As recommended by the Parks and Recreation Commission and the Joint Use Committee, adopt a resolution establishing a policy for the display of advertising in City parks. 2. Direct the staff to return with a resolution amending the City's master fee schedule to set fees for signs at the San Luis Obispo Baseball Stadium at a future Council meeting. DISCUSSION Existing Situation This past summer, an organization using the San Luis Obispo Baseball Stadium, located in Sinsheimer Park, was given permission to display advertising banners in the stadium during games. Using a policy adopted by the Joint Use Committee in the mid 1980's as a guideline, staff required the user group (the Blues Baseball Club) to display the advertising banners only during games. The Blues management disputed this decision, claiming that it caused them a financial hardship to place and then remove the banners for each of their 30 home games. Since none of the other user groups objected and there is not a City Policy covering advertising in parks, staff determined it was appropriate to let the Blues keep their advertising up during the season and to resolve the issue in the Fall. City parks host a significant number of special events during the year. In many cases, these events are sponsored by local non-profit organizations as fizndraisers. The non-profits often enlist the support of private businesses and recognize that support through advertising during their event. The past practice has been to permit this advertising, but only during the actual event. Advertising and Donor Recomnition An advertising policy is important as often situations arise that need quick resolution, and such a policy would guide staff to make a decision that coincides with Council direction and community standards. In determining a policy, it is important to note the difference between advertising and donor recognition. In this instance, advertising would be signage purchased in support of an organization or activity. Sales of the signs would be used to raise funds. There is an implied "quid pro quo" in that the purchaser expects to receive recognition in the form of signage that would name the purchaser and/or business they represent. Such signage could contain language or artwork that promotes a business concern. While donor recognition might contain the name of a business, it should in no way advertise the business. Donor recognition is already covered under the City Donor Acceptance Policy, adopted by the City Council on September 7, 1999. The Policy The recommended policy is based on a community standard that seeks to protect public spaces from the pollution of signage and commercialism. However, it also takes into account the support that private businesses provide for the non-profit and public sectors of the community. The following policy for advertising in City parks is proposed: For City Parks, with the exception of San Luis Obispo Baseball Stadium: 1. All advertising signage in City parks shall be temporary and shall be removed after each daily use. 2. The City reserves the right to accept or deny any signs placed on or in its facilities. 3. The size of a sign shall not exceed 6 feet by 16 feet. 4. Signs shall be posted only at the following sites at the indicated locations: a. San Luis Obispo Swim Center—during swim meets on the perimeter fences. b. Youth Baseball/Softball Fields—on the outfield fences. c. Stockton Softball/Baseball Field—on the outfield fence. d. Sinsheimer Tennis Courts — on exterior fences but not to interfere with tennis courts uses, such as installation at the end of each court. e. Santa Rosa Park softball field, multi-use court, and skate park - on the fences. f. Damon-Garcia Sports Fields - on stand alone banners. g. During recognized special events held in City parks or joint use facilities. 5. There will be no charge for temporary signs to be placed in City parks under a permitted use. For San Luis Obispo Baseball Stadium: 1. With the consent of other San Luis Obispo Baseball Stadium users, organizations will be allowed to place signage on the outfield fence during the baseball season, commencing on May 1 and ending on August 15. 2. Signs may be posted on the outfield fence only. 3. The City reserves the right to accept or deny any signs placed on or in its facilities. 4. The size of a sign shall not exceed 6 feet by 16 feet. CONCURRENCES The Parks and Recreation Commission reviewed and endorsed this policy on September 3, 2003. The Joint Use Committee supported the PRC recommendation as it applies to joint use sites and approved the policy for San Luis Obispo Baseball Stadium signage on September 23, 2003. Copies of the minutes are included as Attachments 2 and 3. At both advisory body meetings, there was a significant amount of discussion about allowing signage to remain up in the San Luis Obispo Baseball Stadium during the baseball season. It was �T Advertising in City Parks Page 3 ultimately determined advertising signage is commonly found on the walls of baseball stadiums and might actually add to the ambiance. The policy has also been forwarded to staff at the San Luis Coastal Joint Unified School District, since it covers joint use facilities. FISCAL IMPACT Both advisory bodies recommend the charging of a fee when signs are left up in the San Luis Obispo Baseball Stadium during the baseball season. The recommended annual fees are $25 for signs 4 feet x 8 feet or smaller and $50 for signs larger than 4 feet x 8 feet. Since