SUBJECT: SOUTH STREET WIDENING (ROUTE 227) BETWEEN HIGUERA AND
BEEBEE STREETS.
CAO RECOMMENDATION
1. Approve the transfer of$66,000 from the Capital Improvement Plan (CIP) Reserve Account
to the South Street widening project, increasing the City's total contribution to $116,000.
2. Authorize the CAO to amend the existing cooperative agreement with Caltrans to provide
additional funding assistance to widen the segment of South Street (State Route 227) with the
revised amount not to exceed$116,000.
DISCUSSION
Caltrans District 5 has completed the design and right of way acquisition for a project to make
operational changes to the segment of Route 227 (South Street) between Higuera and Beebee
Streets. The project will widen the roadway segment, adding left turn lanes and bike lanes, as well
as adding sidewalk and a bus turnout with.landscaping. Caltrans recently opened bids on the project
and it was approximately $266,000 over their Engineers Estimate. Caltrans has asked if the City
could fund a portion of the increased cost,in addition to the already-agreed-to amount of$50,000.
This project has been designed by Caltrans staff and will be constructed under their supervision.
Caltrans has indicated that construction funding is now available and that a California Transportion
Commission (CTC) vote would be required in November to award the contract for the increased
amount.
Why is this an important project for the City?
Staff believes that additional financial participation is warranted because the project will complete
pedestrian and bicycle lane connections across this busy street segment and improve local traffic
flow, all which benefit local residents. The project.is primarily intended for City benefit. As a
regional State Highway, Route 227 has two lanes in each direction and as such serves the State's
needs adequately. The addition of the left tum lanes and pedestrian and transit amenities really
helps the City more, as this location has been the source of numerous complaints from citizens
asking for improvements. The total cost of the project so far has reached nearly $1.5 million,
including right of way and design costs bome by Caltrans. The City's share (and the additional
amount requested) is quite reasonable and will buy the City much more in good will for our
residents. Additionally, the City's financial participation allows Caltrans to leverage funding at the
State level,which might not be available without it.

This project is consistent with the City's Circulation Element (which designates this section of
South Street as an "Arterial"road), with pedestrian policies contained within the element, and with
the Bicycle Transportation Plan. The project had been on hold while the State was resolving their
budget problems, but now has been allowed to move forward to bid because the design was
complete. If the additional funding is not pulled together, the project could be put on hold again,
possibly losing the opportunity to make the improvements in the near future and continuing the less
than optimum situation for pedestrians and bicyclists on this roadway segment.
FISCAL IMPACT
The project is included in the CIP, with $50,000 in General Fund monies as the City's current
contribution. Given that this is a high priority project, leveraged with significant outside funding,
does not impact our limited staff resources and is consistent with Major Council Goals for traffic
congestion and bikeways, it is recommended that the additional funds be transferred from the CIP
Reserve Account, which has a current balance of$175,000 and has been established for use in such
circumstances.
ALTERNATIVES
The City Council could decide not to provide additional funding for the project. Caltrans would
then likely have to cancel the bids received and put the project out to bid again. The,"y could choose
to reduce the scope of the project in order to keep it within their available budget or readvertise it
again as is. New bid costs would not likely go down, but due to recent economic events would
likely be substantially higher.

SUBJECT: OPERATIONAL IMPROVEMENTS TO ROUTE 227
(SOUTH STREET) BETWEEN HIGUERA AND BEEBEE
STREETS.
CAO RECOMMENDATION Authorize the CAO to execute a cooperative agreement with
CalTrans to provide funding assistance to widen the segment
of South Street (State Route 227) with the amount not to
exceed$50,000.
DISCUSSION
CalTrans District 5 wants to pursue state funding (Minor "A" Program) to make operational
changes to the segment of Route 227 (South Street)between Higuera and Beebee Streets. Caltrans
estimates the total project cost will be $180,000 and is requesting that the City contribute $50,000
toward the construction othe new curb, gutter and sidewalk(about 28%of the total project cost).
This project would be designed by CalTrans staff and constructed under their supervision.
CalTrans has indicated that construction would be programmed for Fiscal Year 2001-2002, which
is the third year of the City's upcoming Capital Improvement Program(CIP).
Staff believes that financial participation is warranted because it will complete pedestrian and
bicycle lane connections across this busy street segment and improve local traffic flow, all which
benefit local residents. Also, City financial participation may enable CalTrans to more easily secure
Minor"A"funding.
This project is described in the attached letter from Mr. Nevin Sams of CalTrans Traffic
Department and is shown in preliminary form on the attached copy of Ca1Tran's plan sheet. This
project is consistent with the City's Circulation Element (which designates this section of South
Street as an "Arterial" road), with pedestrian policies contained within the element , and with the
Bicycle Transportation Plan.
FISCAL IMPACT
$50,000 would be the City's contribution. The City may decide to earmark $50,000 of its general
sidewalk construction funds (draft CIP currently eamia_rks $100,000 for FY 2001-02). Other
funding sources might also contribute such as the Minor Project Fund for bicycle and pedestrian
improvements (draft CIP currently earmarks $60,000 for FY2001-02 using state grant.funding). Or
the City could appropriate $50,000 from its unappropriated fund balance that would be targeted for
this particular project.

