Hend on, Water:Division Manager e*Wu SUBJECT: EASEMENTS FOR NACINIIENTO PIPELINE PROJECT CAO RECOMMENDATION Conceptually approve granting easements for the Nacimiento Pipeline Project within City owned properties at no cost. DISCUSSION The design of the Nacimiento Pipeline Project is picking up momentum with numerous major activities underway including: environmental surveys and permitting, geotechnical evaluation, pipeline route surveying; preliminary design and right-of-way acquisition. With the selection of the design consultant for the project several months ago, work on the project is picking up speed and aggressive project schedules have been developed to meet critical project milestones.' One of the more difficult aspects of a major pipeline project is the acquisition of the right-of-way needed to construct the pipeline. The pipeline route will cross numerous public and private properties which will require acquisition of permanent easements for the ongoing operation and maintenance of the pipeline, as well as a temporary easement for construction activities. Easement acquisitions will require property appraisals and negotiations with each property owner. This will be a very time consuming activity and can be a critical item relative to the project schedule. The current proposed pipeline route would cross a, number of properties that are owned by Nacimiento Project participants (i.e. Paso Robles, Atascadero Mutual Water Company, and the City of San Luis Obispo). The properties that are owned by project participants are listed in Attachment 1. The participating agencies have been asked whether acquisition of the easements could be accomplished at no cost. if the agencies agreed to no cost for the easement,no appraisal would be required which would result in some cost savings to the project. Since the project participants are required by contract to share in the costs for the overall project, charging for acquisition of easements will only result 'in higher costs to the participants. It is currently anticipated that the other participating agencies will also grant the easements at no cost, including the County. Staff will return to the City Council for granting of the actual easements once the pipeline route as been specifically defined and the appropriate documents have been prepared.. CONCURRENCES The City Attorney concurs with this recommendation. c3 -/ Nacimiento Pipeline Easements _ Page,2 FISCAL IMPACT The City of San Luis Obispo has contractually committed to participation in the Nacimiento Pipeline Project. The City is required to pay for water"supplied from Nacimiento under the terms of the current contract.. Granting of the easements across City owned property at no cost Will only result in lower costs in the future for the City. ALTERNATIVES 1. Do not approve granting easements at no cost. This option would require-appraisal of the properties and negotiation with each agency to agree on the compensation amount for the easement.. This will only increase the project costs which the City and other participants will be responsible for under the terms of the contract which is already in place. This alternative is not recommended.
