DISCUSSION
On May 17, 2005, the Council voted (4-1, Council member Settle voting no) to introduce
Ordinance No. 1472. This ordinance adds Section 3.50 of the Municipal Code as follows:
1. In accordance with California Health & Safety Code Section 17921, the City will annually
conduct fire and life safety inspections of multi-dwelling properties containing three or more
dwelling rental units, including apartments, hotels, motels, lodging houses and congregate
residences.
2. As provided in California Health & Safety Code Section 13146, the Council will set fees by
resolution to recover the reasonable costs incurred by the City in performing fire and life
safety inspections of multi-dwelling rental properties. These fees are not incident to the
ownership of property but are necessary to recover the costs reasonably incurred by the City
in providing fire and life safety inspections as mandated by the State of California.
3. These fees will be collected via the secured property tax roll.
Ordinance No. 1472 is now ready for adoption and will become effective thirty days after the
date of its final passage.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AUTHORIZING THE COLLECTION OF FEES FOR FIRE AND LIFE SAFETY
INSPECTIONS OF MULTI-DWELLING RENTAL PROPERTIES
ON THE SECURED PROPERTY TAX ROLL
WHEREAS, the City is required by California Health & Safety Code Section 17921 to
annually conduct fire and life-safety inspection of multi-dwelling rental properties containing
three or more dwelling units, including apartments, hotels, motels, lodging houses and
congregate residence, and
WHEREAS, a typical fire and life safety inspection at these facilities includes, but is not
limited to, checking fire alarm systems, fire sprinkler systems, fire extinguishers, common areas
for fire hazards, exiting and fire access issues; and
WHEREAS, California Health & Safety Code Section 13146 provides cities the legal
authority to charge property owners to recover reasonable costs of providing these annual
inspections; and
WHEREAS, the City has adopted a fee program to recover the cost of fire and life safety
inspections of multi-dwelling rental properties; and
WHEREAS, the most cost effective method for collecting these fees is via the secured
property tax roll.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Section 3.50 of the Municipal Code is hereby established as follows:

This ordinance will go into effect at the expiration of thirty (30) days after its final passage.

Dave Romero Mayor and Members of the City Council:
I am requesting that you reconsider the pending approval of rental property inspection program. I am aware of the disagreements and
point of view from both city staff and those opposed to the program. I believe the council should not rush into approving the item and
pull it from the 6/7 agenda. This will allow the council the time and opportunity to obtain a neutral third parry interpretation of the State
Fire Code. My concerns are as follows:
1. I am not convinced the city is mandated by the state to implement an inspection program, I believe the city has relied on and
trusted the interpretation of city staff members and needs to take a step back and be 100%sure those opinions are fact and not
simply loose understandings of the fire code. If the program is implemented and it turns out staff was wrong it will be an
embarrassing and costly mistake to correct..
2. The logistics of inspecting individual apartment units is impractical and by the admission of the fire department will not be
completed. I was told by a fire department official that they would be inspecting common areas, fire equipment, access and an
occasional apartment unit if vacant at the time of their inspection.
3. The costs of the proposed inspection fees seem to be exorbitant. If the program is implemented I request the city conduct
annual audits of the program costs and make any necessary fee adjustments. The thinking on the street is this will become a
revenue generating program as opposed to a cost recovery program.
4. Some of the inspections are already being conducted by other government agencies or by private sources. The County Health
Department operates a program to test all fire line backflow prevention devices. We are also required to conduct quarterly
inspections of fire sprinkler flows and audible alarms by our alarm monitoring company. Would the proposed inspection
program replace these two mandatory inspections and associated costs?
5. Has anyone confirmed if other cities have a similar program in place and if so what are their charges for the same service?
Does CDF have a similar program in place for the unincorporated areas of the county? Did the former city of the current Fire
Chief have a similar program in place and if so what were the fees charged for their inspections?
6. If it is confirmed the requirement exists however it is not being implemented by the mainstream of Cities and is not being
enforced on a state level does SLO really need to be any different than the rest of the state.
I realize there is much more to both sides of the arguments on this issue. The one clear fact is;there is not a consensus which should
leave considerable doubt in your minds. In light of the differing opinions I believe the council has a responsibility to be 100%sure
before approving this ordinance. Please consider a step back and get an independent interpretation of the code.

