Council Members may pull consent items to be considered after Business items. C1. MINUTES OF TUESDAY, DECEMBER 4, 11, and 20, 2001, AND JANUARY 8, 2002. (PRICE/KOPECKY) RECOMMENDATION: Waive oral reading and approve as presented. C2. FINAL.LEASE AGREEMENT FOR THE EL CHORRO REGIONAL PARK SOFTBALL FIELDS. (LESAGE) RECOMMENDATION: As recommended by the Joint Use Committee and the Parks and Recreation Commission, adopt a resolution approving an agreement with the County of San Luis Obispo to cover the improvements to and subsequent operation of the EI Chorro Regional Park Softball Fields. C3. AUTHORIZATION TO APPLY FOR ENVIRONMENTAL GRANT FUNDS FROM (1) STATE RIPARIAN AND_RIVERINE HABITAT PROGRAM,.AND (2) THE STATE WATER RESOURCES.CONTROL BOARD, IN SUPPORT OF THE PROJECT KNOWN AS THE AHEARN PROPERTY ACQUISITION. (GEORGE/HAVLIK) RECOMMENDATION: Adopt a resolution authorizing staff to complete and submit an application for grant monies in the amount of $250,000 from the State Riparian and Riverine Habitat Program and $700,000 from the State Water Resources Control Board, which would be used in support of the acquisition of, and (following acquisition) water quality improvements on, the Ahearn property at Stagecoach Road and Highway. 101. C4. CAPITAL IMPROVEMENT PROJECTS APPROPRIATE FOR PUBLIC ART 2001-2003. (GEORG E/DEJARN ETTE) RECOMMENDATION: Approve staff recommendation that public art funding in the amounts indicated be included in the following Capital Improvement Plan projects scheduled for the 2001-2003 fiscal years: City Hall Downtown Transit Center ($19,000), Railroad Museum Round-About ($19,000), Recreation Center Remodel ($18,500), Santa Rosa Park Renovations ($18,500), Metal Fish Sculpture ($1,100). 3 Council Agenda - Tuesday;January 22, 2002 C5. POLICE FACILITY MASTER PLAN CONSULTANT, SPECIFICATION NO. 90216. (GARDINER/HAZOURI) RECOMMENDATION; Approve a Request for Proposals (RFP) for consultant services to develop a facilities master plan for the Police Department and authorize contract award by the City Administrative Officer if the proposed contract amount is less than $50,000. C6. ENDORSEMENT.OF PROPOSITION 42, THE TRANSPORTATION CONGESTION IMPROVEMENT ACT. (JORGENSEN) RECOMMENDATION: Adopt a resolution endorsing Proposition 42, The Transportation Congestion Improvement Act, which will appear on the March 5, 2002 statewide ballot. C7. VEHICLE FOR STUDENT NEIGHBORHOOD_ASSISTANCE PROGRAM SNAP . (GARD[NER/BISHOP) RECOMMENDATION: Approve retention of unmarked surplus City vehicle for use by the Student Neighborhood Assistance Program through 2003. PUBLIC HEARINGS 1. ORDINANCE AMENDING THE.CITY'S ELECTION CAMPAIGN REGULATIONS. (PRICE/JORGENSEN/SIGURDSON — 15 MINUTES) RECOMMENDATION: As recommended by the Election Campaign Regulations Committee, introduce an ordinance amending Municipal Code Chapter 2.40, as it relates to election campaign regulations, and amending Chapter 15.40 as it relates to political campaign signs. 2. AUGUSTA STREET NEIGHBORHOOD TRAFFIC MANAGEMENT (NTM) .PLAN. (MCCLUSKEY/P. MANDEVILLE —45 MINUTES) RECOMMENDATION: By resolution, adopt the Augusta Street NTM Plan that calls for the installation of three speed tables on Augusta Street between Bishop and Sydney Streets. 3. MODIFICATION OF ALTA VISTA RESIDENTIAL PARKING PERMIT DISTRICT. (MCCLUSKEY/OPALEWSKI — 30 MINUTES) RECOMMENDATION: Adopt a resolution establishing revised boundaries for restricted parking of 200 a.m. to 10:00 p.m., Monday— Friday in the Alta Vista residential parking permit district. 4 Council Agenda - Tuesday, January 22, 2002 4. APPEAL OF ARCHITECTURAL REVIEW COMMISSION'S(ARC) APPROVAL OF A NEW DETACHED GARAGE WITH TEMPORARY DWELLING ON A SENSITIVE SITE WITH SETBACK EXCEPTIONS: MIKE & TRACY HARRIS,. APPPLICANTS, DEVIN & CHARMAINE GALLAGHER, APPELLANTS.. .2713 MEADOW (ARC 120-01). (MANDEVILLE/DUNSMORE — 30 MINUTES) RECOMMENDATION:. Adopt a resolution denying the appeal and upholding the Architectural Review Commission decision. BUSINESS ITEMS 5. PARKING IN-LIEU FEE CHARGES. (MCCLUSKEY/BOCHUM — 60 MINUTES) RECOMMENDATION: 1) Adoptresolution: a) Adopting a policy that the Parking-In- Lieu Fee will collect minimum of 40% of the cost of providing a new structured space in the downtown area. b) Modifying parking in-lieu fees for the Central Commercial Zone at $11,000 for new construction and $2,750 for use changes to reflect that new policy. c) Approving an annual CPI adjustment for both fees. 2) Direct staff to return to Council within the next 60 days with an amendment to Ordinance 1101 (1987 Series) that will delete the provisions for long-term financing of in-lieu fee payment. 