SUBJECT: INTRODUCTION TO LAFCO'S SPHERE OF INFLUENCE UPDATE AND
CONSIDERATION OF A DRAFT MEMORANDUM OF AGREEMENT
REGARDING DEVELOPMENT AND URBAN SERVICES IN THE URBAN
FRINGE.
CAO RECOMMENDATION:
1. Review and endorse the proposed approach to the update;
2. Endorse the Draft Memorandum of Agreement regarding urban services or provide comments
on the draft, as appropriate; and
3. Refer the item to the Planning Commission for consideration and a recommendation.
DISCUSSION
Purpose of Tonight's Meeting
As discussed in detail below, the Sphere of Influence (SOI) helps identify probable urban
boundaries, discourages sprawl and helps preserve open space between communities. The SOI
boundary reflects City policies regarding growth, development and urban services. This study
session will introduce the Council and the public to the SOI update process, key terms and issues,
and give Council an opportunity to provide early direction to the Planning Commission and staff.
Local Agency Formation Commission (LAFCO) staff will give a presentation explaining the SOI
and the update process. Staff will present an update strategy based on existing City policy. The
Council is being asked to: 1) comment on whether or not the SOI boundary should be changed;
and 2) comment on a Draft Memorandum of Agreement (MOA) regarding development at the
City's edges. These items would then be presented to the Planning Commission for a review and
a recommendation to the Council.
Background
The Cortese/Knox/Hertzberg Local Government Reorganization Act of 2000 (CKH Act) requires
,the LAFCO to update the Spheres of Influence (SOI) for all jurisdictions in the County by
January 1, 2006. LAFCOs were created by the State of California to ensure orderly growth of
and the provision of services by cities, independent service districts, and counties. A Sphere of
Influence is defined by Government Code 56425 as "...a plan for the probable physical boundary
and service area of a local agency or municipality...." A SOI is generally considered to be a 20-
year growth boundary for a jurisdiction, however there is no requirement that areas identified in
the SOI be annexed within that period. The Act further requires that a Municipal Service Review
(MSR) be conducted prior to or concurrent with the SOI update. The MSR evaluates the
capability of a jurisdiction to serve their existing residents and future development within its SOI.

The Sphere of Influence (SOI) update being prepared for the City of San Luis Obispo is an
important tool used by LAFCO to plan for future annexations. For a property to be annexed into
a jurisdiction, the property must be inside the jurisdiction's SOI.
Under the CHK Act, LAFCO is required to review a jurisdiction's SOI every five years. LAFCO
has completed SOI updates for many other cities and special districts in San Luis Obispo County
and began work on updating San Luis Obispo's SOI in January 2005. LAFCO staff works
closely with the staff and decision makers of each jurisdiction to: 1) collect accurate data on land
use, demographics, and services, 2) understand each jurisdiction's policies and regulatory
framework, and 3) solicit input on the MSR and the SOI update. The Comrnission consists of
seven members and four alternates, appointed from and by the governing bodies (city councils.,
independent special districts, Board of Supervisors) of the jurisdictions served, plus one public
representative and alternate appointed by the Commission. Among other things, LAFCO has
final decision-making authority over SOI boundaries, annexations and detachments, and special
district boundaries.
San Luis Obispo's Sphere of Influence (and how it differs from the Urban
Reserve Line)
The last comprehensive SOI Study for San Luis Obispo was completed in 1984 when the SOI
was originally adopted. LAFCO will be asked to consider the following actions as a part of this
SOI Update: 1) approve and adopt the environmental documentation pursuant to CEQA, 2)
approve a Municipal Service Review for the City of San Luis Obispo, and 3) approve and adopt
the San Luis Obispo SOI Update.
San Luis Obispo's current SOI boundary, City limits, and Urban Reserve Line are shown in
Attachment 2. The SOI can include areas that have project approvals already or areas in which
development might be considered at an unknown time in the future. Also, a specific development
project may have been approved by the County, but is now more appropriately served by the
City. The SOI differs from the City's Urban Reserve Line (URL) -- which is the extent of the
area to which the City intends to provide urban services -- in that it is used by LAFCO when
considering possible annexations but does not confer any right to receive such services. In
setting the location of the URL, the City identifies those properties that are eligible to receive
City services. To ultimately receive City services, then, a parcel must meet several tests: it must
be within the SOI boundaries, within the URL boundaries, and must be annexed. In some cases,
the SOI and City limits may extend well beyond the URL, primarily to include open space
properties owned by and annexed to the City. Put another way, an expansion of the SOI does not
necessarily involve a commensurate change in the URL.
Draft Memorandum of Understanding
For many years, the City has been interested in an agreement with the County regarding
development just outside of the City limits, covering fringe areas such as the Airport Area or Los
Osos Valley Road near Foothill. Currently no such agreement exists, and until recently, the

