SUBJECT: ACCEPTANCE OF STATE GRANT FOR $75,000 TO INCREASE ALCOHOL
EDUCATION AND ENFORCEMENT PROGRAMS
CAO RECOMMENDATION
1. Adopt a resolution to increase education and enforcement programs focusing on underage
drinking and to enter into a contract with the State to accept $75,000 in grant funding
provided through the Alcoholic Beverage Control in cooperation with the Enforcing
Underage Drinking Laws Community Trials Initiative Program.
2. Authorize the Chief of Police to execute all grant related documents.
DISCUSSION
A major goal of the Police Department is to reduce underage consumption of alcoholic beverages
in our community. Staff began discussions with the California Office of Traffic Safety (OTS) in
June 2003 regarding a potential opportunity for San Luis Obispo, as a community, to be
considered under a federal discretionary program to receive grant funding through the Enforcing
Underage Drinking Laws (EUDL) Community Trials Initiative Program. Discussions were held
with OTS, as they were the state agency to submit the competitive California proposal to the
federal program. Under the EUDL program, selected communities receive community grants
with 50% of the award funding law enforcement and 50% funding non-profit community
coalition groups for local and.school program/policy development to address underage drinking.
On March 16, 2004, the City Council approved the submittal of a grant application via OTS to
the Enforcing Underage Drinking Laws (EUDL) Community Trials Initiative Program and a
separate grant application to the Alcoholic Beverage Control (ABC). The ABC grant proposal
was designed and developed to provide additional law enforcement funding and ABC
investigator staffing resources to more effectively carryout the EUDL program goals and
objectives in our community.
San Luis Obispo has been awarded grant funding from both EUDL and ABC for a combined
total of $75,000. For effective administration of the grant awards and in an effort to avoid
multiple contracts with awarding agencies, which would cause additional agency reporting
requirements, EUDL and ABC agreed to one contract for each funding agency. The law
enforcement contract will be directly with ABC and includes special terms and conditions to
encompass the EUDL program requirements.

California is one of only five states selected to participate in the EUDL program. San Luis
Obispo is one of six intervention communities in the State to receive a grant award to participate
in the EUDL program. San Luis Obispo Police Department is awarded $75,000 and the San Luis
Obispo Community Coalition, consisting of Prevention Alliance, Mayor's Youth Task Force, and
the DUI Task Force is awarded $75,000 for a combined community grant total of $150,000.
Additionally, six comparison communities in California were selected for research comparison
purposes. The comparison communities have similar demographics and crime statistics as the
intervention communities; however, EUDL program funding is not provided to the comparison
communities. The overall goal of the California EUDL project is to plan, design and implement
research-based community initiatives to reduce alcohol availability and underage drinking.
The $75,000 in grant funding is for a two-year program period, July 2004 through June 2006.
Based on current discussions with funding agencies, Police staff anticipates having an
opportunity to apply for additional competitive grant funding in February 2005 to fund year two
of the EUDL program at a greater level.
At this time, staff request the City Council adopt a resolution authorizing the City to enter into a
contract with the State (ABC) and designating the Chief of Police as the official to execute all
grant related documents.
CONCURRENCES
Wayne Hansen of Drug and AlcoholPrevention Alliance, Frank Warren, Chair of the Mayor's
Youth Task Force and Kimberly Mott, Chair of the DUI Task Force concur with this action.
FISCAL IMPACT
The $75,000 grant award will provide full reimbursement for personnel overtime pay and
benefits for the alcohol related enforcements under this grant program, and associated program
equipment and training. This results in no negative fiscal impact to the City.
ALTERNATIVE
Continue with current level of alcohol enforcements and education within existing City budget
resources and do not accept this grant funding. Staff does not recommend this alternative, as this
is a funding opportunity that supports City goals and objectives.

Enclosed please find four copies of the Standard Agreement contract entered.
into between the Department of Alcoholic Beverage Control and your department in
the amount of$75,000.00. Please return all four copies, with an original signature
on each, to my attention. In addition, please advise your Taxpayer's Federal
Employer Identification Number and return your Governing Body's Resolution. Due
to the fact these resolutions have to be put on your governing body's calendar, we ask
that-you do this as soon as possible.
After we receive the contracts and information from your agency, we will
forward the.contract package to the Department of General Services' Legal
Department. Upon their approval, we will return a fully signed contract for your
records.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
TO INCREASE EDUCATION AND ENFORCEMENT PROGRAMS FOCUSING ON
UNDERAGE DRINKING LAWS AND ALCOHOL AVAILABILITY TO MINORS WITH
GRANT FUNDING OF$75,000 PROVIDED THROUGH THE DEPARTMENT OF
ALCOHOLIC BEVERAGE CONTROL
WHEREAS, the San Luis Obispo Police Department through the City of San Luis Obispo
desires to undertake programs to increase education and enforcement to reduce underage drinking in
the community; and
WHEREAS, a certain community trials initiative project to increase education and
enforcement of underage drinking laws is to be funded with grant monies made available through the
federal Enforcing Underage Drinking Laws Program and the California Alcoholic Beverage Control
Grant Assistance Program, with both program funding sources administered through the Department
of Alcoholic Beverage Control; and
WHEREAS, the City of San Luis Obispo has been awarded grant funding in the amount of
$75,000 to increase education and enforcement of underage drinking laws in San Luis Obispo.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo
that the Chief of Police of the City of San Luis Obispo is authorized, on its behalf to execute all grant
related documents including the State of California Standard Agreement contract, any extensions or
amendments thereof and any subsequent contract with the State in relation thereto.
IT IS AGREED that any liability arising out of the performance of this contract, including
civil court actions for damages; shall be the responsibility of the grant recipient and the authorizing
agency. The State of California and the Department of Alcoholic Beverage Control disclaim
responsibility for any such liability.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to
supplant expenditures controlled by this body.
