DISCUSSION Background On January 22, 2001, the City of San Luis Obispo received an application from Jeff Goldenberg of Beach Cities Cab Company requesting consideration of a Certificate of Public Convenience & Necessity and a Taxi Permit. The next step prior to granting a Certificate of Public Convenience& Necessity and a Taxi Permit is to determine if there is a need for additional taxi service. In accordance with Municipal Code Sections 5.20.040 and 5:20.050, the City must investigate whether the need exists for an additional taxi operator and conduct a formal detemunation of need hearing prior to issuance of any new taxi permit. The service request from Beach Cities Cab Company centers on the fact that it currently taxis people from outside the city (most notably the Five Cities area, Arroyo Grande, Pismo Beach and Grover Beach) to areas of high interest such as the Downtown and to the airport. While this type of trip is allowed under the City's taxi ordinance, Beach Cities Cab is currently prohibited from providing the return trip for any of these taxi trips. In determining whether or not the City should grant a Certificate, a number of issues must be examined. Beach Cities Cab Proposal and the Municipal-Code According the Municipal Code 5.20.030, applicants must satisfy minimum requirements, which include experience, financial responsibility, and proposed fleet and color scheme.. The following information addresses these requirements in greater detail. Experience and Financial Responsibility of the Applicant. The applicant is the owner of Beach Cities Cab Company and has been operating in the Cities of Arroyo Grande, Pismo Beach, Paso Robles, and the County of San Luis Obispo since.2000. Though the business has been operating for less than a year,the applicant has demonstrated solid business skills,good customer service, and Council Agenda Report—Beach Cities Cab Page 2 for less than a year,the applicant has demonstrated solid business skills, good customer service, and financial responsibility, as evidenced by the fact the applicant has remained profitable and is expanding his business. Vehicle Fleet Mix and the Color Scheme that Will Be Used. As indicated in Attachment 1, the applicant is proposing to utilize four 1996/1997 Ford Crown Victoria sedans. The primary color scheme is yellow with a teal surfboard logo,and a surfboard permanently mounted to the roof of the vehicle. Overall the vehicles are new, attractive and clean. Photographs are available in the Council Reading File. Determining the Need for Additional Taxi Service The current taxi request is the first such request in a number of years and as such, has required research into the history of the City's taxi ordinance. Historical Experience. The City of San Luis Obispo has had a less than positive experience when allowing multiple taxicab operators to function in the City. Laidlaw operated a profitable taxi service until 1993, when Yellow Cab of Five Cities, owned by Mark Giekseke, was granted a taxi permit. Both taxi companies then began to struggle financially. Laidlaw subsequently decided to withdraw from taxi operations due to the lack of profitability. Yellow Cab of Five Cities' Certificate of Public Convenience & Necessity and Taxi Permit was later revoked ddue to the company's failure to comply with various Municipal Code requirements. On September 6, 1994, City Council approved Resolution 8337, which established the current taxi service levels of a single taxi operator until such time that there is demonstrated demand to support more than one taxi operator(Attachment 3). At that same meeting, Council approved an issuance of a Certificate of Public Convenience &Necessity and Taxi Permit to Yellow Cab Company, owned by Anthony Romero. During Mr. Romero's ownership,taxi service in.the City of San Luis Obispo experienced numerous service interruptions due to the company's: (1) failure to maintain their insurance requirement; (2) failure to maintain safe vehicles; and (3) failure to pass the County's Weights and Measures inspection. Yellow Cab Company's Certificate of Taxi Permit was surrendered in 1998, after many grueling months of effort by Public Works, the City Attorney and Police Departments. On May 7, 1996 (and prior to the surrendering of Yellow Cab Company's permit) the City Council granted a Certificate of Public Convenience & Necessity and Taxi Permit to a second service provider: Central Coast Taxicab Services. In spite of Resolution 8337, the City Council issued this permit primarily due to the deficient quality of service and safety problems stemming from Yellow Cab Company. Central Coast Taxicab provided good service while Yellow Cab Company was self-destructing. However, unlike the friendly but non-profitable competition seen during the prior Laidlaw/Yellow Cab of Five Cities era, this competition turned physical. Yellow Cab Company drivers often initiated physical fights with Central Coast Taxicab drivers, were observed operating recklessly, and jeopardized public safety in order to compete for passengers. Obviously, these activities stopped in 1998 after surrendering of Yellow Cab Council Agenda Report—Beach Cities Cab Page.3 Company's permit. Does this mean that more than one taxi service can not operate within the City? Not. necessarily. However, to avoid the financial and/or physical problems already experienced, per Resolution 8331, the market must dictate that there is enough demand to support two or more service providers. Review of Current Service. During the past four years, Central Coast Taxicab has complied with all requirements of the Municipal Code. In addition, the City has received only one minor complaint during this period regarding these services. As result of this application, neighboring cities were contacted regarding both Central Coast Taxicab and