County has not been interested. However through the SOI update process, LAFCO staff has
facilitated the preparation of a Draft Memorandum of Agreement (MOA) between the City and
County regarding impact mitigation, urban services and development requirements for new
development within the SOI. The proposed MOA, shown in Attachment 1,could help establish
a new level of cooperation between the City and County regarding impact mitigation, fire and
law enforcement services, open space and agricultural preservation, interagency cooperation and
development review within the urban fringe. The Draft MOA, in conjunction with an updated
SOI, could expand City influence over development in the urban fringe and address concerns
with their potential environmental and service impacts.
Sphere of Influence Limitations
The SOI does not convey legal authority for development. It is a planning and policy tool used
by LAFCO to consider future areas to be served by a jurisdiction. Nor does it change land use
categories or give a property owner any more land use entitlements than already exist with a
particular property. The SOI does not define or identify specific development projects, change or
modify zoning, or grant land use entitlements. Being inside the SOI does not require annexation
by the City at any time, nor does it entitle the property owner to compel the City to complete an
annexation or to extend urban services. These actions would require environmental review,
public hearings, and Council approval. An annexation is a mutually agreed upon course of action
that requires the approval of the City,LAFCO and the individual property owner.
LAFCO Sphere of Influence Criteria
Attachment 3 lists policies adopted by LAFCO which guide the determination of a SOI for a
jurisdiction. When LAFCO establishes a SOI, several factors are considered including: service
capacity of a jurisdiction, existing and potential future land uses, the growth inducing nature of
the SOI, and consistency with that jurisdiction's General Plan. Typically LAFCO has tried to
adhere to the General Plan's vision for a jurisdiction. On some occasions the community may
have a different view or the General Plan may be out of date.
The SOI boundary is defined primarily by a city's service capacity and anticipated growth;
however LAFCO can consider open space preservation as a legitimate purpose for defining the
boundary and has done so in the past, as it did with an of the Irish Hills. Parcels on the
City's urban fringe that are likely to be annexed and that will be required to provide significant
open space may logically be included entirely within. the SOI, even though only a portion of the
parcel may eventually receive full urban services. The City typically processes development
projects and annexation of the project site concurrently. This allows for a comprehensive
environmental analysis of the impacts of both actions.
In summary, LAFCO establishes a SOI in cooperation with the City, County, and other interested
stakeholders. LAFCO has broad discretion over the location and nature of the SOI boundary.
LAFCO fully considers not only the jurisdictions' concerns and comments but also those of
public and property owners. LAFCO's goal is to establish a SOI that is both serviceable by the
jurisdiction and realistic in terms of where services might be needed in the next 20 years.

City General Plan
San Luis Obispo's General Plan does not specifically address the SOI; however it does address
this issue in terms of growth management, annexations, compact urban form, hillside planning,
the Urban Reserve, the Greenbelt and other related policies in the Land Use Element (LUE). The
LUE seeks to protect open space outside of the Urban Reserve and within the City's Planning
Area as a Greenbelt and to use annexation as a growth management tool and to maintain
community identity. Some pertinent policies are summarized below.
1. Growth Management: The City shall manage its growth to protect environmental
quality, maintain high level of public services, ensure new development does not outpace
availability of services, accommodate new residents in a orderly way, and encourage
resident's participation in government. The URL shall define the edge of the area in
which urban development might occur. The City will not designate more land for urban
uses than its resources can be expected to support.
2. Urban Form and Edges Character: The City should maintain a compact urban form,
and the boundary between San Luis Obispo's urban development and surrounding open
land should be clear. Development just inside the boundary should use new or existing
tree plantings, hills or other landforms to set the edge of development.
3. Annexation and Services: City shall not supply water and sewer service outside City
limits (unless under pre-existing connections or agreements) outside the URL, above
elevations reliably served by water gravity flow, or below elevations reliably served by
gravity flow or pumps in the City sewer system.
4. Annexation Purpose and Timing: Annexation should be used as a growth management
tool to allow appropriate urban development and protect open space. Areas within the
URL to be developed with urban uses should be annexed before development occurs, and
such areas may be annexed long before development occurs. An area may be annexed in
phases, consistent with a City-approved specific or development plan and in
consideration of topography, needed services and funding, open space objectives, existing
and proposed land uses.
5. Annexations and Open Space: Each annexation should help secure permanent open
space protection, and specific open space standards apply to each named expansion area
(e.g. Irish Hills Area, Margarita, Orcutt and Foothill Areas). Annexations of properties
outside named expansion areas, or "Other Area" properties which are along the URL and
on hillsides, shall dedicate open space land or easements for about four times the area to
be developed.
Status of the Update
LAFCO staff, working with the City and County, has identified several study areas where
changes to the SOI may be appropriate. With a few exceptions, most of the study areas would

