SUBJECT: CONFIDENTIAL EMPLOYEES' COMPENSATION
ADJUSTMENTS
CAO RECOMMENDATION:
Adopt a resolution adjusting compensation for the City of San Luis Obispo Confidential
Employees.
DISCUSSION
The City's confidential employees are not represented by a collective bargaining unit in
accordance with the Government Code and therefore do not formally negotiate with the City with
regards to their compensation and terms and conditions of employment. The Executive Assistant
to the City Administrative Officer, the Executive Assistant to the Human Resources Director, the
Legal Assistant, and the Human Resources Specialist are the confidential employees. Due to the
similarity of these positions with those represented by the San Luis Obispo City Employees
Association (SLOCEA) staff recommends extending to the confidential employees a similar total
compensation adjustment as Council authorized for SLOCEA.
In recognition of the specific interests of this group the following adjustments are recommended:
• Salary increases of 2% effective the first full pay period in April 2005 and 1% effective
the first full pay period in July 2005.
• $30 per month increase to the City's contribution to the cafeteria plan increasing their
total monthly contribution $570 effective April 1, 2005.
• An amendment to the Public Employees' Retirement System (PERS) contract for
miscellaneous employees to provide the "Option 2 Death Benefit" for employees, which
allows the spouse of a deceased employee, who was eligible to retire from service at the
time of death, to select a monthly retirement allowance instead of the lump sum death
benefits currently payable.
Although the specific components of this economic package vary slightly from the SLOCEA one-
year agreement the Council approved on February 1, 2005, the costs in proportion to the total
compensation for each group are very similar.
FISCAL IMPACT
The confidential employees' total compensation is approximately $278,800. The cost of this
resolution is approximately $6,500, with ongoing annual costs of approximately $9,800.
Adequate funding for this increase is currently available in the MOA adjustment account.

ALTERNATIVES
The confidential employees could be asked to receive an identical package as was agreed to by
SLOCEA. However, the package as proposed above more closely meets their individual needs
and is responsive to their particular interests at this time. Although not required, the confidential
employees have indicated that the proposed package is acceptable to them. It has been the City's
practice in establishing compensation with employees to tailor the adjustments for the various
employee groups, whether represented or unrepresented, to the specific interests of each group
within broad Council parameters. This proposal accomplishes that.

A RESOLUTION OF THE CITY COUNCIL OF F THE CITY OF SAN LUIS OBISPO
ADJUSTING THE COMPENSATION FOR THE CITY'S CONFIDENTIAL EMPLOYEES
FOR THE PERIOD OF JANUARY 1,2005 THROUGH DECEMBER 31,2005
WHEREAS, the City of San Luis Obispo designates the Executive Assistant to the City
Administrative Officer, the Executive Assistant to the Director of Human Resources, the Legal
Assistant and the Human Resources Specialist as confidential employees pursuant to the
Government Code,
WHEREAS, as such, confidential employees are precluded from collective bargaining and
therefore are not governed by a collective bargaining agreement,
WHEREAS, the wages, hours and other terms and conditions of employment for
confidential employees are established by resolution,
NOW; THEREFORE, BE IT RESOLVED, that the City Council of the City of San Luis
Obispo hereby resolves as follows
SECTION 1. The salaries of the confidential employees shall be increased 2% effective
the first day of the first full pay period in April 2005 and 1% effective the first day of the first full
pay period in July 2005.
SECTION 2. The cafeteria plan contribution for confidential employees shall be increased
to$570 per month effective April 1,2005.
SECTION 3. The City agrees to amend the PERS contract to include the Pre-Retirement
Optional Settlement 2 Death Benefit(Government Code § 21548)to be effective July 1, 2005.
