CAO RECOMMENDATION
1. Approve and execute Amendment No. 3 to the Agreement to Furnish Design Services for
the Damon-Garcia Sports Complex Under Specification No. 99826 in the amount of:
$61,300.
2. Approve the transfer $34,000 from the construction phase to the design phase of the
project budget to fund Amendment No. 3.
DISCUSSION
On April 18, 2000 the City entered into an agreement with FIRMA to complete preliminary
design of the Damon Garcia Sports Complex. Two subsequent amendments to the original
agreement were processed for FIRMA to complete plans, specifications, and an engineer's
estimate (PS&E), as well as work necessary for the City to acquire all needed permits for the
project. All tasks from the original agreement and the two amendments have been completed
except for work associated with obtaining a Caltrans permit for improvements along the Broad
Street frontage. That work should be completed by mid-July.
The property immediately south of the project is a vacant, undeveloped parcel. During
preliminary design of the Damon Garcia Sports Fields, the owner of this adjacent property filed a
tentative map to develop his property but never finalized the parcel map or completed the
improvements. This proposed development.was to include extending Industrial Way west of
Broad Street, and the Damon-Garcia Sports Complex was originally designed to gain access
from this new street. When it became clear that development by the adjacent property owner
was not going to occur before construction of the sports complex, the City acquired the right of
way needed for the Industrial Way extension, and developing this new street became part of the
sports complex project. Additional work was required by FIRMA to design the extension of
Industrial Way and the Broad Street/Industrial Way intersection. The cost for this additional
work was estimated at $31,270 and is reflected in three separate proposals of work from FIRMA.
As this project has progressed into the construction phase, the City has also retained the services
of FIRMA and its team of subconsultants for construction administration services. These
services include technical support to the City on construction issues, interpretation of the plans
and specifications, review of contractor submittals, and required biological monitoring as
required in the project's various environmental permits. FIRMA has submitted a proposal to
perform the construction support service at a cost of$30,000.

The cost of all the work under Amendment No. 3 is $61,300. Although there is enough money
in the overall project budget to cover this cost, $34,000 must be transferred from the construction
phase to the design phase of the project budget, as shown in the following table:

1. The scope of work for the agreement between the City of San Luis Obispo and
FIRMA dated April 18, 2000 shall be amended to include the following tasks:
a. Engineering design for the parking lot entrance, fire vehicle access, and traffic
signal improvements at a cost of$17,705 per a proposal dated August 20, 2002
from FIRMA,which is incorporated into this amendment by reference.
b. Additional engineering design for revisions to the Broad Street Public
Improvement Plans at a cost of$8,165 per a proposal dated December 6,2002
from FIRMA, which is incorporated into this amendment by reference.
c. Additional engineering design for the intersection of Industrial Way and Broad
Street in response to Caltrans plan check comments at a cost of$5,940 per a
proposal dated June 9, 2003 from FIRMA, which is incorporated into this
amendment by reference.
d. Construction administration at an estimated cost of$30,000 per a proposal dated
March 19, 2003 from FIRMA, which is incorporated into this amendment by
reference.
2. All other terms and conditions of the agreement shall remain in full force and effect.

Attached is the work scope and fee proposal from Cannon Associates for additional services related to
fire truck loading of the bridges and flatwork and Improvement Plans for Industrial Way. As we
discussed, neither of these work areas were foreseen at the time we prepared our original work scope.
The fire truck issue surfaced at ARC review and the Industrial Way issue was in flux due to the Lathrop
project changing direction.
We are not marking up the additional services for Cannon, Higgins Associates and Earth Systems. The
requested fee amount is$17,705.00. I have directed the consultants to proceed based on your email and
verbal authorization.

provide the following services for this project.
SCOPE OF WORK:
IMPROVEMENT PLANS: INDUSTRIAL WAY&BALTIC STREET
Cannon Associates will prepare one(1) set of improvement plans for the expansion of
Industrial Way and the portion of Baltic Street providing the entrance to the sports fields
parking lot. The plans will include a plan and profile of the proposed improvements
including the design of the north half of Industrial Way including curb, gutter, sidewalk,
cross-gutter and drainage devices. In addition, 12 feet of the south portion of the road
will be designed including a transition to exit the site-at Broad Street. The improvement
plans will be designed in conformance with the requirements of the City of San Luis
Obispo Grading Ordinance Road Improvement Standards.