involve minor expansions of the SOI to include parcels that may eventually be annexed.
Attachment 2 shows the general study area. While the general locations of SOI changes have
been discussed, it is too early to identify precise changes in the SOI boundary. Before
proceeding to that step, Council should refer the matter to the Planning Commission for a review
of each sub-area within the study area including General Plan policies, open space preservation
objectives, and urban service implications.
There may be some potential with the update to gain greater City influence overdevelopment in
fringe areas (through the action of the attached MOA), protect open space, better anticipate
possible future urban service needs, and to define a more logical urban boundary. The SOI
update, MSR and MOA would then return, with a Planning Commission recommendation, for
final Council action. Changes to the SOI may pose concerns regarding the timing, rate and
location of development, availability of urban services, environmental effects, and fiscal
implications. These and other issues will be subject to environmental review once the tentative
SOI boundary is established. Significant changes to the SOI before the City's General Plan Land
Use Element (LUE) is updated may be difficult. Such an update is probably at least three to five
years out — possibly coinciding with the next SOI update cycle. By taking an active role in the
current update, however, the City can help LAFCO establish an SOI boundary which
accomplishes minor adjustments in keeping with current General Plan policies.
CONCURRENCES
Police, Fire, Utilities, Administration, Parks and Recreation, Finance, Public Works and
Community Development staff have reviewed the draft MOA and concur with the recommended
actions. City and County staff will continue to refine the draft agreement in response to Council
and Board direction.

MEMORANDUM OF AGREEMENT
BETWEEN THE CITY OF SAN LUIS OBISPO AND
THE COUNTY OF SAN LUIS OBISPO
REGARDING THE CITY'S SPHERE OF INFLUENCE
This Agreement between the City of San Luis Obispo (hereafter"City") and the County
San Luis Obispo County (hereafter"County")is entered into by the City on this day of
2005, and by the County on this day of , 2005.
WITNESSETH
WHEREAS, the Cortese/Knox/Hertzberg Act of 2000 ("the Act")requires the Local
Agency Formation Commission (LAFCO) to update the Spheres of Influence for all applicable
jurisdictions in the County every five years; and
WHEREAS, a Sphere of Influence is defined by the California Government Code 56076
as a plan for the probable physical boundaries and service area of a local agency; and
WHEREAS, pursuant to Government Code 56425 the Sphere of Influence has been
identified by the County of San Luis Obispo and the City of San Luis Obispo as shown in Exhibit
A; and
WHEREAS, the Act further requires that a Municipal Service Review be completed prior
to or, in conjunction with, the update of a Sphere of Influence in accordance with Section 56430
of the California Government Code as a means of identifying and evaluating public services
provided by the City of San Luis Obispo; and
WHEREAS, a Municipal Service Review as stated above has been completed and shall
be considered by LAFCO when establishing the City's Sphere of Influence; and
WHEREAS, the City and County have reached agreement regarding the boundaries
(Exhibit A), development standards, and zoning requirements (Exhibit B)of the Sphere of
Influence to ensure the orderly and logical development of these areas; and
WHEREAS, the City's General Plan provides a clear policy base for growth and
development in the Sphere of Influence areas and defines policies and programs that the City will
implement to ensure the preservation of the agricultural land, open space and the rural character
of San Luis Obispo; and

