DISCUSSION Staff has received a petition from residents living on the 100-200 blocks of Kentucky Avenue seeking to expand the boundaries for restricted parking between 2am-10pm, M-Fri. within the existing Alta Vista residential parking permit district. The petition is requesting that the hours for parking restrictions on the two blocks of Kentucky be extended from the current tam to 5pm to 2am to lOpm, Monday-Friday. This request is a modification of the boundaries for varied time restrictions within the current parking permit district (Attachment 2) and is not a request for a new permit district. Although the residents within the proposed time expansion area were surveyed when the Alta Vista District was divided into two different time restrictions in 1994, at that time there was no strong support to expand the district beyond what was being proposed. This resulted in the boundaries for the two different time restrictions for the Alta Vista parking district that exists today. The new petitioners have the support of 75% (12 out of 16) of the residents who feel that things have changed since 1994 that warrants expanding the extended time restriction boundaries According to the petitioners there are a number of concerns that they feel justifies expanding the late hour parking restrictions: insufficient residential parking protection, heavy traffic, and public safety issues. Although the petitioners realize that later hour parking restrictions will not solve all of the problems in their neighborhood, they believe the proposed parking measures will have a positive effect on their block. Because there is a potential for the parking problem to spillover into the adjoining neighborhood if the district time restrictions were modified as proposed, staff independently surveyed all of the remaining blocks that have 5pm as their ending time to determine if there was interest and support for expanding the district time restrictions further than what was proposed. A total of 92 surveys were sent to adjoining blocks. The results of the survey were mixed and are shown on Attachment 3. Overall, 43 out of 92 (47%) responded to the survey. Of these results only 19 residences (44%) supported becoming part of the expanded time area, with no clear majority for any single block to join the expanded district. Twenty-four residences (56%) did not support becoming part of the proposed parking district modifications. Given there was no majority 3-/ Council Agenda Report-Residential Parking District Page 2 interest to join the time expansion area from the surveyed streets, staff would recommend that the district time restriction boundaries be modified as set forth in the petition. In addition to the mail surveys, staff also conducted field surveys in early December in an attempt to ascertain the level of the problem. Based on the field observations there was support for the petitioners' concerns regarding impacted parking conditions along the blocks within the proposed expanded time restriction area. The 100 block was more heavily impacted while the 200 block experienced a moderate impact as you moved further into the neighborhood. CONCURRENCES The proposed extended hours of 5pm to IOpm for restricted parking fall within the responsibility of the Police Department, and more specifically Student Neighborhood Assistance Program (SNAP) personnel that currently patrol the existing late-hour streets in the district. The two extra blocks can be readily patrolled with reasonable efficiency without a major impact to the current enforcement routine conducted by the SNAP personnel. However, as with other after hours parking enforcement, the Police Department would only be able to dispatch personnel (Police and/or SNAP)when appropriate staff was available to respond to parking issues as opposed to other higher priority calls. The Police Department concurs with this assessment of the potential demands for parking enforcement of the expanded time restrictions for the district. Additionally, in accordance with the Council directive to seek student input regarding residential parking districts, staff informed the Student Community Liaison Committee in November 2001 that a time modification for Alta Vista would be going to Council in January 2002. No formal recommendation was received from the committee. FISCAL IMPACT Modifying the time restrictions for the parking permit district would have a very small financial impact to the City. Signs would cost approximately $150, which can be readily paid out of the current sign budget approved for the parking program. Conversely, there is a potential for producing parking fine revenues to offset the sign cost as well as produce additional revenue depending upon the level of enforcement and the number of citations issued. ALTERNATIVES Given the level of support (75%), creating a larger late-hour residential permit area is the most effective means of meeting the wishes of the majority of residents living on the impacted blocks. Thus, staff would recommend modifying the residential parking permit district to help improve the quality of life for the neighborhood. (2002 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ESTABLISHING THE GREATER ALTA VISTA AREA OF THE CITY AS A RESIDENTIAL PARKING PERMIT DISTRICT AND ESTABLISHING DAYS AND HOURS OF OPERATIONS OF SAID DISTRICT AND TIME OF RENEWAL FOR A PARKING PERMIT AND RESCINDING RESOLUTION NO. 8359 WHEREAS, the Council of the City of San Luis Obispo established the Greater Alta Vista Residential Parking Permit District; and WHEREAS, the Council of the City of San Luis Obispo determined that the quality of life for the residents of this district had been adversely affected by nonresidents using the neighborhood streets for excessive parking; and WHEREAS, the Council of the City of San Luis Obispo has determined that the restriction of nonresident parked vehicles on the neighborhood streets will improve pedestrian and vehicular safety and allow residents to gain proper access to their residences; and WHEREAS, the majority of the residents living on the 100 and 200 blocks of Kentucky within the Greater Alta Vista Residential Parking Permit District have petitioned for a change in the hours of operation; and WHEREAS, the Council of the City of San Luis Obispo has held a public hearing to consider the changes to the parking district and permit distribution and has determined the changes will improve the quality of life for the district residents. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Resolution No. 8359 (1994 Series)is hereby rescinded. SECTION 2. Pursuant to Section 10.36.170 et. Seq. of the San Luis Obispo Municipal Code the residential parking permit district hours are hereby established as shown on Exhibit A. SECTION 3. No vehicle other than vehicles providing services to the Greater Alta Vista District or having a permit clearly displayed on the dashboard on the driver's side of the vehicle shall park on any street within the shaded area from 2:00 a.m. to 10:00 p.m., Monday through Friday and the remaining district boundaries (shown in hashed area) shall restrict parking from 2:00 a.m. to 5:00 p.m., Monday through Friday. SECTION 4. The Public Works Department shall be directed to post the district with signs that clearly indicate these restrictions. 3-11 Attachment 1 SECTION 5. The Parking Division shall issue residential parking permits on demand as permitted in Section 10.36.220 of the Municipal Code. Permits shall be issued for a year effective September 15th of each year. After the current 5 p.m. Restricted parking time ,this block becomes congested with cars of students attending evening classes at Cal Poly and others using the gym facility. Besides creating congestion that interferes with accessing our driveways,there is the additional danger for those walking,skateboarders and bicyiclists. In addition,the street curves at about 174 Kentucky and visibility is obscured for oncoming cars and pedestrians. We make this request for the safety of our children and families and others traveling this block of Kentucky Avenue. We propose that parking permits be required from 2 am. to 10 p.m. Monday through Friday.