Beach Cities Cab. As illustrated by Table 1, both taxi operators have valid permits and no complaints have been received within the jurisdiction they operate. Safe Ride provides approximately six hundred late evening trips per month from 9:00 p.m.to 3:00 a.m. on Thursdays,Fridays, and Saturdays. The purpose of Safe Ride is to provide for the citizenry of San Luis Obispo a safe alternative to driving personal automotives, but it also siphons demand from taxi services. In many ways,the City already has two taxi services. Both ridership and complaints are major indicators in determining the need for an additional taxi operator in the City of San Luis Obispo. Staff reviewed operating statistics, vehicle maintenance records, and conducted an informal vehicle inspection on February 9, 2001. No complaints were received because of insufficient taxis available. Central Coast Taxicab drivers receive a commission of$38.00 per day for approximately six hours of work per day. An additional taxi operator would reduce this commission that is already below the living wage. There is, of course, the argument that direct competition is required to establish a free market and a � Council Agenda Report—Beach Cities Cab Page 4 that more than one taxi provider for the City might be good. However, based upon previous history, this argument is valid only if current fares are too high or if Central Coast Taxicab was price gouging the public. In reviewing this issue, staff concluded that the fares are consistent with industry standards and as previously mentioned, the City has received few complaints regarding current service. Also, based on past experience when two taxi cab companies were operating at the same time, it is reasonable to conclude that Safe Ride Home, but most likely Central Coast Taxicab, might not remain profitable or have successful service levels if a Taxi Permit was granted to Beach Cities Cab at this time. For these reasons, staff feels there is not sufficient demand to warrant the need for an additional taxi operator within the City at this time. While the request to service return trips to the south county is a valid one, the negative possibilities of issuing a. Citywide Taxi Permit to Beach Cities Cab to perform this service substantially outweigh the small positive gain that the City might expect from allowing this service to commence.The return trips that Beach Cities Taxi is currently not providing from the Downtown area and the airport area can adequately be served by the City's current taxi operator. Staff believes Beach Cities Cab to be a fine company,but likewise believes the City is not yet big enough to support a second formal taxi company. FISCAL]IMPACTS There will be no financial impact to the General Fund by approving the CAO Recommendation. ALTERNATIVES The issuance of a Taxi Permit is under thesolepurview of the City Council and as such, a number of alternatives exist that the Council may wish to consider. Alternative 1. The Council may determine that there is a need for a second taxi operator in the City of San Luis Obispo. This alternative is not recommended, since based on previous experience,the City could lose both taxi operators due to lack of sufficient demand. Alternative 2. The Council may decide to deregulate taxi operations. The City currently does not regulate other transportation services, such as van services, limousines, courier services, or charter bus services. The advantage of this alternative is that the City of San Luis Obispo would not have to regulate and administer taxi operations. The disadvantage to this alternative is that it may result in multiple taxi operators, who would aggressively compete in a limited market with little City supervision. Should the.Council choose this alternative, it should direct staff to return with an ordinance modifying the Municipal Code. Alternative 3. The Council may decide to modify the current Municipal Code to allow taxi operators to provide return service to customers whose destination is outside of the City and who may be staying outside city limits. The primary benefit to this alternative is the convenience to P I 1 Council Agenda Report—Beach Cities Cab Pages visitors in using and relying on the same taxi operator from their pick-up outside the City limits. Visitors have already established a business relationship and do not need to worry about which taxi they need to call to return to their hotel outside City limits. Another benefit to this approach is that it would allow Central Coast Taxicab to better concentrate on the needs of the City as opposed to reducing their capacity to serve the City. Should the Council choose this alternative, it should direct staff to return with an ordinance changing the Municipal Code. The reason this alternative is not recommended is that the municipal code is black or whited that is, is there or is there not a need for an additional taxi operator? As currently written, the municipal code does not address return service nor does it provide the latitude for the City to allow return service unless the ordinance is modified. ATTACHMENT 1. Please accept this correspondence in response to the Staff Report prepared for the Public Hearing item on this matter set for May 15, 2001. We begin by stating that the taxi industry is one of the most highly regulated industries on the local level. While many taxicab regulations were instituted as an attempt to improve service quality,the historical legacy has been lower service quality and the overall competitiveness of the industry. The effects have been particularly pernicious for those at the lower end of the socioeconomic ladder since a taxi entrepreneur requires little formal education to be effective and productive. The negative impact of local regulations on economic opportunity is usually an artifact of the way the