SUBJECT: INTERIM TRAINING OFFICER
CAO RECOMMENDATION
Authorize the Fire Department to establish an interim Training Officer position, at no added cost
to the City.
DISCUSSION
In 1993, due to budget constraints, the Training Battalion Chief position was eliminated.. The
duties of that position were assumed by one of the shift Battalion Chiefs. At the same time, Fire
Station 3 was relieved of its Fire Prevention responsibilities, and assigned to work with the shift
Battalion Chief assigned to training. Over the years, our emergency calls have increased by
50%. Fire Station 3 has absorbed much of this call-load due to the addition of a number of
senior care facilities and annexations in that response area. Currently, Fire Station 3 personnel
are not able to devote the required time to do an adequate job with training.
The responsibilities of our training division have increased significantly. In 1997, a study
concluded that the Federal and State required training level had reached a total of 166
hours/firefighter. Given the Training Division's other responsibilities (emergency response), it
is able to deliver only 144 hours/Firefighter. We have been forced to neglect the following
mandated training: confined space, respiratory awareness, Sudden Infant Death Syndrome
training (SIDS) and Utility training requirements. In addition to our own training needs, with the
increased revenue from Cal Poly for contract fire and medical services comes an expectation for
added training courses and programs.
Because of the Training Division's inability to handle all of its responsibilities, the
administrative staff must assume some of these duties. This causes other important areas to go
unattended, i.e. inability to meet the engine company fire prevention needs, long-range planning,
disaster planning, etc.
The need for this position exists now. However, the current budget situation is again as bad, if
not worse, as it was in the 1990's. This has all but eliminated the possibility of creating a new
position for the Fire Department at this time. Because the need for the Training Officer is so
great, a workable solution has been developed that meets the Department's needs yet works
within current budget constraints.
The Training Officer will be taken from shift duty (56-hour work-week) and placed on a 40-hour
work-week schedule requiring overtime to fill the shift position. Additionally, the Training

Officer position will create a vacancy in the field that will require a Fire Engineer to work out of
grade as a Fire Captain and a Firefighter to work out of grade as an Engineer. Both of these
costs have been incorporated into the fiscal impact.
Specifically, the plan involves:
1. Not filling the Fire Marshal's position full time and instead continuing the current temporary
Fire Marshal position through the end of the two-year budget cycle. The Fire Marshal will
work 960 hours/year.
2. The new Training Officer will handle most of the responsibilities of a Training Academy. In
the past, off-duty shift personnel have been required to conduct this training, incurring a
significant overtime cost..
3. The Training Officer will conduct a minimum of two classes per year from Alan Hancock
College. Because these are fee-based classes, they will generate additional income for the
City (approximately $4800/year).
4. The Training Officer will respond out of county on mutual aid assignments. As with all
other mutual aid assignments, this will be reimbursed at a portal-to-portal overtime rate.
Since the position is already funded at the 40-hour/week salary, these monies will be
considered savings.
5. Mutual aid reimbursements are based on a portal-to-portal overtime rate. Out of county
assignments may not require overtime to backfill, thus resulting in savings. Additionally, a
14.61/o administrative rate is charged, which is over and above expenses incurred.
6. As per the fire and medical services contract with Cal Poly, which is over$200,000/year, the
training officer will provide training courses and programs for Cal Poly.
There are several meet and confer items that will need to be discussed prior to implementation of
the proposed plan. However, these issues appear to be minor and should be resolved prior to the
Council meeting.
In conclusion, this plan addresses immediate concerns and provides an interim solution to a
serious problem. Once fiscal conditions improve, the Department hopes to make this Training
Officer a regular position.
CONCURRENCES
The Finance and IT and Human Resources Departments have reviewed this plan and concur with
the recommendation.

FISCAL IMPACT
The fiscal impact will not have an adverse effect on the General Fund because the cost will be
absorbed within the Department and utilizing mutual aid funds.

* Once all mutual aid expenses have been covered, significant revenues have been generated:
approximately $135,000 in 2001-02, $26,000 in 2002-03, and an additional $28,000 has been
invoiced for 2002=03 and is expected to be paid before the end of this fiscal year. Projected
estimates for mutual aid responses in 2003-04 indicate revenues will exceed expenses and be
sufficient to cover the Interim Training Officer position. This trend is expected to continue
in 2004-05. (It should be noted, mutual aid reimbursements are not guaranteed, and as such,
there is the potential for a slightly higher "net' cost with this approach should the mutual aid
reimbursements fall short of projections.)
ALTERNATIVES
1. Maintain the status quo, which does not allow for the coordination and training identified by
the state and federal training mandates. This will make it difficult to put well-trained
Firefighters on the street and is not recommended.
2. Request a regular training officer position, which is not recommended at this time because of
state and local financial instability.

