SUBJECT: FINAL PASSAGE OF ORDINANCE NO. 1443 (2004 SERIES), AN
AMENDMENT TO THE SUBDIVISION REGULATIONS
ALLOWING LOTS WITHIN COMMON INTEREST
DEVELOPMENTS TO HAVE ANY SIZE OR SHAPE, EXCEPT IN
THE R-1 ZONE; TA 76-03.

Grant final passage to Ordinance No.1443.
DISCUSSION
On December 2, 2003, the City Council voted unanimously to introduce Ordinance No.
1443 to print. Ordinance No. 1443 makes a minor revision to Section 16.36.160 of the
Subdivision Regulations. This section currently says that lots within condominium
projects can have any size or shape. The change will allow lots within all types of
Common Interest Developments to have any size or shape. The change does not apply to
the R-1 zone. Besides condominium projects, Common Interest Developments include
planned developments, stock cooperatives, and community apartment projects.
Significant Impacts
The City Council adopted a Mitigated Negative Declaration that concluded that no
significant environmental impacts are anticipated with the re-zoning of the property.
Consequences of Not Taking the Recommended Action
If the Council does not give final passage to the ordinance, only the lots within
condominium projects will continue to be allowed any size or shape.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING AN AMENDMENT TO THE SUBDIVISION REGULATIONS
ALLOWING LOTS IN COMMON INTEREST DEVELOPMENTS TO HAVE
ANY SIZE OR SHAPE,EXCEPT IN THE R-1 ZONE
TA/ER 76-03 (Citywide)
WHEREAS, the Council of the City of San Luis Obispo conducted a public hearing in
the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on December
2, 2003, for the purpose of considering Application TA/ER 76-03, a request to amend the
Subdivision Regulations to allow Common Interest Developments to have lots of any size or
shape; and
WHEREAS, the Planning Commission of the City of San Luis Obispo conducted public
hearings in the Council Chamber of City Hall, 990 Palm Street; San Luis Obispo, California, on
August 27, 2003, and November 5, 2003, and recommended approval of the amendment to the
City Council; and
WHEREAS, notices of said public hearings were made at the time and in the manner
required by law; and
WHEREAS, the City Council has considered the Mitigated Negative Declaration for the
project and has determined that the environmental document adequately addresses the potential
environmental impacts of the project; and
WHEREAS, the City Council has duly considered all evidence, including the testimony
of the applicant, interested parties, and the evaluation and recommendations by staff,presented at
said hearing.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
Section 1. Text Amendment. The proposed amendment to the Subdivision Regulations,
as shown in Exhibit A, is hereby approved based on the following finding.
1. The proposed text amendment is necessary to bring the Subdivision Regulations up to
date, because the current code does not contain any specific standard or direction for
Common Interest Developments, which is a method of subdivision that is authorized by
the California Civil Code and the Subdivision Map Act.
INTRODUCED on the 2nd day of December, 2003, AND FINALLY ADOPTED by
the Council of the City of San Luis Obispo on the 6d' day of January, 2004; on the following roll

Subdivision Regulations Text Amendment
16.36.160 Lot dimensions.
Each lot shall have the minimum area and dimensions indicated in the table below for the
zone in which it is located. Each lot shall front on a street.

Exceptions:
Lots within all common interest subdivisions, as defined by the Davis-Stirling Common
Interest Development Act, may have any size or shape, except in the R-I zone where
subdivisions must meet the lot size and shape standards described in the table above.
Lots which are approved in conjunction with Planned Development (PD) zoning, as
provided for in the Zoning Regulations, may have any size or shape consistent with the
structures and improvements shown in the development plan.
Notes:
1. In residential subdivision, corner lots shall have a minimum area fifteen percent larger
than otherwise required.
2. In residential subdivisions, corner lots shall be ten feet wider than otherwise required.
