McCluskey, Public Works Director#_ Prepared by: Austin O'Dell, Transit Manager SUBJECT: PUBLIC HEARING ON THE 2003-04 PROGRAM OF PROJECTS FOR THE 2003-04 FEDERAL TRANSIT ADMINISTRATION GRANT CAO RECOMMENDATIONS: 1. Conduct a public hearing to review the transit 2003-04 Program of Projects. 2. Adopt a resolution authorizing the Public Works Director to file a grant application and execute the grant agreement from the Federal Transit Administration in the amount of $890,765. 3. Amend the Transit Fund budget for 2003-04 to conform with the Short Range Transit Plan adopted by the Council on August 28, 2003,which is the basis for the grant application. DISCUSSION Since the 1990 census, the City has been classified as an urbanized area and is eligible to receive Federal Transit Administration (FTA) formula grants for operating and capital assistance. To apply for these grants, the Council must annually: 1. Publish the Program of Projects (POP); 2. Hold a public hearing on the proposed POP for Federal transit assistance 3. Seek approval by the San Luis Obispo Urbanized Zone Area Technical Committee 4. Adopt a resolution authorizing the Public Works Director to file a grant application and execute the grant agreement; and, 5. Forward the approved POP to SLOCOG for review and amendment into the Federal Transportation Improvement Program (FTIP). The 2003-04 POP was published in the Tribune on September 30, 2003. The public hearing on the 2003-04 POP is required to a) notify the public how the Urbanized Zone Area will spend its FTA grants, and b) provide the public an opportunity to comment. This public hearing is a formality to satisfy FTA requirements and will allow the City to receive FTA grant reimbursements in the amount of$890,765 for the following projects: �"l � I Council Agenda Report—Transit Program of Projects—2003-04 Page 2 Total Federal Local Cost Share Share SLO Transit Operations for 2003-04 $2,054,519 $635,565 $1,418,954 Capital Cost of Contracting 275,000 220,000 55,000 Bus Stop Improvement/Bus ID 39,000 31,200 7,800 SMART Card Study 5,000 4,000 1,000 Totals $2,373,519 $890,765 $1,482,754 The projects listed are based on the adopted Short Range Transit Plan and differ from the 2003- 05 Financial Plan in the following ways: 1. The cost of SLO Transit Operations is increased by $46,300 to pay for additional services recommended in the adopted Short Range Transit Plan. 2. The Capital Cost of Contracting project cost is increased from $50,000 to $275,000 effective with a recent re-interpretation of FTA regulations. This is advantageous for the City because it allows a commensurate reduction in operating cost and makes it easier to meet fare to cost ratios required as a condition of receiving State grants. 3. The Bus Stop Improvements/Bus Identification project cost is decreased from $56,000 to $39,000. This reduction will allow accumulation of enough Federal grant money to finance the planned Fleet Replacement project. 4. The North Area Regional Facility — Transit project is eliminated based on a recent Council decision to postpone this project. 5. The Transit Smart Card Feasibility Study is moved from the operating budget to the CIP budget. Although the cost is less than $15,000, this move allows a larger Federal share on the project. The grant agreement requires annual certifications of compliance with regard to regulations such as civil rights, procurement procedures, and substance abuse. Authorizing the Public Works Director to apply for the grant and execute the agreement is required by state and federal guidelines. CONCURRENCES The MTC approved the Draft 2003-04 POP at its June 11, 2003 meeting. The minutes of that meeting are attached. C The San Luis Obispo Urbanized Zone Area Technical Committee approved the POP on September 22, 2003. FISCAL IMPACT In addition to the project changes listed above, there is more FTA grant money available because more money was appropriated by Congress for the 2002-03 apportionment than was previously anticipated. This resulted in $93,445 being carried over to the 2003-04 apportionment available to the City. ROLL CALL Present: Deby Anderson(chair), Bob Johnson, Jean Knox,Andrew Rubin, Denise Martinez, and Jim Weir Alternates: Kathryne Howard Staff: Tim Bochum, Deputy Director Austin O'Dell, Transit Manager Absent: None. Vacancies: Technical Representative, and Alternate Alternate Kathryne Howard served as a voting member on the Committee. ANNOUNCEMENTS Ms. Lee Price, City Clerk, swore in the following newly appointed members: Andrew Rubin, Jim Weir, and Denise Martinez. Ms. Price also reminded the Committee of the Annual Advisory Body Training on Wednesday, June 18, 2003 at 5:00 p.m. in the Library Community Room. Ms. Price confirmed Mr. Johnson's RSVP. Ms. Anderson confirmed with.Ms. Price that she will not be attending. Ms. Price also informed the Committee that her office is advertising for the recruitment of the Technical Representative and the Alternate. Mr. O'Dell announced that the City was awarded the Tranney Award from the California Transportation Foundation for the Advance Public Transportation System. 3-7 I A ATTACHMENT Mr. O'Dell has announced that he was appointed to the California Transit Association's Executive Committee. Mr. O'Dell reported that the dedication of the second bus for Art on Bus Program was a success. Mr. Bochum announced that the City received an awarded from the American Public Works Association(Central Coast Chapter) for the Downtown Transit Center. PUBLIC COMMENTS There were no public comments at this time. CONSENT ITEMS A-1. Approval of Special Meeting Minutes of March 26,2003 The following corrections were made to the minutes of the special meeting of March 26, 2003: 1. Referring to the heading of the minutes,,add the word"SPECIAL" in before "MEETING MINUTES." 