HomeMy WebLinkAbout08/16/2005, C5 - MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LOUIS OBISPO AND THE SAN LUIS OBISPO CITY POLICE OF council T- ac,Enaa aEpout Ift=`=W= CITY OF SAN LUIS OBISPO FROM: Monica Irons,Director of Human Resources SUBJECT- MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO CITY POLICE OFFICERS' ASSOCIATION FOR THE PERIOD OF 07/01/04—12/31/05 CAO RECOMMENDATION Adopt a resolution approving the Memorandum of Agreement for an 18-month contract. DISCUSSION The Memorandum of Agreement (MOA) between the City and the San Luis Obispo City Police Officers' Association (POA) expired on.June 30, 2004, after a two-year term. As provided for in the agreement, the City entered into negotiations with the POA in April 2004, to develop a successor agreement. The City's bargaining team was the. by Bill Avery, the City's chief negotiator, and included Monica Irons, Human Resources Director, Karen Jenny; Risk Manager, and Dan Blanke, Police Captain. The POA's bargaining team was led by Dale Strobridge, President of the POA, and included Barbara Sims, Shaana Lichty, Chuck Riedel, and Victor Nunez. The POA presented an initial proposal to the City over a period of three separate meetings that took place between April and September 2004. By late September staff had reviewed the majority of the POA requests and met with Council in closed session to receive negotiating parameters. Formal negotiation meetings were held monthly from September through December 2004 and several informal discussions between the lead negotiators took place through March 2005. In March the Citysent a tentative agreement to the POA. This tentative agreement failed ratification and therefore, formal negotiation meetings were held in June and July. A second tentative agreement was reached in mid July and ratified by the majority of the POA membership on July 19, 2005. The agreement is within the economic guidelines previously discussed with Council. Following is a summary of the significant changes included in the agreement:. Term: July 1, 2004 through December 31,2005 Salary: July 1, 2004 2% increase for all employees in the unit January 13,2005: 5% equity increase for all Police Records Clerks January 13,2005: 5% incentive for all Relief 'Communications Technicians. July 1,2005: 1:5% increase for all employees in the unit Council Agenda Report- SLOPOA MOA Page 2 July-15,2005 Salary Steps: Step- progression for all represented employees shall be at 12-month intervals except for progression to Master Police Officer, Step 7 which involves specialty assignments, This is a change from the current progression which required two years service at Step 4 prior to advancing to Step 5, or Step 6 of the Police Officer range. Retirement: An amendment to the Public Employees' Retirement System (PERS) contract for miscellaneous and safety employees to provide the "Optional Settlement 2 Death Benefit" for employees, which allows the spouse of a deceased employee,who was eligible to retire from service at the time of death, to select a monthly retirement allowance.instead of the lump sum death benefits currently payable. Other Pay Incentives: Slight modifications to the educational incentive, standby pay, and bilingual pay provisions were negotiated; resulting in less than .25% increase in total compensation. Work Schedule Clarification: A comprehensive re-write of the Communications Technician 3, 12 work schedule aimed at clarifying issues in the sign up procedure to ensure 7 day per week, 24-hour per day coverage in the Communications Center. FISCAL IMPACT SLOPOA represents 63 City employees with a current apnual total compensation of$6.3 million. The total cost for this compensation package for the 18-month contract period is $230,400 and an on-going annual cost of approximately $134,000 per year. Adequate funding for this increase is currently available in the MOA adjustment account. ALTERNATIVE Do not approve the resolution and direct staff to negotiate a different successor agreement. This alternative is not recommended as the agreement is consistent with the Council's previous direction and the City's employer-employee relations policies. (2005 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO_ ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SANLUIS OBISPO AND THE SAN LUIS OBISPO POLICE OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 19 2004 THROUGH DECEMBER 31, 2005 BE IT RESOLVED,by the City Council of the City of San Luis Obispo, that: SECTION 1. The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo Police Officers' Association (SLOPOA), attached Hereto as Exhibit"A" and incorporated herein by this reference, is hereby adopted and ratified. SECTION 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. SECTION 3. The City Clerk shall furnish a copy of this resolution and a_ copy of the executed Memorandum of Agreement approved by it to.
