CAO RECOMMENDATION Grant final passage to Ordinance No.1443. DISCUSSION On December 2, 2003, the City Council voted unanimously to introduce Ordinance No. 1443 to print. Ordinance No. 1443 makes a minor revision to Section 16.36.160 of the Subdivision Regulations. This section currently says that lots within condominium projects can have any size or shape. The change will allow lots within all types of Common Interest Developments to have any size or shape. The change does not apply to the R-1 zone. Besides condominium projects, Common Interest Developments include planned developments, stock cooperatives, and community apartment projects. Significant Impacts The City Council adopted a Mitigated Negative Declaration that concluded that no significant environmental impacts are anticipated with the re-zoning of the property. Consequences of Not Taking the Recommended Action If the Council does not give final passage to the ordinance, only the lots within condominium projects will continue to be allowed any size or shape.
