SUBJECT: FOOTHILL BRIDGE REPLACEMENT ENVIRONMENTAL DESIGN
CONTRACT, SPECIFICATION NO. 90197A.
CAO RECOMMENDATION
1. Approve Amendment 5 to the Agreement with Martin; Rivett & Olson (MRO) for design and
other services on the Foothill Bridge Replacement Project and authorize the Mayor to execute
Amendment 5 upon receipt of the signed amendment from MRO.
2. Authorize the City Engineer to execute future amendments up to $24,000 (the remaining
balance in the design account) in order to complete design, environmental work, and right of
Way activities in a timely manner.
DISCUSSION
MRO, the design consultant for the Foothill Bridge, is nearing completion of the various tasks
necessary to bring the bridge project to construction. Over the duration of the contract, Public
Works has authorized two amendments for additional work, including preparation of permit
applications, acquisition of clearances from the Federal Emergency Management Agency, and
design of various minor refinements. One amendment simply authorized commencement of right
of way work at no additional cost. Another amendment reduced costs because the City contracted
directly with subconsultants in order to expedite progress on the project.
Amendment 5 covers revisions to the construction easements needed after review of the easements
by an appraiser. These revisions will minimize impact to adjacent property owners during
construction. The Army Corps of Engineers requiresadditional study of the flow characteristics of
the new structure before it can issue a permit for the project,and a review of the appraisals for the
acquisition of the temporary easements by another appraiser is now a condition of the federal
funding. This requirement represents about half of the additional costs of this amendment.
Public Works is also recommending expanded authorization for the City Engineer to approve
additional work for design, environmental work, or right of way up to the limits of the existing
budget for design. This will expedite any further amendments needed so work can be proceed on
schedule.
FISCAL IMPACT
The cost of Amendment 5 is $10,030. The table on the next page shows the status of the project
design budget.

AMENDMENT FIVE TO AGREEMENT
THIS AMENDMENT FIVE TO AGREEMENT is made and entered in the City of San Luis
Obispo on this _ day of 2003, by and between the CITY
OF SAN LUIS OBISPO, a municipal corporation, herein after referred to as City, and Martin, Rivett
& Olson Inc., Consulting Engineers hereinafter referred to as Consultant.
WITNESSETH;
WHEREAS, on September 26, 2001 the City entered into an Agreement with Consultant for
design and environmental services for the Foothill Street Bridge; and
WHEREAS, the City requires the completion of some additional work to complete the
permit process and the appraisal and acquisition of the necessary construction easements;
NOW THEREFORE, in consideration of their mutual promises, obligations and covenants
hereinafter contained, the parties hereto agree as follows:
1. Authorization is given for additional work to complete permitting and right of way
acquisition in an amount not to exceed $10,030 (See Exhibit A);
2. All other terms and conditions of the Agreement remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this instrument to be executed