2. Referring to the discussion on the Service Stop Master Plan in D2, (7), Ms. Knox noted that the Committee discussed that some funds in the current FY 2002/03 budget would be used for signs. In addition,Ms. Anderson noted that was discussed that there were several surveys mentioned in the Short Range Transit Plan, and that the one survey that inferred that the signs were in good shape was conducted in 1999. 3. Referring to the discussion on the New Route 6 (Cal Poly Circulator) in D2, (1), Ms. Anderson noted that the original recommendation was for the New Route 6 to operate from Monday through Sunday. It has been changed to operate from Monday through Saturday. 4. Referring to the fourth paragraph in D2, (2), Ms. Anderson noted that the sentence should read: "Route 2, Route 3, and the current Route 6 would no longer serve Cal Poly." 5. Ms. Anderson noted that the discussion regarding the next steps (e.g. public meetings, MTC fmal recommendations, Planning Commission,and City Council) is missing. Invitation for Joint Meeting with the Planning Commission and Bicycle Advisory Committee on July 2,2003. Mr.. O'Dell informed the Committee of the invitation for to a joint meeting with the Planning Commission and the Bicycle Advisory Committee to provide input on improvements on Highway 1. The meeting is on July 2, 2003 in the City Council Chambers. Mr. Bochum added that there is an existing plan from Monterey to Santa Barbara counties. Caltrans is requesting input from City transportation advisory committees. Ms. Knox raised her concern of bicycle safety. Mr. Bochum stated that is the kind comment that Caltrans wants to hear. Mr.Johnson asked if the input will be used in a planning document for future projects, and subsequent public meetings will follow. Mr.Bochum confirmed. The following Committee members indicated that they would attend the Joint Meeting with the Planning Commission and Bicycle Advisory Committee on July 2, 2003 at 7;00 p.m. in the City Council Chambers: Deby Anderson, Jim Weir, Kathy Howard, and Denise Martinez. [A] acEnaa n �EpoRt i�mN a C I T Y OF SAN LU I S O B I S P O FROM: Paul LeSage, Parks and Recreation Director Mike McCluskey,Public Works Director SUBJECT: RESOLUTION AUTHORIZING TEMPORARY CLOSING OF CERTAIN STREETS FOR DOWNTOWN ASSOCIATION ANNUAL HOLIDAY PARADE CAO RECOMMENDATION Adopt a resolution authorizing the temporary closing of certain streets for the Downtown Association's annual Holiday Parade. DISCUSSION The Downtown Association's Holiday Parade has been conducted for over twenty years without serious incident. However, as the popularity and size of the event has grown, so has the potential for a conflict between automobile traffic and parade participants and viewers (many of whom are young children.) This risk is greater, also, as this parade occurs well after sunset. Given these factors, the Police, Public Works and Parks and Recreation departments and the City's Risk Manager feel that it is essential that the City have the ability to temporarily close certain streets to Vehicular traffic, including areas to be used for staging and de-staging of floats. Accordingly, for the first time last year, staging areas were closed to vehicles. In response to concerns raised after last year's parade by residents living in the closed areas in and around the parade route, the Downtown Association conducted a meeting for interested neighbors on September 30, 2003, as part of the preparation for this ,year's parade. The Downtown Association explained that based on City'safety requirements,with which it agreed, it intended to continue the practice of closing the staging area to all vehicle traffic. In years past, special entry passes were issued to neighbors to drive into the parade areas during the event. As indicated above, staff and the Downtown Association believe that allowing some vehicles into the area now poses a safety hazard to pedestrian participants and viewers. However, staff did offer an accommodation that we hoped would lessen the neighborhood's inconvenience. Staff has identified and provided a parking lot for resident's use during and after the parade. Thus, people who return home during the evening while the area is blocked off will have a place to park for the night and can then walk a couple of blocks home, or accept a ride on a City electric cart to their residences. They can retrieve their cars later that night or the next day. Unfortunately, few neighbors were actually at the meeting of September 30, 2003, and, although a number of other logistical issues concerning the parade were resolved, the proposed accommodation was not considered acceptable by one of those present. He had circulated a petition opposing the street closure prior to the meeting,but it is unlikely those who had signed it Council Agenda Report—Holiday Parade Street Closures Page 2 are aware of the measures the Downtown Association proposes to accommodate the neighborhood. California Vehicle Code section 21101 (e) authorizes temporary closing of a portion of any street for celebrations, parades, local special events, and other purposes when, in the opinion of local authorities having jurisdiction, or a public officer or employee designated by resolution, the closing is necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing. The City has adopted regulations that