SUBJECT: RESOLUTION DECLARING THE RESULTS OF THE SPECIAL
MUNICIPAL ELECTION HELD TUESDAY, APRIL 26, 2005
CAO RECOMMENDATION
Adopt the attached Resolution declaring the results of the Tuesday, April 26, 2005 Special
Municipal Election.
DISCUSSION
On April 26, 2005, a Special Municipal Election was conducted by the City Clerk's office.
California Elections Code Section 15400 requires that the City Council declare the results of the
election.
The April 26, 2005 election was conducted by the City Clerk's Office in accordance with Council
Resolution No. 9624 (2004 Series) and the canvassing of the returns was done in accordance
with provisions of the Election Code. The City Clerk/Elections Official has certified the results
of the votes for ballot Measures A-05, B-05 and C-05 related to the San Luis Obispo Marketplace
project. The certificate of the canvass was issued by the City Clerk on May 3, 2005, and is
attached to the proposed resolution as Exhibit A.
The following measures related to the Dalidio-San Luis Obispo Marketplace project failed by a
majority vote:
Measure A-05: Resolution 9590 (2004 Series) upholding an appeal of the Planning
Commission's denial of a proposed General Plan Amendment.
Measure B-05: Ordinance No. 1449 (2004 Series), approving a prezoning and
preliminary development plan.
Measure C-05: Ordinance No. 1452 (2004 Series), approving a Development Agreement
and Special Tax Reimbursement Agreement.
CONCURRENCES
The City Attorney has reviewed the City Clerk/Election Official's certificate of canvass and
concurs with the recommendation to declare the election results.

FISCAL IMPACT
There are no costs associated with the adoption of this resolution. The total cost of this election
will be calculated upon receipt of the final invoice from the elections contractor. However,
anticipated expenses are accounted for and included in the City Clerk Elections budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL
ELECTION HELD ON TUESDAY,APRIL 26, 2005,DECLARING THE RESULT
AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a Special Municipal Election was held and conducted in the City of San
Luis Obispo, California, on Tuesday, April 26, 2005, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided by
law; voting precincts were properly established; election officers were appointed and in all
respects the election was held and conducted and the votes were cast, received and canvassed and
the returns made and declared in time, form and manner as required by the provisions of the
Charter; and
WHEREAS, the City Clerk canvassed the returns of the election and has certified the
results to this City Council, the results are received, attached and made a part hereof as "Exhibit
A."
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of San Luis
Obispo as follows:
SECTION 1. That the whole number of ballots cast in the precincts except absent voter
ballots and provisional ballots was 5,929. That the whole number of absent voter ballots cast in
the City was 8,072, and the whole number of provisional ballots cast in the City was 241.
Thereby, making a total of 14,242 ballots cast in the City.
SECTION 2. That the measures voted upon at the election are as follows:
MEASURE A-05:
Shall Resolution No. 9590 (2004 Series),
amending the General Plan Land Use Map by
designating 48.7 acres as general retail, 8.1 acres Yes
as office, 3.3 acres as medium-high density
residential, 54.7 acres as open space, with the
remainder 16.2 acres allocated to roads and an
interchange in conjunction with the San Luis
Obispo Marketplace development project, be No

SECTION 3. That the number of votes given at each precinct and the number of votes
given in the City for and against the measures were as listed in Exhibit "A" attached.
SECTION 4. The City Council does declare and determine: That as a result of the
election, a majority of the voters voting on the measures relating to Resolution No. 9590 (2004
Series), Ordinance 1450 (2004 Series) and Ordinance No. 1452 (2004 Series) did not vote in
favor of them, and that the measures were not carried, and shall not be deemed adopted and
ratified.
SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a
statement of the result of the election, showing: (1)The whole number of ballots cast in the City;
(2) The measures voted upon; (3) The number of votes given at each precinct for and against
each measure; (4)The total number of votes for and against each measure.

