DISCUSSION Background The current contract for transit operations and maintenance will expire on June 30, 2006. The Council executed the contract on May 15, 2001 with First Transit. The contract was for an initial three-year period with two one-year options that were eventually executed. In general, the conditions and the method of compensation identified in the RFP are the same as the current agreement. A significant difference is the number of one year options .that may be executed during the contract. In the past, the Federal Transit Administration (FTA) limited the period of a service contract to five years. FTA has eliminated this limitation. The base term of three years for the agreement will remain the same. However, the new contract will include the potential for seven (7) one year options. This could result in lower costs if the contractor knows their commitment maybe longer than five years. As with the current contract,the City maintains the ability to terminate the contract for convenience should the City determine the contractor is not performing according to the contract. Funding for the purchase of transit services comes from the City's annual distribution of Federal Transit Administration Section 5307 funds, Transportation Development Act (TDA) funds, the Cal Poly subsidy, and farebox collections. CONCURRENCES On July 13, 2005, staff informed the Mass Transportation Committee (MTC) that the City will be soliciting proposals for the operation;and maintenance of the City's transportation services. ALTERNATIVES Alternative 1. The Council may decide to maintain the current term of contract comprised of three base contract years and two one-year options. The consequence to this alternative is that it may limit cost savings becausethe contractor will not be able to take advantage of contract reductions from longer term commitments: Alternative 2. The Council may decide to have a contract comprised of five base contract years and five one year options. The benefit of this option is that it would allow the Contractor to spread their costs over, a longer base term and potentially reduce costs. However, the City may be locked into the contract and may not have provisions to renegotiate costs or services until the fifth year.