authorize the temporary closing of certain streets in conjunction with parades on particular routes. The Downtown Association's Holiday Parade follows one of the City's approved parade routes,but the staging and de-staging areas necessarily impact other local streets. This resolution, which applies to this year's event and subsequent Downtown Association Holiday Parades, allows for the temporary closing of streets for this particular parade and necessary staging and de-staging areas. The attached resolution delegates authority to close streets for this particular event to the Police Chief, the Public Works Director, the Recreation and Parks Director and their designees. CONCURRENCES The Police Department, the City Attorney and the Risk Manager concur with this recommendation. FISCAL IMPACT There is no fiscal impact to this action. The Annual Holiday Parade is already factored into the operations of all affected City departments. ALTERNATIVES 1. The Council could choose to cancel the Holiday Parade and thus no action would be needed to temporarily close any streets. 2. The Council could direct staff to issue parking passes to the neighborhoods,but staff does not recommend this due to the potential for increased exposure to liability. (2003 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AUTHORIZING THE CLOSURE OF CERTAIN STREETS AND TEMPORARILY ESTABLISHING NO PARKING RESTRICTIONS AND TOW AWAY ZONES IN ORDER TO FACILITATE THE DOWNTOWN ASSOCIATION'S ANNUAL HOLIDAY PARADE WHEREAS, the San Luis Obispo Downtown Association traditionally holds its Annual Holiday Parade on the first Friday in December of each year, an event of local significance which attracts large numbers of people to the community; and WHEREAS, the San Luis Obispo Downtown Association will be holding its Annual Holiday Parade this year on December 5, 2003; and WHEREAS, pursuant to Vehicle Code Section 21101(e), the City may temporarily close portions of streets for local special events such as the Annual Downtown Association Holiday Parade, when the closing is necessary for the safety and protection of persons who are to use those portions of the street during the temporary closure; pursuant to Vehicle Code Section 22507, the City may prohibit parking on portions of streets during all or certain hours of the day; and pursuant to Vehicle Code Section 22651 (b), (m), and (n), City peace officers may remove by towing any vehicle from those portions of the street where parking has been prohibited; and WHEREAS, to accommodate the San Luis Obispo Downtown Association Annual Holiday Parade, it is requested that the following streets identified below and shown on Exhibit "A be closed to traffic and no parking and tow away zones be established between the hours of 5:30 p.m. and 10:00 p.m. on the day of the parade: • Higuera Street from Santa Rosa Street to Nipomo Street; • Monterey Street from Santa Rosa Street to Nipomo Street; • Palm Street from Morro Street to Nipomo Street; • Mill Street from Morro Street to Broad Street; • Peach Street at Broad Street—Resident Access Only; • Nipomo Street from Marsh Street to Monterey Street; • Osos Street from Marsh Street to Palm Street; • Morro Street from Marsh Street to Palm Street; • Chorro Street from Marsh Street to Peach Street; • Garden Street from Marsh Street to Higuera Street; and • Broad Street from Marsh Street to Peach Street. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Finding. SECTION 2. Action. The Police, Public Works,and Recreation and Parks Department are ordered to close the above-identified streets, prohibit parking and establish a tow away zone between the hours of 5:30 p.m. and 10:00 p.m. for the Annual Holiday Parade. SECTION 3. The Police Chief, Public Works Director, Director of Recreation and Parks, and their designees are authorized to take appropriate actions to carry out the intent of this resolution, including, but not limited to, the actions set forth in Section 2 above. Furthermore, said City officials are authorized to allow for minor modifications to the parade route as deemed necessary for the public safety and welfare. SECTION 4. This Resolution shall remain if effect for each Downtown Association Annual Holiday Parade held in the City unless rescinded or amended by the City Council. September 11. 2003 To: Downtown residents I, Gary Fowler live at 777 Mill Street and I am a resident and neighbor of yours. The City of San Luis Obispo is planning to close our streets for the annual Christmas Nigh�.Parade on December 5th, Friday. Last year they did not issue passes so that we could enter and leave our residence. This was the first time they had ever done this. It was totally unacceptable. Many of us had to park our cars many blocks away and then go and retrieve them after 11:300m. Additionally, it was raining. I intend to attend the discussion on Tuesday, September 30th, at 5:30pm. If you can not attend this meeting and you feel as I do that the only acceptable solution is the issuance of a pass for all residents, would you please sign this petition and authorize me to s eakin you behalf. The City of San Luis Obispo is planning to close our streets for the annual Christmas Night Parade on December 5th, Friday. Last year they did not issue passes so that we could enter and leave our residence. This was the first time they had ever done this. It was totally unacceptable. Many of us had to park our cars many blocks away and then go and retrieve them after 11:30pm. Additionally, it was raining. I intend to attend the discussion on Tuesday, September 30th, at 5:30pm.
