SUBJECT: ADOPTION OF ORDINANCE NO. 1436 AMENDING MUNICIPAL CODE
CHAPTER 1056 PERTAINING TO SPECIAL SPEED ZONES

Adopt Ordinance No. 1436, amending Chapter 10.56 of the San Luis Obispo Municipal Code.
DISCUSSION
On May 6, 2003 the City Council voted 5:0 to adopt Ordinance No. 1436, which amends the City's
procedures for the designation of speed zones. Ordinance No. 1436 is now ready for adoption. The
amended section of the Municipal Code will become effective 30 Days after adoption of the
ordinance.
Adoption of Ordinance No. 1436 will amend Chapter 10.56 of the San Luis Obispo Municipal Code
in order to comply with State Regulations set forth in the California Vehicle Code. Amendments
include the elimination of existing speed zones designated in the Municipal Code allowing for
future designations to be implemented at a staff level as per methodologies prescribed in the
California Vehicle Code and California Department of Transportation Traffic Manual.
A minor clerical error was noted at section 10.56.010 of Exhibit A to Ordinance No. 1436, and was
subsequently corrected. The City Attorney advises under these circumstances the Council may
proceed with adoption of this ordinance without need for reintroduction.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AMENDING SECTION 10.56.010 OF THE MUNICIPAL CODE (SPEED LIMITS)
TO ACHIEVE CONSISTENCY WITH THE CALIFORNIA VEHICLE CODE
WHEREAS, the City of San Luis Obispo acts as the local authority to establish speed limits
on public streets within its corporate limits; and
WHEREAS, Section 10.56.010 of the City's Municipal Code prescribes speed limits for
some 39 streets; and
WHEREAS, the City has determined that many of the speed limits set forth in Section
10.56.010 do not reflect the results of current engineer and traffic surveys as required by the
California Vehicle Code; and
WHEREAS, it is the City's desire to achieve and maintain consistency between its
Municipal Code provisions and that of the California Vehicle Code.
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1: Chapter 10.56; SPECIAL SPEED ZONES, Section 10.56.010 of the Municipal
Code is hereby amended as shown on Exhibit A, attached hereto and incorporated by reference.
SECTION 2:A summary of this ordinance,together with the names of Council members
voting for and against, shall be published at least five (5) days prior to its final passage, in the
Telegram-Tribune, a newspaper published and circulated in this City. This ordinance shall go into
effect at the expiration of the thirty(30) days after its final passage.
INTRODUCED on the 6 h day of May,2003, AND FINALLY ADOPTED by the Council of
the City of San Luis Obispo at a meeting held on the 20t` day of May, 2003, upon motion of John
Ewan, seconded by Christine Mulholland and on the following roll call vote:

10.56.010 Speed limit designation
Prima facie speedlimitsshall be determined by the city traffic en ig neer pursuant to provisions set forth in the
California Vehicle Code. A speed limit established pursuant to this section shall be effective when appropriate signs
giving notice thereof are erected upon a street.
10.56.020 Regulation of speed by traffic signals-Sign posting.
The city traffic engineer is authorized to regulate the timing of traffic signals so as to permit the movement of traffic
in an orderly and safe manner at speeds slightly at variance from the speeds otherwise applicable within the district
or at intersections,and may erect appropriate signs giving notice thereof.
