Settle, Mayor Dave Romero APPOINTMENTS APPOINTMENTS TO THE 2006 COUNCIL COMPENSATION-COMMITTEE. (HOOPER —5 MINUTES) RECOMMENDATION: Make appointments to the Council Compensation Committee, effective immediately and sunsetting upon presentation of its recommendations to the City Council, and direct them to: a) review the full Council compensation package and make recommendations to the City Council no later than May 1, 2006, and b) review compensation for Planning Commission and Architectural Review Commission . members in conjunction with its review of Council compensation. CONSENT AGENDA The Consent Agenda is approved on one motion. Council Members may pull consent items to be considered after Business items. The public may comment on any item on the Consent Calendar. Council Agenda Tuesday, Jatrt,ary 17, 2006 PUBLIC COMMENTS ON AGENDA ITEMS: You may address the Council on any item described in this agenda by completing a speaker slip and giving it to the City Clerk prior to the meeting. The Mayor will invite public comments before the Council takes action on each item. (Gov. Code Sec. 54954.3(a)) Your speaking time is limited to three (3) minutes. (CC&P Sec.1.3.7) CITY COUNCIL PROCEDURES FOR PUBLIC HEARINGS: The Mayor will announce each item and thereafter, the hearing will be conducted as follows: 1. City staff will present the staff report and recommendation on the proposal being heard and respond to questions from Council. 2. The Mayor will open the public hearing by first asking the project applicant/appellant(or his/her representative)to present any points necessary for the Council,as well as the public,to fully understand the proposal. 3. The Mayor will then ask other interested persons to come to the podium to present testimony either in support of or in opposition to the proposal. 4. Finally, the Mayor will invite the applicant/appellant (or his/her representative) back to the podium to respond to the public testimony, if appropriate. The Mayor will then close the public hearing and limit further discussion to the Council and staff prior to the Council taking a vote. RULES FOR PRESENTING TESTIMONY AT A PUBLIC HEARING: City Council meetings often involve highly emotional issues. It is important that all participants conduct themselves with courtesy, dignity and respect. All persons who wish to present testimony are asked to observe the following rules: 1. Speakers are asked to submit speaker slips to the City Clerk. 2. If you have filled out a Speaker Slip,the Mayor will call you to the podium. 3. Speakers shall address the Council from the podium after giving his/her name and city of residence. Speakers shall direct their comments to the Council, not the audience. 4. Speakers shall limit comments to three minutes. The Mayor, after all others have spoken, may allow additional brief comments from speakers who have already commented on the same agenda item. 5. If testifying as paid representatives, as defined in the Municipal Code speakers shall register as a Municipal Advocate and shall preface their comments by identifying themselves as Municipal Advocates (§2.64.020 & §2.64.050&§2.64.070). 6. Applicants,appellants or applicant representatives desiring to speak shall: a. Submit speaker slips to the City Clerk (available on a plastic rack at the entrance to the Council Chamber). b. Shall be permitted to speak first during the public comment portion of the public hearing for not more than ten minutes. c. Address the Council from the podium after giving their name and address, and/or the name and address of the applicanUappellant they are representing. If the applicant/appellant's representative is a paid Municipal Advocate,they shall comply with Number 5 above. 7. If you challenge an issue in court, you may be limited to raising only those issues you or someone else raised at this public hearing as described above, or in written correspondence delivered to the City before or during the public hearing. ADOPTION OF ORDINANCE NO. 1489 (2006 SERIES) CLARIFYING THE APPEAL PERIOD FOR THE TREE.REGULATIONS IN THE.MUNICIPAL CODE (WALTER/BEIGHTS) RECOMMENDATION: Adopt Ordinance No. 1489 (2006 Series). C3. APPROVE CONTRACT WITH URS CORPORATION FOR SEISMIC ANALYSIS OF-SAUNAS DAM (MOSS/HENDERSON) RECOMMENDATION: 1. Approve the contract with URS Corporation (URS) for seismic analysis of the Salinas Dam in the amount of $225,989 and authorize the Mayor to execute the contract. 