Adopt a resolution to accept the 2004-05 Juvenile Accountability Incentive Block Grant of $6,167 from the State Board of Corrections, with a required City match of$685. 2. Authorize the Chief of Police to execute all grant related documents. DISCUSSION Annually, since 1999 the City Council has approved participation and matching funds in a Juvenile Accountability Incentive Block Grant (JAIBG) program_. The grant available to the City of San Luis Obispo this year is $6,167. The Juvenile Diversion Program areas funded by this ,grant include a part-time program coordinator through Family Care Network and diversion services including mediation, counseling, esteem building and family skills training for at-risk youth or first-time offenders within the city. The base annual cost to operate the City's Juvenile Diversion Program is approximately $18,000. The Police Department budget currently includes $10,000 for this program. The JAIBG award will fund the remaining program costs for fiscal year 2004-05. For the City to benefit from this grant, matching funds in the amount of$685 are required. To date, the Juvenile Diversion Program has exceeded initial expectations. It was originally estimated that program services would be provided to 20-30 youthful offenders per year. However, the need is much greater with over 80 at-risk youth or first-time offenders processed annually and more specifically with 97 youth processed during fiscal year 2003-04. FISCAL IlVIPACT In the Long-Term. The total State allocation for the JAIBG program was $14.4 million in 2003-04 and was reduced over 65%to $4.7 million in 2004-05. Based on staff discussions with State Board of Corrections representatives, the JAIBG program allocation is projected to be significantly reduced by approximately 50% in 2005-06 compared to the 2004-05 allocation. Additionally, the minimum eligible JAIBG award amount has historically been$5,000 annually,based on the.total State allocation amount and formula; local governments whom fall under the $5,000 threshold have not been eligible for JAIBG funding. However, it is projected that the $5,000 threshold will be raised to $10,000 in old t Juvenile Accountability Incentive Block Grant Acceptance Page 2 2005-06. San Luis Obispo's eligible award this year is $6,167. Based on current projections for future State allocations the City would,most likely,not be eligible for JAIBG funding in 2005-06 If, as projected State allocations are reduced and San Luis Obispo Police Department is no longer eligible for JAIBG funding in subsequent State budgets, then additional General Fund commitments would be necessary to maintain the City's Juvenile Diversion Program service levels. Staff is currently examining revenue options, in the form of service fees, in an effort to off-set future General Fund funding requests. In the Short-Term. With the $6,167 in grant revenue, the City match of$685 (which is available in the Police Department budget)and the $10,000 program funding approved.in the 2004-05 City budget, there will be no additional net impact on the General Fund for this full fiscal year. ALTERNATIVES Decline participation in the Juvenile Accountability Incentive Block Grant program and do not accept grant award. Staff does not recommend this alternative, as it would negatively impact the Juvenile Division Program and significantly reduce the juvenile services provided within our community by the San Luis Obispo Police Department. (2004 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO TO PROVIDE JUVENILE DIVERSION PROGRAM SERVICES FOR AT-RISK YOUTH WITH JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT FUNDING OF$69167 PROVIDED BY THE STATE BOARD OF CORRECTIONS AND APPROVING CITY MATCHING FUNDS OF$685 WHEREAS, the San Luis Obispo Police Department through the City of San Luis Obispo desires to continue the Juvenile Diversion Program that has been in operation for six years; and WHEREAS, Juvenile Accountability Incentive Bock Grant funding will help support services offered to at-risk juveniles and their families, including: mediation, counseling, esteem building and family skills training; and WHEREAS, Collectively, these interventions aim to produce early and effective results leading ultimately to a reduction in the number of juvenile court filings; and NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo to adopt a resolution approving continuation of the Juvenile Diversion Program Services and acceptance of the $6,167 Juvenile Accountability Incentive Block Chant with approval for City matching funds of$685. BE IT FURTHER RESOLVED that any liability arising out of the performance of the Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and the Board of Corrections disclaim responsibility for any such liability. BE IT FURTHER RESOLVED by the Council of the City of San Luis Obispo that the Chief of Police is authorized on its behalf to execute all grant related documents including the State of California Standard Agreement contract, any extensions or amendments thereof and any subsequent contract with the State in relation thereto.
