SUBJECT: LOS OSOS VALLEY ROAD MEDIAN PROJECT - PHASE 2,
SPECIFICATION NO. 90527
CAO RECOMMENDATION
1. Award a contract to and authorize the mayor to execute a contract with, John Madonna
Construction, Inc. of San Luis Obispo in the amount of $158,062.45 for: "Los Osos
Valley Road Median Project—Phase 2, Specification No. 90527."
2. Approve the transfer of $13,373.17 from the budget of the completed LOVR Medians
Phase 1 project to the project budget; and
3. Approve the transfer of $11,626.83 from the completed projects account to the project
budget.
DISCUSSION
This project is the 2nd phase of the Los Osos Valley Road landscaped median project which
includes the construction of a landscaped median on Los Osos Valley Road between Descanso
and Prefumo Canyon Road. On November 15, 2005, the Council approved the plans and
specifications and authorized staff to advertise the project. Seven bids were received and
opened on January 26, 2006, all of which were over the engineer's estimate of $135,321. The
low bid of $158,062.45 submitted by John Madonna Construction, Inc. of San Luis Obispo is
$22,741 (approximately 17%) over the Engineer's Estimate.
An analysis of the bid results indicates that the majority of the cost increase is attributed to the
excavation, soil import and concrete curb items of work which range from 50% to 100% over
the estimate: These results are consistent with recent bids received in the last year where
significant cost increases have occurred particularly in items of work which include significant
trucking, fuel and/or steel costs.
CONCURRENCES
1. Environmental clearances have been obtained from the Community Development
Department and Environmental Office of the California Department of Transportation.
2. Authorization to Proceed with construction was received from Caltrans on November 3,
2005.
FISCAL IMPACT
This project was approved by Council at its November 15, 2005 meeting where Federal and
State grant monies in the amount of $150,000 were appropriated into the project. Estimated
Construction costs are shown below:

Grant Funding $150,000.00
Budget Shortfall $257000.00
As shown above, the $150,000 grant is not sufficient to cover the entire cost of the project. Per
the San Luis Obispo Council of Governments (SLOCOG), additional grant monies are not
available for this project; however, there is currently $13,373.17 of General Fund money
remaining in the completed LOVR Median Phase 1 project account as well as over $22,000
currently available in the completed projects account that could be used to supplement the
project budget. Staff recommends transferring the remaining general funds from the completed
LOVR Median Phase 1 project account to this project budget. Additionally, staff recommends
transferring $11,626.83 from the completed projects account to the project account to make up
the remaining shortfall.
ALTERNATIVES
1. Defer the construction. If this project does not proceed, the grant monies will be
forfeited and reallocated to another area of the County.
2. Defer the landscaping. The bid documents were set up to allow the landscaping portion
of the project to be omitted from the contract. Omitting the landscaping would allow the
project to move forward within the current project budget; however, staff does not
recommend this alternative. At this time, there is money available to proceed with the
entire project. Deferring the landscaping will only cost the City more as prices continue
to rise. Also, there is no ,guarantee of when money for landscaping would become
available again in the future. As a result the median could sit unplanted for years.

AGREEMENT
THIS AGREEMENT, made on this day of ,20_,by and between the City of San Luis Obispo,a
municipal corporation and charter city, San Luis Obispo County, California (hereinafter called the Owner) and John
Madonna Construction,Inc.(hereinafter called the Contractor).
WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1,SCOPE OF WORK: The Contractor shall perform everything required to be performed, shall provide
and furnish all of the labori materials,necessary tools,expendable equipment, and all utility and transportation services
required to complete all the work of construction of

in strict accordance with the plans and specifications therefore, including any and all Addenda, adopted by the Owner, in

It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work performed and
completed under the direction and supervision and subject to the approval of the Owner or its authorized
representatives.
ARTICLE H, CONTRACT PRICE: The Owner shall pay the Contractor as full consideration for the faithful
performance of this Contract, subject to any additions or deductions as provided in the Contract Documents, the contact

FOOTNOTE: GUNITE PREMIUM PAY: Workers working from a
Bosn'n's Chair or suspended from a rope or cable shall
receive 40 cents per hour above the foregoing applicable
classification rates. Workers doing gunite and/or
shotcrete work in a tunnel shall receive 35 cents per hour
above the foregoing applicable classification rates, paid
on a portal-to-portal basis. Any work performed on, in or
above any smoke stack, silo, storage elevator or similar