ordinances are designed and implemented. Taxicab ordinances were written when regulators considered taxicabs (and other transportation services) utilities. As a result,taxicab regulations follow traditional regulatory schemes,often limiting competition and access for new companies, regulating fares and rates,and defining key elements of business operations such as hours of operations and location. Taldng into account the above,there is no doubt that the real effect of the City of San Luis Obispo's Taxicab Ordinance is to shut out entrepreneurs, limit competition, and protect existing companies. Indeed,one of the principal arguments in the Staff Report is that revenues for Central Coast Taxicabs will fall. Clearly,the City's process that requires new companies to submit applications and renders decisions based upon forecast financial profitability inherently favors incumbents. It is our opinion that a process that forecasts financial profitability should not be used. This document states that Central Coast Taxicab is currently for sale and claims revenues of$594,000 per year and is currently attempting to sell its business assets for $750,000. This document clearly dispels the notion that a small startup taxicab company such as Beach Cities Cab Company, Inc.,will have a financial impact upon Central Coast Taxicab. In addition,applicants for a certificate to operate a taxicab company in San Luis Obispo face an insurmountable task of demonstrating that adequate service is not being provided by existing companies and that the existing companies cannot provide such service. Existing companies can block entry with the mere assertion that the new company would duplicate the service already being provided. In fact,left to their own devices,private taxicab companies would not try to definitively measure demand due to analytical complexities and inaccurate or incomplete data. One problem with trying to hit this target is that it is invisible. This alone would account for some errors in marksmanship,but the target is also moving. It moves across the time of day with changes in the demands to use roads. It moves across the years as the average level of demand changes with changing incomes,fuel prices,and technology. The difficulty of hitting this target means that the Staff Report prepared by the City's Public Works Director misses the current demand for an additional taxicab company.' The Staff Report erroneously reaches a conclusion that there is no need for an additional taxicab service. This conclusion belies the attached petition with over 97 signatures stating that an additional taxicab service is needed in the City of San Luis Obispo. Furthermore,the Director of Ride-On Services and the Safe Ride Home Program has stated to the Applicant that an additional taxicab service is needed in the City of San Luis Obispo. The Staff Report's conclusion that an additional taxicab service is not needed because the previous taxicab services did not succeed does not warrant the denial of Beach Cities Cab Company, Inc.'s application to operate a taxicab service in San Luis Obispo. It should also be noted that Beach Cities Cab Company,Inc.,currently has valid permits in Pismo Beach,Arroyo Grande,Atascadero, Paso Robles,Morro Bay,Grover Beach and the County. In fact,as City Attorneys for Morro Bay and Pismo Beach,we have first hand knowledge of Beach Cities Cab Company, Inc.,application and qualifications and can say,without hesitation, that Beach Cities Cab Company, Inc., has been a welcomed asset to the community. We conclude by stating that the lifeblood of any economy is its people. Human progress ultimately springs from the inspiration of people who transform their ideas into goods and services that others can use every day. That is why entrepreneurship is critical to the success and growth of a community and economy. Not surprisingly, economic growth is driven by the expansion of small businesses. Entrepreneurs invest in new ventures on a hunch that they are tapping into some unmet demand. Guided by expectations of profits,entrepreneurs experiment with and test new ideas. The business can be established with a car,a driver,and someone with the savvy and gumption to recognize an unfulfilled need in the market. Based upon the foregoing,we submit that the City of San Luis Obispo can promote economic opportunity in the taxicab market,and embrace the dynamism and innovation of the local economy,by approving the enclosed Resolution allowing Beach Cities Cab Company, Inc.,to operate within the City of San Luis Obispo. G u 9|2 § 00 ! 0 \ 0 2 _ 0 2 § _ ! / ! k /\ $ } \ § \ \ 2 ) U a m . _ | | \ ! $ � ■ i3 & o & RESOLUTION NO. -01 A RESOLUTION OF THE CITY OF SAN LUIS OBISPO GRANTING A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO BEACH CITIES CAB COMPANY, INC., TO OPERATE,A TAXICAB SERVICE IN THE CITY OF SAN LUIS OBISPO WHEREAS,the City Council of the City of San Luis Obispo desires to provide for taxi service for its Citizens; and WHEREAS, the City has received an application from Beach Cities Cab Compny, Inc., for a Certificate of Public Convenience and Necessity to operate a taxicab service in the City of San Luis Obispo; and WHEREAS, The City has evaluated the demand for additional taxi operators in the City and has determined that there is a continuing need for a taxicab service to meet the public transportation needs; and WHEREAS, The City has determined that Beach Cities Cab Company, Inc., has the requisite background and financial responsibility to conduct a taxicab service at the established and proposed rates from Beach Cities Cab Company, Inc. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Luis Obispo that a Certificate of Public Convenience and Necessity be issued to Beach Cities Cab Company, Inc.,to operate a taxicab service in the City of San Luis Obispo..
