SUBJECT: ACTING CITY ATTORNEY APPOINTMENT
CAO RECOMMENDATION
Adopt a resolution appointing Gilbert Trujillo as Acting City Attorney
DISCUSSION
City Attorney Jeffrey Jorgensen has announced his intention to retire effective February 9, 2003.
Because of accumulated vacation time, his actual last day of work will be approximately December
20, 2002. A recruitment for a new City Attorney has commenced. However, it is anticipated that
the new City Attorney will start work on or about April 15, 2003. Therefore, there will be a gap of
four months or more in which the City will not have a City Attorney.
In the past, it has been the City's practice to appoint an acting department head under such
circumstances. Staff is recommending that Assistant City Attorney Gilbert Trujillo be appointed
Acting City Attorney during the interim. Mr. Trujillo has been the City's Assistant City Attorney
since 1998 and has served as interim City Attorney in the past when Mr.Jorgensen was on vacation.
FISCAL IMPACT
This appointment will result in a salary savings of approximately $2,000 per month during the
interim period. That reflects the difference in salary between the temporary increase from $7172 to
$8580 per month for the Acting City Attorney and the regular rate of pay for the retiring City
Attorney of $10,723 per month. Additional salary savings will be realized because the Assistant
City Attorney position will be unfilled during the interim period. It is anticipated that contracting
with outside counsel may be necessary if workloads indicate that additional legal services are
required-

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPOINTING GILBERT TRUJILLO ACTING CITY ATTORNEY
WHEREAS, City Attorney Jeffrey G. Jorgensen will be retiring February 9, 2003 and will
be vacating his office on or around December 20, 2002; and
WHEREAS,the City has a need for interim City Attorney services.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo
that Assistant City Attorney Gilbert Trujillo be appointed Acting City Attorney effective January 1,
2003 that is the beginning of the next full pay period following Mr. Jorgensen's departure at a
monthly salary of$8, 580.