CONTRIBUTION AGREEMENT
THIS AGREEMENT, EFFECTIVE ON July 1, 2003, is between the STATE OF CALIFORNIA,
acting by and through its Department of Transportationj referred to herein as"STATE,"and
CITY OF SAN LUIS OBISPO
a body politic and a municipal corporation of
the State of California, referred to herein as
RECITALS
1. STATE and CITY, pursuant to Streets and Highways Code Section 130, are authorized to enter into a
Contribution Agreement for improvements to State highways within the City of San Luis Obispo.
2. STATE contemplates the construction of channetization, curb, gutter, sidewalk, bus tumout, and a
sou,nd wall along State Route 227 between Higuera and Beel3ee Streets in the City of San Luis Obispo, referred
to herein as'PROJEC7'.
3. CITY desires and has requested STATE to install various architectural elements, includiq pedestrian
estrian
strip lighting and a pedestrian bus shelter and signing to replace the ones that will be removed during
construction, along with PROJECT, referred to he-rein as "IMPROVEMENTS", some of which exceed State
standards, and is willing to pay a lump sum of$50,000 toward construction costs of IMPROVEMENTS, including
components which exceed STATE standards.
4. The parties hereto intend to define herein the terms and conditions under which IMPROVEMENTS are
to be constructed, financed and maintained.
SECTION I
STATE AGREES:
1. To provide all necessary preliminary engineering, including; but not limited to, environmental
compliance and approval of PROJECT, investigation of potential cultural resources and hazardous material sites,
plans, specifications, and estimate (PS&E), and complete utility identification and location; to provide all
necessary construction engineering services needed to complete PROJECT; and to bear STATE's share of the
'actual costs thereof. Estimates of PROJECT construction costs are shown on Exhibit A, attached to and made a
part of the AgreemerrL
2. To include CITY's plans for IMPROVEMENTS in StATEFs PROJECT contract-
3. To obtain permits to enter and construct on private property to accommodate construction of
PROJECT and IMPROVEMENTS.
4. To administer the constructiori contract for PROJECT and have the PROJECT construction
contractor fumish and install IMPROVEMENTS as requested�by CITY.

5. STATE reserves the right to delete IMPROVEMENTS from construction contract in the event bids
received for IMPROVEMENTS.are over ten percent(10%) above estimate and CITY fails to provide STATE with
a formal letter agreeing to higher cost within ten(10)days of bid opening.
SECTION II
CITY AGREES:
1. To deposit with STATE within forty five (45) days of receipt of billing therefor (which billing be
forwarded 15 days prior to STATE's bid advertising date of a construction contract for PROJECT) the amount of
$50,000, which figure represents the CITY's agreed to lump sum contribution toward IMPROVEMENTS. CITY's
total obligation under this Agreement shall not exceed the estimate of $50,000, provided that CITY may, at its
sole discretion, in writing, within ten (10)days of bid opening, authorize a greater amount for IMPROVEMENTS.
STATE reserves the right to eliminate individual contract items in the event bids received are over 10% above the
estimated cost of IMPROVEMENTS.
2. To pay a lump sum of $50,000 toward the actual construction cost of IMPROVEMENTS, including
the cost of IMPROVEMENTS'cormtnuction-related claims, the cost of STATE defense of any of those claims, as
determined after completion of work and upon final accounting of costs.
3. To make all arrangements to provide the construction contractor with permits to enter and construct on
CITY lands in the event. that such permits are necessary to accommodate construction of PROJECT and
IMPROVEMENTS, and to certify in a form satisfactory to STATE, prior to STATE'S advertising date of a
construction contract for PROJECT,that such permits have been obtained.
4. To maintain pedestrian strip lighting, bus shelter and bus stop signing and pay one hundred percent .
(100%) of all electrical energy costs associated with the lighting.
SECTION 111
IT IS MUTUALLY AGREED:
1. All obligations of STATE under the terms of this Agreement are subject to the appropriation of
resources by the Legislature and the allocation of resources by the Califomia Transportation Commission:
2. . The current Maintenance Agreement between STATE and CITY will be updated and executed prior
to project completion and acceptance of the construction contract for PROJECT and will further define
maintenance responsibilities. Generally, STATE will be responsible for the structural integrity of the sound wall,
and CITY will maintain (graffiti removal, etc.)the State Route 227 side of sound wall, bus shelter and signing.
3. Upon completion of all work under this Agreement, ownership and title to materials, equipment and
appurtenances, except for pedestrian strip lighting, bus shelter and bus stop signing which will become CITY
property, installed within STATE's right of way will automaticallybe vested in STATE, and materials, equipment:
and appurtenances installed outside of STATE'S right of way will automatically be vested in CITY. No further
agreement will be necessary to transfer ownership as hereinabove stated..
4.. Neither STATE nor any officer or employee thereof is responsible for any damage or liability occurring
by reason of anything done or omitted to be done by CITY under or in connection with any work, authority, or
jurisdiction delegated to CITY under this Agreement. It is understood and agreed that, pursuant to Govemment
Code Section 895.4, CITY shall fully defend, indemnify and save harmless the State of Califomia, all officers and
employees from all claims, suits or actions of every name, kind and description brought for or on account of injury

(as defined in Government Code Section 810.8) occurring by.reason of anything done or omitted to be done by
CITY under or in connection with any work, authority or jurisdiction delegated to CITY under this Agreement..
5. Neither CITY nor any officer or employee thereof is responsible for any damage or liability occurring by
reason of anything done or omitted to be done by STATE under or in connection with any work, authority or
jurisdiction delegated to STATE under this Agreement It is understood and agreed that, pursuant to
Government Code Section 895.4, STATE shall fully defend, indemnify and save harmless the State of California,
all officers and employees from all claims, suits or actions of every name, kind and description brought for or on
account of injury (as defined in Government Code Section 810.8) occurring by reason of anything done or
omitted to be done by STATE under or in connection with any work, authority or jurisdiction delegated to STATE
under this Agreement.
6. This Agreement shall terminate upon full execution of an amended Maintenance Agreement and
completion and acceptance of the construction contract for PROJECT by STATE and final disposition of CITY's
required deposit as specked in Section 11, Article(1) above, or on June 30, 2004, whichever is earlier in time.
