As recommended by the Downtown Association Board of Directors, amend the current employment contract with Deborah Cash, Downtown Association Administrator to clarify language regarding medical insurance benefits; and 2. Authorize the Mayor to execute the agreement. DISCUSSION Administrator Deborah Cash was hired in 1995. In 1996, the Association added a benefit of insurance to her contract allowing her to purchase medical insurance while being reimbursed up to a specified amount each year. As health insurance premiums have increased, the contract has reflected some change in the annual reimbursable amount. Her current employment contract describes her benefit as follows: "The only other paid benefit is medical benefits for employee and dependents not to exceed $7,000.00 annually." In keeping with the methodology used by the City for employees eligible for medical insurance, we recommend providing Deborah Cash the option of enrolling in the Downtown Association's medical insurance or receiving the cash equivalent up to the annual maximum, upon submission of proof of current and valid medical coverage. Staff proposes that the language be changed to: "The Downtown Association offers a paid medical benefit for Employee and dependents not to exceed the $7,000 annually. However, Employee may choose to participate in any health plan of her choice. Should Employee not utilize the medical coverage provided by the Downtown Association, Employee shall be entitled, upon proof of other current and valid medical coverage,to receive the cash equivalent of the$7,000 benefit annually, dispersed in equal partial payments, on a per pay period basis, over the course of each year." CONCURRENCES The City Attorney's office prepared the proposed language for the contract clarification and for the Board's consideration. The Department of Human Resources has reviewed this request and prepared the attached contract amendment. Public attendee Gary Fowler indicated he would pursue legal means to protest this action. Prepared by D.Cash 10-22-03 AMENDMENT TO THE 2003-2004 CONTRACT BETWEEN THE CITY OF SAN LUIS OBISPO AND DEBORAH CASH A. PURPOSE OF THIS AMENDMENT: 1. Pursuant to the July 15, 2003 Contract of Employment for the Downtown Association Administrator, Deborah J. Cash and the Downtown Association have met and conferred regarding adjustment to the Employment Status portion of the contract. The parties have agreed to entitle the Downtown Association Administrator to receive the cash equivalent of the paid medical benefit provided by the Downtown Association. 2. This confirms the agreement of the parties to modify the contract. Except as modified below, all other terms and conditions shall remain in full force and effect. B. MODIFICATION TO THE CONTRACT: 3. Employment Status. Effective , the Contract shall be amended as follows: Employment Status. Employee shall be a full-time employee. Membership in the City PERS retirement program shall be in accordance with PERS requirements with 5% of the employee's share to be paid by Employee, 3% of the employee's share to be paid by the Downtown Association. Employee shall accrue holiday and sick leave benefits consistent with other positions in the City and as determined by the Director of Human Resources. Employee shall accrue 8 hours of vacation per month over the term of this Agreement which shall be taken in a manner consistent with other City employees. Employee shall be granted up to 48 hours per year of administrative leave in lieu of overtime compensation, in recognition of the fact that the employee is exempt from overtime compensation consideration and that the employee's schedule may require work beyond 40 hours in a week.