WHEREAS, the County's General Plan provides a clear policy base for growth and
development in the unincorporated areas and defines policies and programs that the County will
implement to ensure the preservation of the agricultural land, open space and the rural character
of San Luis Obispo; and
WHEREAS, the City and County intend to cooperate regarding growth and development
on the urban fringe of the City, and;
WIEF,REAS, LAFCO is required by Government Code 56425 (b) to give great weight to
this agreement in making its final determination of the City's Sphere of Influence.
NOW, THEREFORE, be it resolved that the parties agree as follows:
1. The Sphere of Influence boundary contained in Exhibit A provides for the orderly and
logical growth for the City of San Luis Obispo and represents an appropriate 20-year
growth boundary (2005-2025) based on available information.
2. The development standards and zoning requirements contained in Exhibit B provide a
framework for completing updates to the General Plans of both the City and the County
for the areas in the Sphere of Influence.
3. The development standards and zoning requirements contained in Exhibit B are intended
to provide the City and the County with the basis for developing specific land use policies
and standards for areas in the City of San Luis Obispo Sphere of Influence and do not
supersede or limit the planning or environmental review process of either jurisdiction.
4. The City's and County's General Plan policies including those found in Exhibits D and E
shall be used to guide the logical and orderly development of these Sphere areas while
preserving the agricultural and open space lands.

DEVELOPMENT STANDARDS AND ZONING REQUIREMENTS
The following development standards and zoning requirements are agreed to and shall be used by
the City of San Luis Obispo and the County of San Luis Obispo to guide development within the
proposed Sphere of Influence as shown in Exhibit A and to update their General Plans.
1. Intent. It is the intent of the County and the City to work cooperatively towards the
goal of developing the agreed upon Sphere of Influence(as shown in Exhibit A) in an
orderly and logical manner consistent with the Cortese/Knox/Hertzberg Act, the City
and County General Plans, the California Environmental Quality Act and any other
applicable laws and regulations.
2. Impact Mitigation. The City and County shall ensure that the
development/mitigation fees needed to offset the fiscal impacts from projects
approved by either jurisdiction in the Referral Planning Area shown in Exhibit C are
collected and distributed in a fair and equitable manner. Mitigation/fees to offset
impacts to fire, law enforcement, emergency medical services, water and wastewater
treatment services, roads and streets, other public services, and housing, shall be
incorporated into the conditions of approval for projects on a case by case basis.
Documentation shall be provided that identifies the project's fiscal, housing, and
services impacts to both the City and the County and shall be considered as part of the
development review process. The documentation shall be used to prepare conditions
of approval and to allocate impact fees as appropriate.
3. Fire and Law Enforcement Services. Cost's associated with fire and emergency
response services shall be given special attention. The County and City Planning
Staff shall meet with the City's Fire Chief and the County Fire Chief regarding
development in the unincorporated areas that would impact the fire service levels.
The purpose of this meeting is to identify and discuss fiscal impacts of development
related to fire services, service delivery impacts of development on the urban fringe,.
and appropriate mitigation measures.
4. Interagency Cooperation. The City and the County shall work cooperatively to plan
for future land uses and public services and facilities to improve and maintain area
circulation connections, and to preserve agricultural land and open space. The County

and City will consider the creation and implementation of various assessment and
financing mechanisms for the construction and maintenance of public improvements,
such as roads, utilities, recreation and trail improvements, parks and open space, and
similar improvements that could serve visitors and residents of the City and the
County. Discretionary development projects and General Plan Amendments within
each agency's jurisdiction shall be referred to the other for review and comment prior
to action on a development proposal. The County shall seek the City's comments
regarding projects in the referral area defined in the County's San Luis Obispo Area
Plan (Exhibit Q. The City shall seek the County's comments regarding projects that
affect the unincorporated area found in Exhibit C. When a discretionary project
application is accepted for processing, it shall be referred to the following contact
person(s) for early review and comment:

This provision shall not supersede other methods of commenting or providing
feedback regarding a proposal or project.
5. Sphere of Influence and City's Urban Reserve Line. The County shall, to the
extent legally possible, limit development within the City's Sphere of Influence (SOI)
and Urban Reserve area to those uses allowed by the County General Plan at the time
of application. The County shall give great weight to the City's General Plan policies
when reviewing development in the City's Urban Reserve
6. Prior City Review. For projects submitted to the County for consideration, as part of
the application the County shall require written documentation (provided in a timely
manner) that indicates the City Council will not support annexation into the City.
7. Development Review Coordination. Projects proposed within the referral area
shown in Exhibit C, and subject to an Initial Study under CEQA, shall cause the City
and County representatives to request a meeting to discuss the proposed project prior
to completion of the Initial Study. The purpose would be to discuss the City's and
County's General Plan policies with regard to the project and to identify key issues
that may need special attention during the CEQA process.

