SUBJECT: THURSDAY NIGHT ACTIVITIES RULES, REGULATIONS AND
FEES UPDATE
CAO RECOMMENDATION:
As recommended by the Downtown Association, adopt a resolution approving changes to
Thursday Night Activities Rules and Regulations and increasing fees as outlined in Exhibit B,
the fee schedule.
DISCUSSION
Annually, the Downtown Association and the Thursday Night Activities(TNA) committee
review both the Rules booklet and TNA budget for necessary adjustments in order to run a safe
and self-sustaining event. At this time, it has been deemed necessary by both the committee and
the Board of Directors to implement the changes.presented in this report. In brief they consist of:
(1) Rule modifications preventing the sales and/or merchandising of alcohol or tobacco at the
TNA Farmers' Market.
(2) The addition of specific rules preventing permanent cosmetics and body piercing at TNA
Farmers' Market.
(3) Modifications of the rule addressing barbecue starting methods at TNA Farmers'Market
to allow the use of propane wands.
(4) Recommended and approved fee increases for participants of TNA Farmers' Market to
cover costs of staging the event
In the matter of fee increases, the level of increase was determined by:
(a) cost increases incurred by the Downtown Association for TNA services and products
(b) there have been no fee increases since 1998
Fees were looked at in individual categories and raised by suggested increments, not percentages.
The overall percentage for all categories is approximately the difference between costs and
income, about 17 percent.
Note: Except for the fee increases, the above changes have been pending in order to
bring all items to Council at one time.

CONCURRENCES
The Downtown Association Board of Directors and TNA committee have approved the
suggested changes.
FISCAL IMPACT
The changes do not require any funding on behalf of the Downtown Association or the City;
except for printing of new TNA booklets, which is part of the regular TNA budget. Increasing
the fees will mean an additional income to the Downtown Association of an estimated$11,000.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN LUIS OBISPO APPROVING CHANGES TO
DOWNTOWN ASSOCIATION RULES,.REGULATIONS AND FEES
FOR THURSDAY NIGHT ACTIVITIES
WHEREAS, The San Luis Obispo Downtown Association conducts a weekly,promotional
event,Thursday Night Activities (TNA), also commonly referred to a Farmers' Market or Thursday
Night; and
WHEREAS, The TNA event is a financially self-sustaining, safe and fun family-oriented
activity; and
WHEREAS, from time to time, the needs and expenses of the activity change; and
WHEREAS, during regular TNA committee meetings and budget meetings the necessary
rule changes and fee changes have been discussed and approved;
NOW,THEREFORE,BE IT RESOLVED, that the City Council of the City of San Luis
Obispo hereby approves the recommended rules and regulations changes and fee modifications as
submitted.

TNA Fee Increase —Committee reviewed breakdown of expenses as well as an increase
proposal that raised fees across the board by 17% and also kept tiered payment for food
vendors and entertainment. Due to the fact that operating costs have increased by more
than 17%, Farmers' Market Association will continue to pay only 15% of operating
costs. Walters made a motion that fee increases should be accepted as submitted, new
billing will go into affect July 1, 2001, we review budget on a monthly basis and review
fees on an annual basis, 2nd by Ortali, PAIF.
Committee directed Bragg to draft a letter that can be sent out to all TNA participants
warning them that contingent on Council approval, TNA fees will be increased come
July 1, 2001.

Bob Noak has sold Country Culture Yogurt. TNA meeting next week will be held at
Gigi's.

Bragg spoke to Darren Drake (Fire Marshall) about whether or not it is okay to use
propane wands to start BBQ's during Thursday Night Activities. Currently rules and
regulations prohibit this. Drake stated that as long as the wand is used for starting the fire
only and then removed from the premises (50 feet away from open flames) it is an
acceptable means to start the BBQ. In the mean time Ortali made a motion that we
temporarily allow the use of propane wands as a viable option for starting BBQ fires.
Once fire is started the propane wand must be removed from the premises (shall not be
located any closer than fifty feet from BBQ), 2nd by Vannier, PAIF.

Bragg - Information booth grossed$253.00. Wesley from Friendship Maintenance needs a
ride out to Los Osos after TNA. Is anyone heading that way or know of anyone who is?