In the San Luis Obispo Land Use Element on page 4, attached,there is a list of past city
votes which voiced residents"desire to preserve environmental assets and control
excessive growth,"page 3 attached. I am writing to request that Council direct staff to
add the results of the recent election to its list of upcoming proposed Land Use
amendments.
We propose the following language be added on page 4as a new bullet item in the list of
elections near the top of the page.
In 2005,voters rejected by referendum three related approvals of a controversial
650,000 square foot commercial development on the Dalidio property: 51%of
the voters rejected a land use amendment which provided less than 65 acres of on-
site open space; 52%of the voters rejected the zoning for the project; and 53%of
the voters rejected the development agreement which would have directed half of
the sales tax back to the developers.

concrete solution. As a result, irreplaceable agricultural land has been lost. This
revision proposes solutions to the continued irretrievable loss of this world--class
natural asset. Another issue that was less well understood in 1977 is the preservation
of important wildlife and native plant habitats; this revision proposes methods to begin
preservation of such habitats, including planning based on the identification, mapping
and monitoring of the community's existing natural assets. This element is a
continuation of the 1977 element; it represents fine tuning rather than a new beginning.
Community Values
As the 1977 element noted, public attitudes and values are an essential part of what
shapes planning documents. The residents of San Luis Obispo have expressed strong
community values. For the past 25 years, residents have again and again voiced their
desire to preserve environmental assets and control excessive growth. There have
been many public votes on such issues, and all have expressed the same set of
community values:
• In 1972, 70% of city voters rejected.by referendum an environmentally-
controversial annexation in the Edna Valley, the Danley Annexation.
• In June 1978, 62%.of city voters amended the city Charter by initiative to
allow voters to vote yes or no on annexations.
• In November 1978, when the first Charter-mandated votes on annexations
were held, 58% of voters rejected the Foothills annexation, and 56 % the
Ferrini annexation.
• In 1983, 73% of city voters said the city should protect sensitive hillsides and
consider purchasing open space in order to preserve it.
• Also in 1983, 69% of city voters said Port San Luis should not be used for
offshore oil activities.
• In 1985, 71% of voters chose to amend the San Luis Obispo Charter to
require that land annexed to the city can only be developed in consistency
with the General Plan.
• In 1989, 68% of city voters said growth management regulations should
apply to all development in the city.
• In 1991, 69% of city voters repealed by referendum Council-approved zoning
for the Islay Hill/Arbors Tract.'

• Also in 1991, in the midst of the worst drought in history, 56% of city voters
said the city should not participate in the State Water Project.
In a 1992 referendum, a similar percentage of city voters rescinded Council
approval for joining the State Water Project.
As voters, the people of San Luis Obispo have spoken clearly and consistently on
environmental protection and quality of life issues for the past 25 years.
Citizens spoke equally clearly when polled by the City in 1988 as part of the current
Land Use Element update. The 585 poll respondents placed quality of life and
environmental issues at the top of their concerns. Ninety percent of respondents listed
the natural environment as their top quality of life concern. Asked, in an open-ended
question, the City's greatest problem, the top response (42%) was excessive growth.
(The next largest response, at 15%, was traffic.) Asked, also in an open-ended
question, the City's greatest strength, 53% of responses concerned environmental
quality and sense of community..
Asked what reductions in quality of life they were willing to accept in return for greater
economic growth, in the following areas a majority said "none":
• air pollution, 83%;
increased traffic and traffic noise, 67%;
• development on peaks and hillsides, 66%;
• development on farmland and ranch land, 51%;
• development harmful to creeks, 67%
• overall pace of life, 51%.
Asked to pick a growth rate from listed categories, 85% of respondents picked
categories ranging from none (15%) to slower than the state and county (51%) to no
faster than the county (19%).
Despite such consistent and strong expression of community values, there has been
continued, incremental degradation of the natural environment expressly valued by
residents of San Luis Obispo.
The present Land Use Element update must be understood as emerging from the
context,of the community's past experiences and present attitudes. It is a document
that charts a future course of concern with environment, society, economy and quality
of life, and responds to the desires of the City's residents.
