SUBJECT: THE FIRST TEE GOLF PROGRAM AT LAGUNA LAKE GOLF COURSE
CAO RECOMMENDATION
1. As recommended by the Parks and Recreation Commission, approve a Use Agreement
between The First Tee Central Coast (The First Tee) and the City of San Luis Obispo for
use of the Laguna Lake Golf Course (LLGC).
2. Authorize the CAO to accept the donations of the chipping area and learning center upon
approval of grant funding by The First Tee.
DISCUSSION
As part of the strategy to increase play and revenue at LLGC by developing new golfers, The
First Tee golf program is being offered to the community.
The First Tee is a nationwide, non-profit, youth golf association. The program is designed to
impact the lives of young people by providing learning facilities and educational programs that
promote character development and life enhancing values through the game of golf. Locally, the
program is known as The First Tee Central Coast. The program covers an area from Santa
Barbara to Paso Robles. There are currently six other locations offering the program. The First
Tee program was started at Laguna Lake Golf Course in the Fall of 2003. It has been very
popular, with over 60 local youths enrolled in each of three sessions.
To enhance the program, The First Tee would like to donate a number of facility improvements
to the golf course. These include:
1. A chipping area to be located in the undeveloped area behind the parking lot. The
chipping area would consist of an area of grass about 25 yards square and a small putting
green. Golfers can work on improving their "short game" or the skill of chipping a ball
near the cup from short range.
2. An indoor learning center that consists of two computer terminals to be located in the
golf course clubhouse. The First Tee provides a number of instructional programs on CD
Rom that are accessible via computer. Program participants would be able to view the
materials as their schedules permitted..
The First Tee national organization has grant funding available for these types of local projects,
but for the local program to qualify for the grants, the owner of the golf course that hosts the

program must indicate a willingness to accept the donations. The attached Agreement serves this
purpose. (Attachment 1) The Agreement does not give blanket approval to the chipping area or
the indoor learning donations at this. time. Each donation will need Council approval per the
standard donation approval process. As with all donations, any project approved in the future
will be subject to City building and construction regulations.
The Agreement includes the terms under which The First Tee program will have access to the
facilities at the golf course. This also is a requirement of The First Tee in order to receive grant
funding. According to the Agreement, The First Tee programs will have priority access to the
facilities they construct, during program sessions (about 6 hours per week). They will also be
able to use course facilities for another 12 hours a week at the discretion of the golf course
supervisor. Participants in The First Tee program will receive a discount for rounds played on
the course.
To protect its investment, The First Tee conditions grant funding for course improvements by
requiring a fifteen-year agreement. In the event that the City prematurely terminates the
Agreement, the City will be expected to reimburse The First Tee some or all of the costs
associated with donated improvements, as stipulated in the Agreement. Within the first five
years, reimbursement will be 100%. Thereafter, a straight line depreciation schedule will be
used to determine the reimbursement. Without this condition, a host site could accept course
improvements, then terminate their agreement with The First Tee. Given the success of the
program currently offered at LLGC, staff believes that the risk to the City is small.
With the Agreement in place, The First Tee also will become eligible to receive donations of golf
equipment from the national organization, including golf clubs, golf bags, and golf balls.
CONCURRENCE
This item was reviewed and unanimously approved by the Parks and Recreation Commission at
its August 4, 2004 meeting. (Attachment 2)
FISCAL IWACT
There is no fiscal impact to the City in approving this Agreement. However, the City will be
expected to maintain any golf course improvements. The Golf Course Supervisor feels that this
program is of high enough priority to warrant the City maintaining the chipping area using
existing resources. The chipping area will increase the total maintained area at the course by less
than 2%. The donated computers will not become part of the regular City inventory.
Information Technology staff assistance will not be required.