fees are being established for a new program, action on setting the fees will be deferred to a future Council meeting, as a public hearing is required to do so. Staff estimates the annual revenue to be around $1,000. The Joint Use Committee also endorsed a recommendation that any revenue received from advertising in the baseball stadium be deposited into the City Joint Use Fund and designated to maintain the stadium at the discretion of the JUC. Staff does not agree with the Committee's recommendation: in accordance with current City policy, the Finance Director recommends depositing these fees into the General Fund to help offset the cost of maintaining this facility, which is significantly greater than the revenue (about $1,000 annually) that will be generated from this fee. This difference between the JUC and staff recommendations can be resolved when this returns for Council approval. ALTERNATIVES Do nothing. Present practice would continue and enforcement would be difficult. Staff would continue to address the issue in facility use contracts. ATTACHMENTS 1. Resolution 2. Joint Use Fund Report The Committee reviewed the Fund Activity Report dated August 20-September 12, 2003. 4. Facility Use Grant—September 2003 Grant Cycle Linda Fitzgerald reviewed a request received from Girls Softball Association for assistance with their June 2004 tournament facility uses at Cal Poly. Katie Peters, representing Girls Softball Association, spoke in support of their request of $2,000 for Cal Poly facility uses. The Committee reviewed the purpose of funds is limited to rental of facilities. Advertising at Joint Use Facilities The Committee reviewed a proposed advertising and sign requirement for all joint use facilities, developed by the assigned subcommittee, in addition to the recommendation of the Parks & Recreation Commission. Tim Golden, SLO Blues, spoke in support of the proposed fee of$50.00 ($25.00 for signs smaller than 4x6). He recommended the size be changed to standard size 4x8 (from the proposed 4x6). The Committee discussed 1) plans for providing funds for maintenance upkeep for banner locations; 2) banner funds collected be earmarked for facility upkeep; 3) City staff will determine appropriate language on banners and each banner receiving approval before being displayed; 4) not charging youth organizations. CONSIDERATION OF MINUTES: The minutes of the August 6, 2003 meeting were approved, with correction of"Vice Chair Bill Pyper called the meeting..."instead of Chair Peter Dunan. Advertising in Parks LeSage explained the Advertising in City Parks agenda report and philosophy. Chair Dunan opened the meeting for public comment: Tim Golden Arroyo Grande, Requested that SLO Stadium users be allowed to leave signs up during the baseball season. Grant Applications LeSage explained the two Proposition 40 Grant Applications to the Commission. Recommendation: ` Endorse the City applications for allocation funding of$340,364 available from the State Department of Parks and Recreation through Proposition 40 Program. (Clay/Buckshi, unanimous). 5. Directors Report LeSage briefed the Commission on the following subjects: • Capital Projects—Damon Garcia update. • Ludwick Dedication is November 15th at 11 am. — 1 p.m. October 13 the City will have an open house and volunteer dinner on October 17th. LeSage invited the Commission. • Commissioners workshop will be held on November 8`h,more information to come. 6. Staff Reports Perrin gave an update on the pool and the future therapy pool. She also gave the Commission a handout with the activities of the department. Beights updated the Commission with various park projects. 7. Committee Reports Commissioners gave reports on Committees they attended. 8. Communications Pyper requested that non-resident fees be added to the next agenda. 9. Ifem 2 would be catastrophic O the future of the Blues Baseball Organaation These smaller signs represent about 25%of our revenue,but this is an area that represents the most hope and potential for the growth for our or- ganization. Without this ability to grow we will have to find new sources of income or we may have to abandon our quest entirely. This would be more than just a set back,it is closer to°a dagger in our backs.° We have invested 10 years and tens of thousands of dollars to build the Bores info a National rem baseball dub. We had over 20,000 fans attend games last year,we have the support of hundreds of businesses,and there are only a few people(d any)that won't agree that the Blues are an asset m the community.We create jobs and bring many people unto town that spend dollars in our hotels,restaurants and other businesses. 1 actually had many compliments on how the stadium looked this summer. 'I had also asked Paul LeSage 0 there were any complaints about lt and he implied that there had not been any. We are a dean,wholesome,family oriented business.The banners that were placed at the stadium this summer made the place look professional and overall the stadium looked great Moreover,l attended 3 meelings(2 JUC&1 Parks Commission)concerning this resolution. During these meetings,never more than a fleeting statement was made in regards to the restriction of locations. To the best of my knowledge there was never any discussion or agreement by any members of the JUC or the Parks Commission ming a provision to restrict signs lathe outfield only. I have reviewed the minutes and cant final any mention of it there. Also,l have consulted mems of the JUC and the Parks Commission and they cant recall any statements,decision or agreement regarding this provision that the banners world be restricted to.only the outfield In fad,none of the banners in the outfield are less than 6'x 17 and the only place you find a 4'x S sign would be in the areas Mare surrounding the interior perimeter of the stadium. A major part of that debate over the$25&$50 fee weld onlypertain to banners that are it x 9 andsmaller. Many members of the Parks Commission even felt that the assessment of a fee was petty and contrary to supporting events such as the Blues. I did not oppose the fees,in hopes that the fees would be rued for impruvemerrts to the stadium. 