8. Agriculture and Open Space. The City and the County shall work together to
preserve the agricultural and open space resources in the SOI area using the City's
Greenbelt and Open Space policies and the County's Agriculture and Open Space
Policies, including the transfer development credit program, as appropriate. The
criteria contained in the County's Agriculture and Open Space Element particularly
Agricultural Policies 17 and 24 (Exhibit D), and the relevant policies in the City's
General Plan (Exhibit E) shall be addressed in the preparation of any land use
entitlements and environmental reports.
9. General Plan Amendment. The City intends to complete environmental review, pre-
zoning, pre-annexation, and any necessary pre-general plan amendment activities
prior to or concurrent with an annexation proposal being processed by LAFCO. The
County intends to complete any necessary amendments to its General Plan in the San
Luis Obispo Area Plan to reflect the annexation of territory to the City of San Luis
Obispo.
10. Zoning Requirements/Speciric Plan. Prior to annexation, the City shall complete
prezoning and environmental review consistent with its General Plan. CEQA review
shall include analysis of issues, including but not limited to the following: a reliable
and safe water supply, sewer capacity, public services, cumulative traffic circulation,
agricultural buffers, jobs-housing balance, use of transfer development credits, and
affordable housing opportunities.

MUNICIPAL SERVICE REVIEW
oval Agency Formation Commissions (LAFCOs) were created in 1963 to
help organize, manage and regulate the provision of public services to
development in response to the post World War II development boom and
the proliferation of development and local agencies providing public
services to California's fast growing communities. The results of this
development boom became evident as more of California's agricultural land was
converted to urban uses. This premature and unplanned development pattern
created inefficient and expensive systems of delivering public services using
multiple small units of local government. In many ways we face some of the
same challenges today in 2005.
Sphere of Influence. The Sphere of Influence (SOI) Update being prepared for
the City of San Luis Obispo is an important tool used by LAFCO to plan for future
annexations. An SOI is defined by Government Code 56425 as "...a plan for the
probable physical boundary and service area of a local agency or municipality..."
The SOI represents an area adjacent to the service area of a jurisdiction where
the provision of services and development might be reasonably expected to
occur in the next 20 years. In order for a property to be annexed into a
jurisdiction, it is required to be inside the Sphere of Influence. LAFCO is required
to review a jurisdictions Sphere of Influence every five years.
The SOI anticipates that a particular area will likely be served by a jurisdiction
over the next 20 years. The City of San Luis Obispo typically processes
development projects and annexation of the project site concurrently. This
allows for a comprehensive environmental analysis of the impacts of both
actions. The SOI is a preliminary action that can include areas that have project
approvals already or project approvals might be considered at an unknown time
in the future. Also, a specific development project may have been approved by

Municipal Service Review. The Cortese-Knox-Hertzberg (CKH) Act further
requires that a Municipal Service Review be conducted prior to or in conjunction
with the update of a Sphere of Influence. The Sphere Update is based upon the
Municipal Service Review completed for the City by the Local Agency Formation
Commission.. The Service Review analyzes the jurisdiction's capability to provide
public services to existing and future residents.
A Municipal Service Review has been prepared for the City of San Luis Obispo in
accordance with Section 56430 of the Califomia Government Code. The Service
Review evaluates the public services provided by the City and possible changes
to the City's Sphere of Influence that are currently under consideration. A
Service Review must have written determinations that address the following
factors in order to update a Sphere of Influence:

The Process. The CKH Act calls for the Service Review to be completed either
prior to or concurrent with the Sphere of Influence update..Establishing the SOI is
a collaborative process that involves the public, the City Council, the Board of
Supervisors, City and County Staff. The process for updating the City of San Luis
Obispo's Sphere of Influence includes the following basic steps:
1. Preparation of a Public Draft Sphere of Influence Update and Municipal
Service Review through collaboration with the City. This involves
gathering information from various Departments and summarizing that
information base.
2. Development of a Memorandum of Agreement (MOA) between the City
and the County. If agreed to, City and County approval of a Memorandum
of Agreement. LAFCO is required by the CKH Act to give great weight to
an agreement between the City and the County when considering the
Sphere of Influence Update.
3. Completion of the environmental review process consistent with the
California Environmental Quality Act (CEQA).
4. Public Review and Comment period for all documents.
5. LAFCO consideration of Sphere of Influence Update, Municipal Service
Review, MOA and environmental review documentation. Q

