Neumann, Fire Chief SUBJECT: CAL POLY FIRE SERVICES AGREEMENT EXTENSION CAO RECOMMENDATION Approve an extension of the existing agreement for fire-related emergency services to Cal Poly to December 31, 2001. DISCUSSION The City has provided fire protection services to Cal Poly since June 1993. The original contract was for a period of three years; the City and Cal Poly renewed the contract in June 1996 for a five-year term. An amendment to the contract was approved in January 2001 establishing a pilot program for the City to provide advanced life support services (paramedic services) to Cal Poly. Since April of this year, staff has been in negotiations with Cal Poly personnel, who have expressed desire for another five-year contract. Due to scheduling conflicts and workload impacts, both parties have not been able to complete negotiations and prepare a new agreement before the June 30, 2001 expiration date. Cal Poly has requested an extension of the existing agreement until December 31, 2001, and has also agreed that any compensation increases in the new contract will be retroactive. FISCAL IMPACT None, given that Cal Poly has agreed to make the new contract retroactive to the old expiration date. ATTACHMENT Amendment to the agreement extending the term to December 31, 2001 C � 1-1 1 AMENDMENT NO. 2 TO AGREEMENT FOR FIRE-RELATED EMERGENCY SERVICES THIS AMENDMENT TO AGREEMENT is made and entered in the City of San Luis Obispo on August 3, 2001 by and between the City of San Luis Obispo (hereinafter referred to as City) and California Polytechnic State University(hereinafter referred to as Cal Poly). WITNESSETH: WHEREAS, the City and Cal Poly entered into an Agreement for fire-related emergency services on July 2, 1996, which was subsequently amended on January 11,2001; and WHEREAS,the term of the Agreement is through June 30,2001; and WHEREAS, the City and Cal Poly want to renew the Agreement, but due to scheduling conflicts and workload impacts, have not been able to complete negotiations and prepare a successor agreement. NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained, the parties hereto agree as follows: 1. The term of the Agreement is extended until December 31, 2001 in order to allow the City and Cal Poly adequate time to complete negotiations and prepare a successor Agreement. 2. Any compensation increase to the City for providing fire-related emergency services to Cal Poly in the successor Agreement will be retroactive to July 1,2001. 3. All other terms and conditions of the Agreement remain in full force and effect.