SOILS ENGINEERING INVESTIGATION
Earth Systems Pacific (EPS)will develop Geotechnical recommendations for the
concrete path and the two bridges(Orcutt and Acacia) associated with the fire access
route. In addition, EPS will provide recommendations for the structural sections for the
entrance to the site; Industrial Way and Baltic Street. The report and recommendations
will be intended to comply with the considerations of Sections 1804.2 through 1804.5,
and 3309.5 of the Uniform Building Code, 1997 edition as amended by pertinent sections
of Title 24.of the California Code of Regulations, and standard soils engineering practice.
It is Earth Systems Pacific intent that the report will be used exclusively by the client and
the architect/engineer to form the geotechnical basis of the design of the project and in
the preparation of plans and specifications.
TRAFFIC SIGNAL IMPROVEMENTS:INDUSTRIAL WAY
Higgins Associates will provide traffic engineering services. Their services will include
the development of appropriate design volumes for the Project Intersection (existing plus
project conditions), as well as all work required to revise the plans and specifications for
the related traffic signal modification improvements. It should be mentioned that the
development of design volumes is required to evaluate the requirements for any
channelization improvements along Broad Street (ie: southbound right-turn lane). The
following section provides an outline of the work associated with the proposed traffic
engineering services.
Summary of Traffic Services
The following text presents a brief description of the tasks required to develop the
appropriate design volumes at the Project Intersection, and revise the traffic signal
modification improvement plans and specifications.
1. Data Collection - This task includes obtaining all available existing traffic count
data for the Project Intersection from the City and Caltrans. In addition, the City
shall provide all data regarding the development of the park project to be located
north of the Scott Lathrop property. Any site specific information for the Scott
Lathrop property shall also be provided by your office.
2. Develop Design Traffic Volumes - This task includes the estimation of trip
generation quantities and trip distribution assignment percentages for the City's park
project and the Scott Lathrop property. The traffic generated from these projects
will be assigned to the Project Intersection to. develop the"existing plus project"
traffic volumes. This will also include any diversion assumptions that may be
required for the future extension of the internal street system to Tank Farm Road.
3. Perform Evaluation of Channelization Requirements - The evaluation of
channelization requirements will include a review of channelization warrant criteria,
as well as the appropriate storage and deceleration requirements.
4. Revise Traffic Signal Modification Plans and Specifications-This task includes our
time required to address the Caltrans comments, and make the necessary revisions

to the plans and specifications. This task also includes a limited amount of time for
any final revisions that may be required by Caltrans and the City to finalize the
improvement Plans, Specifications and Estimates (PS&E).
Not included in the Summary of Services is the collection of any new traffic count data,
the collection of any field survey data, the design of any roadway improvement features
(ie: paving, curb&gutter,pedestrian access ramp improvements, etc.), the preparation of
signal interconnect plans, the attendance at any project meetings, the provision of more
than one (1) set of reproducible pians and specifications, or three (3) copies of the Final
PS&E. Any additional work required to that described under the basic Summary of
Services will be considered extra work. Receipt of written authorization for any
additional work beyond our basic Summary of Services will be required prior to
performing any additional work beyond what is specifically described in this proposal.
ASSUMPTIONS AND EKCLUSIONS
Certain services that might typically accompany the scope of work included herein have
been excluded at this time. These services include retaining wall designs, fencing,dry
utility coordination, construction observation and.support services,and construction
staking. However,these services can be provided as needed on a Time and Materials
basis oras an addendum to this proposal upon written request from the Client. The
following assumptions and exclusions apply to this proposal and the services indicated
herein:
• The preliminary design for Industrial Way, completed in association with the
adjacent property, included water and sewer services associated with the future
development of that site. These utilities and all dry utilities shall be excluded
from the proposed design of Industrial Way and the scope of this proposal.

Traffic Signal Improvements -Revised Proposal to Provide Traffic Engineering Services
Dear Dwight,
I have reviewed the City (dated August 15, 2002) and Caltrans (dated May 24, 2002 - copy
attached) comments, as well as have spoken with Caltrans regarding the encroachment permit
requirements for the proposed improvements at the Broad Street / Industrial Way intersection. As
stated in the Caltrans comment B I. (Traffic Operations Department), the requirement for a traffic
study (ie: design volumes) has been waived. However, as stated in the Caltrans comment B2.
"Once the private property develops, the owner or developer will be required to apply for an
encroachment permit to re-evaluate any additional traffic mitigation to meet future
requirements". At this time it is my understanding that the encroachment permit process for the
Scott Lathrop property (west of Broad Street) has been put on-hold and that the City has submitted
an application for an encroachment permit. Therefore, Caltrans will more than likely consider the
construction of a new City park(north of the Scott Lathrop property) a formal development that will
require review by the Traffic Operations Department. At time we are prepared to reduce our
estimated project cost to a "fixed-fee"of$3,500; which will not include the development of any
design traffic volumes (Task #2) or the evaluation of any channelization requirements (Task #3).
However, it should be mentioned that City staff should discuss this issue with Caltrans prior to
eliminating Tasks #2 and #3 from our proposed scope of work. Caltrans may still require the
development and evaluation of design traffic volumes for the Broad Street / Industrial Way
intersection, which will then be considered extra work and will be subject to additional
compensation. If you have any questions or need additional information, please contact me at your