90%of the people that see these signs are Blues fans. I dont not believe that they affect anyone in a negative way. Over the pact 2 seasons,we have secured extra money from some of our spon- sors/advertisers and passed on generous donation to Babe Ruth and sone of the other users. I agree with the determination that the stadiuun and the Blues are di ferei than other parks. 1 accepted the fees and believe that our rdationstap with city should be more defined I hope for a day that we could actually.have a long terra contract w/the city. As well as a sign of our own,°Home of the SLO Blues°nerd games... Having a relationship based purely on'good faith'with a Recreation Departnert makes it difficult braise log terra capital. I still do rat under- stand why our Recreation Dept will not embrace and foster an organ¢ation such as the Blues. In the past,I have been told I couldn't do this,or that,and because I have asked'Wrt yr'or caked for a soMor I have been told,by the Recreation Dept that l am difficult to work with. Many oth- ers in the community appreciate what we have acoompfished and do not agree with the opinion of the Recreation Dept I admit,it has been diffi- cult at times,keeping the Blues alive in SLO. I have exhausted(invested)my savings,sold my home and to keep this going. I had no idea how difficult it would be,until it was too late to pull the plug. We have barely made it We have been dose to bankruptcy and although we are still in debt..we have high hopes for the fuhm We have prouseded without certainty in many funs,but newer without hope. We will continue to work hard to make that future brighter for the Blues and our community. As I have learned atter 10 season of bringing the Blues back to SLO. It would be catastrophic for the Blues,Americas Paslime and baseball fans throughout the oommunuty. ftespectfrly, cwt 4&— Tim Golden General Manager �I r 3 Proposed Advertising and Sign Regulations at all Joint Use Facilities The following advertising policy is needed in order to provide City Parks staff with the guidelines to make decisions regarding Donor and Advertising in recreational facilities, which come under the joint jurisdiction of the City of San Luis Obispo and the San Luis Coastal Unified School District. Definition: Advertising - Signage purchased in support of any activity using a recreational property. An implied "quid pro quo" exists in that the purchaser expects to receive recognition as a financial supporter of the activity at the facility event. Donor - Recognition is typically a business or individual name and is not intended to be a business advertisement. Donor recognition is for significant facility contribution. If a business name is used, no company logo is included. Non-Profit Youth Sports - Those organizations that typically have youth under the age of 18, and have a non-profit status with the IRS Inappropriate Advertising - Alcohol, tobacco, "Adult", or any offensive activity is not be allowed Regulations: San Luis Stadium/Sinsheimer Pool Complex 1. No Inappropriate Advertising Signs. The City of San Luis Obispo reserves the right to accept or deny any Advertising Signs at its facilities. Advertising Signs are to be removed immediately at the end of the contracted use period. 2. An Advertising Sign fee, paid prior to sign posting, of $100 per contracted use period (generally a season of use). a. No fee is charged to Non Profit Youth Sports organizations; However, all other Advertising and Donor Sign rules apply. b. Revenues from Sign Advertising fees would be applied to facility improvements at the facility where the sign is posted. c. Signs will generally be limited to a size of no larger than 6 feet by 16 feet. d. Signs 3 feet by 5 feet and smaller will have a reduced sign fee of $50 per sign. 3. Donor signs must be approved in size, type, content and location by the Parks Department 4. A copy of the sign regulations is included in the facility contracts for all users. The user will sign and return a copy to the Parks Department. Other Facilities (Stockton Field/Throop Park/Santa Rosa Park/Damon Garcia, etc.) 1. Item #1 in the Resolution states: "All advertising signage in City parks shall be temporary and shall be removed after each daily use." Staff is recommending that the item be expanded to read: "All advertising signage in City parks shall be temporary and shall be removed after each daily use or after an event of less than three days." The addition is to allow organizers of longer events, such as sports tournaments scheduled for two to three days, to leave their signage up for the duration of the event. It was the intent of both the Parks and Recreation Commission and the Joint Use Committee to allow for signage on a short-term basis. The wording was inadvertently left off of the Resolution.