SUBJECT: DEED OF GIFT FOR DOWNTOWN ARTIFACTS
CAO RECOMMENDATION
1. Approve the Deed of Gift to the San Luis Obispo County Archaeological Society for the
significant artifacts resulting from the Downtown Utility Pipeline Installation Projects,
Specification No.s 90241 and 90261.
2. Authorize the Mayor to sign the Deed of Gift
DISCUSSION
The City has been replacing utility lines in the downtown for the past several months. That work
is largely completed now. For the duration of the excavation work, an archeological monitor
was present at the work site to determine if artifacts or previously unidentified archeological sites
were present in the work zone. As a result of that monitoring work, numerous artifacts were
found. The archeologists have recommended a number of pieces be permanently retained in a
curation facility to provide information to researchers. The cannon and partial cannon will not
be part of the curation materials with SLOCAS. Staff is looking into possible public display
locations with the assistance of the Cultural Heritage Commission.
As a part of the curation process, staff recommends that the artifacts be deeded by way of gift to
San Luis Obispo County Archeaological Society (SLOCAS), which is the common practice
when archiving occurs. If the City were to choose to retain ownership of the collection, fees
would shift to a recurring annual charge per box that would result in a substantially higher cost to
the City over the years. The City has previously made a gifts of artifacts found during
construction to the SLOCAS curation facility. Doing this makes the material readily available,
along with other local finds for individuals doing research and study. Staff is recommending that
we continue our practice of using the SLOCAS facility for the artifacts from the recent
downtown pipeline project.
CONCURRENCES
Community Development concurs with the use of the SLOCAS facility to archive the materials.
FISCAL IMPACT
The volume of material the archeologist is recommending for permanent storage will fill two
boxes. One box will house the actual artifacts, and the second the reports and documentation for

the project. SLOCAS charges a one time fee of $700 per box to support the storage of the
materials. Funding for this cost will come from the project's contingency funds.
ALTERNATIVES
The City could decide to retain the materials at a City building. For the small cost associated
with the storage, there appears to be no benefit to storing the materials at a City building where
they might be subject to rough handling or difficult to locate as time passed.

AGREEMENT
THIS AGREEMENT is made and entered into in the CITY of San Luis Obispo on this day of
, 2003 by and between the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafter
referred to as CITY,and THE SAN LUIS OBISPO COUNTY ARCHAEOLOGICAL SOCIETY(SLOCAS).
WITNESSETH:
WHEREAS,CITY desires to curate the 2003 Downtown Utility Pipeline Replacement project artifacts in a proper
storage environment that provides suitable community access to the collection;and
WHEREAS, SLOCAS has as part of its mission to promote conservation of archaeological sites, records and
collections;and
WHEREAS, SLOCAS is qualified to provide this service at its Research and Collections Facility, located in
Buildings 1522 and 1523 on Camp San Luis Obispo;and
NOW THEREFORE, in consideration of their mutual promises, obligations, and covenants hereinafter contained,
the parties hereto agree as follows:
1. TERM. The term of this Agreement shall be from the date this Agreement is made and entered, as first
written above,and shall continue in perpetuity.
2. CITY'S OBLIGATIONS. For providing services as specified in this Agreement, CITY will pay, and
SLOCAS shall receive therefore, $700.00/standard archive box(10"x 12"x15"with weight not to exceed 40 lbs per box).
CITY will deed 2003 Downtown Utility Pipeline Replacement project artifacts the to SLOCAS as specified in the
attached Deed of Gift (Exhibit A). The collection includes all artifacts and the catalogue. Any available supporting
documentation such as field records, photographs, and maps shall be organized and submitted with the artifacts along with
the final reports. The collection will be submitted to SLOCAS following their curation guidelines.
CITY reserves the right to borrow artifacts from the 2003 Downtown Utility Pipeline Replacement project artifacts
under the following conditions:
a. CTTY will submit a written request to borrow specimens for public exhibit and will include: a list or
description of the items needed;the purpose and location of the display;the duration of use;and the name
of the CITY staff member(s)that will be responsible for the materials.
b. Loaned collection materials will be handled, stored, and exhibited in a safe manner and protected from
breakage,theft,and other adverse conditions such as excessive heat or moisture,insects,and rodents.
C. There will be no charge to CITY for SLOCAS staff time unless the loan request requires an unusual
amount of preparation and packaging time,in which case established staff fees will be assessed.
d. Copying,packing,shipping,insurance,or other transport costs will be paid by CITY.
e. CITY will sign an inventory and agreement form prior to release of the artifacts,and will be responsible
for the safe return of all items listed.

3. SLOCAS'S OBLIGATIONS. For and in consideration of the payments and agreements hereinbefore
mentioned to be made and performed by CITY, SLOCAS agrees to provide, storage for the 2003 Downtown Utility
Pipeline Replacement project artifacts.
4. DISSOLUTION OF SLOCAS. In the event of the dissolution of SLOCAS,in concurrence with CITY,
SLOCAS will obtain a curation agreement with another archival facility. Should CITY prefer,CITY will be allowed to
regain ownership of the collection and will be responsible for the curation of the collection.
5. AMENDMENTS. Any amendment,modification,or variation from the terms of this Agreement shall be
in writing and shall be effective only upon approval by the CITY Administrative Officer of the CITY.
6. COMPLETE AGREEMENT. This written Agreement, including all writings specifically incorporated
herein by reference,shall constitute the complete agreement between the parties hereto. No oral agreement,understanding,
or representation not reduced to writing and specifically incorporated herein shall be of any force or effect, nor shall any
such oral agreement,understanding,or representation be binding upon the parties hereto.
7. NOTICE. All written notices to the parties hereto shall be sent by United States mail,postage prepaid by
registered or certified mail addressed as follows:

Exhibit A
Deed of Gift
The City of San Luis Obispo irrevocably and unconditionally gives, transfers and assigns to the San Luis Obispo County
Archaeological Society (SLOCAS) by way of gift, all rights, titles, and interests (including all copyright, trademark and
related interests) in, to, and associated with, the objects collected during the "Downtown Utility Pipeline Installation
Projects, City Specification No.s 90240 and 90261." The City of San Luis Obispo affirms that they own said objects and
that to the best of their knowledge they have good and complete right, title, and interest to deed as a gift. In the event that
SLOCAS is dissolved,SLOCAS will confer with the City and a curation agreement for the collection will be obtained with
another archival facility or the City will regain ownership of the collection and be responsible for its curation.