The amount of this contract amendment is $8,165. As we discussed, this contract amendment will be
billed to Paul LeSage and funded from the approximately $8,300 remaining in the categories "task 10-
Additional Corps permit work"and"task 11- Design contingency" under the Master Plan contract. It is my
understanding that Rincon will also have additional charges to finalize the Mitigation Plan. In the event
that the remaining amount does not cover both Rincon and the PIP revisions, it is my understanding that

Description of Services:
Revision of public improvement plans to move proposed bus turnout to the south
side of Broad Street/Industrial Way intersection. A right land turi> lame will be
added for southbound Broad Street traffic making a right turn onto Industrial Way
to access the new parking lot. Based upon conversations between the City of San
Luis Obispo and Cannon, the proposed bus turnout will be located immediately to
the south of the intersection (like a mirror image of the way it is currently laid out)
and will consist of a widened shoulder of AC pavement with paved access to the
cross-walk, from which pedestrians can cross Industrial Way and proceed down
the access ramp to the parking lot below.
Cannon's work will proceed as follows:
1) Cannon to consult with Higgins Associates on length of right-hand turn lane
required. Cannon will layout right-hand turn lane and new bus turnout. Layout
to be reviewed and approved by the City of S.L.O.
2) Cannon survey crew to perform required field work to obtain the additional
topo necessary to design the new bus turnout after turnout location is approved
by the City.
3) Cannon to preliminarily design bus turnout, notifying the City if additional
right-of-way or retaining walls are required for shoulder widening.
4) Cannon to proceed with vertical design of new bus turnout after obtaining
feedback from City of S.L.O.

Attached is the fee estimate from Cannon Associates, with Higgins Associates as a subconsultant, to

requests. As we discussed most of this work is done and Cannon is continuing to wrap it up. With your
signature this letter will amend our original agreement. The additional work will be billed hourly. The
hourly billing from Cannon will be marked up 10%to cover our administrative costs.

Response to CalTrans Comments
SURVEYORS
Dear David:
I have had an opportunity to review the comments received from CalTrans on the public
improvement plans for the Damon Garcia Sports Fields that you reviewed with Rebekah
Oulton and Dan Van Beveren on May 8`t'. We have prepared the necessary revisions to
the plans, and we intend to set up a meeting with CalTrans' engineers prior to
resubmittal to make sure that the revisions meet with their approval.
One of the required changes was relocation of the bus turnout from the right-hand-tum
pocket to an alternate location north along Broad Street. Relocation of the bus turnout
required redesign for the bus turnout itself and the ramp from the bus turnout to the field,
as well as updates to the grading plans affected by the ramp change.
As you discussed in your May 8"meeting,responding to comments from CalTrans is
included as a service on our previous contracts. However,as you may recall,the location
of the bus turnout within the right hand turn pocket was selected by the City,not Cannon
Associates. Therefore, we feel it is appropriate to request some additional compensation
for the significant effort required to revise the plans to CalTrans' satisfaction.
I have attached a Request for Additional Services that reflects the estimated cost for
updating the plans to relocate the bus turn out. Note that costs for responding to the
other comments from CalTrans are not included in this estimate,but are part of our
previous contract. We would appreciate it if this Request could be authorized before we
set up the review meeting with CalTrans.

At your request, I have prepared the following proposed work scope and fee based on our discussion.
The Basic Services that firma will provide are:
1. Construction Phase-Fee: Hourly
a. Participate in Project site visits, and telephone communications,with the City's Project inspector and
Project Manager,and the Project's contractor to generally review the progress of construction and to
see if the work completed is generally consistent with the intent of the approved Construction
Documents on an as needed,on call basis.
1) Although Landscape Architect and it's subconsultants may observe and discuss potential
problems, these visits are not construction inspections or a guarantee that there will not be
construction deficiencies.
a) If requested, review required contractor submittals, such as shop drawings and samples,
but only to determine if they conform to the visual and aesthetic design intent.
b) If requested, review contractor's payment applications to determine if the amount of work
represented as complete is generally consistent with the Landscape Architect's
observations during its site visits. Landscape Architect's or it's subconsultant's review
shall not be a representation that same has supervised the work, or reviewed how or for
what purpose contractor has used or intends to use Owner's payments
Our subconsultants Cannon Associates, APS Architects and Thoma Engineering will provide the above
services for work related to the plans and specifications prepared by each. The work would not include
drainage or lines and grade certification, soil investigations, surveys, or mitigation monitoring.
All hourly rates for additional services, reimbursable reproduction expenses including prints, reductions,
and postage will be billed per the attached rate schedules. Subconsultants will be billed at cost times 1.1.
