Adopt a resolution declaring buildings at 1049 Orcutt Road surplus property. 2. Approve specifications for Sale and Removal of Surplus City Property Structures at 1049 Orcutt Road, Specification No. 99608A. 3. Authorize staff to advertise for bids for abatement and demolition and authorize the CAO to execute the agreement with the highest bidder. DISCUSSION The widening of Orcutt Road and the realignment of Bullock Lane to intersect Orcutt Road at Laurel Lane is a City Capital Improvement Plan project. On January 18, 2005 Council authorized the purchase of 1049 Orcutt Road, which was needed in order to acquire the property for the realignment of Bullock Lane. The property at 1049 Orcutt Road contains two buildings. One building is a residence and the other an accessory building to the residence. Both structures are currently vacant and would require substantial improvements before they would be habitable. In order to avoid creating an attractive nuisance and reduce possible liability, removing the structure from the property for this future Capital Improvement Plan project is recommended. The buildings on the property are over 50 years old. Under the provisions in Section 15.04.020, 114.3 of the Municipal Code, they must be advertised for sale for a period of 90 days before a demolition permit can be issued. Section 906 of the City Charter requires that the City Council approve the sale or disposal of surplus property with an estimated value greater than $100 which these buildings have. It is unknown how much will be offered for the buildings. It is possible the bids will be lower than $100. If the buildings do not sell after a period of 90 days, staff will proceed with an asbestos abatement and building demolition project. The sale price is not expected to be significant, but there could be some cost savings if the City does not have to pay for asbestos abatement or demolition. (2005 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO DECLARING SURPLUS PROPERTY WHEREAS, the City Charter requires that the Council approve the sale or disposal of surplus property with an estimated value greater than $100; and WHEREAS, the City has adopted a Capital Improvement project to realign Bullock Lane; and WHEREAS,the buildings at 1049 Orcutt Road are in the way of the new alignment. NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of San Luis Obispo hereby declares: SECTION 1. The buildings at 1049 Orcutt Road are no longer needed by the City and are surplus property. SECTION 2. Disposal of the property shall be made by sale through public bidding,or if there are no purchasers, by demolition.
