Approve Amendment to Agreement with TRC in the amount of$6,600 for guard rail design as related to Coon Creek steelhead passage restoration as mitigation for the Water Reuse Project. 2. Approve an additional $3,400 contingency, to be administered by the Project Manager, for possible project design changes. DISCUSSION As part of the Water Reuse Project mitigation, the City must offset project action effects on habitat by acquiring and preserving in perpetuity instream habitat or creating instream habitat. Working with the California Department of Fish and Game and PG&E, City staff identified the replacement of plugged culverts on Coon Creek about a half-mile from the ocean as a mitigation measure which would make approximately 5.6 miles of stream accessible to steelhead. The City awarded a design contract with TRC in the amount of $120,000 on February 28, 2003. The most cost effective solution for the stream crossing is a built in-place slab bridge. As part of the bridge design, PG&E has expressed the desire for guard rails because the bridge will be on the emergency egress route from the Diablo Canyon Power Plant and guard rails will help ensure safe egress across the bridge in the event of an emergency. The area constraints and topography of the bridge crossing will not accommodate the standard metal beam guard rail design. The proposed scope of work is given in Exhibit A of Attachment 1. This design work was not anticipated at the time of the original contract. This Amendment to the February 28, 2003 contract with TRC will provide an additional $6,600 for guard rail design. Staff also recommends approval of a$3,400 contingency, to be administered by the project manager,to address any additional minor design changes in the project resulting from PG&E's review of the plans. FISCAL IMPACT Currently, $784,000 is in the budget for mitigation measures for the Water Reuse Project CIP. There is an available balance of $386,000 in this account to support this project (FY 2001-2003 Financial Plan Appendix B,page 106). ATTACHMENTS 1. WITNESSETHO WHEREAS, on February 28, 2003, the City entered into an Agreement with Consultant for consulting services related to mitigation for the Water Reuse Project per Specification No.99124.90557A;and WHEREAS, the City desires to amend the scope of services to include design for bridge guard rails and Consultant has submitted a proposal for this purpose that is acceptable to the City. NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained,the parties hereto agree as follows: 1. The scope of services and related compensation is hereby amended as set forth in Exhibit A attached hereto. 2. All other terms and conditions of the Agreement remain in full force and effect. In recent meetings with City staff,we have discussed the PG&E requirement that guardrails be provided on the approaches to the bridge to be constructed over Coon Creek in conjunction with the project. Even though the road is private and normally has very low traffic and low travel speed,PG&E has expressed the desire for the guard rails because the bridge will be on the emergency egress route from the Diablo Canyon Power Plant, and the guard rails will help to ensure safe egress across the bridge in the event of an emergency. As we have discussed with City staff, the area constraints and topography at the bridge crossing will not accommodate the standard metal beam guardrail design. Pursuant to our recent discussion,this letter is provided to request an amendment to the contract to allow TRC to develop site-specific metal beam guard rail designs for the bridge approaches. The road configuration and topography at the bridge approaches will require a different design at each of the four comers of the bridge. For the suggested contract amendment, we propose the following work scope: Task 1: Plot out all four corners of the bridge plus 100 feet beyond at a workable scale. The plots will incorporate the physical characteristics of the site,based on the original surveys obtained.early in the project. Task 2: Layout 62'6" of standard guard rail at all four corners of the bridge and then modify as appropriate to fit the site physical characteristics. Task 4: Revise the quantities and estimate to include the Metal Beam Guard Rail. Task 5: Document the modifications to the standard layout for each comer in a letter format to be presented to the City for filing. We estimate that we could develop the metal beam guardrail design for all four comers of the bridge with about two additional design sheets. Based on two additional design sheets, we estimate the cost to complete the above tasks will be approximately$6,600. As we discussed, it would be appropriate to allow a contingency in the event that more than the estimated amount of work is required. We suggest the amendment to the contract be developed for a cost not to exceed $10,000. This would allow up to about four design sheets to be completed, if necessary. Work will be billed on a time-and- materials not-to-exceed basis, according to the schedule of charges referenced in the existing contract, so the City will be billed only for the effort actually incurred. We are prepared to begin work on the guardrail designs promptly upon approval by the City. We expect that the design could be completed in less than a month. Please feel free to call me any time.
