
support the goal of creating parols which more closely conform to current lot standards, and
we appreciate the desire to retain the single-family residence character of our nei0hborhood.
It is also appreciated that you are willing to support a more creative approach which
respects the e�asang conditions of the site and allows, in particular, ability to preserve
existing mature trees and plantings.
We also wish to emphasize our support of the following conditions, in particular:
1) Modify the lot Lane Adjustment map so that each lot has a minimum area of 6.000
square feet,
2) Preserve the existing fledge along the proposed driveway to Parcel "B," adjacent to
the neighboring parcel, wh le allowing pruning to maintain appropriate site distance;
3) Driveways to be paved, while allowing reduced width and creative leeway to
construct a single driveway serving both parcels should that be feasible.
Again, we wish to express support of the proposal and the recommendations of staff, and
to express our appreciation for the thorough preparation of the agenda report by our
planning staff. Thank you for your consideration of our comments while considering this item.