Proll - No report,.Proll was not on duty. Officers who were there reported that it was a
mellow night.

TNA rule addition in regards to body piercing -Motion by Walters, 2nd by Gilreath,to add
rule to TNA Rules and Regulations stating that tattooing,permanent cosmetics and body
piercing may not be performed or administered during TNA.Body piercing does not
include piercing the leading edge or earlobe of the ear. PAIF.

Ortali informed the Committee that the Babe Ruth All Star Regional Baseball
Championships will be held.in SLO this weekend.

Carnival Like Atmosphere-It has always been policy that TNA not become carnival like in
atmosphere,but as a promotion for the businesses in the Downtown area. When an
application to do temporary tattoos on the market was denied by the majority of the TNA
Committee the question was asked what is and what isdt a carnival like atmosphere.
Vannier felt that we could not be the morality police. Tucker noted that one of our top
priorities is to promote an event with a family atmosphere and to him things like temporary
tattoos and ear piercing does not promote this. Ortali said that as a committee we have
always had discretion over entertainment that is allowed on the market so if the activity
being proposed is carnival in nature then the question should be asked if it is family
oriented. Gilreath noted that this is our market.When it comes to entertainment the
committee has the right to approve or deny. With businesses in the Downtown district we
do not have that discretion whether or not we like or dislike the business.
Discussion summed up: To maintain a family atmosphere on the market is a top priority.
When it comes to approving entertainment the Committee can approve or deny with a
majority vote.
In regards to Unique Beads and ear piercing out on the street,Bragg will ask them to
discontinue the piercing while she investigates whether or not there are any health or safety
regulations or permits that they need. Following the investigation if Unique Beads wants to
continue to pierce they will need to reapply to have their application amended.
Promotion of Tobacco Products - After discussing whether or not selling and advertising
tobacco products during TNA is conducive to a family atmosphere the committee decided
they would like to add a rule to the Rules and Regulations to not allow it. Bragg came up
with this rule -Tobacco products and merchandise may not be sold or advertised during the
event. Motion made to recommend this new rule to the Downtown Association Board of
Directors by Vannier, 2nd by Ortali, PAIF..
KCET- Bragg will be meeting with KCET staff on Thursday, July 8th.

Officer Proll brought up the issue of entertainment parking passes. During TNA on July 1st
the band on Garden St. (Goza) were not very cooperative with Officers when they were
told they needed to move their cars(the whole street was filled) or they would be ticketed.
The band ended up getting parking passes from Bragg. A motion was made by Gilreath to
not allow any parking passes to be given out on Garden St., 2nd by Ortali, PAIF.
Bragg and Proll will meet to discuss an entertainment parking pass policy.

including Spare Change. Stanton and C. Weaver said prices are high enough; Schinkel said we already do
so many other fundraisers to help out; on a vote motion failed 1-8, Kastner in favor.
Brown also said the committee is looking at including wording in rules ®s to restrict sales of tobacco
or tobacco related products at the market; he said the organization should get a rule on the books before
anyone applies as there had been an inquiry recently. Brown made a motion to uphold the
recommendation of the TNA committee to prohibit sales or promotion of tobacco or tobacco related
products at the market, 2nd by Swem, PAIF.
Promotions
Weaver stated that the bar at the concerts is in a much better location this year, stage is phenomenal,better
sound; are seeing about 3,000 per concert/increased beverage sales; Cisco's patio is full and the weather
has been great. Swem said we may have to look into developing a plan if the crowds become too large:
Stanton said he thinks the crowds are self-leveling;Weaver said it wouldn't hurt to work on a plan, if too
crowded will have to limit access at entrances. Swem said with the large crowds and congestion, it's easy
for moms to lose their kids.
Weaver also reported that the Wheels of SLO will have about 400 cars,there will be trophies, goody bags
and a vendor fair as well as some closure of the Farmers Market area on Higuera St.
Stanton asked if it's possible to have two lines at the concert bar; Weaver said the line isn't that bad if you
look at the layout and it move pretty fast. Brown says he thinks the current system is the most effective.
Swem said he has attended the Chamber of Commerce Board meeting and that Dave Garth has expressed
he would like to meet with Swem and Holley to discuss partnerships on numerous issues; this might be an
opportunity to encourage discussion.