LAFCO Actions.The last comprehensive SOI Study for San Luis Obispo was
completed in 1984 when the sphere was originally adopted. LAFCO is being
asked to consider the following actions as a part of this Sphere of Influence
Update: 1) Approve and adopt the environmental documentation pursuant to
CEQA; 2) Approve Municipal Service Review for the City of San Luis Obispo;
and 3) Approve and adopt the San Luis Obispo Sphere of Influence Update.
Summary. The attached policies adopted by LAFCO help guide the
determination of a Sphere of Influence fora jurisdiction. When LAFCO
establishes a Sphere of Influence several factors are considered including;
service capability of a jurisdiction, existing use and potential future land uses, the
growth inducing nature of the SOI, and consistency with the General Plan.
Typically LAFCO has tried to adhere to the General Plan's vision for a
jurisdiction. On some occasions the Community may have a different view or the
General Plan may be out of date.
In summary, LAFCO establishes a Sphere of Influence in cooperation with the
jurisdiction and other interested stakeholders. LAFCO has broad discretion over
the location and nature of the Sphere of Influence boundary. LAFCO fully
considers not only the jurisdictions concerns and comments but also those of
public and property owners. LAFCO's goal is to establish a SOI that is both
serviceable by the jurisdiction and realistic in terms of where services might be
needed in the next 20 years.

SANLUIS OBISPO LAFCO POLICY BASE
The San Luis Obispo LAFCO has adopted policies regarding Sphere of
Influences. These policies provide a guide for LAFCO to establish a Sphere of
Influence:
VI. Sphere of Influence and Municipal Service Review Policies
The Cortese/Knox/Hertzberg Act provides the legislative authority and intent for
establishing a Sphere of Influence and is included by reference in these policies.
A Sphere of Influence is the 20-year growth boundary for a jurisdiction's physical
development. These policies are intended to be consistent with CKH and take
into consideration local conditions and circumstances. All procedures and
definitions in the CKH Act are incorporated into these policies by reference.
Sphere of Influence Policies
1. LAFCO intends that its sphere of influence determinations will serve as a
master plan for the future organization of local government within the
county. The sphere shall be used to discourage urban sprawl and the
proliferation of local governmental agencies, and to encourage efficiency,
economy and orderly changes in local government.
2. The sphere of influence line shall be a declaration of policy which shall be
a primary guide to LAFCO in the decision on any proposal under its
jurisdiction. Every determination made by the Commission shall be
consistent with the spheres of influence of the agencies affected by those
determinations.
3. No proposal which is inconsistent with an agency's adopted sphere of
influence shall be approved until the Commission, at a noticed public
hearing, has considered an amendment or revision to that agency's
sphere of influence.
4. The adopted sphere of influence shall reflect city and county general
plans, growth management policies, annexation policies, resource
management policies, and any other policies related to ultimate boundary
and service area of an affected agency unless those plans or policies
conflict with the legislative intent of the Cortese-Knox (Government Code
Section 56000 et seq.).
Where inconsistencies between plans exist, LAFCO shall rely upon that
plan which most closely follows the legislature's directive to discourage
urban sprawl, direct development away from prime agricultural land and
open-space lands, and encourage the orderly formation and development
of local governmental agencies based upon local conditions and
circumstances.
5. In accordance with CKH and the State Office of Planning and Research
guidelines, a Municipal Service Review shall be conducted prior to a
comprehensive update of a jurisdiction's Sphere of Influence. The Service

Review is intended to be basis for updating a jurisdiction's Sphere of
Influence.
6. LAFCO will designate a sphere of influence line for each local agency that
represents the agency's probable physical boundary and includes territory
eligible for annexation and the extension of that agency's services within a
zero to twenty-year period.
7. LAFCO shall consider the following factors in determining an agency's
sphere of influence.
a. Present and future need for agency services and the service levels
specified for the subject area in applicable general plans, growth
management plans, annexation policies, resource management
plans, and any other plans or policies related to an agency's
ultimate boundary and service area.
b. Capability of the local agency to provide needed services, taking
into account evidence of resource capacity sufficient to provide for
internal needs and urban expansion.
C. The existence of agricultural preserves, agricultural lands and open
space lands in the area and the effect that inclusion within a sphere
of influence shall have on the physical and economic integrity of
maintaining the land in non-urban use.
d. Present and future cost and adequacy of services anticipated to be
extended within the sphere of influence.
e. Present and projected population growth, population densities, land
uses, land area, ownership patterns, assessed valuations, and
proximity to other populated areas.
f. The agency's capital improvement or other plans that delineate
planned facility expansions and the timing of that expansion.
g. Social or economic communities of interest in the area.
8. LAFCO may adopt a zero sphere of influence encompassing no territory
for an agency. This occurs where LAFCO determines that the public
service functions of the agency are either non-existent, no longer needed,
or should be reallocated to some other agency of government. The local
agency which has been assigned a zero sphere of influence should
ultimately be dissolved.
9. Territory not in need of urban services, including open space, agriculture,
recreational, rural lands or residential rural areas, shall not be assigned to
an agency's sphere of influence, unless the area's exclusion would
impede the planned, orderly and efficient development of the area.

