SUBJECT: HIGHWAY EASEMENT ACQUISITIONS BY CALTRANS FOR ROUTE 1
CAO RECOMMENDATION
Accept an offer from Caltrans for the acquisition of a Permanent Highway Easement and
Temporary Construction Easements as part of the Highway 1 (Santa Rosa Street) rehabilitation
project, and authorize the Mayor to sign the agreements.
DISCUSSION
The California Department of Transportation wishes to acquire a Permanent Highway Easement
and Temporary Construction Easements on City properties located at 1042 Walnut Street and
190 Santa Rosa Street in San Luis Obispo. The requested parcels are identified as San Luis
Obispo County Assessor's Parcel Nos. 001-205-013 and 001-031-028 and are necessary for the
rehabilitation of the existing roadway and to construct curb and sidewalk improvements on Santa
Rosa Street(see Attachments 1 and 2).
Per the easement document exhibits, Parcel 10034-1, is located on the northeast comer of Santa
Rosa and Walnut streets near the Police Station and encompasses 31.8 square feet of permanent
easement. Parcel 10034 at the same corner, encompasses 83.8 square feet of temporary
construction easement. Parcel 10049-1, located on the northeast corner of Santa.Rosa and Oak
streets near Santa Rosa Park,encompasses 95.0 square feet of temporary construction easement.
The acquisitions allow Caltrans to complete the rehabilitation project improvements which
include improved accessibility. This will provide a,benefit to City residents.
FISCAL IMPACT
In addition to receiving the benefit of the rehabilitation project, the State will provide the City
with a monetary compensation totaling $ 2,350 for the permanent and temporary easements. The
Valuation Summary Statements in Attachment 4 provide a summary of the basis for these
payments for both the permanent and the temporary easements.
ALTERNATIVES
Council could reject the offer from Caltrans. The result would be two corners on a City street that
would not be upgraded to current accessibility standards.

and a TEMPORARY CONSTRUCTION EASEMENT for 12 months covering the property
particularly described in Clause 4 below has been executed and delivered to
Gina Rodriguez, Right of Way Agent for the State of California.
In consideration of which, and the other considerations hereinafter set
forth, .it is mutually agreed as follows :
1 . The parties have herein set forth the whole of their agreement . The
performance of this agreement constitutes the entire consideration for
said document and shall relieve the State of all further obligation or
claims on this account, or on account of the location, grade or
construction of the proposed improvement.
2 . (A) The State shall pay the undersigned grantor (s) the contract sum
of $2, 000 . 00 for a Permanent Highway Easement and a Temporary
Construction Easement for 12 months as required for the proposed
rehabilitation of the existing roadway and construct curb and
sidewalk improvements on Highway 1 in the city of San. Luis
Obispo.
(B) A PERMANENT HIGHWAY EASEMENT is required on Parcel 10034-1 for
rehabilitation of the existing roadway and construct curb and
sidewalk improvements . The permanent easement area required is
31 . 8 sq. ft .
(C) A TEMPORARY CONSTRUCTION EASEMENT on Parcel 10034-2 is required
for 12 months beginning from the start of construction. The
temporary easement area required is 83 . 8 sq. ft .
(D) IMPROVEMENTS : 31 . 8 sq. ft of PCC (concrete) walkway.
3 . DAMAGES AND BENEFITS : There are no damages or special benefits
associated with the proposed project.
4 . Permission is hereby granted the State or its authorized agent to
enter upon grantor's land where necessary within that certain area
shown outlined on the map marked Exhibit "A" attached hereto and made
a part hereof, for the purpose of rehabilitation of the existing
roadway and construct curb and sidewalk improvements .

5. The State agrees to indemnify and hold harmless the grantor(s) from
any liability arising out of the State' s operation under this
agreement . The State further agrees to assume responsibility for any
damages proximately caused by reason of the State' s operations under
this agreement and State will, at its option, either repair or pay for
such damages .
6 . The undersigned grantor (s) warrant (s) that they arethe owner (s) in
fee simple of the property affected by this PERMANENT HIGHWAY EASEMENT
and TEMPORARY CONSTRUCTION EASEMENT for 12 months as described in
Clause 4 above and that they have the exclusive right to grant these
easements .
7. This transaction will be handled through an internal escrow by the .
State of California, Department of Transportation, District 5 Office,
50 Higuera Street, San Luis Obispo, CA 93401-5415 .

3 . Permission is hereby granted the State or its authorized agent to
enter upon grantor's land where necessary within that certain area
shown outlined in color on the map marked Exhibit "A" attached hereto
and made a part hereof, for the purpose of installing new sidewalks
and/or handicap ramps .
4 . The. State agrees to indemnify and hold harmless the grantor(s) from
any liability arising out of the State' s operations under this
agreement . The State further agrees to assume responsibility for any
damages proximately caused_ by reason of State' s operation under this
agreement and State will, at its option, either repair or pay for such
damages .
5 . The undersigned grantor(s) warrant (s) that they are the owner (s) in
fee simple of the property affected by this Temporary Construction
Easement as described in Clause 3 above and that they have the
exclusive right to grant this easement .

The California Department of Transportation is proposing to rehabilitate the
existing roadway and construct curb and sidewalk improvements on Highway 1.
Your property, located at 1042 Walnut Street is within the project area; and is
also identified by your county assessor as Parcel No. 001-205-013.
Title III of the Uniform Relocation Assistance and Real Property Acquisition
Policies Act of 1970 and the California Relocation Assistance and Real Property
Acquisition Guidelines require that each owner from whom the Department of Transportation
purchases real property or an interest therein or each tenant owning improvements on said
property be provided with a summary of the appraisal of the real property or interest
therein, as well as the following information:
1. You are entitled-to receive full payment prior to vacating the real property
being purchased unless you have heretofore waived such entitlement. You are not
required to pay recording fees, transfer taxes, or the pro rata portion of real
property taxes which are allocable to any period subsequent to the passage of
title or possession.
2. The State will offer to purchase any remnant(s) considered by the State to be
uneconomic unit(s) which is/(are) owned by you or, if applicable, occupied by
you as a tenant and which is/(are) contiguous to the land being conveyed.
3. All buildings structures and other improvements affixed to the land described in
the referenced document(s) covering this transaction and owned by the. grantor(s)
herein or, if applicable, owned by you as a tenant, are being conveyed unless
other disposition of these improvements has been made. The interest acquired is
Permanent Highway Easement and Temporary Construction Easement. The property

property to be acquired prior to the date of valuation caused by the public
improvement for which the property is to be acquired or by the likelihood
that the property would be acquired for such public improvement, other than
that due to physical deterioration within the reasonable control of the
owner or occupant; and
d. Does not reflect any consideration of or allowance for any relocation
assistance and payments or other benefits which the owner is entitled to
receive under an agreement with the Department of transportation.
5. The owner of a business conducted on a property to be acquired, or conducted on
the remaining property which will be affected by the purchase of the required
property, may be entitled to compensation for the loss of goodwill. Entitlement
is contingent upon the ability to prove such loss in accordance with the
provisions of Sections 1263.510 and 1263.520 of the Code of Civil Procedure.
6. If you ultimately elect to reject the State's offer for your property, you are
entitled to have the amount of compensation determined by a court of law in
accordance with the laws of the State of California.

SUBJECT: Consent Item 2— Easements for Caltrans Rte 1 Rehabilitation Project.
Staff requested and received from Caltrans an aerial photo showing the Police Station
and the requested easements at the corner of Santa Rosa and Walnut streets. This
provides the Council with a little better visual, compared to those available with the staff
report, as to the location of the easements relative to the improvements at the comer.
