DISCUSSION Several weeks ago, during the Communication section of the agenda, the Council agreed that it would be helpful to receive a presentation regarding County development projects and applications near the City. City staff therefore followed up with the County to schedule this study session. During the session, County staff will provide the Council with an overview of recent and potential development projects near the City. By way of background, both the City and County have been notifying each other for years of development applications in and around one another's jurisdictions. In fact, the Council's request for a briefing was prompted in part by our work with the County to mitigate the impacts of the recent Senn/Glick and MorabitoBurke projects in the County. These projects are outside of, but immediately adjacent to, the City's Urban Reserve Line and city limits, and are a result of general plan amendments made by the Board of Supervisors in 1996. These projects also exemplified two of the primary concerns that have been expressed about the approval process for projects in the County and close to the City. First, there is often a significant lag-time between the original project proposal that generates a City response and the project actually going to hearings for approval. Many aspects of a project can change during such a period of time and a lot of new information is generated (such as a significant traffic study in the case of the above two projects). If an EIR is prepared for the project, various City departments have an opportunity to review the draft reports before the EIR is completed but this is not always the case with Negative Declarations. Staffs of the County and City have cooperatively worked out a method of addressing this issue and this method will be covered in the study session. Second, a lot of relatively smaller projects can take place with little fanfare and still result in a noticeable change in an area around the City, if the agencies are not communicating. In recent years, communication protocols have been established — and protocols for determining when an application within the City's urban reserve line should be processed—that should avoid surprises. This study session offers one other way of informing the Council about what projects are being considered and how they may relate to the overall development around the City. Having looked at a draft of a map County staff will use during the study session, there should be no major surprises. CONCURRENCES This Council briefing is being given by the County Department of Planning and Building and may include staff from the County Public Works Department. Members of City staff from Community Development and Public Works have met with the County staff and will be available at the briefing to help answer questions the Council may have. FISCAL IMPACT Because this is a study session on potential projects around the City, there will be no decisions made that could have a fiscal impact on the City's budget. As we indicated in our meeting, we will refer applicants for projects within this area for evaluation for possible annexation within the city. This should serve as an early consultation on the possibility of annexation and the development requirements of the city. • For projects that have not yet been submitted to the county, we will require written documentation be submitted as part of the initial application that the City will not grant the approvals they seek. • For those projects that are under review with the County but not yet accepted for processing, we will inform applicants of this same need as part of the county review. This should eliminate some of the duplication of efforts for those areas where the city is willing and able to pursue annexation. • For projects that are currently under County review but have previously been accepted for processing, we will inform the applicants of the city's request and request consultation with the city prior to public hearings, yet complying with our legal requirements for project review. If the city is unable to accommodate annexation, then the county will be aware of the development requirements that the city would want to see incorporated into the project,to the extent that the county can legally impose such conditions. These conditions will be developed cooperatively with City staff on a case-by-case basis. We will attempt to address aspects of vehicular circulation improvements such as traffic impact fees, right-of-way width and other design standards, and integration of.storm water drainage systems to the degree feasible and legally defensible. In addition, City and County staff may need to further discuss how to implement common improvement standards or how to implement common fees in thh fringe area so there is a clear rationale and nexus for the requirements, through both thecounty and/or the City at the time of annexation.
