ADOPTION OF ORDINANCE NO. 1481 (2005 SERIES), DAPLEMENTING THE PROPERTY DEVELOPMENT STANDARDS, DESIGN STANDARDS; ROADWAY STANDARDS, ZONING AND PREZONING FOR THE AIRPORT AREA SPECIFIC PLAN; SP 116-98. CAO RECOMMENDATION Adopt Ordinance No.1481 (2005 Series)._ DISCUSSION On August 23, 2005, the City Council voted 4-1 to approve the Airport Area Specific Plan (AASP). Ordinance No. 1481 is the implementing ordinance for the AASP: The standards contained in the specific plan are adopted by ordinance, as an amendment to the City's Zoning Regulations. The ordinance specifically adopts the standards contained in the following sections of the AASP: Chapter 4: Table 4.3 =Allowed Uses Chapter 4: Section 4.4—Development Intensity Standards Chapter 5: Standards 5.1.1 through 5.20.9 exclusively Chapter 6. Standards 6.4.1.1 through 6.4.9.4 exclusively Ordinance No. 1481 also amends the City's Official Zoning Map to reflect the zoning established by the approval of the AASP. Pre-zoning is established for the unincorporated properties. Ordinance No. 1481 is now ready for adoption and will become effective 30 days after the date of its final passage. Siomificant Impacts The City Council adopted environmental findings, mitigation measures and a statement of overriding consideration as part of its approval of the AASP. Consequences of Not Taking the Recommended Action if the Council does not give final passage to the ordinance, the zoning designations and. standards established by the AASP will not take effect. ATTACHNIO NTS Attachment 1: Ordinance No.1481 LX0UNC1L\WP(ord bd read).doc C9 - i ORDINANCE NO. 1481 (2005 Series) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING THE STANDARDS CONTAINED IN THE AIRPORT AREA SPECIFIC PLAN AS AN AMENDMENT TO THE ZONING REGULATIONS,AND AMENDING THE CITY'S ZONING MAP TO REFLECT THE ZONING APPROVED AS PART OF THE AIRPORT AREA SPECIFIC PLAN FOR THOSE PROPERTIES PRESENTLY WITHIN THE CITY LIMITS, AND ESTABLISHING PREZONING TO APPLY UPON ANNEXATION OF OTHER PROPERTIES WITHIN THE SPECIFIC PLAN AREA. (APPLICATION NO.SP, GP/R, 116-98) WHEREAS, the City General Plan (band Use Element Policies LU 2.3 and LU 2.3.1) requires the preparation of a specific plan for the Airport Area prior to annexation and further development, and sets specific requirements for information to be included in the Plan; and WHEREAS, the City of San Luis Obispo General Plan contains general goals and. policies relating to growth and development in the Airport Area; which may be implemented in a variety of ways, including the specific plan procedure as outlined by California State Law (State Government Code 6.5450 et.seq.); and WHEREAS,the City of San.Luis Obispo,with the participation of property owners, citizens, public agencies, and other interested parties, has prepared a draft specific plan for the Airport Area pursuant to the General Plan and the State Government Code; and WHEREAS, on March 9; 2005, and again on April 13; 2005, the Planning Commission held a public hearing to consider the recommendations of staff and consider the Specific Plan map, text and necessary changes to the General Plan Map and Zoning Map to implement the Specific Plan for the purpose of making a recommendation to the City Council; and WHEREAS, on April 13, 2.005, the Planning Commission recommended that the City Council adopt the Specific Plan with findings of significant eriviionmental effects, mitigation measures and findings of overriding considerations;and WHEREAS, on June 14, July 26 and August 23, 2005, the City Council held a public hearing to consider the recommendations of the Planning Commission and staff, and to consider the Specific Plan map, text and necessary changes to the General Plan Map and Zoning Map to implement the Specific Plan; and WHEREAS, the Specific Plan is consistent with the City's General.Plan, as amended, and WHEREAS, as a result of its deliberations, the City Council has decided to adopt the Airport Area Specific Plan and an ordinance is required to implement the zoning identified in the Specific Plan. Ordinance No. (2005 Series) Page 2 Airport Area Specific Plan NOW,THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo, the following:. SECTION 1. Environmental Determination. The City Council has certified the Final Program Environmental Impact Report (EIR) for the Airport Area and Margarita Area Specific Plans and Related Facilities Master Plans and finds that the EIR adequately addresses. the potential significant environmental impacts of the proposed Zoning.Regulations and Zoning Map amendments, and reflects the independent judgment of the City Council. SECTION 2. AASP Property Development Standards. The following sections of the AASP are hereby approved as an amendment to the Zoning Regulations and incorporated by this reference to regulate those aspects of development in the Airport Area, per the text of the RASP: Chapter 4: Table 4.3 —Allowed Uses Chapter 4: Section 4.4_Development Intensity Standards Chapter 5: Standards 5.1.1 through 5.20.9 exclusively Chapter 6: Standards 6.4.1.1 through 6.4.9.4 exclusively SECTION 3. Zoning May Amendment and Pre-zoning. The City Zoning Map is hereby amended to reflect the appropriate zoning for those properties within the Specific Plan area that are already annexed into the City, as shown in "Exhibit A." For those properties currently outside of the City limits, the Council hereby pre-zones those properties as.shown in Exhibit`B," so that the zoning becomes effective upon annexation. SECTION 4. Summary. A summary of this ordinance, approved by the City Attorney, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of thirty (30) days after its final passage.