2. Approve transferring $230,000 from existing project balances that are either completed or not proceeding as originally anticipated in order to fund this work, including $4,011 for contingencies. C4. AMGEN TOUR OF-CALIFORNIA PARTICIPATION AGREEMENT. (FITZGERALD) RECOMMENDATION: Approve agreement with AEG Cycling in substantially the same form as the attached draft version, with the understanding that any outstanding issues are resolved to the satisfaction of the City Attorney for the City of San Luis Obispo's participation in the Amgen Tour of California cycling event and authorize the Mayor to execute the final agreement. C5. TRENCH REPAIR 2006, SPECIFICATION.NO. 90618. (WALTER/LAWRENCE) RECOMMENDATION: 1. Approve plans and specifications for"Trench Repair 2006, Specification No. 90618.° 2. Authorize staff to advertise for bids and authorize the CAO to award the contract if the lowest responsible bid is within the Engineer's Estimate of $105,000. C6. DONATION OF A SURPLUS 1983 MACK FIRE ENGINE. (CALLAHAN) RECOMMENDATION: Adopt a resolution authorizing the Fire Chief to proceed with the donation of the 1983 Mack fire engine to the City of La Paz, Mexico. C7. NEW BISHOP WATER TANK SPECIFICATION NO. 9023213. (WALTER/HORN) RECOMMENDATION: 1. Approve the plans and specifications.for the "New Bishop Water Tank", Specification No. 90232B. 2. REIMBURSEMENT AGREEMENT WITH SOURCE COMMERCIAL GROUP FOR PUBLIC IMPROVEMENTS AT THE INTERSECTION OF ORCUTT ROAD AT BROAD STREET. (WALTER/BOCHUM) RECOMMENDATION: Approve a reimbursement agreement with Source Commercial Group in an amount not to exceed $204,625.56 for"oversizing" of public improvements at the intersection of Orcutt Road at Broad Street. PUBLIC HEARINGS 1. 919.PALM PARKING STRUCTURE RATES. (WALTER/HORCH — 10 MINUTES) RECOMMENDATION: 1. Adopt a resolution setting rates at the 919 Palm Parking Structure, as follows: a) An hourly parking rate of $0.75, $7.50 daily maximum, with the first hour free. b) A long term parking rate of $75 a month or$225 per quarter. 2. Conceptually endorse the use of the 919 Palm Parking Structure for Tour of California parking, if feasible. BUSINESS ITEMS 2. STATUS REPORT: UNREINFORCED MASONRY HAZARD MITIGATION PROGRAM. (STANWYCK/CLARK - 30 MINUTES) RECOMMENDATION: Receive report and discuss status of Unreinforced Masonry Hazard Mitigation (URM) Program. 3. WATER TREATMENT PLANT MASTER PLAN IMPROVEMNETS. (MOSS/HENDERSON - 20 MINUTES) RECOMMENDATION: Authorize staff to proceed with finalization of the plans and specifications for the Water Treatment Plant Master Plan Improvements and increase the project total budget from $8,943,600 to $13,406,800. 6:45. (WALTER/BEIGHTS — 30 MINUTES) RECOMMENDATION: Adopt a resolution denying the appeal of the Tree Committee's decision to deny the tree removal request at 313 Patricia Drive. 5. CONSIDERATION OF A TENTATIVE TRACT MAP TO FINALIZE_A CONDOMINIUM CONVERSION FOR TWENTY MULTI-FAMILY RENTAL APARTMENT PROPERTIES AT 2975 ROCKVIEW(TR.167-05). (MAN DEVI LLE/DU NSMO RE - 20 MINUTES) RECOMMENDATION: Adopt a resolution which approves the tentative tract map to allow individual sale of twenty condominium units at 2975 Rockview Place, based on findings and subject to conditions and code requirements. 6. REQUEST FOR ANNEXATION..GENERAL PLAN AMENDMENT AND PRE- ZONE TO LOW DENSITY RESIDENTIAL AND CONSERVATION OPEN SPACE TO ALLOW AN 11--LOT RESIDENTIAL TRACT MAP ON A 9.76 ACRE PROPERTY WEST OF THE CITY LIMITS ON FOOTHILL BOULEVARD (ANNEX/GP/R/TR/ER 124-03). (MANDEVILLE/DUNSMORE - 2 HOURS) RECOMMENDATION: As recommended by the Planning Commission at a Public Hearing on November 9, 2005; 1. Adopt a resolution approving the annexation and amending the General Plan Land Use Element map to change the land use designation from Interim Open Space to Low-Density Residential and Conservation / Open Space, and approving a revised Mitigated Negative Declaration (ER 124-03). 2. A typical fire and life safety inspection at this type of facility includes checking fire alarm systems, fire sprinkler systems, fire extinguishers, common areas for fire-hazards, exit signs and exit access doors, fire lane access,hydrant access and signage. Additionally, we will be offering a public education presentation to apartment owners, managers, and residents to educate them about how to prevent fires from occurring as well as how to increase their chances of survival in the event a fire does occur. How will this program benefit me? Fire and life safety inspections are done to protect property owners and residents from the devastating effects of fire. By ensuring a safe living environment in these types of facilities, the chance for fire decreases. Fire can kill, disable, destroy property and completely disrupt lives. How much will it cost? The fees vary according to the type of property being inspected. Some types of properties have on-site maintenance staff that are immediately available to correct deficiencies, while others require more frequent or in-depth inspections to ensure compliance with state code requirements. The following tables outline the fee schedule.