10. LAFCO may adopt a sphere of influence that excludes territory currently
within that agency's boundaries. This occurs where LAFCO determines
that the territory consists of agricultural lands, open space lands, or
agricultural preserves whose preservation would be jeopardized by
inclusion within an agency's sphere of influence. Exclusion of these areas
from an agency's sphere of influence indicates that detachment is
appropriate.
11. Where an area could be assigned to the sphere of influence of more than
one agency providing a particular needed service, the following hierarchy
shall apply dependent upon ability to service.
a. Inclusion within a municipality sphere of influence.
b. Inclusion within a multi-purpose district sphere of influence.
C. Inclusion within a single-purpose district sphere of influence.
In deciding which of two or more equally-capable agencies shall include
an area within its sphere of influence, LAFCO shall consider the agencies'
service and financial capabilities, social and economic interdependencies,
topographic factors, and the effect that eventual service extension will
have on adjacent agencies.
12. Sphere of influence boundaries shall not create islands or corridors unless
it can be demonstrated that the irregular boundaries represent the most
logical and orderly service area of an agency.
13. Non-adjacent, publicly-owned properties and facilities used for urban
purposes may be 'included within that public agency's sphere of influence
if eventual annexation would provide an overall benefit to agency
residents.
14. At the time of adoption of a city sphere of influence, LAFCO may develop
and adopt in cooperation with the municipality an Urban Service Area
Boundary pursuant to policies adopted by the Commission in accordance
with Government Code Section 56080. LAFCO shall not consider any
area for inclusion within an Urban Service Area Boundary that is not
addressed in the general plan of the affected municipality, or is not
proposed to be served by urban facilities, utilities, and services within the
first five years of the affected city's capital improvement program.
15. LAFCO shall review sphere of influence determinations every five years or
sooner when deemed necessary by the Commission. If a local agency or
the county desires amendment or revision of an adopted sphere of
influence, the local agency by resolution may file such a request with the
Executive Officer. Any local agency or county making such a request shall
reimburse the Commission for the actual and direct costs incurred by the
Commission. The Commission may waive such reimbursement if it finds
that the request may be considered as part of its periodic review of
spheres of influence.

16. LAFCO shall adopt, amend or revise sphere of influence determinations
following the procedural steps set forth in the Cortese-Knox-Hertzberg,
Government Code Section 56000 et seq.
Municipal Service Review Policies
The following policies are meant to guide the San Luis Obispo LAFCO in the
preparation of the Municipal Service Reviews for jurisdictions:
17. The Commission shall use the Municipal Service Review Guidelines
prepared by the State Office of Planning and Research as a framework for
preparing a Municipal Service Review for a jurisdiction. The Commission
shall also use the guidelines adopted in Appendix A of this document to
gather and evaluation information for municipal service review.
18. In order to prepare and update Spheres of Influence in accordance with
Section 56425, the Commission shall conduct a Service Review of the
municipal services provided by the local agency or service jurisdiction.
19. LAFCO shall complete Service Reviews consistent with the provisions
contained in the Cortese-Knox-Hertzberg Act.
20. LAFCO shall work together with the affected jurisdictions and facilitate a
constructive dialogue of the issues related to a Service Review with the
goal of achieving an agreement, which can be given "great weight" by the
Commission in their deliberations. The following steps shall be taken to
encourage such discussion and develop a Memorandum of Agreement
between a City and County regarding a city's Sphere of Influence:
a. Prepare agendas and facilitate initial meetings between
representatives of the City, and the County to identify potential
Sphere of Influence areas and possible land use development
standards. The County Agriculture Commissioner's Office and
property owners should be included in these discussions as
appropriate.
b. The negotiation period shall begin upon submittal of a Resolution of
Application by the affected City. However, preliminary discussion
should take place prior to adoption of the Resolution of Application.
The involved parties have up to 60 days to come to an agreement
following adoption of the Resolution of Application.
C. Prepare a draft Memorandum of Agreement that includes a map of
the proposed Sphere of Influence along with Development
Standards and Zoning Requirements.
d. Conduct a series of meetings to discuss issues and agree to
specific language and provisions, if possible.

