Lowell, City Attorney3t- SUBJECT: AUTHORIZATION FOR CITY'S DELEGATE TO VOTE REGARDING PROPOSED CONSTITUTIONAL AMENDMENT AT LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE CAO RECOMMENDATION Authorize the City's Voting Delegate to support at the General Assembly of City Voting Delegates at the League of California Cities Annual Conference a proposed constitutional amendment to protect municipal revenues. DISCUSSION In response to the current state budget crisis, the League of California Cities is developing and seeks to sponsor a proposed constitutional amendment that would check the power of the state government to balance the state budget by appropriating local tax funds that pay for police, fire, EMS, infrastructure maintenance, park and library services. The measure would be placed before the voters by initiative in November 2004. The General Assembly of City Voting Delegates will consider, the proposed constitutional amendment at the League's Annual Conference in Sacramento, September 7-10, 2003. The Council has previously designated Mayor Romero as the City of San Luis Obispo's voting delegate and Vice Mayor Mulholland as the alternate voting delegate. The City's delegate should be granted authority to cast a vote in favor of the League of California Cities' sponsorship of the proposed constitutional amendment. FISCAL IMPACT None. However, without passage of the proposed constitutional amendment, cities will continue to be subject to fiscal uncertainty in the face of potential further state take-aways. ALTERNATIVES Not authorize the City's delegate to vote on this matter. This alternative is not recommended as it deprives the City of a voice regarding a matter that impacts the City's fiscal condition.