6. APPROVE IMPLEMENTATION OF VOLUNTARY WATER USE OFFSET PROGRAM PER THE-WATER ALLOCATION REGULATIONS. (MOSS/MUNDS - 15 MINUTES) RECOMMENDATION: Direct staff to implement voluntary Water Use Offset Program using the guidelines and procedures established during the mandatory Water Use Offset Program and contained in the Water Allocation Regulations. COUNCIL LIAISON REPORTS (not to exceed 15 minutes) Council Members report on conferences or other City activities. Time limit=3 minutes. COMMUNICATIONS (not to exceed 15 minutes) At this time, any Council Member or the City Administrative Officer may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council Policies and Procedures, they may provide a reference to staff or other resources for factual information, request staff to report back to the Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda (Gov. Code Sec. 54954.2). A. ADJOURN. 5 i January 22, 2002 City Council Mayor Settle, John Ewan, Jan Marx Christine Mulhulland, Ken Schwartz, —� Community Development Director John Mandeville City Finance Director John Stotler To all concerned members, One thing we are all in agreement on is the need and desire to provide our children with sports fields and as soon as possible. In view of all the monetary expenses since 9-11 and in view of this current pictorial of big government acquiring state funds, and with sincere concern as a parent, I am requesting that the proceeds from the 2001 Lease Revenue Refunding Bonds, in particular reference to Series C, be placed in a separate trust fund for our childrens sports fields. The bond proceeds were stated to be used for the development of the athletic fields. That amount is approximately $3 million dollars. We need to protect our children's funds. I am requesting that the proceeds immediately be put into a separate interest bearing account where no one can spend it. Interest on $3 million dollars is pretty good, even short term. It is best to err on the side of caution. In view of the the rapidly changing events in the world today, we do not know what changes will occur with time or development. Some unforseen crisis like contamination could create the need to move elsewhere. Whatever happens we should protect those funds. Can we place our childrens $3 million sports field development money in a separate account designated to be spend only for construction of sports fields? I have another question: Staff says we applied for an army corps permit that included the design to build 4 fields. If that permit comes back with recommendations for only 3 fields, won't that make these fields quite expensive at almost $2million each? How much do other cities spend on sports fields? I would appreciate a written response as most of my questions never seem to be addressed. I am also requesting that this letter be included in the records of tonights meeting. NOAA is currently taking comments on the management plans for the Monterey Bay National Marine Sanctuary including boundary extensions. I think we have every reason to support the extension of the boundaries of existing sanctuaries to cover San Luis Obispo coastal areas. The Pacific coastal area of San Luis Obispo California is situated between two National Marine Sanctuaries, the Channel Islands National Marine Sanctuary to the south and the Monterey Bay National Marine Sanctuary to the north. Nestled within our coastal environs are: the Morro Bay National Estuary, the Santa Lucia Bank, a major off-shore bank; the five fingered, mile deep Arguello Canyon; three major upwelling' s, including one that is persistent between Pt. Conception and Pt. Sal, which form the basis for the basin's lush web of life that provides nutrients to the entire Northem Pacific Basin; a world class benthic community, supported by the permanent upwelling;and Chumash archeological sites, some of which were continuously occupied for 9,000 or more years. The Los Padres National Forest and the many State and County Park areas dotted along the coastal areas from San Simeon to the Nipomo Dunes are natural activities that account for a significant part of San Luis Obispo's tourist population dollars. All of these features, located within the San Luis Obispo coastal region, clearly illustrate the significance of the area. I urge you to send a letter in support of extending the existing Monterey Bay National Marine Sanctuary to at least Pt. Sal.
