CAO RECOMMENDATION
Adopt resolution (Attachment 1) accepting the public improvements and releasing the bonds for
Tract 2307 (Vicinity Map, Attachment 2).
DISCUSSION
The required subdivision improvements approved with the tentative map, per Resolution No.
8975 (1999 Series) approved October 19, 1999, have been completed to City standards and
specifications. The subdivider has requested acceptance'of the public improvements by the City
and release of the respective sureties. Public improvements include approximately a 0.93 acre
park, 5,500 linear feet of new public streets (including Spooner Drive, Eto Circle, Welsh and
Foreman Courts and portions of De Vaul Ranch and Tonini Drives), water, sewer, storm drain
and typical utility company mains and services.
The final map for Tract 2307 was approved, per Resolution No. 9224 (2001 Series), on September
1, 2001. Included with the final map approval was a subdivision agreement that allowed the
Subdivision Labor and Materials and the Faithful Performance bonds to be released "upon City
Council acceptance of the subdivision improvements and upon receipt of a guarantee for ten
percent of the cost of the public improvements. The cost of the public improvements was estimated
to be$4,494,677. The subdivider has provided a surety bond in the amount of$449,468.
This guarantee is to insure that the subdivider will remedy any defects in the improvements arising
from faulty workmanship or materials or defective construction of said improvements occurring
within twelve (12) months after subdivision acceptance, in accordance with City Council
Resolution 9313 (2002 Series) and Sections 66499.7 and 66499.9 of the Government Code of the
State of California.
Remaining Issues
The subdivider has proposed that the following two known issues be resolved during the 12 month
warrantee period: .
Privately Maintained Detention Basin
The detention basin located adjacent to Madonna Road near the center of Tract 2307 is generally
functioning as anticipated. The basin temporarily detains storm water runoff as mitigation for the

development of the site. The basin also captures and retains sediments, which improves the water
quality of the overall tributary area. Nuisance flows are accommodated by a perimeter drainage
system comprised of an 8 inch PVC pipe extending to the outflow weir structure. This basin and
associated site improvements is privately owned and maintained.by the Homeowners Association
(HOA), although the City has easement rights for use of the basin area for recreation purposes
(see Lot 151 in Figure 1).

This winter the City of San Luis Obispo received over 35 inches of rain, which is 67% above the
average annual rainfall. This uncharacteristically high annual rainfall caused a large amount of
sediment and eucalyptus debris to be carried from the Irish Hills towards the underground storm,
drain systems adjacent to the historic farmhouse. The sediment runoff was enough to cause a
partial clogging of the perimeter drainage system, and fill the concrete aprons at the discharge
points of the HDPE pipes with sediment. The saturated conditions have made sediment removal
from the basin difficult. Once the basin dries, the sediments will be removed and perimeter
drainage system in the basin will be cleaned. Much of this maintenance work will be required by
the HOA after each rainy season in order to maintain a functioning detention system.
Traffic Circle
The traffic circle at Eto Circle and Madonna Road still remains a problem with the directional
signs being hit and drivers continuing to drive over the center paver area and the edge of the
landscaped area. The subdivider has requested that additional "maintenance" improvements, to

the already constructed traffic circle, be deferred to the warrantee period so that Public Works
and Fire Department staff can re-evaluate the approved design and work with the subdivider,
Home Owners Association and the subdivider'.s engineer to resolve the problem.
CONCURRENCES
Both the Utilities.and Community Development Directors concur with the recommended action
of accepting the public improvements.
FISCAL IMPACT
Typical maintenance and operation of public facilities will be required for park, street, stormdrain,
sidewalk, sewer and water infrastructure. The cost for maintenance and operation of the sewer
and water facilities will be, offset by the monthly service charges. The costs for street
maintenance and other non-enterprise fund items such as park services, fire protection and police
protection are general fund costs.

RESOLUTION NO. (2005 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBI_SPO
ACCEPTING THE PUBLIC IMPROVEMENTS FOR TRACT NO. 2.307
WHEREAS, the City Council made certain findings concerning Tract 2307, as
prescribed in Resolution No. 8975 (1999 Series); and
WHEREAS, the City Council approved the final map for Tract 2307 per
Resolution No..9224 (2001 Series); and
WHEREAS, the subdivider has satisfactorily completed the public and common
area improvements required for Tract 2307, in accordance with City standards,
specifications and the subdivision agreement, and has requested acceptance of the public
improvements for maintenance and operation by the City.
NOW THEREFORE, BE IT RESOLVED, the City Council hereby accepts the
public improvements for Tract No. 2307. The current Faithful Performance surety is
hereby reduced to $449,468, being ten percent of .the total cost of the public
improvements, to be held for one year from this date, in the
with the subdivision
agreement. The Labor & Materials surety may be released at this time, since the
conditions of Section 66499.7 of the California Government Code have been met.
