DISCUSSION The City has been offered a donation of a shade structure, valued at $6,800, by the family and friends of the late Adrian Brown. Since the value of this donation exceeds $5,000, it must be accepted by the City Council. A copy of the donor agreement is included as Attachment 1 of this report. The structure would be located at the Damon-Garcia Sports Fields in a small triangular area adjacent to the single field on the west side of the complex. The purpose of the structure would be to provide a shaded rest area for players using the fields, especially during tournaments where players could find themselves on site for the entire day. There is very little natural shade at the fields, so the structure would be a valuable addition to the site. A diagram of the structure, along with specifications, is included as Attachment 2 to this report. It will be placed on small turf area that is not usable for athletic events. Parks maintenance staff will oversee the installation. It can be accommodated without any site changes. A site map showing the structure's location is included as Attachment 3. Adrian Brown lived in the community, working as a computer programmer. He passed away last year at the age of 34. Adrian was an avid soccer player, who certainly would have been a regular at the Damon-Garcia Fields. The donation is being made in his memory by his family and friends. A small plaque with wording mutually agreeable to the family and friends and the City will be placed adjacent to the structure. This plaque will memorialize the donation.. The donation will be made in cash to the City. Staff will make the purchase and, as was previously mentioned, supervise the installation. Damon-Garcia Shade Structure Donation Page 2 CONCURRENCES The Parks and Recreation Commission will review this donation at their December 1, 2004 meeting; however, Commissioners were briefed on it at the November meeting. Because the donation must be completed before the end of the year, and there will only be one Council meeting in the month of December, staff has prepared this report prior to the Commission taking formal action. It is anticipated that the Commission will recommend approval of the donation. A copy of the minutes of that meeting will be forwarded to Council prior to the Council meeting. The Community Development Department has found this structure to be architecturally insignificant. FISCAL IMPACT Once installed, the City will assume maintenance responsibility for the structure. The actual shade portion of the structure will probably last 10 years and then need replacement. The cost would be about$1,000. ATTACHMENTS 1. Donor Agreement 2. WITNESSETH: WHEREAS,The Donor desires to donate a shade:structure at the Damon-Garcia Sports Fields;and WHEREAS, acceptance of the donation is consistent with City Policy as set forth in Resolution No. 8965 (1999 Series). NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained,the parties hereto agree as follows: 1. TERM. The term of this Agreement shall be from the date this Agreement is made and entered,as first written above,until acceptance or completion of the Donation. 2. DONOR'S OBLIGATIONS: Donor shall perform as follows: • Donate$6,800 to the City. 3. CITY OBLIGATIONS: City shall perform as follows: • Purchase and install a shade structure at the Damon-Garcia Sports Fields. • Maintain the structure once installed. 4. RECOGNITION: The donation.shall be recognized in the following manner: a. A plaque 18" x 9" with wording mutually agreeable to the Donor and the City will be placed adjacent to the structure. The Donor will purchase the plaque. 5. COMPLETE AGREEMENT. This written Agreement, including all writings specifically incorporated herein by reference, shall constitute the complete agreement between the parties hereto. AMENDMENTS. Any amendment,.modification, or variation from the terms of this Agreement shall be in writing and shall be effective only upon approval by the City Administrative Officer of the City. 7. NOTICE. The vote in favor was unanimous. The colors selected for the structure are a rust covering and cream colored legs. This is an attempt to match the existing building at the sports fields. (A picture is attached) The Commission is aware that a green color has also been suggested.