e. Provide the City and County with a final Memorandum of
Agreement for a public hearing and consideration by the City
Council and the Board of Supervisors.
f. If approved by the City and the County, the Commission is required
to give the agreement "great weight' in making a decision regarding
the Sphere of Influence.
g. If the Sphere of Influence approved by the Commission is
consistent with the agreement, the City and County shall implement
the provisions of the agreement by amending their respective
General Plans, then any development approved by the County
within the Sphere shall be consistent with the terms of the
agreement.
If the Commission changes the Sphere of Influence agreed upon by the City and
County, the agreement shall not be implemented; however, it may be re-
negotiated, if both parties agree to further discussions.

As a concerned resident of San Luis Obispo,I offer the following comments.

LAFCO and Sphere of Influence
I think this can be very important for us in shaping the future of our city.I encourage you to take a proactive stance and use the SOI
approach to enable an effective Greenbelt through good planning,effective zoning and parcel size. Some of the area is under
Williamson Act,and that is good,but it is not permanent and is subject to change or even buyout.Work with the county,include their
planning,parks and agriculture departments for effective communication of our interests.Work to make the county a partner in
actualizing our Greenbelt.We need to strongly discourage sprawl.
In the early 1970s,Napa Valley passed a very proactive and strong agricultural zoning law.It has really helped preserve some great
grape growing land. It stated minimum parcel size,district boundaries and how many houses could be build on each parcel.This
might be a approach we could take.We have some wonderfulagricultural lands around our city.We need large parcel sizes,minimal
roads,rights of way,housing and buildings,effective zoning and great communication between city and county.I see in the SOI
MOA,that only Community Development is listed as a contact.I suggest that the MOA contain language that makes sure there is
effective communication at the city level,with natural resources also.As for at the county level,I think it is very important that
agricultural and parks be include.At the county level,agricultural is the big issue.
I encourage you to go beyond the minimum and strongly push our interests.

Airport Land Use Plan
--In the Airport Area,-we need-to-work-for-the maximum amount of public safety-not the minimum.-Accidents do happen at-airports-- -
and proper planning is essential.I encourage you to reduce the amount of commercial activities/businesses in the airport area.Make
most of the area a safety zone.That will also have the side benefit of less noise exposure to the public.Airplane traffic will only get
more frequent with larger planes.

Memorandum of Agreement (MOA)-City and County. The City and County staff have
reached conceptual agreement with regard to the Memorandum of Agreement (MOA).
We continue to make progress towards agreement on the Sphere of Influence
Boundary, but have yet to reach agreement regarding the actual boundary. One reason
is that the SOI Study Areas have been modified recently and will need to be discussed
with the City and County staff.
Key provisions of the MOA include; coordination between the City and County regarding
development impact and mitigation fees, working with the police and fire agencies to
address impacts to service levels, formalizing the project referral process, and
coordination of the City and County General Plans.
Recent Activities. Staff made a presentation regarding the SOI at the Airport Land
Use Commission on February 16, 2005. The presentation was well received and staff
will continue to keep the ALUC apprised of the SOI. The MOA will be readied for
consideration by the City Council and the County and the SOI Update and MSR will be
prepared for release to the public.
Staff prepared several maps for the City showing other areas to be studied for inclusion
into the Sphere of Influence. These maps were used by the City for inter-department
discussions about the Sphere of Influence.
A draft initial study pursuant to CEQA has been prepared but will need to be revised to
include the newly added study areas. A subsequent environmental determination will be
completed when the Sphere of Influence Update and Municipal Service Review are
released for public review.
Public Outreach/Schedule. It is anticipated that a 45 day public review period would
be needed for the SOI-MSR. Staff will be attending meetings and_ hearings and be
available for consultation. We hope to be able to release the documents for public
review in the first week in May. As mentioned earlier, the City Council will conduct a
study session regarding the SOI on May 17. The property owners within the Sphere of
Influence area shall be notified directly about the SOI update process. The documents
will be available on the internet at www.siolafco.com.