USE AGREEMENT BETWEEN
THE FIRST TEE CENTRAL COAST AND THE CITY OF SAN LUIS OBISPO
REGARDING THE LAGUNA LAKE GOLF COURSE
WHEREAS, Central Coast Junior Golf, Inc. dba The First Tee Central Coast
(The First Tee), a 501(c)(3) not-for-profit organization, desires to construct and donate a
practice facility consisting of a practice green, chipping area and learning center at the
Laguna Lake Golf Course ("LLGC") located at 1175 Los Osos Valley Road, San Luis
Obispo, CA. 93405; and
WHEREAS, LLGC is owned by the City of San Luis Obispo, a municipal
corporation and charter city ("City"); and
WHEREAS, The First Tee further desires to operate a junior golf program at
LLGC and desires to develop additional facilities for the program; and
WHEREAS, The First Tee requires a commitment from the City to allow The
First Tee to operate a junior golf program at LLGC in order to apply for and obtain the
necessary funding from its governing board to construct the practice area and other
improvements at the LLGC; and
WHEREAS, The First Tee's willingness to construct and donate the practice area
to the City represents a special opportunity to improve the LLGC that might not
otherwise be available; and
WHEREAS, the parties desire to enter into this agreement to describe the project
and the proposed uses should The First Tee obtain funding for facility improvements.
NOW,THEREFORE, the parties agree as follows:
1. STATEMENT OF COMMON PURPOSE:
The First Tee and City desire to provide affordable access to golf for anyone who is
interested in playing the game, with a special emphasis on the educational and character
development of children.
2. PROPOSED PROJECT:
Based upon The First Tee's ability to raise funds, and after approval from their governing
board and acceptance of the donations by the City Administrative Officer, The First Tee
shall construct a short game chipping area (collectively known as; the practice facility)
and a learning center in the clubhouse. These improvements are for the benefit of The
First Tee to enhance the quality of services offered to the junior golf program.

3. PROJECT APPROVAL
Any proposed project shall have prior written approval from the City of San Luis Obispo.
The First Tee shall provide construction plans and documents to the city for approval
prior to any building permit application submitted to the City of San Luis Obispo. The
parties understand and agree that those approvals required of the City acting in its
governmental or regulatory capacity are separate and distinct from those approvals
required by the City under this Agreement. Notwithstanding anything to the contrary in
this Agreement, nothing herein shall be interpreted to mean that the City is in any way
waiving, limiting, or weakening any regulatory or police power the City may have in any
of its governmental capacities.
4. BASIC TERMS, CONDITIONS,AND REQUIREMENTS:
A. The First Tee programs will have complete and unlimited access to the
practice facility and learning center during scheduled program sessions.
B. In addition, The First Tee programs will have limited access to the practice
area and or the nine-hole golf course for a minimum of 12 hours per week. Access
during peak hours, weekends and holidays are at the discretion of City
management and staff.
C. The First Tee will be responsible for fees associated with the programs
conducted on LLGC.
D. All advertising, marketing and promotional materials shall be agreed upon.
E. The First Tee shall be responsible for expenses incurred by the program and
City shall bill The First Tee by invoice for those costs.
F. City will maintain the proper utilities, maintenance, property taxes and
insurance for the learning center building and the practice facility.
G. City will maintain the turf grass and practice facility at no cost to The First
Tee.
5. COST FOR FACILITY USE:
A. The price structure will be reviewed annually by The First Tee and City but
will always remain affordable and consistent with the mission and purpose.
B. The First Tee proposes juniors with a valid The First Tee membership card
pay $2.00 on weekdays and $4.00 on weekends for the use of the 9-hole golf
course during off-peak hours.

C. Special events and fund-raisers held by The First Tee are discretionary and
require the prior written consent of City.
D. Other uses and fees for programming to be determined.
6. TERMINATION:
In the event the parties enter into a binding use agreement and such agreement is
terminated by City, The First Tee will be refunded any money spent on capital
improvements to the building or the practice facility as follows: in the years 0 through 5,
The First Tee will receive a 100 percent refund; in years 6 through 15, a straight line
depreciation schedule will be used to determine the amount of refund.
7. DURATION AND TERMS OF AGREEMENT:
This agreement shall be valid for (15 years) from, date: LLGC is
permitted to execute this type of use agreement under its operating agreement with the
City of San Luis Obispo. The undersigned have read and agree to the terms of this
document.
8. NATURE OF THE AGREEMENT:
This Use Agreement summarizes what The First Tee and the City perceive to be the
major deal points with respect to the project (and the contemplated improvements as
described in section 2.)