Dear Mayor and City Council,
Please do not change your mind on the Rental Inspection Fee issue.
Often, as I have precinct walked, I have come across people, many of
them students, minimium wage workers or seniors, living in units which
landlords have refused to keep in minimal condition. These renters are RECEIVED
afraid to complain because they fear retaliation in a tight rental
market. Fire inspections and correcting violations discovered will go J0 U 7 ZCTJ
along way toward improving the quality of life for renters. And,
remember just about half of our residents are renters. I urge you to SLO CITY CLERK
stay the course..

In comparing just the impact of optional rate structures, Alternatives 1 and 2-A are the most
comparable to our recommendation, since both are based on the enhanced program at full (or
very high) cost recovery. As reflected above, at 30 units the three rate structures produce the
same fees. Compared with the recommended "per unit" rate structure, the flat rate structure
results in higher fees for smaller complexes and lower fees for larger ones. There is some
analytical basis for this, since on a per unit basis, there are some economies of scale in
performing annual inspections. On the other hand, this results in a "per unit" cost that is higher
for smaller complexes, and this presents equity concerns as well, which is why the Council may
want to consider Alternative 1 as a blending of the goals for an enhanced program, high cost
recovery and a rate structure that makes sense for larger properties as well as smaller ones.
This "balancing" is the same challenge presented to the Council in all of other fee and rate-
setting situations, such as water, sewer and refuse collection: there is not one "correct"
analytical" answer in weighing the pros and cons of each approach.

Subject: Multi-Dwelling Rental Property Inspection Cost Recovery
Dear Mayor Romero and Council Members,
We have received a number of communications regarding tomorrow night's consent agenda item re the
multi-dwelling Rental Property Inspection Program. Our members continue to be very concerned about the
inequality of this so called "cost recovery" plan and we respectfully request that it be pulled from the
consent agenda and that you re-evaluate the wisdom of insituting this fee.
The cumulative effect of cost recovery fees along With increased rates for various city services is causing
concern among our members. While we understand the need for the city to balance its budget, we do not
agree that the multi-dwelling rental property inspection cost recovery/enhanced program is an appropriate
means toward that end.

We are writing in regards to the adoption of ordinance no. 1472,the fire inspection fee
collection. This item is on the June 7`h City Council meeting consent agenda. Included in
this ordinance is a proposed fee of$477 per fraternity/sorority per year. As leaders of the
Cal Poly Greek community,we have deep concerns over this proposed ordinance
adoption:
CAL POLY STATE 1. For the level of service received,this fee is extremely excessive.
UN1vERsiTY 2. Smaller houses will pay the same fee as larger houses.
Student Life&Leadership
uu 217 3. The fee does not take into account the need for conducting secondary inspections.
San Luis Obispo.CA 93401 4. The fee is a tax on low income individuals and students.
Phone:805.756.2476 Many strides have been taken in the Greek community over the last year to work with the
city to help improve the relationship between students and city officials. Greeks
supported the city's Mardi Gras position and took an active stance to encourage safety and
responsibility. While Greek leaders continue to foster a respectful relationship with city
officials, other members of the Greek community do not share the same sentiment as a
result of recent fines. The adoption of the fire inspection fee collection will only augment
dissatisfaction between San Luis Obispo city officials and Greek members.
These fees will be interpreted by the members of the Greek community as the city taking
another hit at students. I urge you to consider removing this item from the consent agenda
and readdress this issue after city staff has the opportunity to directly discuss these fees
with Greek leaders. As Greek leaders, we are ready to engage city staff and discuss a fair
compromise. We are confident that both city and Greek leaders can come to a fair
agreement. .
